Chief Joseph Lambe is the holder of the statutory right of occupancy in respect of the choice piece of land at Lambe Close, Ikoyi, Lagos State by virtue of the Federal Certificate of Occupancy No. FCO/111/2001 issued to him by the Minister of Lands and Urban Development sometime in 2007. Royal Estates Limited, a real estate development company, desirous of buying the property from Chief Lambe, entered into negotiation with him. N250m was agreed as the purchase price. A contract of sale was thereafter executed by both parties on 1st June 2015. Some of the clauses in the agreement are as follows: The purchaser shall pay to the seller the sum of N25m being 10% of the purchase price as deposit before the execution of this contract. Upon the execution of this agreement, the seller shall hand over possession of the land to the purchaser and the purchaser shall be at liberty to commence construction work on the land immediately. Balance of the agreed purchase price shall be paid on or before 1st November, 2015 After payment of the deposit and execution of the contract of sale, the purchaser moved into possession and started construction of a 10 storey residential apartments on the land but did not pay balance of the purchase price as agreed. On the 1st December, 2015, the seller wrote a letter to the purchaser demanding that the purchaser pay the balance of purchase price or give up possession of the land. A similar letter was written on the 5th of January, 2016. On the 7th January 2016, the seller wrote another letter terminating the contract of sale and demanding that the purchaser vacate the land within 7 days of service of the letter. However, on the 8th of January, the purchaser paid the balance of purchase price which was promptly returned by the sellers. In addition to the N25m paid as deposit, the purchaser has spent N75m on construction works on the land consisting of N15m for building plans and approvals, N10 for quantity surveying and N50m for piling. The projected annual income from the developed property is N60m. On 1st April, 2002 Mr. Kunle Komolafe was employed as a medical doctor in the medical department of First Atlantic Petroleum Company Nigeria Ltd, a subsidiary of Nigeria Petroleum Corporation (NNPC). Land conveyance is required to be in writing. The reason being ableness to point finger to piece of written document as an evidence of transactions relating to land after a long period of time. Thus, even though lease of land may be created orally, in writing or deed. A lease longer than a period of three years must be in writing. This position is seen in Statute of Fraud section 3 which provides " leases among other things relating to real estate in land must be by deed or in writing" The Real Property act section 3 also provides that "A lease required by law to be in writing...shall be void by law unless made by deed" The question that seems to arise if only a lease longer than a period of three years is allowed to be in writing is; If lease created for a period of one year is subject to renewal which will last for the period of 5 years should such a lease be in writing or not? For the sake of this article the question will not be answered or See Hand v Hall. Overtime, people use failure to put land agreement into writing as an excuse to enforce the agreement even though an enforceable agreement has been reached. For example, what will be the position of Law in a transaction which has been put into writing but one of the parties fail to sign the document because of his selfish interest. If the court fail to enforce the agreement, it will be against equity good conscience and natural justice. The main reason why common law mandated land agreement to be in writing is to prevent fraud. If "fraud" which is said to be curb, will have to see the light of the day during implentation of the writing requirement then the court have to take a look at doctrine of equity. The equitable remedy for the "Writing requirements" is called the doctrine of Part performance It can be explained as, if a perticular tenant has paid for the rent and had stayed in the house for some time with the consent or acquiescence of the Landlord the fact that the lease is not in writing will be quashed by the court of law. Lord Reid held " You take the whole circumstance leaving aside evidence about the oral contract, to see whether it is proved that the acts relied on were done in reliance on a contract that will be proved if it is shown to be more probable or not" The learned justice also continue saying " ...You must not first look at the oral contract and then see whether the alleged acts of part performance are consistent with It. You must first look at the alleged acts of part performance to see whether they prove that there must have been a contract and it's only if they do so that you can bring in the oral contract". When I was still a student someone entered my room and said my T.V looks like BREAD. He uttered the statement in the midst of my crush and one of my neigbour whom I have been wooing for some month. The sorrow that acupuntured my marrow is more than a straight bullet; I felt like buring the T.V instantly. As if that was not enough I tried chnging the channel to HIP T.V so I could gain my ground back, but because there was no remote. I kept pressing channel button so it will get to the destination station. After I pressed for some seconds; he directed the attention of everybody to his Samsung Tablet which screen he said to be bigger than that of my television. My hands were shaking as I kept on changing the station that I did not know, that I have pressed pass Hip T.V. When they left, the thought of what I could do to "My small boy big God" kept dancing through my memory. Then I tried covering my T.v with my curtain whenever I have a visitor but the hunch-back of the T.V will not allow me to do that. People with big plasma T.V with an LD screen might not know the value of what they have until they live with small box. Then I decided to search where I could get a better Better Television set. Can a traveller who decides to be lodging in a hotel every weekend whenever he is on a journey be classified as a Tenant or a lodger? If there is a main difference between a tenant and a lodger, does the different has a main effect on the right of the tenant and lodger or will the classification be only for academic purpose. The main difference between a tenant and lodger is that of exclusive possession. A tenant has exclusive possession against the Landlord and third party while a lodger has exclusive possession only against a third party, but not against a tenant. A tenant cannot bring in a tenant without the consent of the Landlord what will be the position of Law concerning a Family member who agreed to stay with him while not around. This can be illustrated as A who decides to rent a house from the Landlord while the Landlord gave him an exclusion clause preventing him from bringing in a new Tenant, If he brings in C. The fact that you are paying a rent does not make you a tenant. A tenant is anybody who is occupying a particular premises or house. The simple definition is If A who pays money to a Landlord ask B to be staying in the house B is thus recognised as the tenant. This does not however prevent A from being a Tenant if he stays in the house. It happened about three years ago when U.B.A bank went to meet Mrs tejuoso requesting her to lease her building to them for banking operation but the letter was stated "subject to contract" and the lease will take effect the moment their is physical possession of the property. After this, the bank made mention of some changes they want in the property to suit their banking operation which includes; That all main services which include main waters, main electricity, plumbing system and sewage disposal facility were in good condition That they will demolish structure to make space for bank operations. THE PRICE OF A PROPERTY DOES NOT MATTER Propertylover sold a land worth $50,000 dollars to his friend at $5 because his friend lost his job and might not be able to pay the real price for the land. Thus, he decided to sell the land for $5 which he called "chicken change". Some years later Propertylover's friend was able to secure his job back and propertylover needs land for his failing business. However, he brought an action to collect the land back; giving claim that he had the intention of giving the land to his friend for free, and now he wants to have it back he even said that the $5 he collected from him is just to complete the transaction, which he is ready to pay back if he gives him the land back. Propertylover friend however bring an action for breach of contract. The court gave decision in favour of the his friend with these reasons 1) In absence of fraud,the price you sell your property does not matter, so far it's something of value in the eye of the law. You get to mingle with different people with different background,different temprament all packed in one compound. But the problem is that you cannot just be on your own, even if you are on your own the annoying sound of your neigbours generator will wake you up. You automatically become a nursing mother the moment your neighbour gave birth, her crying baby will not allow you to sleep.
