Bayelsa Elections 2023: PDP Supporters in Ogbia 2 state constituency Cries out to the President of the Appeal Court.

The supporters of the Peoples Democratic Party, PDP candidate Honourable Munalayefa Edwin Gibson, for the Ogbia 2 state constituency elections for has called on the President of the Appeal Court, Hon. Justice Monica Dongban-Mensem to prevail on the three-member tribunal panel headed by Hon. Justice Oluwatoyin Mojisola Fadeyi in the National/State Houses Of Assembly Elections Tribunal Holden at Yenegoa, Bayelsa State.

Between:

Honourable Munalayefa Edwin Gibson and Peoples Democratic Party PDP; the 1st and 2nd petitioners respectively filed a petition (with Petition NO: EPT/BY/SHA/22/2023) challenging the result declared by the Independent National Electoral Commission (INEC) in favour of All Progressive Congress and her candidate Mr Godknows Obein as 1st, 2nd and 3rd respondents respectively for the ogbia 2 state constituency supplementary elections held on the 15th of April, 2023.

Chief Maxwell Odiba who made the call after the three-member tribunal panel namely:
HON. JUSTICE OLUWATONYIN MOJISOLA FADEYI (female) from Oyo State Ibadan as Chairman,
HON. JUSTICE OLAYINKA DAVID AFOLABI (male) member 1 from Osun State and
HON. JUSTICE MICHAEL ONOCHIE (male) member 2 from Anambra State unconditionally and repeatedly adjourned our case severally without any cogent reason knowing fully well of the exigency of time which they also complained but forcing the Petitioners to call just 4 witnesses in one day to cover 25 polling units, a strategic way to fraustrate the petitions.

“We are hereby calling on the President of the Court of Appeal of Nigeria, HON. JUSTICE MONICA BOLNA'AN DONGBAN-MENSEM (CFR) to use her good office to prevail on this three-member tribunal panel headed by HON. JUSTICE OLUWATOYIN MOJISOLA FADEYI to allow us present our case in due time without any back hand tactics or delay game as the tribunal is time-bound.”

It was when PW2 was in the witness box to testify when Hon. Justice O.M Fadeyi raise suo moto and tactically dismiss our petition for applying for multiple issuance of pre-hearing notice even as the last applications was ok by law and having been overtaking by event, claiming that our applications were premature. This was done without any objections or fillings from the 1st, 2nd and 3rd respondents.

Then the PDP candidate of the Ogbia 2 state constituency in Bayesla State Appealed the ruling within two days on the 16th of August, 2023 at the Appeal Court in Portharcourt. The Appeal Court on the 15th of September, 2023 gave a judgement in our favour and returned the case back to the tribunal and ordered for an expeditious continuation of trial.

Ever since the case returned to trial Hon. Justice O.M Fadeyi has adjourned the case severally without any substantial reason.

The PDP supporters said it has been one delay tactics or the other since the case started at the tribunal after the filling of our petition. They emphasized that these adjournments did not come from the respondents but the Judges themselves against the will of the litigants.

PDP supporters noted that it is strange that the judges will be the ones calling for adjournment on a case that is time-bound and both parties are fully prepared to see through the proceedings.

Since Appeal Court set aside Hon Justice M O Fadeyi pre-trial ruling, we returned back to the tribunal but our case is adjourned daily not considering we pay dues without progress, the most worisome is the last adjourn date on Friday 29th September, 2023 as it was agreed by all parties to have our expert witness due to exigency of time but to our greatest surprise, Hon. Justice O.M Fadeyi surprisingly adjourned our case again till Thursday 5th October, 2023 without any reason as all parties were present in court and ready to go ahead with proceedings when no reason for such.

Supporters said they are appealing to the President of the Court of Appeal to prevail on this three-member panel to allow the court proceedings to go ahead without any hinderance and fraustration and allow Justice prevail.

"We want to be allowed to prove out petition at the tribunal and call our witnesses within the stipulated time allowed by the constitution for this trial. We hope that the tribunal panel will not technically delay the proceedings and give room for our legal team to extensively prove our petition”

PDP supporters made this passionate appeal to the President of the Court of Appeal of Nigeria, Hon Justice Monica Dongban-Mensem while addressing newsmen in Yenegoa on Friday 29th September, 2023 of their bitter experiences over this Hon. Justices

The Peoples Democratic Party, PDP, presidential candidate, Alhaji Atiku Abubakar, sympathized with the victims of flood in Jigawa State when he paid a sympathy visit to the state yesterday.

This is coming weeks after his media adviser, Paul Ibe, in a statement said the PDP presidential candidate will commence a tour of states with high incidences of flooding across all geo-political zones in the country.

Atiku who was in Jigawa on Friday night to offer his sympathy and support to the victims of flood visited the emirs of Hadejia and Dutse to sympathize with them on behalf of the victims.

He urged the victims to take it as an act of God and prayed for Almighty Allah to grant the soul of the deceased eternal rest and the fortitude to bear the loss.

While reacting, the Emir of Dutse, Dr Nuhu Muhammad Sanusi, commended the presidential candidate for the gesture, while he also gave assurances of proper monitoring of the distribution of donations including those given by presidential candidates.

“I am sure the committee for the raising and distribution of flood palliative will do the needful to channel all the support to the affected victims,” he said.

DAILY POST reported that the All Progressives Congress, APC, presidential candidate Bola Ahmed Tinubu and Kebbi State Governor Abubakar Atiku Bagudu have made similar donations to the Jigawa State flood victims.

Nigerian actress,  Anita Joseph says after 2 years a child shouldn’t see your unclothedness as a parent.

This is coming after she lashed out at the Ghanaian celebrity, Akupem Poloo who went completely nude in a photoshoot with her son , to celebrate his 7th birthday.

She called her delusional and needed mental evaluation .

The photo has since received several backlash as so many people find the photo really offending.

Akupem Poloo in a video apologized for the misunderstanding in the photo ,saying she usually bath with her son and was only displaying an artistic perspective and message.

Anita Joseph said she grew up not seeing her parents unclothedness and believes its totally wrong to expose a child to such nudity.

According to her, its more like messing up his innocent mind.

She advised parents to look for another way to bond with their kids but definitely not by bathing with them.

She added that a child’s mind is too young to understand everything in your body.

‘One day,you might have to explain what your pubic hairs are to your child’ ,she added.

Pentecostal Christianity has corrupted our way of living. The damage that Pentecostal pastors have caused with their exploitative sermons will take decades to undo. Right across the continent, their sermons have destroyed critical thinking and produced a generation of Africans who are magical thinkers. The corruption is pervasive. It is in government, our schools, businesses, in our homes and even in our universities - the seat of all learning and philosophy. It is everywhere.

Our universities are populated by "intellectuals" who not only believe but also teach that witches are real, that prayers can bring dead people back to life and cure all diseases and make cars drive without any fuel. Our Vice President is a professor of law and he is an ardent follower of a pastor who claims he has all these powers. We are now at a point where the generation that has suffered the most brainwashing is at the helms of our affairs. And they are spreading their corruption. If the person who teaches you science discredits evolution but argues their pastor's car can drive without fuel or that their pastor has resurrected people and cured every disease through prayers and fasting, what values are they imparting to you? The purpose of education is to overcome ignorance, not to validate it.
Of what use is the kind of education that does not cause us to examine our prejudices? If I received a penny for every time a fellow Nigerian medical doctor argued that prayers cure cancer or resurrect people or that witches and demons are real, I would be a millionaire today. Their evidence is usually stories that have been narrated to them by their pastors, friends and families or the bible. And when I say to them the bible mentions talking snakes and donkeys they tell me I am spiritually blind and cannot understand the things of God. I think it is possible to believe in the existence of God without all that literalism but this is a subject for another day. But what value has pentecostalism added to our society? I can think of none. We are still one of the most corrupt nations on earth, the majority of our citizens subsist on less than one dollar/day, workers are owed wages sometimes running up to six months in arrears, the elderly cannot access their pensions, and our unemployed youths are forced into prostitution and armed robbery.

The pastorpreneurs do not live by what they preach. They do not care about integrity. We have seen them physically assault church members, involved in questionable business deals, sleep with female church members, tell lies and so on. I could go on and on for days but I would struggle to identify one benefit of Pentecostalism. Greed and selfishness are the ethos of the Pentecostal movement as I have observed it practiced in Nigeria. Pastorpreneurs take money from the weakest and the most vulnerable members of the society such as widows, pensioners, the unemployed and the sick.
They use it to buy themselves private jets and to build expansive business empires which they will bequeath to their children. They use tithes and offerings to build private schools and universities but the poor church members whose donations built these institutions cannot afford to send their children to these places. On matters that relate to human rights and good governance, we just never hear from these pastorpreneurs. Nigerians are drowning daily in the Mediterranean Sea in search of a better life in Europe. Eunice was murdered in Abuja last year by Muslim youths during evangelism. Another Christian woman was murdered by a Muslim mob in Kano recently.

Do you hear pastorpreneurs talk about these issues? No! They are deaf and dumb, and they don’t want to know about such “mundane” issues. But as soon as you speak against tithing and threaten their livelihood they come out of hiding and one after the other, sermon after sermon, they use death threats to frighten church members to continue to pay tithes to them. They swamp us with sermons about how an all-sufficient God needs money. They say, God, who is supposedly all-powerful and omnibenevolent, needs money to be able to bless his worshippers.

Curiously, I have yet to find one pastor use the scriptures to contradict Daddy Freeze on tithing. They have issued curses, death wishes and even tried to use his personal challenges to discredit him but not one bible verse has been used to support their position on tithing. Considering the number of scriptures these people have memorized, I think it is telling that none of them has been able to produce a SINGLE verse to support their craft. One important lesson the debate on tithing has taught us is this: Most Nigerian Christians are pastor-worshippers. They do not think for themselves and cannot read their Bibles without hearing the voices of their pastors in the background. It has taken one man to expose the shallowness with which millions of believers relate to the scriptures they claim to read daily.
The other lesson is this: When pastorpreneurs use death threats to frighten believers into paying tithes, it proves neither the pastorpreneurs nor the believers truly believe what they preach. If heaven is the fabulous place where ALL the believer’s aspirations come to fruition then why are believers so scared of death to the point it can be used to manipulate them? This is like someone who fantasises about emigrating to America but when they are informed they require a travel visa they say, “I reject the visa in Jesus’ name.”

You cannot go to your beloved heaven if you do not die. To conclude, Pentecostalism is a doctrine of greed and selfishness. It thrives on fear. It exploits the weak. It destroys critical thinking. Our salvation is in insisting on a rational society. Enough of these superstitions and greed.

The Economic and Financial Crimes Commission (EFCC) was given permission by the National Judicial Council (NJC) to try Justice Hyeladzira Nganjiwa and other judges accused of bribery, raising questions over the Court of Appeal’s dismissal of charges against Justice Nganjiwa on the grounds that the anti-graft agency does not have the power to prosecute any sitting judge.

In documents made available to SaharaReporters, the NJC wrote to the EFCC acknowledging that charges had been filed against Justice Nganjiwa, as well as Justices Rita Ajumogobia and James Agbadu-Fishim.

The NJC therefore notified the EFCC that the concerned judges had been directed to not perform any judicial duties pending the conclusion of their cases.

“I have been directed to inform you that Council, at is Meeting which was held on 2nd and 3rd November, 2016 decided that indicted Judicial Officers should not perform judicial duties until the anticipated cases against them are concluded,” the NJC said in its letter to the EFCC.

“I am to inform you that the Honourable, the Chief Justice of Nigeria and Chairman of the National Judicial Council, Hon. Justice W.S.N. Onnoghen, GCON has instructed their respective Heads of Court to direct them to stop sitting in line with Council’s decision of 1st and 2nd November, 2016, as charges have now been filed against them.”

By asking the accused judges to step down from their posts while they face trial, the NJC indicated that it would allow the judges to face trial.
This is contrary to Justice Abimbola Adejumo-Obaseki’s ruling on Monday at the Court of Appeal that held that no sitting judge could be tried by the EFCC.

He stated that a sitting judge could only be tried by the NJC unless he or she is dismissed or forced into retirement by the NJC.
However, while urging the EFCC to the send petitions to the NJC before taking disciplinary action against a judge, the NJC raised no objection to the EFCC filing charges against Justice Nganjiwa and two other sitting judges.

In a controversial ruling on Monday, Justice Obaseki, presiding of the Court of Appeal in Abuja, dismissed bribery charges filed against Justice Nganjiwa. The EFCC swiftly announced plans to appeal the ruling before the Supreme Court.

SaharaReporters learnt that the lead justice, Obaseki-Adejumo, is a spouse of the head of the National Industrial Court, Babatunde Adejumo, where another judge, James Agbadu-Fishim, is facing trial for receiving bribes from several lawyers.

A report by Daily Trust has given details of how Governor Ifeanyi Okowa of Delta state, played host to Governors Aminu Tambuwal and Nyesom Wike of Sokoto and Rivers state respectively in Asaba, barely three days after the national convention of the Peoples’ Democratic Party (PDP).

According to the report, former governor of Delta state, Chief James Ibori who was not present at the PDP convention was also at the discreet meeting.

Chief Ibori had earlier made a surprise showing at the products exhibition by beneficiaries of a skills acquisition program of Governor Ifeanyi Okowa's administration.

Unnamed government sources quoted in the report believe that the governors coming together in Asaba cannot be unconnected to discreet political permutations in the build up to 2019.

Earlier in the day, the governor of Rivers state, Barr. Nyesom Wike, had commissioned a road constructed by Okowa administration.

Tambuwal has always been described as a 'presidential material' by his admirers in Sokoto state and beyond, given the matured way he presided over the House of Representatives as its speaker from 2011 to 2015.

However, the friendship between Governors Wike and Tambuwal, dates back to their days as young lawyers and they have sustained despite being on different political divides. Both governors are in their 50s and are generally seen as politicians with a bright future.

Ibori on his part, is regarded as the indisputable godfather of Delta state. Wike was in his country home in Oghara, Delta state three months ago to pay homage to him.

During the visit, Ibori, urged governors in the south-south part of the country to unite and work together to ensure massive development of the region.

Uche Secondus, a chairmanship aspirant of the Peoples Democratic Party in the December 9 national convention disclosed what he would do if he becomes the national chairman of the party. Nigerian Tribune reports that Secondus declared that he would not look at the permutation of the All Progressive Congress (APC) on how to win in 2019 presidential election. According to him, ''If I become the chairman, I will not look at the permutation of the APC on how to win election.

''I have a different strategy on how to win elections. So it has to be about collective leadership position. ''Our first assignment is to determine who becomes our presidential candidate and the choice of the running mate will be the exclusive right of the candidate.

''So we are not positioning that. We are not going to say it should come from here or from there. I believe that taking the party back to the people is very important.'' Meanwhile, NAIJ.com had reported that a chairmanship aspirant of the PDP Tunde Adeniran disclosed that the southwest may present a consensus candidate to represent the zone at the December 9 convention of the party. Adeniran gave the indication during his visit to canvass votes from the 59 delegates of the party in Ondo state.

Famed as Total Chairman when he held sway as the chairman of the Rivers State chapter of the party, he subsequently emerged as the National Organising Secretary, deputy National Chairman and most recently, the Acting National Chairman of the party. Now an aspirant for the post of National Chairman of the party, Secondus in this interview speaks on his aspiration, goals and plans for the party. Excerpts:

Before the Port Harcourt Convention in 2016, you aspired to be the Deputy National Chairman. What changed so much that you are now contending for the office of national chairman?

The truth is that by last year I was gunning for the Deputy. The arrangement was such that somebody from the South West would emerge as the Chairman. That time, we had two and a half years to the general election. But now, we believe that we don’t have time. Therefore we need an experienced person who knows that from the first day he will just start working.

The second reason is that relatively you need a zone where there may not be crisis, and I believe that in my state and in my zone, we don’t have a crisis within the party unlike in other zones where they have some issues. I don’t want to go into details. These are some of the reasons I am volunteering myself for the position.

Given that the party is very strong in the South-South and the South East, and that it would have been logical to woo the Southwest with the office?

That is purely sentimental. In reality, if you want to win an election you don’t start from the unknown. You begin with the known. Apart from the chairman, there are three or four major positions if you are talking about the zoning of the positions. The South West is a very important zone in the country, if not the number one zone, if you like in terms of intellectualism, media and so on.

We know they have produced the President. So if you look at the president, Vice President, and the Senate President, these are key government positions. So if you are also talking of what will benefit the people directly, you will see that with these three key positions, there is no way the South West can be ignored; but we are down, so we want to start from a safer place to move.

And going from there, I will deliver my state during the elections. As the chairman, you must deliver your place first, since they say that charity begins at home. I will deliver my place and then proceed to win other states and regions.

My agenda for the party will be based on 3Rs: Rebuild, Reposition and Regain. I will want to remain focused on it in terms of building the party. As we are doing that, we do it together with the other two – repositioning in terms of membership, going digital and mostly emphasising on the youth who are leaders of tomorrow.

The general impression is that if you become the National Chairman of the PDP, the South West would be considered for Vice Presidency slot to give APC the big fight. How true is that permutation?

If I become the chairman, I will not look at the permutation of the APC on how to win elections. I have a different strategy on how to win elections. So it has to be about collective leadership. Our first assignment is to determine who our presidential candidate becomes and the choice of the running mate will be the exclusive right of the candidate. So we are not positioning that. We are not going to say it should come from here or from there.

Professor Adeniran, one of your co-aspirants, has alleged a plot by the outgoing national chairman to impose you and there are also allegations that you did not manage the resources when you served as acting national chairman?

80 percent of the time, rumours is more than the fact. This is Nigerian politics for you. Speculations and imaginations engulf most of our thinking. But I believe that the media will do more findings than just headline news. There is no truth in it that Wike drafted me to do Makarfi’s bidding. I’m close to virtually all the governors, and I consulted all of them, including the BoT Chairman.

In truth, I have never sat down with Makarfi on how to become Chairman; all those are speculations. This is pull-down syndrome. There is no iota of truth in it. I have no arrangement with Makarfi; no one is trying to impose me on people. I have been there before. I contested as National Organising Secretary, I have contested for Deputy National Chairman, I acted as National Chairman of our party. These are records that you can cross check. On the issue of what Mu’azu left, again, this is a calculated attempt to blackmail me by whosoever is behind it whether from within or outside, I don’t want to mention names. For anybody to say N9billion was missing or N9 billion was left, it means that money was not even used for the election. The money realised was about N11 billion from sales of forms nationwide. And in our guidelines and constitutions, when you realise such money, it is shared among the local governments, the states, the zones and the national.

Even the mere mention of N9 billion means, no money was given to them as I mentioned above. I want to plead with you to get into the secretariat, there is a Director of Finance, there is an acting Treasurer, go and find out the fact not taking blackmail or headline news from other people. These are sponsored by some people.

After the 30 percent was shared, you can do the mathematics yourself; money was kept for completion of our national headquarters. There was no money at all that we met. Now, the money that was kept was about N5 billion while Mua’zu was still the chairman.

The truth is that, after we lost the presidential election, we could not raise the money for other elections.

So the leaders looked and said that the money that was reserved should be used. I was still in Rivers State when the Chairman called all of us from our states and said they could not get money to disburse again. So, the Chairman disbursed the money.

Let me tell you I’ve been Chairman of PDP in Rivers State; I was never found wanting. I was National Organising Secretary, I raised the money in 2011, and I was not found wanting. If you recall, Taraba election was inconclusive. There was repeat election in Taraba, Imo and I think in Abia. All these were expenses of the party. By the time we returned, of course, Mu’azu gave us account of all money, all the money had been used apart from payment of salaries and a few things that we needed while the other balance was still in the bank.

I challenge you to go to the Secretariat to get your figures accurately because I may not be accurate with figures. But no money was missing apart from N500 million that the bank seized. The issue of missing N9 billion is to misinform the people to change their minds against some of us who want to contest.

When I appeared before the Senate caucus, on my own, I shed light on the alleged missing money. Some of them brought money to me but I rejected it, and I said they should go and use the money for the election. I have been mentored to know that money destroys in politics.

What is your plan B as you prepare for the convention?

My plan B is to support anybody that wins that day. It can be me, and I will be very glad and thank God. But if someone else emerges, I will support him because I am a team player.

Barely two weeks to the National Convention of the Peoples Democratic Party (PDP), tension is mounting as to what the result of the elections would be and what the results portends for the future of the party.

This is as the National Executive Council (NEC) of the party has fixed Thursday for a meeting to discuss issues being generated by the convention.

While many of the aspirants are worried because of the failure of the national leadership of the party to release the list of those that would conduct the December 9 National Convention, there are strong indications that the odds favour Prince Uche Secondus, a candidate considered as the dark horse in the race, to clinch the chairmanship position.

This is because many believe that the former acting National Chairman has deep experience in the internal workings of the party and that is his strongest selling point.

Secondus, The Daily Times gathered, fit perfectly well into the mindset of a cross-section of PDP stakeholders that have vowed not to settle for anything less than experience as the most critical consideration for supporting any of the candidates jostling for the soul of the party.

The former chairman of the party in Rivers State is also seen by many as a person that knows the party inside out. His role in the rebuilding process of the party could not be ignored, as he is acknowledged as one of the very few that saved the PDP’s ship from a total wreck. He is believed to be strong, bold and pushful and that with him on the driver’s seat, the party may return to power in 2019.

To some members of the party organs, Prince Secondus remains the most qualified for the chairmanship position going by his antecedents before and after the crisis that culminated in the loss of the party in the 2015 general election.

While the PDP’s Governors Forum has not made an open preference, it is believed that majority of the governors will back Secondus for the position.

A grapevine from the forum said: “It is almost clear that PDP governors prefer Secondus. Governors of the party from the South East and South-South automatically throw their weights behind him and he also has the support of their Excellencies from the Northern zones and most surprisingly is that of Ekiti State governor who naturally should be rooting for one of the candidates from the South West.”

Though feelers from the camp of PDP former governors painted a divided house with about three candidates getting attention, however, former governors from the South East and South-South states are solidly behind Secondus.

It was further learnt that these former governors from South East and South-South have enlisted the support of some of their Northern counterparts for Secondus, while those from the South West already had their fold depleted with three of them, Chief Olabode George of Lagos State, Gbenga Daniel of Ogun State and Rasheed Ladoja of Oyo State eyeing the post. None of them is ready to step down while the lack of consensus candidate from South West will favour Secondus.

A member of the PDP Board of Trustees who spoke with The Daily Times on condition of anonymity, said: “At this critical stage of our party’s life, we need an experienced person, who knows the nitty-gritty of the party, who knows about the day-to-day affairs of the party and that is why someone like our former Deputy National Chairman, Uche Secondus, is the most preferred candidate.

“He is somebody who has been in the engine room of the party, who has been at the head of the party; he would be able to rebuild the party, reunite old members, and reposition the PDP to take back power in 2019.”

He further justified Secondus’ eligibility to run for the position, which according to him, has been blanketly zoned to the Southern part of the country as against the belief of a micro-zoning to the South-West.

“He is eminently qualified because he is from one of the three geo-political zones in the Southern part of the country to which the chairmanship position has been zoned. He is from the South-South zone where the party is having less crisis and River State where there is no crisis within the party unlike in other zones where we have some issues,” he said.

One of the contestants in the chairmanship race, Prof. Tunde Adeniran, has even accused the national leadership of the party of working to favour Secondus in the race.

Adeniran, in a letter to the party leadership, accused them of deliberately including the names of five loyalists of Secondus on the list of those to conduct congresses; an action which he said was aimed at giving him undue advantage.

But the party executive has said there was no deliberate plan to favour anyone, as there was no way they would know those loyal to a particular candidate before appointing them to undertake party duties when they are known to be faithful party members.

Secondus campaign group has also denied an allegation that their principal is an anointed candidate in the race, rather they attributed Secondus’ wide acceptance to a result of his wide consultations across the country.

He was said to have been reaching out to delegates across the 36 states, seeking their votes and presenting his agenda for the revival of the party ahead of 2019.
