Fair point. but like nduchuks said, the judge will make that decision. That's why I said it's up to him to consider this CASE! he cant apply it for every other case. If you are worried about the judge making the right decision, that's where EXPERIENCE comes in.

But my larger point is, if he considers public interest is more important than disqualifying over a trivial issue (again, we assume that GMB didn't meet the SSCE requirement. . huge assumption), it would NOT be an illegal move. The LAW allows for it.

First of all, you said that APC failed to screen properly. You are assuming that GMB should be disqualified. based on??

Heresay? Rumours? YOUR judgement? No verdict has been reached yet o. So your assumption is faulty.

Bear in mind that INEC as well is responsible for ensuring that candidates meet the requirements. They had certified that already and asked whoever was aggrieved to go to court. The PDP challenged it and went to court. perfect! much better than the running around in the early days.

Now, to your point: If the court actually finds that GMB did not meet the "requirements", should he be disqualified or should there be larger considerations?

Answer: Not a simple answer! I am not a lawyer but I do remember that there is a principle in law that allows for LARGER CONSIDERATIONS/REASON/SENSE to be considered in cases like this. When you weigh the potentiality of ABSOLUTE CHAOS because someone said his docs were with the Army (when the army verified that already and later 'changed their mind') etc, you'll see that the reasons to disqualify him are SO TRIVIAL, it would be insane to risk the magnitude of chaos.

Does that mean GMB is above the law? NO!! Because the judge taking that decision would be LEGALLY JUSTIFIED! Law is very complicated o. It's not just black and white.

Now, will it set a bad precedence? Not necessarily. because these kinds of situations are often rare and are taken on a case-by-case basis. For instance, if someone is found to be an ex serial killer just before an election, no matter how popular he is or how much chaos there could be, the judge may still disqualify him, because the case of a serial killer is serious. For SSCE? Com'on! Even many Pro-GEJs won't advise that.

But, just my 2 cents. maybe an actual LAWYER in the house can help expatiate!

If by chance Buhari wins this election, extremely hard times lies ahead for this country. 

Definitely, the creeks will go haywire again, Buhari will send the troops to the creeks and together they will set the oil facilities ablaze.

While these persists, the oil producing companies will simply withdraw their personnel from the volatile region and all foreign investment will seize in all sectors.And even if the troops kill 90% of the militants, it will take just one militant, a dynamite and just one location along the multi- kilometre trunklines to continue to wreck havoc. 

Fast forward to 2019, if we remain one country and without a civil war,, we will be an economic wreck with no allocations and salaries, no capital projects, no hope with dollar exchanging for 400 naira and we are worse off than we were in 2015.

Cos the truth is that without crude proceeds for now, Nigeria is finished. 

And then, we'll be screaming another 'Change' because we would have learnt a bitter lesson in the hands of the Fulanis, Tinubu and Saraki.And then we will ask.... Why were we this silly?

And before you quote me, make sure you outline in clear terms how you or Buhari will avert this obvious calamity staring us in the face

The entire world stands to benefit from a crisis in the Niger delta. Its not a coincidence that USA who abandoned us at the height of bokoharam is busy shouting for change in govt . Crises in the ND will reduce supply of crude to the Oil market and that would drive up the price of crude for producing countries.... But at Nigeria's expense.

The summary of this is given below:

PDP is projected to win in 13 states: Anambra, Ebonyi, Imo, Enugu, Abia, Delta, Bayelsa, Cross River, Akwa Ibom, Rivers, Ondo, Benue and Taraba

APC is projected to win in 16 states: Ogun, Osun, Oyo, kwara, Niger, Kaduna, Kano, Katsina, Jigawa, Kebbi, Zamfara, Sokoto, Bauchi, Gombe, Yobe and Borno.

The following states (eight) are too close to call: Edo, Lagos, Benue, Plateau, Ekiti, Nasarawa, Adamawa and I will add FCT in the list.

Going by this analysis, GMB will win the election on the following facts:

1. He is expected to record outright win in 16 states while GEJ should win outrightly in 13 states.

2. The states GMB is projected to win have more votes than GEJ's states.

3. Even if GEJ wins all the eight too-close-to-call states, GMB will record at least 40% of the votes there. The win margin for GEJ (assuming he wins all of them) will be very narrow because they are states that can be won by either of them.

4. With all eight toss-up states marginally won by GEJ (big assumption), his total states won will be 19 (13+6) while GMB wins in 16 states with additional 40% to 50%% in the spring states. The implication of this scenario is that GMB will record more popular votes and will have equally secured more than 25% in 2/3 of the 36 states of the federation (i.e wins in 16 states, 40%-50% in 8 states, and at least 25% in Imo, Rivers, Ondo and Taraba which are projected for GEJ's win).

Therefore, however it turns out in the too-close-to-call states, GMB will be declared the president based on more popular votes.
