A veteran journalist and activist, Mr. Peter Enahoro, yesterday called for the restructuring of Nigeria with a warning that the continued delay to address the issue was dangerous for the country.

He said there was no better time to make the drastic decision for equity between the North and South than now.

He, however, explained that for this to happen, militant southerners and progressive northerners must collaborate to rejig the country.

Speaking yesterday on ARISE NEWS Channel, the broadcast arm of THISDAY Newspapers, he said the far North had depended on the South for too long and that some parts of the country had suffered the decision since the British rule.

He said: “Nigeria cannot be great without restructuring. If we had militant southerners, by now we will be on the brink of breaking up. But right now, we don’t have them and no one is ready to do it. The only people who tried it are the Igbo and they were defeated. I don’t think anyone will try it again, but power has to be taken away from people who squander it. How long can this go on? This has got to stop if Nigeria is to progress, and it will only be done if an alliance is made between militant south and the progressive north. This will not happen without pressure. Nationhood takes time, and this is the time.

“A colleague was interviewing someone on restructuring recently, and the interviewer said North-west will not permit restructuring. I almost fell from my bed. Who is the North-west to decide for the whole country? We must accept the fact that it cannot go on like this anymore. If you are from the Delta region, you will see that your waters and fishes have been polluted. You will have to go several miles to get fishes. When these same people need something from the Nigeria National Petroleum Corporation (NNPC), they will have to go to Daura for help. This is a country where fellow citizens say they were born to rule over others. This got to stop.”

According to him, the kind of restructuring Nigeria needs is the type where states or regions that work hard would have to benefit more.

He said the present situation makes it possible for the far North to always live at the expense of the South, which has the resources.

He said: “People go to Mecca virtually every year when the Koran has said you can go once in your lifetime. Where do you think the money for the waste is coming from? It is from oil. This is a scandal and that is where we are today. What is needed is that states which work hard should be the richest. The richest public officeholder in America is not the president. When Bill Clinton was governor for 12 years, his salary was less than that of a mayor in New York because New York had more money. Nigeria has deteriorated because we have leaders without a clue.

“We have allowed the far North to dictate to this country. The amalgamation of the North and South was only because the North had no money and it was always broke, whereas the South had a surplus, and Lord Lugard at the time just merged the two.

“Money from the South was used in assisting the North. The far North is the spoilt child of the federation.”

He explained that without restructuring, the brilliant Nigerians in certain states would not get their dues because of the present quota system.

He stated that such persons could not get into institutions of learning they deserved to because people from other regions with fewer qualifications would also have slots to fill.

He described the system being operated in the country as one where the hardworking ones were being pulled down, adding that this was reflective in the standard of education and healthcare in the country.

The police in Ogun State have sent strong warning to Bishop David Oyedepo of the Living Faith Church (Winners Chapel) over his plan to reopen his church.

DAILY POST recalls that Bishop Oyedepo, in a viral video, on Friday, said he had declared churches open, saying anybody against the reopening of churches will die.

Oyedepo’s Living Faith Church is headquartered in Ota, Ado-Odo/Ota Local Government area of Ogun State.

In a veiled reference to Oyedepo, the police said they have information that some religious leaders in Ogun are preparing to open their religious centres for people to converge.

This, the police said was in total disobedience to both the state and federal government directives.

A statement by the state Police Spokesperson, Abimbola Oyeyemi, said appealed to such religious leaders to have a change of heart, saying “security agencies in the state will view the opening of worship centres with all seriousness.”

Oyeyemi said the police would not tolerate any act capable of undermining the determination of the state and federal government to fight Coronavirus to a standstill, stressing that “the ban on all forms of gathering be it social or religious is still in force.”

The statement reads:

“It has come to the notice of Ogun State Police Command that some religious leaders in the state are preparing to open their various religious centers for people to converge in total disobedience to both the state and federal government directives.

“The command hereby appeals to such religious leaders in both Islamic and Christian faith who may be having such intention to have a change of mind because the security agencies in the state will view such with all seriousness.

“The command will not tolerate any act capable of undermining the determination of the state and federal government to fight the COVID 19 pandemic to a standstill.

“The commissioner of police, therefore, wish to use this medium to remind all religious leaders that the ban on all forms of gathering; be it social or religious is still in force. He also admonished all and sundry to cooperate with the government in its efforts to make the state coronavirus-free.”

The Aliko Dangote Foundation (ADF) has donated N1.5 billion ($3.8 million) to the ‘Nigeria/United Nations COVID-19 Basket Fund’ to boost the fight against the novel coronavirus disease.

The UN in Nigeria announced the donation in a statement issued on Wednesday in Abuja.

According to the statement, ADF collaboration with the UN will booster the Nigerian Government’s efforts at strengthening the functional capacity of the healthcare systems and support to those affected by the novel coronavirus.

The statement quoted Alhaji Aliko Dangote, President and Chief Executive of Dangote Group and Chairman of the ADF, as saying that the contribution would support in the procurement of medical supplies.

The Federal Government has described racial discrimination in Guangzhou, China, as a red line, vowing to fight it to the very end. Speaking in Abuja yesterday at a briefing of the Presidential Task Force on COVID-19, Foreign Affairs Minister Geoffrey Onyeama condemned reported maltreatment of Nigerians and other Africans in Guangzhou.

He said Nigeria had made it clear to the Chinese Government that under no circumstances would it accept racial discrimination against Nigerians or indeed Africans or blacks in China “Now, we’ve been engaging with Chinese government at various levels at the level of our Consulate in Guangzhou, which is where these cases of discrimination and racism have been taking place and also at the federal level Beijing with our ambassador and the embassy in Beijing. “They (the Chinese Government) have in turn told us there’s no case of that ongoing. But clearly, we’re seeing videos, I’ve received reports and we’ve told them it’s unacceptable and we’re also engaging with other African countries to decide and work together on definitive steps and measures we’ll take because of this situation.

“In addition, I’ve directed the Consulate in Guangzhou to systematically detail every single case of discrimination and every single case of loss or damage suffered by any Nigerian and we’ll pursue each and every single one very robustly with the Chinese government. If it requires compensation and damages etc.

“So for us, it’s a red line and we are going to fight it to the very end. We’re extremely disappointed because we have excellent relations with the government and people of China, that such a thing can happen at this stage,” the minister said. “Really we’re deeply wounded by what has happened to Nigerians and other Africans in China. Of course, the government has given us explanations and so forth, but really, it’s something we never expected and we’ll pursue it to its final conclusion and we’ll not make any compromises in doing so.

President Trump claimed on Friday that China was minimizing the number of deaths it has suffered from the coronavirus, disputing figures that showed the United States had suffered more fatalities from the disease.

According to a reputable coronavirus tracking tool compiled by the Johns Hopkins University, there have been more than 36,000 deaths in the United States from COVID-19, the respiratory disease caused by the coronavirus. The number of reported deaths in China, where the pandemic originated in December 2019, currently stands at 4,632.

According to Trump, however, those figures are incorrect.

“We don’t have the-most-in-the-world deaths,” Trump said during Friday’s briefing of the White House coronavirus task force. “The most in the world has to be China,” he added, reprising an accusation he made earlier in the week.

“It’s a massive country,” he went on. “It’s gone through a tremendous problem with this, a tremendous problem. And they must have the most.”

The president did not offer evidence to back up that assertion, but his argument is at least partially bolstered by China’s admission on Friday that it had undercounted the number of deaths in Wuhan, the city in central China where the outbreak appears to have begun in a so-called wet market. It raised the number of deaths there by 1,290, bringing the reported total to 3,869.

For skeptics of Beijing’s authoritarian regime, that lone admission is but a hint of the actual coronavirus statistics in China, whose population stands at 1.4 billion. Although Wuhan and surrounding areas were locked down once authorities grasped the severity of the disease, the rapidity with which the coronavirus spreads makes it likely that it did damage beyond what the official numbers indicate.

“And that’s only in Wuhan. They’re not talking about outside of Wuhan,” Trump said, in reference to Friday’s correction. He deemed China’s alleged dishonesty “a sad state of affairs.”

Trump also entertained — though did not endorse — the theory that the virus did not originate in a wet market but, rather, was accidentally released from a Wuhan laboratory with lax biosecurity standards.

“We’re looking at it,” Trump said of that theory. “A lot of people are looking at it.”

The Executive Governor of Bauchi state, Senator Bala Abdulkadur Mohammed today paid an unscheduled visit to inspect the road project from Burga town of Tafawa Balewa Local Government to Alkaleri Local Government.

The road project awarded at the cost of over 8 billion naira, covered communities of Yalwan Duguri to Badaran Dutse, Birim-Bajama to Kumbala, and Kundak-Wurno to Burga.
The road was designed to have a length of 58.4km with the total width of 10.3m which comprised of a carriageway of 7.3m and 1.5m shoulders on each side would be constructed with 4 bridges, 45 box culverts and 70 pipe culverts of different sizes.

Electoral managers need to be firm, focused, says Bauchi REC
The Resident Electoral Commissioner (REC) for Bauchi State, Alhaji Abdullahi Ibrahim, said his former job as a retired director in the Department of State Services (DSS), assisted him in his conduct of the controversial 2019 election in Bauchi State. In this interview with RAUF OYEWOLE, the REC narrates how political actors from the two major political parties, All Progressives Congress (APC) and Peoples Democratic Party (PDP), subjected him to intense pressure to influence the outcome of the 2019 general elections. Excerpts:

What was your experience during the conduct of this year’s general elections in Bauchi State?
It was a very worthy experience. Since our appointment as Resident Electoral Commissioners, it was the first major election I conducted though I have conducted by-elections, both at federal and state levels and I believe that helped me to understand the system better. Given my background as a former director in SSS, I have witnessed the conduct of so many elections, which also prepared me ahead of tensions some people tend to generate as a result of their perceptions on likely outcome or interference. At the end, I think it went well.

What would you say were your major challenges during the 2019 polls in the state?
During the elections, some typical politicians gave me pressure by way of making propaganda and wild allegations of perceived unfairness. That was the major challenge. But for someone who understands politicians like I said, because of my background in SSS, I was able to deal with them as expected of my position. Many elections were held when I was director of SSS in several states that I presided over.Honestly, it was not easy because of pressures and, if one is not firm, you can easily be derailed. The only way you can remain resolute and focused is by keeping off anything that may be used against you.

The way I interact with people in town, I don’t mingle unnecessarily and I don’t commit myself materially. That helped me a lot, because I made sure I remain neutral, especially for the two major political parties. All of them mounted pressures on me. They are all selfish and they don’t care. If you do their bidding, even if it is not in line with the guideline and even if you don’t do it they will say you’re bad. So, all of them mounted pressures in their own ways; it was a big challenge, especially from local politicians.

What was the nature of the pressures?
Some of the pressures were demand to declare the result when it was not due and proper, like the issue of Tafawa Balewa Local Government result. There are procedures and processes to guide our conduct in any election and these pressures don’t guide the activities, but a politician wouldn’t mind. The moment he sights what he considers victory, he wants you to give it to him even before concluding and allowing the process to run its full course. He wants you to follow shortcut. One, because this is the right thing; two, for posterity and even because of litigation, you should be able to give account.

It is just like a judge, law must guide any ruling. Most pressure from politicians is that they want you to put people that will serve their partisan interests in electoral positions; all of them are guilty of that. But glory to God, I was able to stand firm and do the right thing.

At a point, you declared the governorship election inclusive and that generated protests from different groups and political parties and even litigation. Was there a threat to your life?
There was no threat to my life at all. In fact, the peaceful demonstration was not around my office; it took place on the streets and maybe they weren’t conversant with the procedures of declaring of an election. For politicians, they feel that is the only weapon they could use to mount pressure to make sure their interest is protected.

What lessons did you draw from the rough and tough process?
One of the lessons I learnt was being firm and doing the right thing no matter the pressure, because politicians are very difficult to handle and one must be careful. Some of the wild allegations leveled against me were unimaginable. I saw a gentleman who cooked up an allegation against me, but at the end he said it was a game. A lot of lies were said by way of rumour and even feeding the press with these lies. Imagine if the press hasn’t been careful, maybe misinformation would have been published than what they did but because the pressmen were professional, that was why they stopped at where they stopped, because they (politicians) don’t mind mudslinging. It’s a watchword as far as politicians are concerned. To them, you’re either for me or against me and everybody will strive to bend you to their side. These pressures come separately –from west, south, north and east. Everyone mounts it. If you refuse, they will say you are with the other person (party).

Was monetary inducement part of the pressures from politicians?
There was no monetary pressure; just that they come to influence by way of an appeal to one’s conscience. I cannot remember any monetary pressure. First, I refused to mingle with them. If not that, pressure wouldn’t have come in that form. You don’t open up for them to penetrate and that is one of their major problems with me. I don’t like to sit down one-on-one with anyone of them (politicians) and that helped me a lot. There is a limit to how they can say rubbish to me. Some of the reports about me were compromised as a REC. At least if you claim someone is corrupt you should be able to prove it. Like I said earlier, I have experience in dealing with politicians though in different capacity. I know what they are up to and I avoid anything that can implicate me.

I have also learnt to be transparent and focused in order to run a successful election. Just like the last election we had, Bauchi is one of the few states where we had mixed choices unlike in some states where it is one way. I can tell you, the state has four political parties with representation in both national and state assemblies. People’s Redemption Party (PRP) got two federal seats; NNPP has a seat at the state assembly; PDP won governorship and assembly seats and APC also have their own share. This is good development: one, it shows the sophistication of the state’s electorate and also, confirm the neutrality of the electoral umpire for allowing such a thing to happen. Ordinarily, people were afraid that smaller parties would be stifled, but you can see the wishes of the people have been respected and their choices were also allowed to prevail.

Were you also under pressure to replace the collation officer for Tafawa Balewa Local Government after declaring the governorship election inconclusive, because she said she was forced to announce the result under duress?
You see, because of the controversies the collation of Tafawa Balewa result generated and because of the mistake she made during her presentation, she did not only confuse herself but also the audience (at the state collation centre). A situation where someone said, ‘this thing I want to give you is not the correct thing but all the same I have to give it to you.’ I remember she said she was presenting a result that she was forced to announce; the clips are there. She said she was under duress to do it and to save her life, which means she didn’t believe what she was saying. She said all these in public, to the world. Because of this, it attracted a lot of controversies around her, and created doubt about her impartiality. And more so, she said she was not interested in continuing, claiming she was threatened after making such comments. She got series of threats; she was afraid and somebody had to come and finish the job.

Poor welfare was part of the major complaints of ad-hoc staff in virtually all the states with some instances of corps members sleeping on bare floors and inside vehicles during the election. What’s INEC doing to correct that?
Fine, let me clarify something today; the corps members are supposed to be in one place 24 hours before the voting. The only place that we gathered corps members were at was the RAC centres – where election materials would be distributed to them and where they would undergo refresher training before heading to their respective polling units. The only thing we provided at that point was just a small resting material, because it is usually a busy place. But we made provision for mats, although they are not supposed to be sleeping; they must be active. It is erroneous for them to say they were not given rooms, beds and all that; they are mainly there to be trained and be moved to their places of primary assignment.

The Presidential Election Petitions Tribunal sitting in Abuja will today deliver judgement in the petition filed by the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar and his party against the victory of President Muhammadu Buhari of the All Progressives Congress (APC) in the February 23, 2019 election.

The secretariat of the tribunal located at the premises of the Court of Appeal, Abuja Division had yesterday indicated that the judgement will be delivered today by 9.00a.m.

The notice reads: “Presidential Election Tribunal: Please be informed, notice has been given for judgement to be delivered tomorrow (today) September 11, 2019, 9.00am.”

The Electoral Law had provided for the Tribunal to hear and determine the petition within 180 days. The time frame elapses on Sunday, September 15.

Justice Mohammed Garba, Chairman of the five-man panel of justices had stated that the judgement date would be communicated to parties.

The Independent National Electoral Commission (INEC) had on February 27, declared Buhari and his party, the APC, as the winner of the presidential election, having polled a total of 15,191,847 votes to defeat his closest rival, Atiku, who it said polled a total of 11,262,978 votes.

Atiku, PDP’s petition

Not satisfied with the result, Atiku and his party had in a joint petition approached the Tribunal through their team of lawyers led by Dr. Livy Uzoukwu (SAN) to challenge the election on the ground that the result released by INEC was not the true position of the election.

It was the contention of the petitioners that they won the election, based on the results transmitted electronically to INEC’s server.

They also contended that Buhari did not possess the relevant academic qualification to contest the election. Joined as 1st to 3rd Respondents are: INEC, Buhari and the APC.

Atiku and his party in their petition marked CA/PEPC/002/2019 and filed on March 18 submitted that the APC candidate, Buhari, was not validly elected by the majority of votes cast across the country in the February 23 presidential election.

The petitioners also contended that the election was marred by corruption. In addition, the petitioners alleged that the election of Buhari is invalid, having not complied with the provisions of the Electoral Act.

Also the petitioners submitted that Buhari was not at the time of the election qualified to contest, having submitted a fake academic qualification to the electoral body.

Reliefs sought

The petitioners in their reliefs prayed the tribunal to declare that Buhari was not duly elected and ought not to have been returned and that the election is null and void.

They also prayed that Atiku be declared as the validly elected winner of the election having polled the highest number of votes as provided by the Electoral Act.

They also prayed for an order of the tribunal to direct INEC to issue a Certificate of Return to Atiku, having been validly elected by the majority of votes cast on February 23.

In the alternative, the petitioners prayed the tribunal to nullify the February 23 election and order a fresh presidential election.

Buhari, APC’s defence

Opposing the petition, Buhari and APC challenged its competence. Their main contention was that Atiku did not have locus standi to even participate in the presidential poll.

Buhari had described Atiku as a serial loser, boasting that he had always defeated him in every electoral contest that they took part in.

The President insisted that the electorate always chose him ahead of Atiku in inter-party or intra-party contests, citing the 2014 presidential primary election of the APC as an example.

In addition, Buhari queried the powers of the tribunal to nullify his victory at the poll, contending that the joint petition Atiku and the PDP filed was incompetent as it was based on conjectures.

He insisted that the reliefs the petitioners are seeking from the tribunal were “vague, nebulous and lacking in specificity.”

The President equally argued that most of the issues and grounds of the petition were not only “mutually exclusive,” but also outside the jurisdiction of the tribunal.

He further contended that by virtue of section 31(5) and (6) of the Electoral Act, 2010, as amended, only the Federal High Court or High Court of a State has jurisdiction to adjudicate on some of the issues, among which include the allegation that he was bereft of the requisite educational qualification.

The APC, in its own objection, alleged that Atiku is an alien, insisting that he is not a Nigerian by birth and therefore was not qualified to contest the February 23 presidential poll.

The party submitted that Atiku is a Cameroonian and that he was born on November 25, 1946 in Jada, Adamawa, in Northern Cameroon and is therefore a citizen of Cameroon and not a Nigerian by birth.

Witnesses

At the end of the hearing, the petitioners called 62 witnesses, the APC and INEC did not call any witness, while Buhari called on seven witnesses.

Part of the evidence of the petitioners’ witnesses were that INEC used electronic server to transmit results, that Buhari did not possess any academic qualification and that the election was marred by irregularities.

Petitioners’ written address

In their final written address, the petitioners strongly alleged that Buhari used fundamental falsehood to secure clearance from INEC to participate in the election.

They also insisted that Buhari, as candidate of the APC, lied on oath in his Form CF001 presented to INEC before standing for the presidential election.

The petitioners drew the attention of the Tribunal to a portion of Buhari’s INEC form, where he claimed to have three different certificates; comprising Primary School Leaving Certificate, WAEC certificate and Officers Cadet certificate.

The also said it was shocking and surprising that “no provisional certificate, no certified true copy of the certificates, no photocopy of certificates, and in fact, no electronic version of any of the certificates was presented by Buhari throughout the hearing of the petition to dispute the claim of the petitioners.

They added: “More worrisome is the fact that Buhari’s own witness, Major General Paul Tafa (rtd), who joined the Nigerian Army with him in 1962, told the tribunal that they were never asked to submit their certificates to the Nigerian Army Board as claimed by Buhari in his Form CF001.

“At any rate the Secretary of the Nigerian Army Board, Olatunde Olaleye, had in a statement, clarified that Buhari had no single certificate in his personal file with the Nigerian Army.”

Atiku therefore urged the tribunal to nullify the participation of Buhari in the election on the grounds that he lied on oath to deceive Nigerians and to secure unlawful qualification for the election.

The former Vice President informed the tribunal that Buhari’s claim that he can read and write in English language as enough qualification is not tenable because ordinary artisans on the streets of Nigeria can also do so, adding that a grave allegation bordering on certificate was not addressed by Buhari as required by law.

The PDP presidential candidate also faulted INEC’s claim that it has no central server, adding that server is a storage facility, including computer, where database of registered voters, number of Permanent Voters’ Cards and election results amongst others are stored for references.

He said the claim by INEC that it has no device like server to store information, “is laughable, tragic and a story for the dogs.” Atiku also debunked the claim of INEC that collation and transmission of results electronically was prohibited by law in Nigeria.

He asserted that by the Electoral Amendment Act of March 26, 2015, the use of electronics became law and was officially gazetted for the country, adding that section 9 of the Act, which made provision for electronic collation of results replaced section 52, which hitherto prohibited the use of electronics and which INEC erroneously held that electronic results transmission is prohibited.

He therefore urged the tribunal to uphold the petition and nullify the participation of Buhari in the election on the grounds that he was not qualified to have stood for the election in addition to malpractices that prompted his declaration as winner of the election.

INEC’s submission

Counsel to INEC, Yunus Usman (SAN), in his submission, urged the tribunal to dismiss the petition with substantial cost because the electoral body conducted the election in total compliance with the Nigerian Constitution and Electoral Act 2010.

Usman insisted that INEC did not transmit election results electronically because doing so is prohibited by law and that the commission did not call any witness because there was no need to do so.

Buhari, APC’s submission

In his defence, Buhari through his counsel, Chief Wole Olanipekun (SAN), argued that Atiku’s petition was liable to be dismissed because it is lacking in evidence, merit and substance and that the petition is ill advised and signified nothing.

Olanipekun cited section 131 of the Constitution, which stipulated a minimum of secondary school attendance to qualify for election in Nigeria, adding that Buhari cannot go beyond that and that he does not need to tender or attach his certificate before he can get qualification for any election.

He submitted that there was nothing in law to persuade the tribunal to nullify the February 23 presidential election as pleaded by Atiku and urged the tribunal to dismiss the petition with substantial cost.

The APC represented by Lateef Fagbemi (SAN), in its own submission, said the petition lacked quality evidence that could warrant the nullification of the election as pleaded by the petitioners and urged the tribunal to throw out the petition as long as its hand can do with huge cost.

The judiciary ‘trial’

New Telegraph recalls that the tribunal had earlier refused the petitioners’ application seeking to inspect the INEC server. The tribunal premised its reason for refusal on the ground that granting such will be pre-judicial. The Supreme Court had also on appeal refused the application.

However some stakeholders have opined that whatever the verdict of the tribunal is, it will go a long way to shape and determine the nation’s electoral jurisprudence, one way or the other.

According to them, the judgement will either renew or dampen the hope of the citizenry in the judiciary.

Pleading with the tribunal to live up to its expectation of delivering a judgement based on objectivity and fairness and which will make all parties in the suit not to have a bias mind against the judiciary, the stakeholders said: “Justice is for three parties namely – the petitioners, respondent and the public.”

No doubt, the country’s judiciary has been in the eye of the storm, however, its ability to deliver a just and fair verdict will restore the hope of the common man.

Nigerians have earlier commended the President of the Court of Appeal, Justice Zainab Bulkachuwa, who was the former chairman of the tribunal for recusing herself from the panel.

Justice Bulkachuwa’s action was premised on an application filed by the petitioners at the pre-hearing stage, wherein they (petitioners) alleged bias on the ground that Bulkachuwa’s husband and son are card carrying members of the APC.

They also alleged that Justice Bulkachuwa at the inaugural sitting of the panel stated that “no matter how free and fair an election is in Nigeria, there will always be a petition.”

Though the panel held that the petitioners could not prove the ingredients of bias against its chairman, Justice Bulkachuwa, however held that she would recuse herself on personal ground.

This act, to a greater extent, earned the panel a great deal of credibility and stakeholders saw it as a step towards objectivity and fairness. This optimism was further strengthened, when the incumbent chairman of the tribunal, Justice Mohammed Garba, assured all parties that they will be treated equally.
