Crime / Rape Myths And Victims ; Reforming Rape Laws In Nigeria. by SeaUrchin(f): 2:49pm On Mar 26, 2020
Rape is denounce able and condemnable. It is inhumane and ruthless. It is an unjustifiable act that needs to be expunged. Simply put, rape is nonconsensual sexual intercourse.
Under the Criminal Code of Nigeria; Rape is defined as having unlawful carnal knowledge of a woman or girl, without her consent, or with her consent, if the consent is obtained by force or by means of threats or intimidation of any kind, or by fear of harm, or by means of false act or in case of a married woman, be personating her husband. The offence is punishable by imprisonment for life with or without caning (see sec 357 and 358 of the Criminal Code Cap ‘38’ Laws of the Federation, 2004). The Criminal Code is applicable in the Southern Part of Nigeria, it is restrictive in its interpretation. Its only made provisions for female rape victims segregating male.
Under the Penal Code (applicable in Northern part of Nigeria) Rape is when a man has sexual intercourse with a woman against her will, without her consent or with incorrectly obtained consent; when the consent is obtained by putting her in fear or death or of hurt. It goes further to say even when the girl is a wife of the person, such person will be guilty of rape if she has not attained puberty (see sec 282 of the Penal Code). This code is restrictive just like the Criminal Code. It only recognizes female rape victims excluding male victims.
Under the Violence Against Persons Prohibition Act (sec1) states “a person commits the offence of rape if he or she intentionally penetrates the vagina, anus or mouth of another person with any other part of his/her body or anything else without consent, or the consent is obtained by force”. The VAPP Act is a federal law, a progressive piece of legislation. It is expansive in its interpretation, as it makes provisions for both male and female sexual offenders and victims. Unfortunately, this Act is only applicable in FCT, Abuja and by virtue of its domestication it is also applicable in Lagos, Anambra, Ebonyi and Oyo States respectively.
In the case of Popoola v. State(2013) 17 NWLR (pt1382)p. 100 per Muntaka-Coomasie J.S.C at page 120 paras G-H on rape said “the offence appeared to be heinous and heartless. The sentence meted out by the trial court amounts to abdicating its role as a judicial officer. I condemn such type of sentence. The sentence is unnecessary lenient and loose”. In other words rape is a despicable act, the severity of the offence cannot be over emphasized. It is a serious crime that needs to be backed up with grievous sanctions.
Victims of rape are made to suffer unquantifiable anguish, post traumatic stress disorder, eating disorder, emotional disorder, dissociation from reality, depersonalization, physical violence, sexually transmitted diseases, unwanted pregnancy amongst other ills. Rape has been categorized into various categories namely acquaintance rape, command rape, fraud rape, date rape, incestuous rape, underage rape, statutory rape, gang rape and marital rape.
Modern realities and cases have shown us that the legal and statutory definition of rape is now ineffective and inadequate because it does not define rape in its entirety. The statutory definition of rape gave us the understanding that rape can only be committed against a female, that is its definition is gendered based. I am of the opinion that rape could happen to anyone, no matter your age, sexual orientation, or gender identity. In recent times, men and boys can also be raped, but they are faced with some challenges because of social attitudes and stereotypes about men and masculinity. Some persons sees male rape as ridiculous and impossible because of the belief that a man can never be vulnerable. The assumption that only female can be raped is based on stereotypes and wrong belief. Male could be raped by females or by male. In 1978,it was reported that a certain lady named Joyce McKinney in the case of “Mormon sex in chains” scandal was convicted for chaining a man and forcing him to have sexual intercourse with her. That is to show that a male can also be a rape victim. In Africa, no man is allowed to be vulnerable. As a man, you have to be masculine and strong. You should never break down or cry. He is meant to be a leader and provides for the whole family. When he fails to reach that set standard, society perceives that there is something wrong. This stereotypical belief has caused much harm and part of the harm is that male are not believed to be rape victims because of their supposed invulnerability. We much understand that victims of rape is not only limited to female it also involves male.
Conclusively, rape is an act that affects its victims psychologically, physically and emotionally. Our laws are said to be progressive, dynamic and never static. Therefore, it should review its statutory provisions for rape and incorporate modern changes in society including provisions for male rape victims . Rape is a serious crime against the dignity and sexual rights of an individual, it can happen to anyone including male and females. A more inclusive and all encompassing definition of rape should be included in our laws and serve as parameters to determine acts which can be classified as rape. Statutory laws on rape should be reformed and reviewed in other to curb the menace of rape.

A CONTROVERSIAL BILL _ GENERATING SETS (PROHIBITION/ BAN ) BILL 2020
As we all know, Generating sets are machines that are used for producing electricity which run on diesel, petrol and the likes.
Senator Bima Muhammad Enagi from the Niger south senatorial district sponsored a bill titled – “a bill for an Act to prohibit/ban the importation /use of Generating sets to curb the menace of environmental (air) pollution and facilitate the development of the power sector”. The bill was read for the first time at plenary Wednesday dated 11th, March 2020 in the red chamber that is the senate. The bill seeks to ban the importation and use of generating sets(generators) in the country and to curb the menace of environmental pollution which leads to potential health hazards it poses to the whole nation. The bill provides ten years imprisonment for any person who imports generating sets or knowingly sells generating sets. However, its provisions gave some exceptions stating that the ban/prohibition of generating sets shall not include generating sets used for essential purposes to wit; medical purposes, railway stations, airports, elevators, escalators, research institution and facilities that require twenty four hours electric power supply.
The People Democratic Party chieftain, chief Sunny Onuesoke said that, “It is a criminal offence to use or import generators in Egypt. This is because there is twenty four hours electricity supply. Even in Ghana, our nearest West-Africa neighbour, people do not use generating sets. This is because there is regular power supply. Nigeria should firstly put their house in order before passing laws that could be described as oppressive to the masses”. I unite myself with his assertion. Nigeria is currently faced with the challenge of poor power supply, generation and distribution despite huge budgetary allocations by current and past administration to fix the power sector. According to United States Agency for International Development (USAID), Nigeria has the potential to generate 12522 megawatts(MW) of electric power from existing plants, but is only able to generate around 4000MW,which is insufficient and inadequate considering its population. Nigeria is not utilizing its full capacity in power generation.
Despite privatization of the distribution companies whose aim was to improve on the distribution of electricity, power distribution remains a huge challenge in Nigeria. The electricity sector is characterized with unstableness, acrimony, inefficiency and frequent blackout. Nigerians bewail over the poor supply of power which is needed to sustain their businesses. So in other to mitigate the inadequacy of the power supply, Nigerians use generating sets for their businesses. However, if there is a good supply of electricity nobody will be convenient using generating sets considering the resources used in maintaining it. Consequently due to the poor power supply, businesses that are dependent on electricity will not survive except with the use of generating sets.
Furthermore, Electricity is useful in our residents and for domestic purposes. Most times there will be days and months blackout without electricity; our saving grace in such situations are generating sets. Electricity is an essential part of modern life because the list of its uses are inexhaustible.
To sum it all, the said that bill seeks prohibit generating sets is absurd, silly, comical and laughable considering the poor power supply in Nigeria. I’m of the view that instead of implementing such undemocratic law, Nigeria should focus on how to fix the power sector which will results to discouraging the use of generator. Majority of the countries that has ban the use of generator has stable and sound power supply. If Nigeria wants to tread such path, they should first tackle the challenges posed by poor power supply. The aim of this said bill as stated by its sponsors is to curb environmental pollution and development of the power sector. I will say this is an illusion, it is delusional because there are other tested and trusted methods that can curb environmental pollution apart form banning generators.
Conclusively, our law makers should concern themselves with other societal ills that are harmful to our economy, government and the society at large instead of thinking of banning the use of generators which is ridiculous.

Well...
The ban placed by the governor of Lagos state on motorcycle and tricycle to me is hilarious. He has taken away the people means of livelihood. Some of these people provide for themselves and families through this means, they work hard so as not to take criminal activities as an option. Probably the governor did it for a greater good, but the welfare of the people is also one of his priority. He should look for alternative for the people since tricycle and motorcycle are no longer used in Lagos. Then those that use tricycle and motorcycle to source for income he should also make alternative for them so they won't get involved in criminal activities.
It would have been better if he had provided alternatives before effecting the ban on motorcycles and tricycles

I am yet to write my JAMB but some kind of fear has gotten to me, due to the bad stories I heard from past jamb participants.

I was planning to read through the textbooks but a friend of mine who also Read through His textbook could only archive a score of 183 and he is intelligent, some also said jamb is Hard.

So I Will like advice from old jambites to please give me advice to archive a high jamb score. My school of choice is UNIBEN (Computer Engineering).

I will advise you to not believe the bad talk people have about the exam...
Jamb has different experience for different people. I also had similar fears when preparing for mine in 2018,what helped me was prayer, reading of textbooks and past questions...
Well I did not really base all my efforts on the past questions, but on the textbook.
Also be a source of inspiration to yourself, motivate yourself l, stay true to yourself. People always have bad things to say about everything in life, you just have chose what you believe

God do love us. You don't expect him to come from heaven to rule us,he instill that leadership qualities in us t rule over ourselves. Nigeria our country needs good citizens and leaders not the ones that criticize the economy instead of bringing out possible solutions to our problems. So the mentality of 'God dont love us' is not true

Yaradua that would have done better, God allow death to take him from us, God ended up giving us a man that doesn't see stealing as corruption. The guy actually did the wrong by retaliating, but the policeman also has a temper to put under control. At most he should arrest the boy or punish him instead of shooting him. The constitution of Nigeria guarantees our rights to life, no man has the right t take his life or take the life of another person. So the police man action actually contradicts the law. The police man needs to face the full course of the law.

We all should just learn to control our emotions and anger when alone and when we are with others.

The government should look 4 better solutions to it... Nd if its by taking rape cases more seriously nd making d punishment severe... All we want is 4 all this issues of rape to reduce
