If I am Gbajabiamila I will not answer the
family's fake demand letter orchestrated by Ozekhome.

I will ask them to go and sue DSS and not me. Because it is not the Speaker that ordered DSS to shoot the vendor. I will let the case runs its course through the Nigeria court processes.

Though the incident is tragic and traumatic for the vendor's family, but threatening through a court suit is not the best action to take.

This will now move public sympathy away from them, as the family (and invariably all Ibo people) will now be termed opportunists and money mongers.

Strictly speaking, N500million isn't too much to ask for to compensate for a human life lost through gross misconduct. However, it is not a realistic demand in Nigeria's context.

The real question is about who should bear the cost. Is it Gbaja or the DSS? Can the idiotic operative be said to be under Gbaja's control or the DSS' duties at the time of the incidence? These are the questions the lawyers have to debate on.

To illustrate better, if an uber driver or a driver for a car hire company, hits a pedestrian to death in the course of driving you to your destination which you are paying for, is it you, the driver or Uber/Car hire company that is liable to be held responsible? I am sure no nairalander will accept responsibility for the death.

I think the matter will be settled out of court eventually maybe at about N20 - 40million in 9ja style.

I believe this sort of case hinges on the legal doctrine of "Vicarious Liability"...

I think that is what the counsel to the family is trying to exploit here.

But, I am thinking it is going to be hard to establish vicarious liability here unless they can rope in the DSS into the case too...

I don't know where they want to goo with this. The Speak was a friend of the deceased. He never ordered the aid to shoot let alone kill someone. The aid acted alone. The family should be swayed by hungry lawyers to cash out on this.
I don't see how Gaja can be legally culpable here

I’m in 2 minds. What I consider is that when people are killed due to negligence, error malpractice etc., You don’t hear families of the deceased petitioning for a pay out, but for an enquiry. The payout is done hush hush and somewhat automatically.

And when a civilian is murdered/shot, likewise, you hear the families seeking justice, not money.
Settlements are often done off record and out of public domain where possible.

Perhaps the issue is they shouldn’t even need to ask and have felt sidelined/belittled, or maybe even insulted by the original offer which is quite shameful on GBA’s side. He should know the appropriate measures to take.

On the other hand you wonder, is money the answer to grief? Does a recently bereaved person immediate take up a fight for money? Feels a bit uncouth.

It’s already public knowledge so what’s in it for GBA to pay? Not like they will sign any disclosure to prevent his image from tarnishing. And if it’s a case for the FGN, then payouts definitely won’t make a difference.
