-No fixed Date For NASS reconvening to consider INEC Budget, Saraki, Dogara Says

YBTC NEWS-The National Assembly have said they are yet to fix a date for the reconvening of the legislative chambers for the consideration of the Independent National Election Commission budget.

The Senate President, Dr. Abubakar Bukola Saraki and Speaker, House of Representatives, Rt. Hon. Yakubu Dogara, have directed that we inform all Senators, Honorable Members and the public that a date has not been set for the reconvening of the Senate and the House of Representatives to consider the Independent National Electoral Commission (INEC) 2019 elections budget request forwarded by President Muhammadu Buhari on July 17, 2018.

The leadership of the two chambers had met and agreed to reconvene to consider the proposal this week before which a meeting between the Joint Senate and House of Representatives Committees on Electoral Matters and officials of the INEC must have held on or before Monday August 13, 2018.

YBTC NEWS-For long now many have doubted the competence of Lawal Daura, the now former Director General of the State Security Service and with the recent charade he put up on Tuesday at the National Assembly, his termination was only imminent bringing his almost a decade career in State security to a “round-stop”.

YBTC news had earlier reported the incident on Tuesday, 7th August, 2018 where some members of the Parliament were denied entry into the Assembly by the DSS on orders of its then DG, Mr Daura.

According to a report by The Nation newspaper ( 7th August, 2018), the DSS operatives were acting based on orders from “above”. The siege however was to prevent some Senate-members from entering into the Red Chamber of the National Assembly. It can be recalled that on Tuesday, the embattled Senate President, Bukola Saraki had called for an emergency joint leadership meeting of the two chambers of the Assembly.

The Acting President, Professor Yemi Osibanjo in response to this contempt of the law , issued an immediate “termination letter” to Mr Daura. For this singular act, the Presidency deserves some accolade .

However, the question is, “was Daura fired for the siege on the National Assembly? Or was he sacked because of his overdued incompetence?”
In addition, Mr Daura was nabbed by the Economic and Financial Crimes Commission, EFCC. However, his arrest by the EFCC is not strange, considering his recounted fall out with the EFCC boss, Ibrahim Magu. For one, Magu is still in acting capacity because of Mr Daura . YBTC News covers the constitutional implication of Saraki’s impeachment

A lot of controversies have been rounding the air regarding the defection of the 8th Assembly’s Senate President, Bukola Saraki to opposition minority party, the People’s Democratic Party (PDP).

This to many, has made the Leader of the Assembly lose his rights to the office and as such should either resign or be impeached. Therefore, the impeachment attempt of Tuesday 7th of August,2018 only buttresses this notion.

But what we should note is, ” whether or not calling for his impeachment is constitutional”.

However, here is what the Nigerian 1999 Constitution as amended stipulates as regards the National Assembly’s Leadership :

According to Section 50 (1)(a), of the constitution, ” A President and Deputy President of the Senate, shall be elected by the members of that House from among themselves”.

As stipulated above, there is no constraint placed on lawmakers from the minority party from seeking the position of the Senate President. As rightly noted, Saraki emerged leader of the 8th Assembly through a majority vote cast by the multi-member plurality voting system of the Senate, marking his eligibility.

Similarly, only in the following situations will the Senate President or his Deputy, the Speaker or Deputy Speaker of House of Representatives eligibility may cease:

a) if he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise then by reason of a dissolution of the Senate or the House of Representatives; or
b) when the House of which he was a member first sits after any dissolution of that House; or
c) if removed from office by a resolution of the Senate or the House of Representatives, as the case may be, by votes of not less than two-thirds majority of the members of the House.
Unless impeached by a two-thirds majority in the Senate, Bukola Saraki’s eligibility as the Senate President cannot be contested. And with a failed attempt yesterday which yielded 48 lawmakers voting in his favour......
