hello just to share the good news with you that the decision to refuse husband's visa has been overturned today and he has been asked to send in his passport and TB test certificate. Thanks so much for your help and advise. You are doing a great job on here. you would not believe is thanks to you that I gathered the courage to contact my MP as my solicitor refused that it was not a good idea to contact MP and I did all my paper work my self and sent to the Home office and the MP.

thanks so much I am so over the moon. Honestly some of these solicitors are goats just wanting to eat peoples money because he wanted my case to go to court so he could represent me and make money but I have a law qualification and worked with a law firm for years so did my paper work alone. they got paper work two days ago and overturned the decision today. thanks once more and may god bless you

Please just wondering if the ECM can refused to overturn the decision to grant the visa based on another reason and not what it was originally refused on.

Please just to ask your advice as I have been asked to send my financial requirement. should I send copies or both copies and originals of bank statement and payslips.

I am sending bank statement, payslips, contract of employment and letters from employer, letters from doctor and sick notes that I sent when we applied for the visa

The eco refused the visa unjustly as they did not consider that I was off sick when my husband made his application and sent the last six payslips before I was off sick

we relied on paragraph( 6) of the financial requirement and I am sure the ECO was not aware of that paragraph and rejected the application

Just to thank you that I finally contacted my MP who wrote a letter to the Home office and they responded to him requesting that I resend my financial requirement for them to reconsider their decision so I hope something good comes out of it. I did also appeal and I am waiting as the documents have also been forwarded to the Home office for a review.

please just a point of correction that you still get housing and council tax benefit up to a salary of £20000 a year. its not the number of hours you work but the amount of salary you get. I am on a salary of £20000 a year but still get housing benefit because I have two kids and also get working and child tax credits.

secondly I applied for my husband's visa and honestly told them that I receive all of the following benefits and it does not affect your application as long as you earn the income required by law.

Thirdly a lot of people on here seem to believe that when you receive the processed email with a reference number it means you have a visa, and I will say it is not true because my husband had the reference number and his visa was rejected and it took a month before we had the Health Surcharge refunded.

Please just wanted to ask if it is a good idea to contact my MP regarding my appeal to see if he can contact the home office to review my appeal quickly. I know it takes 15 weeks for the ECM to review the appeal but the wait is too long and I am thinking of contacting my local MP. Please let me know if it is a good idea or not. thanks

Please I need help with an appeal I am making for a spouse settlement visa. I want to know if I still need to send photos with the appeal bundle as I have so many photos. I was refused on financial grounds. thanks

Check on the TLS website. There are conditions and think the fees is gone up to £420

I have also asked my boss to confirm again in writing that I am off sick and receiving SSP and that my job is guaranteed when I come back from sick leave. I have also asked the doctor to confirm my condition again in writing but honestly very confused as I had already submitted all of these when we made the application. thanks

Please I will like you to help me with this. I a making the appeal tomorrow and wanted to know if I should only resend the documents I initially sent when I made my application or I do need to add new evidence. like I said I a off sick and submitted the last six payslips prior to me going off sick as stated in paragraph (6) of the financial requirement.

I did not send any payslips showing statutory sick pay, because that section did not require me to send any. I was refused just because the ECO did not take that paragraph into consideration and as such said they checked with HMRC and they were informed that the amount I was paid which was during the period I was off sick did not correspond to my salary as claimed and so they were not convinced that I work for the company I said I worked for. HMRC also confirmed to the ECO that I had worked and paid the hours on the payslip I submitted but the ECO still went ahead to reject our application saying they were not convinced I worked for my company.

please do I need to send the SSP payslips or just need to resend the six payslips before I went off sick as required. do I need to provide new supporting evidence till date or I just need to resend all the evidence I provided when we submitted the application . its confusing and do I need to send photos again. we met every other requirement except this silly reason that we were rejected for. the ECO completely ignored that I was off sick and did not take Paragraph (6) into consideration.

Again how much was I suppose to pay for Health Surcharge as we paid £600 and I have Indefinite Leave. Thanks and waiting for your reply

Thanks very much for your help and I had made up my mind to go for an appeal. do I need to do the appeal as the sponsor or is it my husband who has to do the appeal?

Thanks for your response but I have only 28days from yesterday to send an appeal. I also wanted to know if I can make the AR if the ECO did not give me the right to it. I read some where that the ECO needs to give you the right to an AR.

yes i do have all the documents we presented with the application. everything was complete and even gave letter from employer confirming that i was off sick and receiving statutory sick pay. i also provided sick notes and letters from the doctor to confirm this. i am so surprised that they just ignored them and decided to refuse the application using some silly reason

@justwise . yes it was a spouse settlement visa application. the ECO refused and reasons been that i did not meet financial requirement which off course i did. the ECO did not take time to look at all the documents supplied as i am off sick and provided the last 6 payslips and bank statement corresponding to the period before i went off sick as requested in section (6.1) of the financial requirement. the ECO said they contacted HMRC who confirmed i was only paid £450 in January which is what i am receiving as statutory sick pay at the moment as i am off sick. the ECO therefore without taking into consideration that i was off sick concluded that she was not satisfied that i worked for the company i said i worked for as the salary does not correspond to what i declared. the ECO even went along to mention the name of a company that i do not even work for and that my husband did not pay for the Health Surcharge and he paid for this and even sent confirmation. the ECO said my husband had to pay £900 for Health Surcharge and i do know its £600 for spouse settlement visa. please advice me if that is the correct fee or may be we made a mistake during our application.

please can you advice me if i should request for a review and also appeal as i am still off sick and there is no way i can make another application as i will still have to give the same payslips and bank statement.

hello I am new to this forum but I just wanted to clarify the issue of acquiring British citizenship. if you are a child of a British citizen or a settled person in the UK, it does not matter which of the parents has the citizenship as the laws changed in July 2006.

firstly if a child was born after July 2006 to a parent who is a British citizen or a person settled in the uk, that child automatically is a British citizen and it does not matter which of the two parents , and you do not need to be married for the child to acquire citizenship.

secondly if the child was born before July 2006 then the child will need to apply for indefinite leave to remain and after a year of holding it the child can then apply to naturalise.

another thing to know is that if the child was born before any of the two parents became settled in the uk and the child was born after July 2006 then the child will only need to naturalise as a British citizen.

I have been in the same situation and applied for naturalisation for my child first child and he acquired it from his father and we were not married and the second one automatically acquired it from me after I had my indefinite leave.
