seanfer:In 2016 before the elections, Obaseki had no immunity. Section 308 insulates the Governor and deputy from even criminal prosecution. The Tribunal is where l am looking towards IF and IF Obaseki wins. |

seanfer:A Pre-election matter must be brought up not more than 14 days after the cause of action....which is the PDP Primaries. Anything after that cannot qualify as a pre-election suit...unless we subscribe to Justice Ekwo's ruling on Nwosu. The 14 days expired on July 9. I don't know the date this was filed. |

RTSC:There are precedents to this kind of case. The Gov and Deputy cannot waive immunity. They can decide to stay out altogether and they will still have the law behind them. The case may even be adjourned sine die. Ona personal note, if they indeed have nothing to hide....I see no wrong in pursuing it now. |

fergie001:If you read the court papers. INEC is the First respondent. And the case has to do with the forms submitted to INEC. If you count the day the case was initiated and the day PDP Submitted the form to INEC, then you will see that it is within the 14 days. This politicians are devil incarnate. |

seanfer:Section 285(9) explained this thoroughly. Like I explained up there.....the cause of action is the Primaries. That is what birthed INEC's acceptance of the name(s). INEC has no power to disqualify. Dansuqi:This is section 285(9): “Notwithstanding anything to the contrary in this constitution, every pre-election matter shall be filed not later than 14 days from the date of the occurrence of the event, decision or action complained of in the suit”. Mind the word EVERY. I must have explained from a layperson perspective wrt to the Primaries. Lokpobiri didn't challenge the holding of the APC primaries....he was asking the Court to declare him winner. In this case, INEC form CF001 was submitted by all parties on June 29, 2020.
