Again, Peter Obi lied in Canada when he said, "Amazon came and said there was no glitch." to the INEC server. And Peter knows this is a lie, because he presented a witness at the Presidential Election Petition Court, who said the same thing. When asked to produce evidence, the witness said there was no evidence and tendered a worthless document not even issued by Amazon, which had no relationship to the INEC server.Ā 

Peter Obi also lied again when he said, "We brought down an Amazon person"Ā Ā That is another Gbajue. The witness Peter Obi brought to court isĀ Mpeh Clarita Ogar, who admitted in court (and on video) that I "Am here as an expert witness, am not here on the mandate of Amazon."

Furthermore, Peter Obi's so-called 'Amazon expert' turned out in reality to be the failed Labour Party for the Federal House of Representatives election forĀ Yala/Ogoga Federal Constituency, in Cross River State.Ā

It depends on his performance and the people contending with him, I voted for him in February but I'm yet to be pleased with his actions especially in terms of the economy, there are better ideas that he can work on with less cost.if Peter obi and Atiku are still his main challengers and his performance is below par, I'll likely not come out to vote, I still wish him and our great country the best.

This is a response to a comment on my October 30, 2023, piece on: ā€œHow Supreme Court trashed Atikuā€™s ā€˜fresh evidenceā€™ from Chicago.ā€ Former Vice President Atiku Abubakar of Peoples Democratic Party (PDP) got the new evidence from President Bola Tinubuā€™s academic records and deposition to authenticate his certificate by the Chicago State University, in Illinois, United States, on October 2 and 3, respectively.

The respondent to the article on ā€˜NTA Benin Family Forumā€™ WhatsApp page, reposted a fabled, ā€œJustice in 21st century Nigeria,ā€ woven by Usman Muhammad around a murder case, in which the suspect was found guilty by the High Court and Appeal Court. But on his appeal to the Supreme Court, CCTV footage showed the suspect didnā€™t commit the crime. Yet, the Supreme Court justices said: ā€œSince your lawyers didnā€™t tender the footage at the lower court within 21 days of your arrest, you will be hanged as earlier ruled.ā€ The poser: Why should the Supreme Court refuse the fresh evidence of fact that couldā€™ve exonerated the suspect? Corollary, why should the Supreme Court refuse Atikuā€™s ā€œnew evidenceā€ to prove that Tinubu presented a ā€œforged certificateā€ to the Independent National Electoral Commission (INEC) for clearance for the February 25, 2023, poll? Reproduced below are excerpts from my response, ā€œVery wrong and off-the-point analogy,ā€ to the respondentā€™s query: ā€œElections are of a different kind (sui generis) from conventional legal matters. Thatā€™s why the rules and procedures are different, too. ā€œThe rules guiding the 2023 General Election, as per the amended Electoral Act 2022, mandate litigants to front-load their pleadings, and witnesses to be called. ā€œOnce the actual proceedings start, you canā€™t plead what you didnā€™t front-load, because the other party to the dispute will no longer have a chance to reply. You canā€™t catch your opponent from behind. ā€œThatā€™s what Atiku wanted to do with the CSU academic records of President Tinubu, and CSUā€™s deposition therefrom regarding the authenticity of his certificate.

ā€œBesides, Atiku breached the Supreme Court Rules 1985 (as amended), whose Order 2, Rule 12 set three conditions for admitting new, fresh or additional evidence at the appeal stage. Theyā€™re: ā€œ(1) The new evidence shouldnā€™t have existed or existed but couldnā€™t be diligently obtained before the appeal. Did Tinubuā€™s certificate saga just happen yesterday? No! Itā€™s been on since 2003, when he ran for re-election as Governor of Lagos State. ā€œ(2) The new evidence shouldnā€™t be such that it will affect the entire appeal. Thatā€™s, the evidence must not torpedo the appeal, which primarily emanated from the February 25 presidential poll. ā€œ(3) The evidence should be credible and believable, and neednā€™t be incontrovertible. ā€œAtiku held up the evidence as such, relying on CSUā€™s deposition,ā€ but ā€œTinubu controverted Atikuā€™s allegation that CSU denied the certificate he submitted to INEC.ā€ ā€œAtiku also fouled the rules when he initiated his case against CSUā€¦ He went to court in the U.S. because itā€™d dawned on him heā€™s going to lose the case at the PEPC.


Thatā€™s taking undue advantage of the situation, which is against natural justice. ā€œSo, you (respondent) wanted the Supreme Court to ignore these facts, including Atiku breaching the rules of court, both at the PEPC and Supreme Court, and give him judgment based on emotions, sentiments and morality? ā€œThis is similar to what Peter Obi (former Anambra State Governor of Labour Party (LP)) said on November 6, 2023, at a press conference: that the Supreme Court ignored Public Opinion, and affirmed Tinubuā€™s victory! ā€œHow did they expect 5 Justices of the Appeal Court, and 7 Justices of the Supreme Court to abandon the law for public opinion? Public opinion is the rule of the jungle, and not of human society! ā€œThe maxim is, ā€˜The Law is the Lawā€™. Youā€™re not supposed to twist the law to favour one party, and disfavour the other party to a dispute.ā€ Were public opinion ā€“ a mob mentality that runs on emotions ā€“ the main determinant for choosing the President, there wonā€™t be need for elections. Simply apply the rule of the thumb, and pick the candidate thatā€™s more voices of support on social media. This was evident at the February poll when Obiā€™s supporters, who dominated social media, took that psyche to the election, believing that ā€œthe vote is in the bagā€ for Obi, who led in several opinion polls.

But he didnā€™t stay the course, to establish allegations of massive fraud and violence, and INECā€™s connivance with Tinubu and APC to deny him victory. Rather, he concentrated on obvious pre-election matters to have Tinubu disqualified, so he could be declared the President (as he placed second in the February 25 presidential poll), have a re-run with Tinubu or a fresh election that excluded Tinubu. Thus, Atikuā€™s fresh evidence from Chicago wasnā€™t that of a factual report capable of turning the tables in his favour ā€“ such as the CCTV footage cited in the fabled murder case that couldā€™ve saved an innocent suspect from the hangmanā€™s noose ā€“ as itā€™s procured with deliberate disregard to the rules that govern election matters. Lawyers know that strict observance of or adherence to the law, and rules and procedures of the court is sacrosanct.

You ignore them at your own legal peril! And in election matters, the law, and rules and procedures canā€™t be sacrificed on the altar of admitting belated remedial evidence. Plaintiffs and respondents front-load their pleadings, and witnesses to be called at the exchange of briefs and replies by parties during pre-hearings, as no new, fresh or additional and better evidence ā€“ no matter how compelling ā€“ are allowed by the courts thereafter. Lawyers are apprised with these processes before filing clientsā€™ briefs, and during pre-hearings, and are, ipso facto, obligated to obey them throughout the proceedings from the lower to higher courts. Did Atiku obey these processes ā€“ akin to a code of conduct ā€“ that his team of senior lawyers were abreast with? No! Actually, Atikuā€™s lead lawyer, Chief Chris Uche (SAN), admitted at the Supreme Court that he (Atiku) didnā€™t plead the new evidence he strove to impose on the court. Mr Uche also agreed that the time for fresh evidence had lapsed, but he would rather the court give substantial justice ā€“ a euphemism for abandoning the law for emotion ā€“ based on the new evidence from Atikuā€™s discovery in Chicago. You canā€™t break the law and also ask the law (court) to protect your right because youā€™ve a compelling reason for breaking the law. Thatā€™s what Atiku did! He purposely ignored the rules of engagement, went to CSU without the courtā€™s authorisation, obtained the new evidence he didnā€™t plead, and emotionally asked the court to accept it, ā€œto prevent President Tinubu from embarrassing and damaging Nigeria and Nigeriansā€™ image in the global community.ā€ No self-respecting court would accommodate such an entreaty from an appellant that affrontly breached the law, and the rules and procedures that guide election matters. Hence Atikuā€™s appeal, like that of Obi, merited dismissal, and the Supreme Court accordingly threw it into the dustbin of history!

Nigerians defeated APC during the last presidential election. But because Buhari placed his kinsman, Mahmood Yakubu, on INEC, picked his own court judges to Nigeria's apex courts before he left office, the winner of the presidential election was denied victory by Mahmood Yakubu through a most primitive and fraudulent manipulation of the election.
Others were asked to go to court knowing full well that the court judges were mostly APC picked into the judiciary.

Story,it seems Nigeria justice system is not blind rather it very much awake and dispenses biased judgement.
They are sacking LP candidates left and right based on pre election matters according to them but in some cases like Shettima the VP it was ruled in his favour.
2022 electoral act said it expressly that you can only be sacked for forgery if the certificate in question is the one you used as a means of qualification, in sanwoolu's case he has additional degree.
