THE SACK OF FUNKE OSIBUDU AND BEDC MANAGEMENT SHOULD BE TOP PRIORITY:

___angered Funke throws more than half of Benin City into darkness for over 5 days and still counting.

___boasts of buying PHCN for eternity and that nothing anybody can do about it.

Not many of us understands the core of our agitations against the sack of Funke Osibudu led management team for over five years now. The incessant protests by members of Edo Civil Society Organisations at any given given opportunity goes beyond the non provision of meters, lack of transformers, intimidation of customers using the military and police, estimated and crazy billing among other issues that have been raised overtime.

Funke and her team have subjected the people of Edo, Delta, Ondo and Ekiti states to untold hardship and suffering due to her own preferred style of business model. It should be recalled, she was the managing director of Union Bank Plc as at the time it encountered serious setback which the bank is yet to recover from till date.

Recently, the Performance Agreement of ten out of the eleven DISCOs was to come to an end on the 31st of October, 2018 after a five year operation. The Bureau of Public Procurement and the Nigerian Electricity Regulatory Commission surreptitiously planned an extension with one year which the civil society resisted with a five day well mobilised protests at the Benin NERC Forum Office.

The reaction from the managment of the Benin Electricity Distribution Company to the protests by the civil society was that, there is no renewal of any licence whatsoever, they went further in their statement to affirm that the defunct PHCN had been sold to them for eternity. In other words, they have bought and paid and that we have no choice than to accept whatever they decide to do with it.

Now, what Funke does is to take little power from the Transmission Company of Nigeria while rejecting the allocated power that will improve supply. She ensures that the entities and individuals on her SPECIAL LINES gets up to 20 hours daily while people in communities and made to share 2-3 hours daily. What matters to her is huge profit and not service delivery. Access to electricity is everybody's right and must not be done by discretion by anybody offering such an important public service.

Here comes the time not to leave this battle for the civil society alone because, from the foregoing, it is a battle she has put up with the people. This is a strong call to the governors of her franchise states, unions, associatons, traditional rulers, communities and all well meaning citizens must rise up to this challenge in ensuring that whatever their plans are to further plunge us into pains and sufferings is defeated by our collective will. We either speak up now or sold into electricity slavery forever.

Funke and her management team must be sent parking in order for us enjoy any form of improvement in electricity supply. BEDC is the worse of all DISCOs and must not continue under Funke and her team.

THIS IS A BATTLE TO FINISH. NO RETREAT, NO SURRENDER.

FUNKE MUST GO!

Same thing happened to a friend at ring road last week, after assaulting him they ended up taking the last 5k that he wanted to use to buy extra material he needed to make a clients dress after asking him to pay 70k and gave him two hundred naira for transport.He said before he left ,they were already harassing another guy.

PRESS RELEASE:

EDHA REJECTION OF STATE HOUSES OF ASSEMBLY AND JUDICIARY AUTONOMY, A SHAME ON LEGISLATIVE REPRESENTATION.

The leadership and members of Edo Civil Society Organisations, a network of civil society groups in Edo state received with rude shock of the rejection of the autonomy of State Houses of Assembly and the Judiciary in the ongoing amendment of the country’s constitution for the strengthening and deepening of democracy in Nigeria.

It should be noted that Uyi Igbe led Edo State House of Assembly in 2014 rejected a similar attempt to give autonomy to state houses of assembly in the country. The continuous rejection of this component of our constitutional amendment by persons elected to represent the voice of the people calls for concern and urgent response before our democratic growth is retrogressed twenty years backward by elected few.

The people’s aspiration should be paramount above the desire of any political party leaders in a true democratic dispensation. We are being taken aback that an arm of government would vote against its independence, the interpretation of such action is that, the legislative and judicial arm of government should continuously remain as the apron string of the executive arm of government. For democracy to be deepened and conforms to international best practices, it must have the ingredients of checks and balances among the three arms of government.

We are demanding that members Edo State House of Assembly should rescind its resolution for the rejection of the autonomy of the state houses of assembly and the judiciary before it is sent to the National House Assembly to save us from the impending shame as a state, since 32 states have already approved same in the contrary. If this request is not considered as soon as possible, we will not fail as a formidable and foremost network of civil society groups in the state to mobilize Edo people in the shortest time to remind our lawmakers that their election is to represent the yearnings of the masses not that of their political party or leaders.

The state houses of assembly and the judiciary represent the voice of the people and the people are not willing to trade it on the altar of political patronage and personal aggrandizement by any elected representative. The legislature should be the most powerful arm of government because it represents the people from whom sovereignty belongs to. Our lawmakers are hereby reminded to think of posterity at the end of legislative representation.

Edo Civil Society Organisations shut down the headquarters of the Benin Electricity Distribution Company in a well coordinated protest today.

The activists have lamented the way and manner the management of BEDC treat citizens in the state and the other three states (Delta, Ondo and Ekiti) they operates for the past three years they took over the distribution of electricity.

The issues raised are the issuance of estimated and outrageous bills, deliberate non supply of meters, high handedness, disrespect for customers, coersion of communities to procure equipment and the use of military personnel that escorts some white expatriates that work with the power company who brutalise citizens over electricity bills.

The straw that broke the camel's back was the disconnection of one Mr. Innocent Okpara in their Ekae business district over non payment of electricity bills which he had contested overtime and waited for the power company to issue him bills based on his actual consumptions. While he never resisted his disconnection that fateful day, he requested to hold on to his service cable when the white expatriate working with BEDC ordered the military personnel attached to him to molest and brutalise him for daring to request for his service wires. Mr. Okpara has taken steps since by paying part of the bills and demanded that he should be reconnected pending the resolution of his bill's contestation.

It is very unfortunate that the management of BEDC has demanded that before he is reconnected, he must first withdraw his petitions against the company and the white expatriate that ordered his beating by military personnel. We have viewed this as oppression and intimidation in the highest order and have vowed to state that if this is the last vestige of colonialization to overthrow, we shall fight it with the last drop of our blood even if the Federal Government refuses to take steps.These other activities of BEDC against citizens have reached the highest of the heavens that requires our collected voice to demand the revocation of the licence of BEDC which should be taken over for a more competent firm for happiness of us all.

Edo Civil Society Organisations in 2016 through their lawyer Barrister Toluwani Adebiyi had secured a judgment against the 11 Distribution Companies across the country and the Nigerian Electricity Regulatory Commission to the effect that there should be a reversal of tariff because the process of increment did not pass through legal procedures, they have since refused to obey the court judgment, a situation that made the activists to stop paying the illegal tarrif. The Human Rights Group had in their last three General Assembly Meeting resolved to resume payment of bills commesurate to what they consume monthly.

The last is yet to be seen as we have declared this phase of the struggle as FESTIVAL OF PROTESTS until the Federal Goverment revokes the licence of BEDC whose operations have caused a lot of businesses and individuals hardship and discontentment across their coverage areas.

We will not rest in this struggle until Mr. Innocent Okpara is connected back to the network.

POLICE FORCES ACTIVIST TO DO MONEY TRANSFER TO OWN ACCOUNT OVER TINT PERMIT CERTIFICATE:

This is the ordeal of one Comrade Justice Oni-Edigin who hails from Edo state in the hands of men of the police force on Monday the 31st of July, 2017 over tint permit authentication.

His naration goes thus:

On Monday the 31st of July, 2017 at about 5pm as he was returning from Lagos to Benin, he met men of the Nigeria Police along the Lagos-Benin express Road few minutes drive to Ore in Ondo state, the first checkpoint he met said his tint permit document is the old one that they will not allow him to proceed with his journey, he either settle them with the sum of N10, 000 or he will be kept there with them till in the morning, he pleaded that, since the officers have educated him on it, he will take steps in updating it as soon as he gets to Benin, He was refused and ignored while they attended to other motorists. As soon as he introduced himself as an activist, they became furious and threatened to deal with him as the location is the highway where he can be labeled to be anything and he won't have anyone to defend him, he became afraid and pleaded with the sum of N2000 which one of the officers by the name Musa Ibrahim collected and allowed him to go.

At the second checkpoint which is just few minutes drive away, he was stopped and same issue of old tint permit came up, he explained to them that he is an activist and that he had been told by the men at the checkpoint before theirs about it and promised to do the needful as soon as he gets to Benin, all he said fell on deaf hears as they demanded the sum of N20, 000 from him if he does not want to stay till morning with them. He told them he has exhausted his cash, they requested that he do a transfer, he pleaded that they should just let him go or take him to their station so that he can have a word with the DPO, they refused and ignored him. One of the officers offered him his account number to do the transfer to. Seeing that, they weren't ready to take him to their station and not too sure of the plans they have, he became scared as it was around after 8pm this time. He had to do a transfer of N2,020 to the account with the name AFOLABI SAR, a name that appears not to be full due to bank alert constraints but full details can obtained from beneficiary's bank.

He talked about too much desperation displayed by the officers on their duty post in extorting citizens due to one thing or the other.

He has requested that the police officers involved in this should be sanctioned in other to cleanse the force of such elements who could do anything to get what they want from citizens abandoning prefessional conducts of the police in the discharge of their duties.

SINCE WHEN THIS WAS SENT TO PUBLIC COMPLAINT UNIT OF THE POLICE, NO RESPONSE EVEN THE POST CAN NO LONGER BE FOUND ON THEIR FACEBOOK PAGE, THE WHATSAPP NUMBER DID NOT RESPOND EITHER.

IS THE POLICE AUTHORITY TRULY SINCERE WITH THE FIGHT AGAINST INTERNAL CORRUPTION?

WHITE MAN ORDERS SOLDIERS TO BEAT UP A NIGERIAN OVER ELECTRICITY BILL IN EDO STATE:

Earlier today, a white man working with the Benin Electricity Distribution Company (BEDC) orders Military personnel attached to him to beat up one Mr. Innocent Okpara over resistance of the electricity company officials to take his expensive wires after disconnection for non payment of electricity bills.
This happened behind Santana Market, Sapele Road, Benin City in the presence of the Business Manager, a Nigerian in charge of the business unit that covers the area. The man has been disconnected for owing the company an amount he said could not be justified, his argument was that, he bought the wires with his money and that it does not belong to the private company hence, he was not going to allow them to take away the expensive wires.

Similar reports have reached the human rights community of the activities in the past of same white men who go about with military personnel to harass, intimidate, humiliate, brutalize and in some cases threaten to shoot citizens of the Federal Republic of Nigeria over electricity issues. Such case was that of one Mr. Owas Evbuomwan about a month ago in Oluku-Iguosa axis who was threatened by military personnel attached to another white man working with BEDC to shoot if he dares question the authority of a white man in threatening a Nigerian like him. It should be noted that there are three of them working with BEDC and they all exhibit the habit of creating fear and tension in the minds of Nigerians thereby making Nigerians look like cowards in their own land.

Reports have been passed to the 4 Mechanized Brigade, Benin City severally on the activities of soldiers who molest and assault citizens and no action have been demonstrated to show there is still value for human rights even in a democratic dispensation like ours. A lot of such incidences are archived with pictorial evidences and victims are readily available to testify of military brutalization and assault on their persons without direct provocation that warrants same.

It is important for Nigerians to still know if our leaders have finally handed over the life and destiny to foreigners or this is another round of colonial rule using our military to achieve.

The Edo Civil Society Organisations will stop at nothing to mobilize all other Nigerians to resist any form of colonial tendencies even if our leaders are docile and non chalant about it. We cannot tolerate it, because Nigerians in the Diaspora cannot try what these white men are daring here.

To this end, we are demanding a full scale investigation into the activities of these white men working with BEDC to the extent that whether they possess such rights in line with our constitution to command our military personnel to unleash terror on citizens. We cannot be slaves in our own land because these white men are here to elk a living for themselves and another round of colonial tendencies we shall resist even with the last drop of our blood. The most stupid Nigerian at least deserves some respects from a foreigner in his land.

We own the Land.

AN ADDRESS BY HIS ROYAL HIGHNESS, CROWN PRINCE, (AMBASSADOR) EHENEDEN EREDIAUWA, EDAIKEN N’ USELU ON THE OCCASION OF HIS CORONATION AS THE OBA OF BENIN AT URHOKPOTA, BENIN CITY, ON THE 20TH OCTOBER, 2016.

1. The events of today mark the end of activities prescribed by customs and tradition for my ascension to the revered throne of this ancient kingdom. I accept with faith and humility the Destiny which ordained that henceforth, I shall be the embodiment and expression of the Culture, Aspirations and History of our people.

2. As the principal actor in the events of several months that led to this awesome position, I have had a unique opportunity to reflect on the values and essence of our historical continuum. What Royalty represents for our people are Justice, Peace and Unity. These ideals shall be re-awakened, and will be sustained in the dispensation that will soon unfold.

3. The time-tested, rancor-free succession process bequeathed to us in our customs and tradition, is a great tribute to far-sightedness and wisdom of our forefathers and our people. This collective achievement is a veritable proof of our ability to manage our own affairs. It makes us very proud of our heritage.

4. Distinguished ladies and gentlemen, let me begin by paying deserved tribute to my illustrious father, OMO N’OBA N’EDO, Uku Akpolokpolo EREDIAUWA, CFR who joined our ancestors after 37 years of glorious reign. With all due modesty, I must admit that as his son and heir, I enjoyed and benefitted from his fatherly love and wisdom more than anyone else. His visionary leadership, courage and dedication to the protection of our cultural heritage, ensured that the legacy of several centuries was preserved.

5. He was a true symbol of our cultural identity. Throughout his reign, the Palace was a warm and welcome home to all who had need for good counsel, guidance and material assistance. Traditional Rulers from far and near consulted him for clarity on
touchy issues or to resolve a vast range of socio-cultural problems.

6. Ethnicity, religion or social status were no barriers to reaching him for advice or support. He was a good and caring father to us all. He led our common cause with dignity, tact and wisdom. In the comity of Royalties, he was exemplary and hence, he was revered throughout his kingdom and beyond. Although for him, culture and tradition occupied the pride of place, he was open to new idea and respectful of progress made through social and scientific innovations.

7. Time constraint will not allow me to give a full account of all my father’s achievements, or the benefits his reign brought to Benin Kingdom, Edo State, our country, and indeed, to humanity. His life of service is aptly captured in the title of his own Auto-Biography – “I remain, Sir, your Obedient Servant’. His views and wise counsel on several issues affecting man and society are well documented in his work – ‘Cradle of Ideas: A compendium of Speeches and Writings of Omo N’Oba Erediauwa of Great Benin”. These two literally works give some insight into the monumental legacy that is now left for us.

8. Our responsibility from now on is daunting. But I am confident that with the blessing of God Almighty, the love and support of my family, my people, Nigerians in general and my international friends, we shall succeed in this life mission of building upon the legacies of our father.

9. Let me crave your indulgence to also make a few remarks about my late Mother – PRINCESS IKUOYEMWEN AKENZUA, of blessed memory, who passed on to the great beyond in 1976, when my father was still Crown Prince. It was my mother who taught me to work hard for success in everything I set my mind upon to achieve. Circumstances and hands of fate did not allow her to enjoy the status of a Queen in her life time. But she was a Princess in her own right. By my Coronation today, she is now qualified to be bestowed with the title of IYOBA, (QUEEN MOTHER) which custom allows us to confer posthumously. This will be consummated at the appropriate time.

10. Reminiscences are not just for sentiment because the experiences reinforced in us the importance of history. History also reminds us of the importance of the present time which is the only opportunity we have to take the different and too often fragmented components of our collective past to prepare the foundation for a unified and collective future.

11. The long line of succession of Kings in the Kingdom known as Benin started in the 12th Century by modern reckoning. There may be some differing views about the origin of some of our ancestors, but there is unanimity in the shared heritage between the peoples of Benin and Ile-Ife in identifying Oduduwa as forebear of kingship in many kingdoms in the part of Africa called Nigeria today.

12. Historians all agree that Oduduwa sent his son Oronmiyan at the request of elders of Benin to return with them as ruler of their realm. Oronmiyan’s stay in Benin may have been short, but before he left, a child was born to him, who was later crowned Oba (King) and is known today as Eweka I. Oronmiyan’s time in Benin, however short lived, he was an Oba; and so, he was the first Oba after the Ogiso dynasty came to an end. He established Obaship in Benin. By implication, the listing of past Obas should therefore begin from Oronmiyan as it is listed in Egharevba’s book – Short History of Benin, making my revered father 39th Oba that reigned in Benin – if the listing is counted from and, should be counted from Oronmiyan.

13. I therefore stand before you today as the 40th Oba of Benin, a direct descendant of Oronmiyan, the son of Oduduwa whom the Benin people of that era knew as Ekaladerhan, their self-exiled Prince who later became ruler in Ile-Ife. The Benin people recognize Oduduwa and his origin but it is not our place to force this recognition on others outside our boundaries. The history of the world is a shared one and there will certainly be unexpected connections in the future. This is thus a time for unity and not divisiveness, a time for mutual respect, recognizing that our wholeness as peoples is so much more than the sum of our parts. – “E pluribus Unum.”

14. Now, what does the new dispensation hold for us? The Oba remains the channel through which the powers of the ancestors continue to guide and protect the Kingdom and its people. To that extent, we shall faithfully discharge this sacred responsibility. We shall pay due attention to all matters of custom and tradition, focusing on real issues of security of our communities and the welfare and development for our people. We shall carry out reforms in palace administration in order to be adequately responsive to our peoples’ sincere and deep longing for justice, equity and stability. We shall strive to ensure that conflicts are resolved between individuals, families and communities along the principles of social justice. We shall use cultural diplomacy as veritable tool for the promotion of harmonious relationships with our neighbours far and near. I also strongly advise my Benin people to strive to maintain our culture especially our language by insisting on its use in communicating with our children and each other. You will agree with me that Benin Empire which encompasses part of Lagos across to Asaba even then Dahomey has now shrunk to within only one State. To survive it is imperative that we maintain our culture which is now the only unifying force for our people. Our culture and tradition remains the one main factor that the entire country and international community respects us for. I appeal to our Benin People to uphold and respect our traditional institution at all times. I implore Government also to include Edo language and Benin history our schools’ curriculum.

15. We shall forge links with other traditional institutions here in Nigeria, in Africa and beyond. We must specially acknowledge how honoured and gratified we are to have in our midst today, representatives of Monarchs from other parts of the world. The Zulu King in South Africa, the Kabaka of the Kingdom of Buganda as well as the Queen of England and the Monarchs of Sweden, Denmark and Norway are all represented at this event by the Ambassadors of their respective countries. I hope that this will provide an opportunity to strengthen contacts and build linkages that will complement and enhance excellent bilateral relationships that already exist between our countries.

16. We shall uphold and maintain the principle of neutrality and non-partisanship in political party activities, while our people remain free to play politics by subscribing to any political party of their choice. We shall however continue to pray for, and will always support the right kind of political leaders, who will safe guard the welfare of our people, provide for their basic needs, and who will accord due recognition to traditional institutions.

17. We will initiate a cultural renaissance that will focus on tourism promotion through Arts and Crafts. To drive this initiative, we have already established two Special Purpose Vehicles (SPVs), The Benin Royal Dynasty Trust will in collaboration with Benin Traditional Council establish a foundry or two in Igun Eronmwon Quarters to enhance the productivity of the Bronze Casters Guild. Benin Royal Academy for Performing Arts will train youths and develop their talents. They will reach out to international choreographers in different parts of the world for the purpose of transforming Benin Dance Drama into an international brand.

18. Through these initiatives we hope to attract tourism to our land and provide jobs for our teeming youths. We shall also support efforts to build partnerships and seek international assistance for the restoration of Bini monuments including revival of the creative and artistic talents of Binis, which are already globally acknowledged through our rich artifacts.

19. It is pertinent at this point to express our deep concern, about the pervasive poverty at the grassroots and the astronomical rise in crime and juvenile delinquency in our society. The problem is both a consequence of and is aggravated by widespread youth unemployment. The solution would require well-articulated and structured youth development and empowerment programmes with active support of government at all levels. We shall partner with the government to attract domestic and international resources for the establishment of clusters of Agro-based industries in each of our seven local government areas (LGAs).

20. In this regard, the transformation of Gelegele into an Export Processing Zone for Agro-Allied industries shall remain one of our major projects in the state, with the support of the Federal Government. We shall join forces with Government at all levels and other well-meaning individuals in pursuing poverty alleviation strategies which will be driven by the Royal Dynasty Trust. We will also partner with relevant government agencies to pursue programmes and policies for the conservation of our forest endowment. To this end we will establish a Prize for the Local Government in Edo State that is best in annual tree-planting competitions.

21. Today is an important day for us. It marks a turning point in our life. We will therefore do two other important things to mark this day. First to honour the memory of our illustrious father, we established today Oba Erediauwa Annual Lecture Series. For this, the sum of N10, 000,000.00 (Ten Million Naira) will be invested in a Trust Fund and the proceeds will be used to support an annual well researched oration on any subject in Benin History, Public Administration or Edo Language. Secondly, we will unveil a new crest which states my motto: “AMAMIESON AIMIUWA, OSAKHUE NO KHUODIN” meaning: No reward without industry, God protects the defenceless.

22. Finally, we appreciate your presence here today and especially those who have supported us in numerous ways to bring this coronation to the high level of pomp and grandeur that we have seen. We remain grateful to the multitude of people who lined the routes everywhere we passed and all those who worked tirelessly to ensure success in all activities that have culminated in today’s event. The show of support and affection for me each time I step out for any outdoor traditional activity since I was initiated into Uko N’Iwebo up till now has been amazing. The support of Palace Women Groups: Isikhuian, Ewuwuagba, Emehe and Uselu Community Women Group has been phenomenal. I will never forget how they serenaded me with melodious songs of praise and support everyday unfailingly. The Uselu Youths were also wonderful. My special appreciation goes to His Eminence, the Sultan of Sokoto who showed his love and support for us and, of course by logical extension, the ancient throne of Benin and the Benin People, by directing that the famous Durbar tradition of Sokoto Caliphate be brought to Benin to support my coronation. Your participation and support are indications of the love you have for the throne and the deep respect for our common heritage. We are immensely grateful.

No one needs a university degree to understand diplomatic immunity never mind whatever it is you are claiming you are.Assuming indeed he is a diplomat and has diplomatic immunity(Not all embassy staff do) The fact is the Nigerian Government can ask him to leave the country if they find his presence unacceptable. They can give him 48 hours to leave and if he is still here he will find himself in court. He has no right to be in Nigeria ,it is a privilege

As a graduate of International Studies and Diplomacy from the Great UNIBEN, I have the authority to tell everyone that the diplomat cannot be prosecuted in Nigeria. He has immunity, our diplomat can do same even in the USA and nothing will happen. The immunity that the guy enjoya is derived from the president of the sending country, in this case his president.

I don't want to go into details but the bottom line is that the Traffic Warden was not properly trained about diplomatic practices in his police training hence we was wasting his time with him. There is nothing our government can do about it. As a matter of international practice, diplomats' bags, residents and domestic staff are immuned, they don't pay tax too. There is another one known as Privileges aside the immunity they enjoy.

That is all I can say for now for the purpose of education so that some of should not be fooling ourselves with certain comments.

EDOCSO PROTEST ROCKS EDO STATE OVER FUEL PRICE INCREMENT:

Members of Edo Civil Society Organisations today took protest to major streets in the state capital to bear their minds on the recently increased pump price of fuel by the Federal Government of Nigeria.

We are not against the deregulation of the downstream sector of the oil sector or the removal of subsidy until curtains things have been put in place before such deregulation as it stands now, the fate of fuel price will be hanging on dollars exchange rate per time.

The Federal Government should first, Fix our refineries, license modular refineries, build new refineries, stiffen security in our ever porous national borders. The new price regime has made life unbearable to the people of Nigeria as such we cannot afford to keep quiet.

NIGERIA SHOULD HAVE NO BUSINESS IMPORTING FUEL IF WE KNOW WHAT WE ARE DOING.

THE AGITATION CONTINUES TOMORROW UNTIL THERE IS A REVERSAL OF PRICE.

BENIN ELECTRICITY DISTRIBUTION COMPANY HAS DECLARED WAR ON EDO PEOPLE………………ANARCHY LOOMS

I write this post today to bring to the notice of the general public the open war declared by the Benin Electricity Distribution Company on the good people of Edo state.

You would recall in 2014 when members of Edo Civil Society Organisations raised issues that bother on electricity exploitation, extortion, non provision of metres, compulsory payment for darkness by the people and other ancillary issues which the governor lent his voice and condemned same.

We took same matter to the Edo State House of Assembly, the Oba Palace, and the National Assembly which all these institutions spoke in the same vein with you. For purpose of legal clarity, we took the matter to the Federal High Court in Lagos through our counsel, Barrister Toluwani Adebiyi to seek for an injunction to stop further increment on tariff, mandatory supply of metres among other things. The injunction was granted by the court on the 28th day of May, 2015, which states that there shall be no increment in tariff till the determination of the substantive suit.

To our greatest surprise, the Nigerian Electricity Regulatory Commission (NERC) and the eleven Distribution Companies across the country, on 1st February, 2016 went ahead to increase tariff against the court order. It is also of note that, the legal process of tariff fixing in accordance with the Electric Power Reform Act, 2005, particularly section 76 was not adhered to.

In recent development, the management of BEDC have engaged the services of military and police personnel who go about oppressing, intimidating Edo people, coercing them to pay the new tariff against the court order, more worrisome is the use of the police in arresting persons who have rejected the new tariff and charging them to court for prosecution through the Command Monitoring Unit which is directly supervised by the Commissioner of Police. It is on good record that, for this purpose, 15 new Hilux vans were procured to convey military and police officers to different locations across the state to forcefully disconnect and arrest citizens that have refused to pay the illegal tariff imposed on them by BEDC.

The thrust of this post is to urgently draw everybody’s attention to an impending anarchy in the state which will be as a result of Edo Civil Society Organisations’ resistance/confrontation with the military and police personnel used by BEDC in oppressing, intimidating, harassing, coercing Edo people despite a subsisting court order. We will do anything within our powers in protecting our cherished democracy and Edo people even if it means sacrificing our lives. It will be a moral sin for us to fold our arms and watch the judiciary ridiculed by few capitalists in a democratic dispensation where the court is expected to be the last bus stop to every dispute and contention.

It should also be noted that, the Managing Director of the Benin Electricity Distribution Company, Mrs. Funke Osibudu is very wealthy hence she has a lot of money to mobilize the police and military against Edo people in a democratic era, Edo people now live in absolute fear daily due to the oppressive, intimidating, oppressive actions by BEDC using the military and police.

Our demands are simple, they are:

1. BEDC MUST obey the court order

2. They MUST follow the legal process of tariff fixing in accordance with the Electric Power Reform Act, 2005, particularly Section 76

3. Prepaid metres MUST be supplied Free of Charge to all consumers in accordance with the agreement with the Federal Government of Nigeria.

4. Stop the militarization of Edo state and the use of police in arresting and prosecuting Edo people forthwith.

We will not stop until the people enjoy adequate services for their money.

Your Excellency,

For better service delivery I got the subsisting Court Order against NERC on 28th May, 2015 not to increase electricity Tariff until the substantive matter is decided and as such the plaintiff in the said matter

We are fully aware of your intention in conjunction with NERC to Increase electricity Tariff; even though as good as, and of positive response the content of the proposal may seem to our prayers before the Court, it leaves a sour taste and great odium of a precedence and bad example of great concern to our Legal System and Nigeria Bar.

a. Particularly in a situation where there is a subsisting court order not to increase tariff until substantive suit is determined, it is an intentional, disrespectful-disregard of the court and our rules of law.

b. It becomes very sad, frightening and legally embarrassing when such flagrant disregard happens not in a military era, but in a democratic dispensation where.

i. The NERC Chairman is not only a Legal Practitioner, but having practiced with one of our greatest legal icon, Late Chief Gani Fawehinmi, even conducting the Trial of Late Ken Sarowiwa with him.

ii. The Honourable Power Minister is a Senior member of the bar, a Senior Advocate of Nigeria.

iii. The Vice – President who has been backing up the Increment (amidst insistence by the Senate who described attitudes of Power Sector as “Unfair Trading Practices”, amidst warming by House of Representative that Incrementation this biting economy recession will mean insensitivity) is also another respected Senior Advocate of Nigeria).

Won’t it have been neater, won’t the court have felt highly honoured, won’t it have portrayed a great hallmark of respect for the rules of law, if the Respondents had Initiated Terms of Settlement out of Court with all those proposals put down as Terms of Settlement for consent judgment of the Court do you think there is anyone who will not like it?

Whatever good or evil a man does will forever live after him. If you prefer ignoring this path of honour it shall go down in History that a Vice – President, a Power Minister, both Senior Advocate of Nigeria together with another Senior Member of the Bar, Chairman of NERC, flagrantly in conspiracy against the plight of exploited Nigerians, in glaring intoxication of political power, disrespectfully disregard rules of law and subsisting Court’s Order.

Your Excellency Sir, In furtherance to my SMS sent to your phone, I obtained the subsisting court order in May 2015 against NERC’s Unfair Trading Practices not for any personal gain.

1. We challenged NERC in Court for a better service delivery to Nigerians, electricity supply must be balanced with tariff Increment. The issue affect us all, including you and I.
a. Right Now, Nigerians are not even getting value for what they are paying, despite government investment of about $20Billion for the past 10 years with no significant improvement, is it the money to be raked from the already exploited consumers that they now want to use to bring significant change?

b. Yes we agree that private investors are doing business and should make profit, but had failed to do their home work well and so could not anticipate and appreciate the enormous challenges before poking their heads, more so there is lack of professional management of the power sector, should the innocent consumers be at the receiving end?

c. NERC argument for fixed charge is that it is universal and shall be to service permanent investments like cables, poles, transformers e.t.c, yet they are not providing 24hrs light as supplied by those countries, the initiators of the fixed charge. Till date, communities are still providing poles, cables and transformers for their own use. Thank God the fraudulent fixed charge is now abolished.

d. Non-availability of meters is intentional, as it allows the DISCOS to get anything they want through the outrageous estimated billings, despite the N2.9B metering subsidy made available for this purpose by the Federal Government (details of this fact is in Further and Better Affidavit dated 16th July 2015 aforementioned in my SMS to you)

2. I don’t want you to be deceived or be misled or destroy the good name made so far in Nigeria, but if care is not taken, all these good marks made on sand of time can be unconsciously ruined, particularly with your desire to make a quick charge in the power sector. You must be adequately informed and systematic about it. We want the best for you and for Nigeria.

You had served the people well in Lagos, and unimpeachable record which God used to humble your foes who did everything to damage your image and prevent you from ministerial nomination which convinced the president from being carried away by their antagonism.

3. Sir, I still strongly insist that you get from Chief Anthony Idigbe (SAN) for NERC (08023969381) or from Olaniwun Ajayi’s Chamber (08029305505) for the DISCOS, our Further and Better Affidavit dated 16th July 2015, this process will readily assist you, keep you duly informed on the transformation you want in the Sector, providing necessary direction and platform for your inherent ability of change, in solving the protracted problems in power sector and doing same without tarnishing your good image and enduring public acceptance. Don’t forget that when you live the present position, you are still coming back to us and what you make of the present and where you place the masses in your heart will largely determine your future acceptability. My Brother, do everything in consciousness of this and be wise about it.

Finally sir, increasing tariff amidst the tangled web of power instability and supply of gross darkness will be totally unacceptable, pains inflicting and wickedness to Nigerians.

More Importantly is the subsisting court order not to increase tariff until same is determined. As a Senior member of the bar, you know the full implications of this, as such negates the rules of law, we will not hesitate to bring contempt charge against whosoever acts contemptuously against the subsisting order of court, infact the form 48 and 49 are already prepared against who-will-be defaulter. Find attached the subsisting court order and a letter to the CJ Federal High Court, buttressing some issues to keep you informed.

SaharaReporters confirmed that President Buhari forced the Director General of State Security Services, Ita Ekpeyong, to resign effective immediately.

A source at Aso Rock told our SaharaReporters correspondent that the order came directly from President Buhari and that it would take immediate effect.

Mr. Ekpeyong’s termination comes at a time when power struggles within the Department of State Security Service has been public knowledge, with authorities in the Presidential Villa removing DSS officials from Presidential protection.

It has also been learned that Lawal Musa Daura has been appointed as the Director General of the DSS, which was stated in a letter by the Head of Civil Service of the Federation, Barr. Danladi Kifasi.

Barr. Kifasi was once the Deputy Director Presidential Communication, Command and Control Centre at the Presidential Villa Abuja between 2003 and 2007. He also served as the State Director of Security Service at various times in Kano, Sokoto, Edo, Lagos, Osun and Imo States.
