ABUJA—The crisis rocking the Senate over alleged forgery of the 2015 Standing Order yesterday took another dimension as the Committee on Judiciary, Human Rights and Legal Matters walked out the Special Assistant to President Muhammadu Buhari on Prosecution, Okoi Obono- Oblo. SENATE CHAMBER The committee also noted that failure of the Attorney General of the Federation, AGF, and Minister of Justice, Abubakar Malami, SAN, to appear was not only a slap on the Senate, but also insultive. The AGF, for the second time yesterday, shunned the summon of Senate to explain why he dragged the Senate President, Bukola Saraki, Deputy Senate President, Ike Ekweremadu and two others to court over alleged forgery of the Senate Standing Order. Soon after Oblo, who appeared before the committee, headed by Senator David Umaru, APC Niger East, introduced himself as the Special Assistant to President Buhari who is attached to the office of the Minister, the Committee members dismissed his presence insisting on seeing the AGF and not the President. Umaru told Mr. Obono-obla that the committee did not invite President Muhammadu Buhari, but the Justice Minister, adding that since the Minister failed to honour the invitation, he did not respond to the committee. Umaru, who noted that the Minister had initially requested that the committee grant him time to study the issues, stressed that there was an imminent threat to democracy because of the action of the AGF. “Our democracy is seriously under threat because the AGF who had asked for time to prepare has now refused to appear. We cannot hear you, I am sorry,’’ he said. Corroborating the Committee Chairman, one of the members of the Committee, Senator Chukwuka Utazi, said the committee never invited the President, but the Attorney General and since he has failed to honour the invitation, it thus means that the Minister did not respond to the invitation of the committee. Senator Utazi, who is the Chairman, Senate Committee on Anti- Corruption, said: “We did not invite the president to appear before us, so since the AGF is not here, we deem it that he did not respond to our invitation. This (failure of AGF to appear before the senate) is a slap on this arm of government. The AGF had refused to appear before us, leaving us to decide what to do. According to him, the senate committee is only interested in asking the AGF questions on his decision to initiate the prosecution of the principal officers of the Senate, despite ongoing cases in courts of coordinate jurisdiction, challenging the case against the leaders of the Senate. Soon after the senators said they will not hear him, Okoi Obono-Oblo stormed out of the venue, the Senate Meeting Room 313, 3rd Floor, New Senate Building, National Assembly Complex. After the exit of Okoi Obono - Oblo from the meeting room, Chairman of the Committee, David Umaru, noted that the action of the AGF showed total lack of respect for the parliament, especially the Senate,. He said the committee would report back to the entire Senate at plenary where an action would then be taken. Senator Umaru said: “ Having invited the AGF twice to appear before us as mandated by the Senate without him responding to the summons. This committee will surely report the matter to the Senate at plenary for appropriate action.” But speaking with journalists outside the meeting room, the Special Assistant to President Buhari on Prosecution, said it was unconstitutional for the Senate to summon the Attorney General because the red chambers couldn’t be a judge in its own case, just as he said that the Presidency had no confidence in the Senate Committee. Defending the Minister of Justice for dragging Senate President Saraki, his Deputy, Senator Ike Ekweremadu and others to court, Oblo noted that the Attorney General had the right to do that. He said those allegedly involved should go and defend themselves in court, adding that being the Senate President did not make Saraki bigger than the laws of the land. Okoi Obono- Oblo said: “The AGF has not done anything wrong. The AGF has not undermined democracy. He acted pursuant to the powers vested in him by the Constitution. Section 174 (1) says he can prosecute anybody. And he has done that. ‘’The Senate is not on trial. He has not taken the Senate to court. He has taken four persons to court. They are not the Senate. Being President of the Senate does not make you the Senate of the Federal Republic of Nigeria. “The matter was investigated by the police and a prima facie case was established and the AG invoked his powers under Section 174 (1) to initiate criminal proceedings against those persons. And this matter is now before a court of law. There is separation of powers in Nigeria. It is not position of the Senate to constitute themselves into a court of law. “ On the issues raised by Saraki that what was happening was an infringement on their powers, the Presidential aide said: “It is not. How does it? When asked that the matter was simply an internal affair of the Senate, he said: “It is not true. If I go to the chambers of the National Assembly to shoot you, would it be an internal affair? The Senate Rule is a law and somebody allegedly forged the rules.” Asked how he knew the standing Order was forged, Oblo answered thus, “the police investigation.” On whether the police wrote the rules in the first place, he said: “That question is neither here nor there. They don’t need to write the rules. The Lagos State Government on Wednesday, shut down 70 churches, 20 mosques and about 11 hotels, club houses and beer parlours in a move aimed at reducing noise in the state. The General Manager, Lagos State Environmental Protection Agency (LASEPA), Bola Shabi, who made this known, said that henceforth, the state government would no longer allow make-shift buildings to be used as places of worship. Shabi said: “Precisely about 70 churches, 20 mosques and about 11 hotels, club houses and beer parlours were shut and we’ve given them some directives to follow. “We’ve been so strict now that we are not going to even allow make- shift churches in the state any longer. “What I mean by make-shift, using tents and uncompleted building, we are not going to allow that any further in the state. “But I will strongly tell you that the level of compliance is more on the mosque area, because immediately you shut them, they instantly bring down their speakers or reduce the noise they make.’’ Shabi said that LASEPA planned to reduce noise in the state to 70 percent and to zero per cent by the year 2020. “As at today, we are only able to reduce the noise level to about 35 per cent. That is not a pass mark yet. So, until we reach that target of 70 to 80 per cent, we will continue the enforcement. Enforcement is a continuous exercise and we have set a target for ourselves. We want to ensure that Lagos is noise-free by the year 2020. Against the backdrop of calls to restructure the country and calls to implement report of the 2014 confab report, Senator representing Kaduna Central Senatorial district, Sen. Sani Shehu, on Wednesday, opined that the President Muhammadu Buhari's led administration has five options towards doing this. This came as several eminent Nigerians have urged President Buhari to restructure the country, as well as implement reports of the 2014 national confab convened by the immediate- past President Goodluck Jonathan. Recall that former Vice President, Atiku Abubakar had on May 31, 2016 called for the restructuring of the Nigerian federation to cater for the aspirations of its component units. Atiku, who spoke in Abuja, at the unveiling of a book, ‘We are all Biafrans,’ written by a journalist, Chido Onumah, had opined that such restructuring is the only answer to the current agitation for a Biafra Republic. Similarly, erudite Scholar and Deputy Chairman, 2014 National Conference, Professor Bolaji Akinyemi, recently lashed at the Secretary General of the Federation (SGF), Engineer Babachir Lawal, who had in a recent interview stated that the President Buhari administration was too busy with issues of governance, and thus may not have the luxury of time at the moment to look into the report of the confab. Babachir had also described delegates at the confab as 'boys,' who were each given N7 million by the past administration. But in a statement personally signed by him, Prof. Akinyemi had expressed dismay at the choice of words, which he said Lawal used in a recent interview published in several national newspapers, describing it as “intemperate language, crude, rude, offensive and unbecoming of the high office of state he occupies.” Professor Akinyemi stated that among the delegates the SGF referred to as boys were “the Emir of Ilorin, the Lamido of Adamawa, King Alfred Diete Spiff, the Gbong Gwom of Jos, Emir of Yauri, Emir of Dutse, Emir of Askira and the Amanyanabo of Nembe. “Various judges of the High Courts, delegates included a former Chief of Defence Staff, a former Chief of Air Staff, three former foreign ministers, a former Inspector General of Police, two former senate presidents, a former SGF, several former ministers, several SANs, several former governors, professors… Presiding was a former Chief Justice of Nigeria and a former Minister of External Affairs.” He added, “My own upbringing and diplomatic and scholar’s disposition will not allow me to yield to the temptation to call Engr Lawal by the name his own choice of words has reduced him to.” Continuing, Prof. Akinyemi had said that most of the delegates, there were people who had paid their dues; served this country in high and exalted positions, risked their lives in the civil war and other domestic insurrections and showed exceptional excellence in the performance of their duties, obviously more excellence than Engr Lawal had demonstrated in his one year in office.” Professor Akinyemi, however, called out the SGF to get his facts right in response to the SGF’s comment in the published interview where he (SGF) said “… everybody in the committee got N7 million.” “Come on Mr SGF. You have been in the office that funded the conference and you have been there for over a year, and all you need to do is to send for the files to know that what members were paid is much less than N7 million per head. You do not have to depend on rumours or ‘dem say." He however pointed that "Frankly, I will not plead for the report of the conference to be considered by your government. Governments come and governments go. The problems will remain. We will all be judged by whether we were part of the solution or part of the problems." In the same vein, Sen. Sanni who took to his Facebook page to suggest options to President Buhari said: "Ex- President Goodluck Jonathan's confab report options for the President Muhammadu Buhari administration are: To implement it in full; to implement some of it; to donate it to libraries; to keep it in Government shelves and to shred and recycle the hard copies to tissue paper and keep the soft copies in the National archives." A prosecution witness, Ibrahim Mahir, has testified that retired Col. Sambo Dasuki authorised the payment of 40 million dollars in favour of One Plus Holdings. Mahir made this known when he testified in the case of Azibaola Roberts, cousin to former President Goodluck Jonathan at the Federal High Court in Abuja on Monday. He said that Dasuki, a former National Security Adviser (NSA), instructed him to prepare a payment mandate of 40 million dollars in favour of the company. Roberts and his wife Stella were arraigned on June 8 on a seven-count charge of money laundering. Mahir, who was the first prosecution witness, told the court that Dasuki had endorsed a memo to him with details of the company's account. ``On Aug. 20, 2014, the NSA endorsed a memo to me which originated from the director of finance and administration in the office of the NSA giving bank details of a company called One Plus. ``The memo also gave details of the purpose for which the company was to be paid the sum of 40 million dollars. ``The NSA instructed me to prepare payment and my understanding of that was that I should prepare the payment mandate for One Plus for his signature. ``After I got the memo, I prepared the payment mandate, sent it to him, he signed and sent it back to me. ``The subsequent necessary action was for me to countersign, which I did and I sent it to the CBN for payment,’’ Mahir said. Earlier, Roberts lead counsel, Mr Chris Uche (SAN), had applied for a short adjournment. Uche said the adjournment would give him time to meet with his client to prepare his defence. He said that when bail was granted, his team had difficulties in perfecting the bail conditions, adding that the conditions were only perfected last week. He said they needed more time to prepare their defence because there were some documents that they needed to subpoena from the office of the NSA. Uche also sighted indisposition as part of the reasons his team was asking for an adjournment. The prosecuting counsel, Mr Sylvanus Tahir, however, objected to the application on the grounds that they had a witness already in court who was stopped from going on lesser hajj on account of the trial. Tahir said that they had prevailed on the witness to postpone his trip and not allowing him to give his testimony would amount to a waste of effort. On the issue of indisposition, Tahir said the defence had about 19 other lawyers on the team and without the lead counsel, trial could commence. The judge, Justice Nnamdi Dimgba, agreed with the prosecution that trial should commence since the defence had sufficient time to prepare their defence. The All Progressives Congress (APC) in Ekiti State has assured Governor Ayodele Fayose that it will soon react to the fraud charge by the Economic and Financial Crime Commission (EFCC) on how arms cash was fraudulently diverted to illegally fund his election. The APC also called on the EFCC to beam its searchlights on other banks and Fayose's homes. Reacting to Fayose's allegation that the party funded the protest rally against him by the civil society organisations in Ado-Ekiti at the weekend, Publicity Secretary, Taiwo Olatunbosun, said the governor was confused on how to react to "a clearly criminal expose by the anti- graft agency on how he fraudulently diverted arms cash to win his election". He counselled the governor to stop being paranoid about the fate that awaits him having "intentionally and fraudulently" engaged himself in criminal acts that have no place under the current President Muhammadiu Buhari's administration. He denied the party's involvement in the civil society groups' rally, assuring the governor that very soon, the party will react through street actions to draw the world's attention that the governor allegedly represented evil in Ekiti State. Olatunbosun also faulted the governor over the insinuation that APC had petitioned President Buhari not to grant Ekiti State another bailout to pay workers' salaries. He said Fayose should clean that he could not meet the conditions set by the Federal Government to be qualified for another bailout rather than blackmail and set the workers against APC leaders. "Fayose has no audited account for the past 18 months. His IGR has no records. He refuses to implement TSA. The debt profile of the state he sent to the CBN is inconsistent with official records in the Debt Management Office (DMO) while fake workers' BVN numbers were discovered in records Fayose sent to CBN," Olatunbosun explained, adding that these are the CBN conditions that cannot be met by the governor but for which he was mischievously blaming APC leaders. Asking Fayose to surrender the state money allegedly in his possession to enable civil servants take their salaries, Olatunbosun urged EFCC to comb other banks where the governor allegedly kept the state's money in secret accounts. "We call on EFCC to beam its searchlights on other banks and his so-called secret South Africa-made safe kept in his Afao home and Lagos where the governor allegedly keeps Ekiti money. "We believe that N4.7b poll fund fraud will be a child's play by the time the EFCC hits some banks that Fayose has his cronies who help in keeping funds realised from IGR in secret accounts. "We have cried over time for the governor to declare IGR figures officially and disclose the accounts IGR cash is being kept, but he railed at us, telling all sorts of lies, the same way he bullied the civil servants when they demanded for the details of IGR kept in secret accounts being coordinated by his cronies through official conspiracy," Olatunbosun said. He added: "We are aware of the usual blackmail by the governor and his media aides about the finances of the state, but we make bold to say that no amount of blackmail will stop APC from asking questions about the finances of the state. "We will continue to fight for the welfare and well-being of Ekiti workers who the governor has turned to paupers, beggars and petty thieves due to non-payment of salaries. "We never wrote any letter to stop bailout to Ekiti government. said he was innocent of alleged forgery of Senate
Standing Rules, which he was being charged to court. He insisted that he knows nothing about how the rules adopted in the inauguration of the Eighth Senate on June 9, 2015 was formulated. He said the on-going efforts to drag him into a case of forgery before the Federal Capital Territory (FCT) High Court, was just another phase in the orchestrated persecution he has faced since he emerged as Senate President a little over a year ago. Saraki, in a statement by his Special Adviser, Media and Publicity, Yusuph Olaniyonu, stated that he was not a part of the leadership of the 7th Senate that made the rules in question and prior to his unanimous election as Senate President on June 9, 2015, he was merely a senator-elect like all his colleagues, and therefore was not in a position to influence the rules that were to be used in the conduct of the election. "The Police in their investigation were conscious that the incumbent Senate President was not in office prior to June 9, 2015 and that was why in their letters inviting some individuals for their investigation, they only mentioned officers of the 7th Senate. An Ikeja High Court on Thursday sentenced a 25- year-old, Patrick Ezeji, to two years imprisonment for defrauding a Canadian woman, Sheila Griffiths, of 32,220 dollars. The convict, who was arraigned by the Economic and Financial Crimes Commission (EFCC) on a two-count charge of conspiracy to steal and stealing, had entered a plea bargain. He had promised to refund the woman’s stolen money. Ezeji has only refunded 2,220 dollars out of the 32,220 dollars. Justice Kudirat Jose, while sentencing Ezeji, said his punishment should serve as a deterrent to youths who might want to tow the path of crime. "I have listened to the allocutus of Mr Victor Okpara and I have considered that the defendant has promised to pay the outstanding balance of the money to the victim. "I am of the view that young people should desist from deceiving people to part with their hard-earned money. "The defendant is hereby sentenced to two years in prison; the sentence starts from the first day of the judgment. "This should serve as a deterrent to other young people considering a life of crime,’’ she ruled. Earlier, Counsel to Ezeji, Mr Victor Okpara in his allocutus, had pleaded with the court to temper justice with mercy. He said:"My Lord, the defendant did not waste the time of the court, he is 25 years of age and he has just been admitted to study Political Science at the National Open University of Nigeria (NOUN). "He is a first time offender and he is doing restitution as contained in the plea bargain arrangement. "He has been incarcerated since Dec. 3, 2012, in the prison environment, he is well known as a talented graphic design artist, he will use his skill more productively and with the fear of God if he is released into the society.’’ The EFCC, represented by Mrs Anita Imo, had alleged that Ezeji and an accomplice, Anthony Okpara, conspired to steal 32,220 dollars online from Sheila Griffiths. She said the victim upon realising that she had been scammed, contacted the Canadian High Commission which in turn petitioned the EFCC. The offences contravened Sections 390 and 516 of the Criminal Code, Laws of Lagos State, 2003. Justice Adeniyi Ademola of the Federal High Court, Abuja, on Thursday, indefinitely adjourned a suit challenging the academic credentials of President Muhammadu Buhari. Justice Adeniyi in his ruling said that the case was being adjourned indefinitely, following a notice of appeal filed byPresident Buhari. Recall that President Buhari had Wednesday, appealed against a previous ruling of the court dismissing his preliminary objection to the suit filed by Nnamdi Nwokocha-Ahaaiwe, an Abuja-based lawyer. Nwokocha-Ahaaiwe had in his suit argued that President Buhari was not qualified to run for president because he did not possess the minimum qualification to run for the office. He is alleging that Buhari did not sit for the Cambridge West African School Certificate (WASC) in 1961. To however argue his case, President Buhari hired 13 Senior lawyers led by Wole Olanipekun (SAN). Others were Lateef O. Fagbemi (SAN), Akin Olujinmi (SAN), Oluwarotimi O. Akeredolu (SAN), Kola Awodein (SAN), Taiwo Osipitan (SAN), Charles Edosomwan (SAN), Emeka Ngige (SAN), Femi Atoyebi (SAN), Femi Falana (SAN), Funke Aboyade (SAN), H.O. Afolabi and 10 other counsels.
