All this talk is getting this case nowhere.

It doesn't matter how much the buyer did or did not pay for the waybill, he didn't receive the item so a refund is due to him. I would personally advice you take the matter to court if no settlement plan is reached, the contract was the delivery of goods and there was a breach. That way you have legal backing. Forget all those advising "bring police", "bring soldier", you don't know who they also know and you'll just end up spending your time and money.

I know it sounds heartless, but the fulfillment agent (which is the driver ) is ultimately liable for the loss. You aren't responsible for getting him to pay up, that's Omic's job. He has agreed to provide a service so he bears the total risk.

You don't have issues with Omic, yours is with the seller.

All these talk about what should or shouldn't have been is bygone.

I think to limit your liability as a seller, please kindly state the risks involved in the type of courier service you choose to use. If the customer accepts it, fine.

I could remember when Mikky had issues with some people's items and he had to give them a refund. I don't see how this case is different, home delivery or not.

Hmm, I disagree with you. As a seller, I know that when a buyer wants an item and it has to be waybilled, I would try to get the buyers own choice on the method to be used, after doing that and handling the phone over to the company/driver, that phone is no longer under my custody.

I can and will provide after sales services, but nothing to do with waybill.

Omicpet did what he was told to do, waybill a phone to ibadan.

Seller was not supposed to include the handling fee and transport within lagos to the 4k for waybill.

@Harryfrosh called me around 3 am that he's interested in samsung note 20 ultra and we discussed about the price. We agreed on 370k and he asked me where he's going to receive his item and I told him my final destination is at omipet office in Lagos State. He said he resides in ibadan then I said as soon as his item arrived, he can send his friend or any of his relatives to pick up the item at omipet office and he said he's going to make part payment that as soon as the item arrived, he will complete the payment. He made an upfront payment of 70k. The item arrived last week Saturday which I informed him to send someone to pick up the item for inspection so that he could pay up the balance of 300k. On that Saturday evening, I received an alert of 304k which I quickly put a call across to him that I received 304k instead of 300k and he pleaded that I should help him process the waybill to ibadan and we didn't discuss anything about home delivery with the waybill fee but he assumed that the waybill money shouldn't be more than 4k from lagos to ibadan.. On Tuesday, I contacted omicpet to forward his item to ibadan and I was charged 3k and I called him immediately that the waybill to ibadan was 3k that he should send me his acc number so that I could refund him the extra 1k but he insisted I should not bother to send it rather I should use it as my calling card.
Around 7:30 pm, he called that a driver called him from lagos that his item would be delivered to him in ibadan that they should try and meet at a place in ibadan. He told me that he's also expecting another item from Lagos State but not too sure if the item is from omipet or from someone else. Around 10pm, I received his call and he said he was told by the driver that his three tyres burst simultaneously. Around 4:30am, I received his call and he said the driver told him that he was robbed and I was shocked to hear this owing to the fact that the driver had earlier said that his vehicle three tyres burst simultaneously and he said that he's going to meet the driver as soon as the day break.
Around 9:28am today, he told me that he has finally seen the driver and that out of all the items that were with the driver, only his item was carted away by the armed robbers.. I quickly called his attention to the lies being told by the driver that he should hold the driver to ransom by reporting the case to the police. He said the police came but they couldn't arrest anyone. I gave him another ingenious suggestion to look for any available military man which he later called that the driver has agreed to pay him 200k. I was shocked to my marrow by telling huge lies that he discussed home delivery and waybill fee with me and of course there was nothing of such in our previous conversation.

When you send a waybill, it is your duty to follow up till it gets to the receiver.

Imagine an item of 370k, u dey give driver. Funny enough, dem fit don tell driver say na small thing dey inside, just to pay small money.

I am into Logistics and I can tell you that many Nigerians do wrong things when it comes to waybill, some will collect 3k and send waybill with 500.

Phone of 370k, what happened to GIG? EMS?

OP from everything discussed here, it's obvious the seller and the shipper are trying to play the smart card and absolve themselves of responsibility and accountability. If you can, please arrest them and make sure they pay in full including the money you use to mobilize the uniformed men.

1.when you sell an item to a buyer it’s either the item gets to him or you refund him his money , even DHL won’t update the tracking ID till buyer signs to have received it
2. You promised a waybill number where was it ? why wasn’t it sent ?
3. Did the buyer instruct you? or any form of agreement between you and buyer to use the park to deliver the item ?
4. If in your own disgression without contacting the buyer you agreed with the courier in question and item was sent through garage or whatsoever , there is NO LIABILITY ON THE BUYER AND AS SUCH SHOULD BE REFUNDED OR GIVING ANOTHER ITEM as to the subject in fact in issue
5. Let’s be guided and not play around please a buyer will only be liable to certain liabilities if the mode of delivery was suggested by him or he gave he’s expressed approval to it before item was dispatched

Good evening everyone... I'm just really annoyed and angry right now because of what's going on between @bdemix and @omicpet.. Last two weeks ago.. I was scrolling the offerup thread and saw @bdemix post about Samsung note 20 ultra TLC 370k... I called him around 3am that day because I need phone urgently.. I talked to him that day about price and he insisted on the 370k... I said OK... I'll pay... And later asked him when the phone will land... Just to know maybe i can wait or not... He said in between two weeks... I said I have no option than to wait then... I paid him 70k and last week Saturday he called me that the phone is now in Nigeria and @omicpet will handle the waybill... I transferred the remaining balance of 300k... I now asked about the waybill bill... He said @omicpet company will handle that... I told him I'll like to know the actual price... So I can pay everything.. Then I went on to tell him I want home delivery.. Because I just moved to ibadan without knowing any place... And to also be on the safe side... He said Lagos to ibadan should be around 3k or 4k but maximum of 5k... I said OK... I sent him 4k... I was expecting home delivery... Then a man called me around 7pm yesterday.. The man said he was to deliver a package to me... I was really confused.. I called @bdemix just to confirm because I don't really understand... @bdemix said he was expecting the waybill number... And he also mentioned that to me yesterday morning when I asked him for any updates... He said he already sent 3k to @omicpet office and he'll call then in the evening to ask for the delivery number... Just for a public transport man to called me about the package... I said OK no problem... I went to challenge street spending #300 like 1 hour plus to my place.. I called @bdemix before going and getting there around 8:30pm yesterday evening... Driver is not there... I called him and he said he's still in elewe.. I don't know that place.. I asked around and they said elewe is in Lagos.. I feel angry... But I have 370k phone at stake... I told myself I'll wait... Around 9pm I called the man again and he said he was around ogere... I also don't know that place... I keep calling @bdemix to tell him what's going on and my displeasure about the situation... Around 10pm the man is no longer going through... I keep telling myself to wait.. Till around 12am and all the area is empty... Only me and I look for hotel around... The one available is occupied.. I don't just know what to do and I'm really scared... I was just thinking then I saw a filling station.. I walked in and explained what's going on to the filling station security man and the man pity my condition and let me in.. I sat on a bench till 4am I can't sleep because I'm really scared... Exactly 4am I called @bdemix to let him know I slept in the street... But he don't pick up.. I guess he was sleeping.. I called the driver and he went through... Hello sir... I slept inside filling station because of you yesterday and I was just crying on the phone because I've never expected that to happen to me at all... Sleeping in filling station... Empty place... The man said if I see him myself... I'll pity him.. He said he was robbed coming to ibadan.. I don't know what to say.. I called @bdemix again and he picked up dis time around 4:30am.. I explained everything to him on the phone and he told me not to worry that I'm safe... I said OK.. Already around 5am cap already moving... I stopped a cap and went back to my place... Around 8am the man called me again to come to the park.. I put on my clothes and board a cab again and on getting there.. I saw the man really damaged.. His car was also damaged like seriously.. I start feeling scared and nervous.. The man explained what happened to me how him and his passengers were robbed and injured... He now said my own package was stolen by the robbers... He said because the package is not that big.. He put it in front of the car and that's how the robbers was able to cat away the phone and other passengers phones and money... In dis junction, I don't know what to do or say because the man is really injured and his car is also damaged badly... I called @bdemix to explained and he said I should hold the driver responsible... That I should called police on him and all that... Me.. I don't want all dis stuff that's why I paid for home delivery and gave you my home address which you asked for... After all back and forth... I was able to invite some police to the discussion... The people around won't allow the police to do anything because they keep saying if the robbers killed the man like they killed a driver last week who will be asking questions... I called @bdemix and he said i should not agree and hold him very well.. But how na.. He now suggest using Army officers... I don't know any army here in ibadan... I called a junior brother who is army in Lagos and he called some of his friends in ibadan and they also showed up... When they arrived... They asked questions and they said all of us should go to where the robbery happened... We entered and on getting there... It's true robbers operate in the area over night... People around the area confirmed that and the person who towed the man vehicle also showed up that it's one of his friend that paid the man 20k towing money.. The army said we should go back and getting back... The oldest man among the army called me to corner that the situation now should be between me and those who sent the phone... He said I should call them.. I called @bdemix and he said I should call @omicpet and calling @omicpet he asked me did i paid for home delivery and I said yes.. He now asked if I sent my home address.. I said I sent it to @bdemix.. He then asked if I received a call about my package and I said a man called me around 7:30pm yesterday.. He now said since the man called me about my package and the phone already left his jurisdiction and the only thing for me to do is to hold the driver... The Army officer behind is really angry about that statement... But me.. I'm just tired... I don't sleep all night because of my phone and now the phone is nowhere to be found.. I now beg the man to calm down and help me because I'm really tired of everything.... He now went back to the driver to negotiate and the driver said he bought his car just few months ago via higher purchase and still paying debts monthly... But he should be able to pay 200k and keep paying 20k weekly.. The man... His wife and his two children are all crying.. The man said they paid him just 1k for the package... Remember I sent 4k for home delivery... I called @bdemix about it and he said the money is too low... But me I don't just know what to say again or do... I went back home and just trying to get some rest since yesterday.. But I've been trying to reach @omicpet since... Not picking up... And it's like @bdemix is also not ready to say anything about it... And to make things worse... The driver called me not long ago that his car dealer heard about the robbery and the man insist that he must pay his car money finish first and that he the driver will not be able to meet up with the phone money again... I called the army officers and they told me the case is between me and @bdemix and @omicpet that all of us should be able to reach agreement... I called @omicpet again not going through... I don't just have anywhere to than to create dis thread for others nairaland should also see to it and help out... 370k phone and 4k waybill and currently nothing to show for it

Drivers are not our employees , park waybills is traditional method of forwarding items via means of drivers who ply the route , once item has been handed to a driver( who in turn receives payment for his service to deliver ) and communication between driver and recipient has been established , item delivery is now sole responsibility of the driver to the receiver and receivers responsibility to receive his item from driver .

There my friend is one of the reasons why they are other unique services .

Now I’ll ask you a question ,

Can you be liable for an item that’s not in your jurisdiction or under the jurisdiction of your coy .

Our service ended at the point of handing item to driver and at point where driver established communication with the receiver .

I gave him my terms and conditions that my final destination is omipet office and I told him his item could be picked at omipet office with a code to claim his item and if peradventure he is not chance, any of his relatives could come for the pick up on his behalf which he told me he doesn't have anyone and I told him to contact omipet who is the handler of logistics and of course I wasn't aware of how he got omipet number.

(Anyone here who has bought TLC from me knows perfectly well that I don't handle their shipment out of Lagos but always direct them to contact omipet with respect to delivery out of Lagos).

U mess up about 400k? Ain't u have enough gain on the deal? Why not used gig logistics for deal of such amount especially from 100k and above. U people are wicked and needs to be treated as such. Just imagine because of 1k or 2k u wanna make from the waybill

1.you told him to contact omic office and which he did ? Okay who was the dispatch amount (4000) paid to ?
2. You say you don’t help people in delivery outside the jurisdiction of Lagos , but you did assist him in delivering the item ? And I’d ask again who was the 4000 naira delivery fee sent to ?
3. You had no awareness that omic used a garage to send item and buyer said you where contacting your shipping company ? Is omic a shipping company that specializes within and outside the jurisdiction of Lagos ?
4. If you had no awareness of the mode of which the item was sent , and your final destination has always been omic office , the burden of proof is no longer on the buyer to prove anything because he never received his item !!! Please you and omic should discuss and provide the item please. Buyer never got the item , buyer doesn’t even have awareness it was dispatched via a garage , buyer doesn’t even have the driver number till a call came in ....or know the driver to the extent of even receiving the driver number before the driver took off .... so abeg make una sort bring this phone out or the refund
