RuudVanNisteroy:A criminal trial or any trial at all, doesn't always go the way it is laid out or expected, even in the face of supposed damning evidence. This is because there are laid down procedures contained in a law which regulates production of evidence. This law is called the Evidence Act. Now since the news report didn't follow the progress of the trial, we would not be able to tell if the evidence, particularly the video was produced and handed ro rhe court, in line with the Evidence Act. It is very possible that the video evidence was rejected by the court for failing to be introduced in the manner prescribed by the Evidence Act. This may be as a result of lack of competence of the Prosecutor to produce the video evidence as I earlier explained or it may be as a result of a deliberate show of incompetence by the prosecutor to deliberate produce the video evidence in a manner not supported by the Evidence Act. I remember a case of forgery I did for client who was accused of forging a Certificate of occupancy. When the supposedly forged certificate was produced, I raised series of objections and it was rejected. When I cross-examined the supposed victim of the forgery, the case died almost immediately. These are the technicalities that could lead to losing a simple case with glaring evidence. 4 Likes |

This is a sad end to the story. However, we should not totally hold the judge responsible for this miscarriage of justice. More often than not, the real traversity of justice starts with the prosecution. All criminal cases are prosecuted by the police and when they are mobilized enough, they scuttle otherwise very good cases. The easiest way of doing this is to present a very weak case, deliberate refusal to call crucial witnesses (like in this case) or an outright selling the complainant out to the defendant. This happens regularly in our judicial system. May the Lord take control of Nigeria. |

Instead of ranting and wailing online, I suggest we start a petition seeking redress to this terribly absurd State of our judiciary, using this case as a pilot case. Government agencies really need to up their legal teams. EFCC, ICPC, Police and many other bodies keep losing cases they clearly should have won. There are also good grounds to believe that prosecution teams do compromise. In this case, the Judge upheld Abbo's no-case submission and dismissed the suit for lack of diligent prosecution by the police. The police definitely didn't do justice to this case. There is no room for emotions in law. Judgements are delivered based on evidence/facts presented before the court. 4 Likes |
