The trial of the Senate President, Bukola
Saraki, at the Code of Conduct Tribunal, CCT,
has been suspended, following an order of the
Supreme Court suspending trial pending the
determination of his appeal.
Mr. Saraki was billed to appear at the tribunal
today for the continuation of hearing.
The News Agency of Nigeria (NAN) reports
that the Public Relations Officer of the
tribunal, Ibraheem Alhassan, made the
disclosure in Abuja on Monday.
Mr. Alhassan said the decision to suspend
hearing was to show due respect to the apex
court’s directive for stay of proceedings.
“The case was slated for hearing on Nov. 23,
but as a mark of respect for the apex court,
the tribunal decided to tarry a while pending
the determination of Saraki’s appeal
challenging the jurisdiction of the tribunal to
try him,” he said.
NAN recalls that Justice John Fabiyi, leading a
five-man panel of justices of the apex court,
ordered the Justice Danladi Umar-led tribunal
to suspend further hearing in the matter.
Mr. Fabiyi held that the stay of proceeding
was to enable the apex court hear and
determine the substantive appeal brought by
Mr. Saraki.
“It is imperative to state that all the parties,
including the Code of Conduct Tribunal,
should tarry a while to enable this court
determine the appeal before it.
“In effect, further proceeding at the CCT
should be stayed pending the hearing of the
appeal.
“Hearing date will be communicated to all the
parties,” the apex court said in a unanimous
ruling.
The Supreme Court, however, gave both
parties seven days each to file and serve their
briefs in order to ensure accelerated hearing.
Following this development, the prosecuting
counsel, Rotimi Jacobs, gave an undertaking
that the federal government would not do
anything until the Supreme Court had reached
a final decision on the appeal.
Mr. Jacobs, a Senior Advocate of Nigeria,
urged the court to give the matter accelerated
hearing in line with Section 306 of the
Administration of Criminal Justice Act 2015.
Mr. Saraki is facing a13-count criminal
charge, to which he had pleaded not guilty.

Independent National Electoral
Commission has been plunged
into confusion, following the
constitutional logjam created by
the death of Abubakar Audu of
the All Progressives Congress,
who was on the verge of winning
Saturday’s governorship election
in Kogi State.
The election was however
declared inconclusive following
cancellation of elections in 91
polling units.
According to results so far
declared by the Returning Officer,
Emmanuel Kucha, Mr. Audu of
the All Progressives Congress
scored 240,867, while Idris Wada
of the Peoples Democratic Party
polled 199,514 votes.
A top official of the electoral
agency told PREMIUM TIMES on
Monday that his commission was
in a ‘deep state state of
confusion’.
“I can tell you that everyone is
confused,” the official said, asking
not to be named because he had
no authority to make that
disclosure to the media.
“We don’t know how to proceed
at this point. We have been
consulting extensively, but we
have been unable to reach any
conclusion.”
“Several meetings have been held
here but no conclusion has been
reached.”
When contacted, the
commission’s Director of Voters’
Education and Publicity, Ozaze
Uzzi, confirmed to PREMIUM
TIMES that the commission was
yet to reach any position
regarding the election.
He said consultations were still
ongoing and the commission
would hold some meetings to
reach a decision.
“We should be able to say
something between 24 and 48
hours,” Mr. Uzzi said.
The returning officer at the election, Mr.
Kucha, had, citing INEC guideline, declared the
election inconclusive, saying the margin of
votes scored between Messrs Audu and Wada
was less than the number of registered voters
in 91 polling units were elections were either
cancelled or did not hold.
Mr. Audu had 41,353 votes more than Mr.
Wada, while the total number of registered
voters in the affected polling units is 49,953.
Nigerian law did not provide for the kind of
political logjam that has developed in Kogi,
where a governorship candidate died before
conclusion of the election.
Legal experts have expressed divergent
opinions on the matter.
Lagos-based constitutional lawyers, Jiti
Ogunye and Festus Keyamo said Mr. Audu’s
running mate, James Faleke, should
automatically be made the APC’s governorship
candidate while the supplementary election in
the affected 91 units continues.
On the hand, Muideen Olagunju, a lawyer,
holds different opinion, asking the Attorney
General of the Federation to approach the
Supreme Court to determine the way out.
He argued that Mr. Faleke could not
automatically continue with the election as the
governorship candidate since there was no
provision in the constitution to that effect.

The Independent National Electoral Commission (INEC), on Monday, said it would apply available
legal provisions on the recent development over Saturday’s governorship election in Kogi State.
Deputy Director of Publicity of the commission, Mr Nick Dazang, stated this in an interview with
the News Agency of Nigeria (NAN) in Abuja.
Dazang, however, said that the All Progressives Congress (APC) was yet to inform the
commission of the death of Prince Abubakar Audu, the party’s standard bearer in the election.
"APC has to do proper notification and accompany it with the certificate of death issued by a
medical doctor," he said.
Audu, who was leading the Peoples Democratic Party (PDP) candidate and incumbent governor of
the state, Idris Wada, in the election which was declared inconclusive by INEC, died suddenly on
Sunday in his home in Ogbonicha.
He was buried on Monday according to Islamic injunction.
Dazang said that INEC would apply relevant laws and make a pronouncement on its position on
the election immediately it received official notification of Audu’s death from his political party.
He said that there were legal provisions to address such incidents in the country’s electoral
process.
"When something like this happens, the party on which platform the candidate contested will need
to notify the commission. Of course, we have heard and read like everyone else but we need to be
notified.
"Once the commission is notified, it will look at relevant clauses of the 1999 Constitution as
amended, the Electoral Act 2010 as amended and also the constitution of APC itself.
"All these relevant laws will be looked at with a view to determining what to be done to ensure that
whatever is done subsequently is done within the ambit of the law.
"INEC as a law-abiding body will do everything prescribed by the law.
"Thankfully we have some Senior Advocates of Nigeria (SAN) that provide counsel to the
commission. We also have a very vibrant legal service department, headed by a SAN," Dazang
said.
He said that before the report of the death of Audu, INEC, on the directive of its chairman, was
already making provision for a supplementary election.
He said that the commission would follow the constitution and not the opinion of people on the
election, saying there were legal provisions for such incident.

Muhammadu Buhari to abandon what he termed the ‘old
Buharinomics’ if he must bring about the desired change in
the country.
Soludo made the call while delivering a lecture at the
Realnews third annual lecture in Lagos on Thursday which
he titled ‘Avoiding the mistakes of the last Buharinomics’.
Soludo said there seemed to be a perception of the sense of
nostalgia, a thing about command and control regime
battling with what is required in a competitive market
economy worldwide.
He said: ‘the element of the old ‘Buharinomics’ that we need
to change include Fix exchange rate, fix capital control,
import bans and forex rationing”.

Nigeria has been ranked third of the 162 countries of the
world that have been worst hit by terrorist attacks,
according to the 2015 Global Terrorism Index.
The country, Africa’s largest oil producer, was ranked fourth
in 2014.
Going by the latest ranking, Nigeria is only better than two
Middle Eastern countries – Iraq and Afghanistan – who
were ranked first and second respectively.
Another two Middle East countries, Pakistan and Syria are
ranked fourth and fifth respectively, after Nigeria.
The only African countries closer in ranking to Nigeria are
Somalia and Libya which are in the eighth and ninth
positions respectively.
France, which recently experienced deadly terrorist attacks
that killed about 160 people in Paris, is ranked 36th, same
as the United States of America.
“Terrorist attacks are much more lethal in Nigeria than any
other country,” the GTI report said.
The report, released on November 16, 2015 by the Institute
for Economics and Peace, said the Islamist terror group in
Nigeria, Boko Haram, overtook ISIL in 2014 to become the
most deadly terrorist group in the world.
The Institute for Economics and Peace is an independent,
non-partisan, non-profit think tank with offices in Sydney,
New York and Mexico City.
The 2015 GTI report said Boko Haram, in 2014, was also
able to spread outside Nigeria to launch two deadly attacks
in neighbouring Cameroon, killing 530 people.
Cameroon, the report said, didn’t record any death from
terrorism between 2000 and 2013 until Boko Haram struck
in 2014.
Although published in November 2015, the GTI report was
produced from data gathered in 2014.
In 2014, Nigeria experienced the biggest yearly deterioration
in terrorism on record, the report said.
“There were 5,662 more people killed (in Nigeria) from
terrorism in 2014 than in 2013, an increase of almost 300
per cent,” it says.
The number of people killed in Nigeria by terrorist attack in
2014 was 6,118, compared to the 1,595 killed in 2013.
According to the report, “Nigeria has moved from the
country with the fifth highest levels of fatalities in 2013 to
the second highest in 2014.”
In summary, Nigeria recorded 662 terrorist attacks in 2014,
with 7,512 people killed, 2,246 injured and 1,512 properties
destroyed.
But then, Boko Haram isn’t the only terror group in Nigeria
that kills; the Fulani militants in the northern part of Nigeria
is recorded to have killed as many as 1,229 people in the
country in 2014, which is an incredible leap from 63
recorded in 2013.
Unlike religious fanaticism which drives Boko Haram, the
Fulani militants are driven by conflict over access and
control of land between the semi-nomadic Fulani herdsmen
and farmers in north-eastern Nigeria, the report said.
Nigeria, alongside four other countries – Iraq, Afghanistan,
Pakistan and Syria – accounted for 78 per cent of lives lost
globally in 2014 through terrorist attacks.
Of 20 most fatal terrorist attacks in the world in 2014, nine
of them took place in Nigeria.
Boko Haram was responsible for eight of those nine
attacks, while the Fulani militants were responsible for one
which took place at Galadima where 200 people were
reportedly killed.
The worst terrorist attack in Nigeria in 2014, according to
the 2015 GTI report, was in Kano city on November 28, 2014
when two suicide bombers and roadside bomb detonated at
the Grand Mosque in the city.
Boko Haram terrorists reportedly opened fire on
worshippers fleeing the explosions. One hundred and
twenty-two (122) people were killed, while 270 were injured.
Nigeria for several years now has been battling Boko Haram
insurgency which is responsible for thousands of deaths in
the northeast of the country. PREMIUM TIMES has
extensively reported on the insurgency.
“The nature of terrorism in Nigeria is different to Iraq and
Afghanistan,” the report said.
“Terrorist activity in Nigeria has more in common with the
tactics of organised crime and gangs, focusing more on
armed assaults using firearms and knives than on the
bombings of other large terrorist groups.
“Firearms were used in over half of all attacks in Nigeria
and were responsible for 67 per cent of all deaths by Boko
Haram and 92 per cent of deaths from Fulani militants.
“Whilst previously the use of suicide attacks by Boko Haram
was rare, in 2014 they were responsible for 31 suicide
attacks with an average of nearly 15 deaths per attack.
“The majority of these attacks were against private citizens
and education and religious institutions. No other group in
Nigeria conducted suicide attacks in 2014,” the report said.
The number of people killed by terrorism around the world
increased from 18,111 in 2013 to 32,658 in 2014.
The increase is said to be the largest ever recorded.
The report put the global cost of terrorism in 2014 at US$
52.9 billion, compared to US$32.9 billion in 2013.
The GTI, which is currently in its third edition, is “based on
data from the Global Terrorism Database (GTD) which is
collected and collated by the National Consortium for the
Study of Terrorism and Responses to Terrorism”.
The GTI score for a country in a given year is said to be
based on unique scoring system to account for the relative
impact of terrorism incidents in the year.
“The four factors counted in each country’s yearly score,
are: total number of terrorist incidents in a given year; total
number of fatalities caused by terrorists in a given year;
total number of injuries caused by terrorists in a given year;
a measure of the total property damage from terrorist
incidents in a given year.”

The Chief of Defence Staff, Abayomi
Olonishakin, on Friday admitted that a
number of Nigerian soldiers went missing
after a fierce gunfight with Boko Haram
insurgents.
Mr. Olonishakin, a general, said the soldiers
went missing due to some ‘operational issue’
during the battle with the terrorists.
”There were operational issues, but as I speak
with you, the troops have re-joined their
units,” the defence chief said in Jos when
journalists asked him the status of the missing
soldiers.
Mr Olonishakin’s confirmation of the incident
came hours after the army, after three
previous self-contradicting statements, also
admitted the incident happened.
PREMIUM TIMES had exclusively and
authoritatively reported that at least 105
soldiers attached to the 157 battalion went
missing after they came under intense attack
from Boko Haram insurgents in Gudunbali,
Borno State, on Wednesday morning.
Reliable military insiders also told this
newspaper that the terrorists captured a T-72
tank as well as several artillery weapons from
the unit.
The army was initially reluctant to answer
questions about the incident when contacted
by PREMIUM TIMES.
The spokesperson of the army, Sani Usman,
before the story was published, directed us to
forward our enquiries to officials of 7 Division
in Maiduguri.
However, the spokesperson of the 7 Division,
Tukur Gusau, a colonel, also declined to
comment, saying the commander of the
division would address a press conference on
the issue later on Thursday and that it was
improper for him to pre-empt his
commanding officer.
However, after our story ran, Mr. Usman
called our reporter to officially confirm that
the attack indeed took place as reported.
“I want to confirm the incidence at Gudunbali
but the details you provided were not correct.
“The unit attacked is within the area of
responsibility of the MNJTF and troops are
now organising to counteract the attack,” he
said.
However, he did not give contrary details of
the attack to counter PREMIUM TIMES account
of the incident. He merely added that the
theatre of command would provide details
during a press conference in Maiduguri later
on Thursday.
At the press briefing, attended by our reporter
in Maiduguri, the commander of 7 Division,
Yushau Abubakar, also admitted that the
troops were involved in a major clash with
the insurgents. He further stated that several
causalities were recorded on both sides.
“Our troops were attacked in Gudumbali
where we dislodged the Boko Haram there.
We had an attack and we are sorting it out.
But I have not heard anything relating to what
is being reported in the media, he said.
He however became evasive when pressed
further for details of the attack by journalists.
“I have spoken with the CO (commanding
officer) there even this morning and I have
not heard anything of such from him. Yes, we
went to Gudumbali and we were attacked and
we repelled them and we are currently
sorting out the situation. In war anything can
happen and the operation is ongoing.”
However, later on Thursday evening, the
military issued a statement describing the
report of the attack as a product of “the
imagination of those sympathetic to Boko
Haram ways of life.”
“The attention of the Theatre Command
Operation Lafiya Dole was drawn to an online
media publication saying troops of 157 Task
Force Battalion were overran by the Boko
Haram terrorists in Guzamala axis of Borno
state and that several personnel were killed
and several others cannot be accounted for
including the Commanding Officer of the Unit,
the statement signed by Mr. Gusau read.
At no point in our two reports on the matter
did PREMIUM TIMES say the soldiers were
killed. We merely reported that they were
missing.
“The Theatre Command wants to state clearly
that the story is a fabrication from the
imagination of those sympathetic to Boko
Haram ways of life.
“Although the location of 157 Battalion was
attacked last Wednesday and was
subsequently repelled by the gallant troops of
the Unit, the Commanding Officer of the Unit
is in contact with his Brigade Commander.
“However, the unit suffered some casualties
which is normal in military operations. The
affected personnel sustained minor injuries
but no gunshot wound was sustained by the
troops.
“The number of casualty and equipment lost
as being circulated is not correct. The situation
was unnecessarily blown beyond proportion
to give terrorists the type of propaganda they
desired,” he stated.
However, in another statement sent to
PREMIUM TIMES on Friday, spokesman of the
Nigerian Army, Sani Usman, however
admitted the return of the missing soldiers,
lamenting that the army suffered a “slight
setback”.
“Nigerian troops operating in the Northern
Borno State towns of Gudumbali and Kareto
had slight setback within the week. However,
the situation is being stabilized.
“The troops have re-joined their units for
further action.
“The earlier media reports were exaggerated.
The CO (Commanding Officer) is currently
with his soldiers.
“The incidence was just a minor setback,
which is common in military operations,” Mr.
Usman, a colonel, said in a brief statement.
PREMIUM TIMES gathered that the
commanding officer, alongside a few other
soldiers, emerged from the bush in a van
several hours after the encounter.
It was also gathered that some injured soldiers
were taken to the 7 Division hospital in Borno
State.

Born on September 21, 1938, the former Finance minister was kidnapped by over 20 Fulani herdsmen who invaded his farm and attacked his over 200 workers.

Many of his workers including the farm Manager identified as Bruno were matcheted while others were reportedly wounded and are on admission in different hospitals.

Reports from the family said that the fulani herdsmen have been having issues with the workers in the farm over the grazing and the destruction of the farmland by their cows.

The herdsmen reportedly came back on Monday in large number and attacked the farm before abducting the politician.
Vanguard was told that on arrival the herdsmen shot indiscriminately into the air, a situation which made the workers to flee to different directions.

They reportedly beat up the National chairman of the Social Democratic Party SDP and dragged him on the floor when he refused to go with them.

Police source however said that the Fulani herdsmen may have been used by other interested party who have requested for a ransom.

The herdsmen according to the police source may have been paid off and the victim handed over to those who have made contact with the family after carrying out the hatchet job.

Speaking with newsmen, the spokesman of the SDP in the state, Remi Olayiwola said that the abductors have contacted the wife of the ‎victim Mrs Rachel Falae and requested for N100m ransom expected to be paid before the end of work on Tuesday.

Olayiwola said that the accent of those who contacted the wife of their National chairman was that of the fulani.

Newsmen were ‎barred from entry into his residence located along Oba-ile in Akure metropolis while other sympathizers and party members gained free access into the compound.

The state police authorities ‎confirmed that the Funali herdmen invaded the farm, attacked, wounded and beat up the former Minister before whisking him away to an unknown destination.

Spokesman for the state command, Wole Ogodo said that ‎Chief Falae was taken away while some of his staff were seriously wounded.

Ogodo pointed out that in a swift response no fewer than 50 policemen had been deployed to the area to search for him.

He added that‎ until the search party led by the Deputy Commissioner of Police, operation Ishola Abdulahi, the command would not be able to ascertain the whereabouts of the septuagenarian politician
