Now the lady has a filed a suit against my uncle. She actually attached a VIDEO purporting to be my uncle making love to her.

Now, we have seen the said video and can confirm it is doctored.

My question is: If proven that the video is doctored in court, could there be any legal consequences against the lady for presenting a doctored video to the courts?

Will the doctored video have any impact on the final decision of the court?

The court follows process.

When the paternity is determined, then the doctored video + character defamation will put her in a very tight corner. Like someone said, kirikiri for her or she pays high damages.

Regardless, even if the video is true; it does not proof paternity, so the case will still be tossed until a more competent evidence like dna is properly introduced into evidence.

Don’t let anybody deceive you, in the process of the suit the other lawyer can object to the authenticity of the video and court would simply do away with and give judgment based on the evidence before it. Court would not arrest anybody for rendering fake document[b] we do it all the time while trying to win a case win some loose some life goes on.[/b]

It is a court of law....it is not the position of the court to proof that, the video is doctored, that is for you to prove.

You can attack the video chain of custody and authenticity, if you are successful; the video will be stricken from the evidence. The court may or may not hold her in contempt for attempting to introduce false evidence.

The main question is, what is she suing for? If her intentions is to use the video to proof paternity, it will not work. The court would rather wait until she give birth and do a dna.

If you want her to pay for presenting a doctored video, then sue her for defamation. But, before you do that, ensure that your uncle’s hands are clean and that he did not actually sleep with her.

If your uncle actually slept with her, but because she did not have anyway to proof it and hence he doctored the video and it came out in court that your uncle slept with her....your defamation case will fail, because your uncle actually did perform the act she is alleging.

Defamation cases are usually civil carrying financial penalties, unless she is trying to use the video to extort him, which makes it a crime for which she can go to jail. In that, you have to report her to the police and they will assist in prosecuting the case.
