In other words, PMB is not accountable to Nigerians. The NASS, however lopsided in population, represents Nigerians. |

Re: Malami: National Assembly Has No Power To Summon Buhari by Nchenches: 6:13pm On Dec 09, 2020 |
Elvictor: PMB is shielded by the lopsided political representation favoring Buhari’s far north- lopsided political representation derived from the skewed political structure of 20 states in the northern region but 17 states in the two southern regions that formed independent Nigeria with the northern region. Through this skewed political structure created by north through its loyal military dictators, the Buhari’s of northern Nigeria can do anything they want about Nigeria - no consequences if what they did was bad. |

plaindealer: My argument is the boldened emphasis on my first quote from your statement that; the legislature cannot summon the executive regarding the "use of power" I am sure by now you are smart enough to correct that statement. |

Racoon: Like Mallami is now shielding Buhari- Andooaka was shielding dead Yar’Adua until some Ministers summoned courage with a memo that declared Yar’Adua’s position vacant. Shortly after that, the remains of Yar’Adua were flown in to Abuja at the dead of the night. Nigeria got a new president. 1 Like |

plaindealer:My dearest God what happen to the educational system in Nigeria? I was on the second page about to throw up before you rescue me. Who thought these people civics? The legislature can compel neither the president nor the chief justice to appear before them. They can appear voluntarily. The legislature have the power of the purse which they can use to pressure head of ministries to come and give account of there ministries. They also have investigative power which they can use to compel member of the executive branch to give testimony before it. The president can prevent close adviser like his chief of staff or special assistant from honoring legislative invitation. |

Re: Malami: National Assembly Has No Power To Summon Buhari by Dijita: 6:37pm On Dec 09, 2020 |
chriscrosss:If they have cause they can call him to come and testified in his own impeachment. If he failed to show up he can be impeached not because he did not show up but because he did not defend the allegation against him. The moment the legislature have the power to force president to appear before them they have become more powerful than the president. The 3 branches of government are equal and as such one cannot force the other to appear before it. It is the principle of separate and equal. |
Re: Malami: National Assembly Has No Power To Summon Buhari by Dijita: 6:45pm On Dec 09, 2020 |
sapientia: You are right to point it out. The president doesn't have the power to remove the chief justice that is why many people kicked against it when it was done. I think the president was able to do that because of weak legislature and corrupt judiciary. Also, although they are equal, the president enjoy the highest privilege 1 Like |

Elvictor: Nice said and very accurate bt sadly we had a chance to correct these anomalies b4 Buhari especially during Jonathan’s time bt nobody care to now the loopholes are being taken advantage off. Nobody cried for restructuring and true federalism during Buhari’s time besides Apc who was the opposition then and like we have seen it was only for selfish gain and interests as they have turned their back on everything they fought for and fought with. If Pdp enter they might do same because they are all selfish unless we find a way to demand and ensure it’s done. Most people even clamoring for it now are doing cos of Buhari if he leaves they might all cool down who knows. |

And this hopelessly corrupt quota system attorney general does not see anything wrong with that constitution? A constitution where the representative of the people can not invite an elected president to give account of his stewardship. If UK says they are practising democracy, Nigeria too will raise up their hands? . |
Re: Malami: National Assembly Has No Power To Summon Buhari by plaindealer: 7:07pm On Dec 09, 2020 |
Dijita: This is your opinion which you are entitled to, but it's not constitutional facts unless you are able to show us the particular portion of the constitution that opined that the legislature can demand the appearance of the president which I'm 100% you can not, all you have is your own opinion that's not rooted in constitutional facts and precedents. Power of the purse or investigation has nothing to do with summoning the executive. Try at least by showing us the relevant part in the Nigerian constitution that says the legislature can summon the executive. |

optimusprime2: 1. Who begins the process of impeachment to the executive arm of government? The legislature after they have carried out an investigation of the president. during the investigation president Trump prevented some member of his cabinet from appearing before congress see picture 1 below or read from this link: https://www.nytimes.com/2019/12/04/us/politics/turley-impeachment.html b) on what grounds can impeachment be triggered? Article II, section 4 of the U.S. Constitution defines the grounds for impeachment and conviction as ''treason, bribery, or other high crimes and misdemeanors. 2. The US runs a democratic government model, give a detailed analysis of the impeachment hearing against president Donald Trump on December 18 2019? Trump was impeached for abuse of power and obstruction of congress see picture 2 and 3 below and detail in the following link https://www.congress.gov/116/bills/hres755/BILLS-116hres755enr.pdf b) list the proponents and list the accusations of the impeachment. You will see your answer in the link provided 3. With the answers provided from 1 and 2 can a president be summoned by legislature, to answer to "use of power" in a Democratic model which Nigeria practices? Summon as it is used in the context under discussion connote force and authority like judge summoning a defendant or a witness. The legislature did not have the power or authority to compel a president to appear before it the way a judge have the power to summon a defendant or a witness. This was demonstrated during the impeachment proceeding against Donald J Trump in USA. It should also be noted that the legislature are acting as judges during impeachment and therefore may be afforded some privileges they may not have during normal cause of business Bottom line Trump was not impeached for failure to appear before congress but for blocking material witnesses that are his aides from appearing before congress and blocking them from providing government documents to congress

plaindealer:the president can be summoned concerning the security situation and human right abuse by the military, and also questioned. your argument of being the commander of the armed forces does not make him immune to query, if you can't sack your failed service chiefs then you need to answer why. |
