No you cannot use result notification/certificate less than a university degree for proof of English Language requirement, it has to be your original bachelor (or higher) degree certificate. But if you've just recently finished the university or lost your degree certificate then you will have to follow this UKBA instructions:http://www.ukba.homeoffice.gov.uk/visas-immigration/partners-families/citizens-settled/spouse-cp/documents/english-language/...check the paragraph that mention this:

Degree taught in English
If you want to show that you meet the English language requirement because you hold an acceptable degree taught in English, you should provide the original certificate of your award.

This certificate must be original, and must clearly show:

your name
the title of the award
the date of the award
the name of the awarding institution
Original provisional certificates are not acceptable.

You must provide the original certificate of your award unless:

you have successfully completed your degree but you are awaiting graduation; or
you no longer have the certificate and the awarding institution cannot issue a replacement.
In either of those situations, you must provide the original academic reference from the institution, and the original academic transcript. Both documents must be on the institution's official headed paper.

The original academic reference must clearly show:

your name
the title of the award
confirmation that the certificate will be or has been issued
the date that the certificate will be issued, or confirmation that the institution cannot issue a replacement
The original academic reference will not be suitable evidence if it does not state which qualification has been awarded.

The academic transcript must clearly show:

your name
the name of the academic institution
the course title
confirmation of the award
You should ensure that the contact details for the awarding body are up to date. If we need to verify the details and we cannot contact the institution, we will not accept this evidence and may therefore refuse your application.

Well that is another stuffs ... may be you will then have to ask the appeal tribunal to send your pack to the ECM in Sheffield. Although, on closer look it seems to me that during appeal what looks like the review process can be ordered really ... see http://ukimmigrationspecialist.com/2012/08/17/immigration-appeals-timelines/

See just do the two ...I think you can always ask your document back.

Note the statement in the 3rd paragraph:'However, all applicants can apply for an administrative review, which is a mechanism for reviewing refusal decisions.'

please fill out the form and explain that

1. you have your original marriage certificate but was mistakenly excluded

2. Your payslips may have been lumped up with other supporting docs so the ECO found it difficult to make out which is the correct payslips

3. That you have now retrieved all your communication with your spouse via the Skype helpdesk which you were not aware that you can be able to retrieve before.

Explain to him/her to re-consider your application in the light that you will now make sure the supporting evidences will be properly package this time around in order for the ECO to sort them without any issue.

I believe it will work ... just try it ... you have nothing to loose.

Send the application back with your VAC Ref No. Sheffield Visa Section with the attention of the ECO that worked on your last application.

@ Windseeker - VFS' website tracker was updated in the afternoon of Wednesdday - 3rd, then my wife received a text in the night of same day that her application is ready for collection.

Guys - I plan submitting my appeal on the 3 issues they raised with these supporting documents.

1 - The original marriage certificate. We always had it but thought the photocopy will do. We obviouly know better now so will put the original in the appeal.

2 - Payslips. I have got my company to authenticate all 6 payslips again and they are doing that that. They are already on company letter headed slips tho.

3 - I now have our Rebtel call history for almost a year. We've only used skype for about 6 months and I have the call log now. My whatsapp crashed four months ago and I only have history from November last year. I am requesting my Viber call history but havent got that yet. I also have a few calling cards I used in the past. We recenly chat most on iMessage
but chat history there can't be downloaded (I don't mind sending them my iPhone, if thats safe?)

Not sure of anything more to add.

A friend is advising I submit a new application instead of appeal as that would be faster. Is there any sense in doing this? Don't want to further complicate my issue.
@Ebeano49...I will suggest that you go the way of appeal. You don't need to waste another N222,000 + Postage cost and other logistics.

I will advise that you submit your appeal and at the same time ask for a review of your rejected application by the ECO that signed your rejection letter. Just explain to him/her that it was a mistake from your part to have misplaced the documents that you already do have them and included them, stating that you do not intend to confuse him/her.

Now try to get a folder file with dividers and properly divide all your supporting document into sections ( you can follow the way I stated them in my post earlier on) and ask him to reconsider your application in the light that you have now corrected all the highlighted errors by the ECO.

Now if he accepted your application, it will be faster and no need for appeal. If he rejected it ... he will advise you to go and appeal and you've already done that, so no lost from your own part. Although I must say if you use wisdom to express your review covering letter smartly hardly will they reject a review. Just give it a try, it's worth itsmiley

Well from most people that started applying from May 2013 in Nija show roughly 3 weeks ... I saw somebody with this timeline in another site:

'Spouse settlement application submitted at Ikeja Lagos on Friday 10.05.13
Supporting documents sent by DHL to UKBA Sheffield on Friday 10.05.13
Supporting documents received at UKBA Sheffield on Monday 13.05.13
Passport/Application received by UKBA Sheffield on Wednesday 29.05.13 '

So you see they take a while to send your application accross even if you had already DHL'd your supporting documents.

Although i don't know the nature or reasons for your refusal, i am aware that refusal in visitor visa category does not necessarily affect your settlement visa application. I may be wrong though!

@Ebeano49 sorry about your application rejection..Yes just like @mato-justo stated you will need to get all the required supporting documents or evidences for all the points raised in the rejection pack before making any appeal for you to stand a chance. I pray that God will help you guys through this. my advise is that you just calm down, think through each step to take and ask questions especially from experienced guys from the forum so that you can present a very good appeal application.

@darlene_10, Congrats oh ... yours seem faster than that of @ebean049, although it looks within the 60 days forecasted period by UKBA to have completed 75%.

Well we have just submitted our application and I will like eagle eyes guys to help scrutinize the possibility of a first time approval here, though I hope I am not puting the horse before the cart having submitted the application already...but we got the ideas of what documents to submit from this forum coupled with the UKBA sites as well.

Well here is the list of what was submitted as supporting documents as evidence for our application:

A. Application
1. covering letter detailing our relationship history( how we met, How we communicated even before we met face to face, place and date of marriage), plans to committing to living together permanently in the UK.
2. Sponsor's decalration letter for the applicant

B. Evidence of Age
1. Wife's date of birth
2. My British passport biodata page

C. Evidence of Marriage and Freedom from marriage
1. Our marriage certificate
2. Wedding photographs
3. UK Decree Absolute certificate

D. Evidence that we have met, Marriage is genuine and subsisting
1. Our wedding photographs plus loads of other photos showing us together at different places in nija.
2. Communication (Email logs starting from the beginning of dating till very recent as much as we can get, daily phone call logs itemised showing call dates and time, caller and reciever phone numbers and call duration).
3. Western union receipts for monthly allowance to fiance before marriage.
4. Evidence of birthday gift, cash gift for Xmas and valentine celebration.

E. Evidence of Sponsor's Financial State
1. UK Employment letter on my company letterhead (stating title and gross salary per year, date i joined, type of employment)
2. Recent P60 (original and a copy)
3. 6 months bank stmts (original direct from the bank)
4. 6 months payslips (printed copies with company logo, I later sent in original copies on the company’s headed paper, stamped and signed by a senior manager)
5. Savings bank passbook copies.
6. Company shares stmt copies
7. Wife's savings passbook (original and copies)

F. Evidence of accommodation
1. Original Tenancy Agreement
2. Letter from Landlord stating wife can stay and flat exclusively for our use.
3. BT Bill for proof of address

G. Evidence of English language Ability
1. Wife's B.Sc degree certificate,LASU (Original and copy)

H. Evidence of Spouse travel
1. Copies of my boarding passes
2. Copy of passport showing visa, entry and departure pages ( as I used my British passport to travel to Nija)

I. Evidence of Job opportinity for Wife in the UK
1. copies of job adverts in wife's areas of specialities and statement of intent and how to seek for good opportunities in the UK without recourse to public fund.


Well, I need to say that we were introduced by a friend in Nigeria some 11 months ago before our wedding last month in Nigeria and we only stayed together for two weeks ( 1 week before and 1 week after the wedding).

I also need to mention that it never cross my mind that I will fall in love with someone remotely with just the pictures and daily chatting on phones and emails but it did happen. We genuinely fell in love and our physical first time meeting was as if we had been going out for years...we are Christians and we were truthful and open to each other through out and it was very easy for us to blend together so much so that it was a surprise to all our friends who knew about how we met.

My concern is, giving all the loads of supporting documents above, will the ECO be spotty about the length of the relationship and time together leading to the wedding, do they look at these stuffs, seriously?

Well, I received a response almost immediately from the UKBA Sheffield office stating that they have receieved the supporting documents but are yet to receive the documents submitted by wife at VAC in Nigeria.

Does anyone know how long it takes to send the document from VAC Nigeria to UKBA Sheffield please?
