No, not all. You should always live peaceably with all men and pray for wisdom enough to help in all situations you may find yourself. Your company may be having some issues as per their business and inability to pay salaries now but I can assure you it's is temporary, they will get pass that phase.

One thing you have forgotten though, I don't know how long you have spent with them, is that, you need references from your previous jobs up to between 3 and 5 years depending on what role or what organisational HR policy. In this case, if you don't sort yourself out you may not be able to get a good reference and could affect your ability to get next job unless you have made up your mind to start your own business.

If I were you, I will go back to the director and apologise, just get a personal meeting with him and apologise and move on. You see our people normally say, If we don't eat palm oil because of yam, we eat yam because of palm oil. A very simple advise is enough for the wise my bro.

You state he came as a child of a UK citizen, then say best to wait for his ILR and now you mentioned the visa is in fact of an EEA national, this would be a family permit, so please I'm confused.
@Portsmouth86, you were right to be confused but there is no farce here though. I was not given the correct picture of the situation at first when I jumped on the thread. I later got the true picture that his mother is a BC but he came into the UK using the Surinder Singh route as an adult child of a UK born....Now he wants to get marry to a non-EEA... but will wait till he acquire his PR before sponsoring her to join him in the UK.

The question is can they get marry now and then process spouse visa later?

I am not sure what the complete picture is but I can not see anything wrong in getting married. I think even with his limited leave to remain he can still bring his spouse to the UK. For example with a student visa, you are allowed to bring your spouse to the UK and they will be allowed to work and this is the same with a Tier 2 work permit as well. But obviously you will have to meet all the requirements in terms of financial e.t.c. Btw family member of a EEA national? Whats the relationship? I hope it is not spouse.

He is actually 33 years old. He has a limited leave to remain expecting to get is ILR in 2018 and the visa is a family member of EEA National - Employment and Business Allowed.

I hope you get the picture now. can he still get marry?

Hopeforallone: @Dunique - We are refused on paragraph 320 that's why we are going to court. So we are trying to provide as many statements from family and friends. We only just started to ask people. All the other requirements are met, so we are going to court over the history.
We can not provide any other information for them really. Because there is nothing to prove.
I will suggest to further enhance the proofs that your marriage is genuine and subsisting by asking 2-4 members across your families, friends and/or work colleagues to give you either sworn affidavits or written testaments in support of your relationship that they are aware of it and/or present at your wedding and that it is genuine and subsisting.

I had to do this in support of my wife's application although this was at the appeal level and I believe it worked for us. Here is a template to use, you can always add as much info to suit your circumstance:

I, <Name of Attestator>, <Gender,Religion,tribe,citizenship> residing at <address> of nigeria do hereby make an oath and declare as follows:-

1. that I am the deponent herein

2. That I am a childhood friend of <spouse name>

3. that i have known him/her since <year>

4. That I have know the husband/wife <other spouse name> since <date> (explaining where you met and how you were introduced to each other)

5. That I was part of the wedding organizers and the wedding ceremony was conducted on <wedding date>.

6. That I affirm that the marriage between Mr. and Mrs <family names> is genuine and subsisting.

7. That I swear to this Affidavit for record and official purpose

8 That I swear to this affidavit in good faith believing same to be true and correct in accordance with the statutory declaration laws of <state name> of Nigeria, <year law was enacted>.
Please gather as much information as you can and by God's grace things will turn out well in your favour.

@damyoyepitan, Congratulations! I am really happy for you, the storm is over and now the calms has come for you. This is a great news indeed and it is marvelous in our eyes. I pray that it shall be a blessed visa and many more memories of joyousness with you and your hubby in the UK and beyond in Jesus name.

About the returning of passport with the visa, from the day it was received in Sheffield barring any holiday or unfavorable circumstances, it usually takes between 7 to 14 working days for your visa to reach you. Just continue to send emails after 3 or 4 days passport is received to ask about the progress of the visa issuance and if passport has been sent back to the UK High commission in Nigeria.

I wish you all the best and enjoyable stay in the UK.

A sponsor (authorised or not) is not considered a party to an appeal and the Tribunal is therefore unable to provide you with the outcome of this appeal
@ leeon2011 I will advise you to really exercise patience. I understand what you are passing through but you cannot force these guys in the tribunal, they will always follow or exceed the allocated times to the appeal processes. I wish you and your wife the very best of luck.

Hello @Leeon2011, I think you will need to exercise a little bit of patience as stated by UKBA in their website it might take some 6 weeks after promulgation for the determination to be received at Post http://www.ukba.homeoffice.gov.uk/policyandlaw/guidance/ecg/apl/apl2/#header8:

APL2.9 Appellant or representative receives allowed determination before Post
It can take up to six weeks from the date of promulgation for the determination to be received at Post.

Determinations should only be requested from the POU responsible for the appeal if an applicant makes contact with Post and 6 weeks have passed since the appeal was allowed. Applicants / representatives / sponsors will usually provide a copy of the allowed determination which will detail a) the appeal number b) date of promulgation and c) hearing centre. Post should use this information to request a determination from the relevant POU. The POU will forward the determination and SAT minute to Post or make arrangements to obtain a copy if unavailable. Direct determination requests to the IAC should not be made.

If the POU confirms that an application has been made for reconsideration, the applicant should be told that a visa will not be issued until the re-consideration is resolved. Post should ask the POU to advise them of the outcome of the reconsideration application.
I think yours is still on the queue, that's what they normally do.

Please all the people in the house, God has done it again cheesy cheesy cheesy cheesy Join us in praising GOD for showing I and my wife his favour and benevolence as the ECM has overturned the ECO refusal decision of our settlement visa application and she has been asked to submit her passport for the visa today.

I thank Girlfio, Justwise, Johnwray, Ebeano,Halle, damy and all those who have contributed positively in all ramification to the success of this application. It was a very tricky one but God showed He is God and favours us in the end.

I pray for all the people that are still waiting that God who has done ours will do yours in Jesus name.

@leeon2011, I will advise that you take it easy....see some FAQs from the First tribunal website - http://www.justice.gov.uk/tribunals/immigration-asylum-upper/appeals/appeals-faq, I think some of these may have answers for your case:

Visas and entry clearance

The Judge has allowed my appeal, but the visa section doesn’t have a copy of the decision. Why?
When an appeal is allowed, the UTIAC will forward the Tribunal determination to you, your representative and the Respondent (the UK Border Agency). This is so that any party who wants to challenge the determination on a point of law can do so. The UTIAC aims to do this within 12 working days of the hearing. The UK Border Agency will let the Entry Clearance Officer know of the decision. The UK Border Agency has 5 days in which to challenge the determination. If they decide not to do so they will send a copy of the determination to the Entry Clearance Officer and aim to do this within 4 weeks.
The visa section has received a copy of the decision but is yet to issue my entry clearance. What happens now?
When the Entry Clearance Officer (ECO) receives a copy of the decision, they will link it to your file and take one of the following actions:
They will contact you regarding the issue of your entry clearance. The visa section will aim to contact you as soon as possible but this can take up to 4 weeks.
When the Judge has allowed an appeal the ECO will confirm whether you still wish to travel, the category of entry clearance required and whether there has been any change of circumstances. This may require another brief interview and the need to see further documents. The entry clearance should then be issued unless there has been a significant and material change of circumstances since the refusal decision, or a material deception has come to light of which the Judge would be unaware.
Once the UTIAC has given its decision, it is no longer within our jurisdiction. There is very little that we can do to speed things up. If you are waiting for a visa to be issued, we recommend that you contact the ECO for an update. Contact details can be found on the UK Border Agency – Visa services website.
The Judge allowed my appeal some time ago. Why has the Visa Section not contacted me about my entry clearance?
Once the UK Border Agency have reviewed the determination and have decided that they are not going to challenge the decision, they will inform the ECO by sending a copy of the determination to them by their internal postage system. The ECO is unable to issue a visa until they have received the copy of the determination directly from the UK Border Agency. Please note that this can take at least 4 weeks.
When the ECO receives a copy of the decision, they will link it to your file and assess what action is to be taken. You will then be contacted about your entry clearance. This process can take up to another 4 weeks at busy visa sections such as Islamabad, Addis Ababa, or Kingston.
The Judge allowed my appeal, but the Entry Clearance Officer has refused to issue my entry clearance. Why can they do this?
If there has been a significant and material change in circumstances since the refusal decision, or a material deception of which the Judge would not have been aware, the ECO can refuse an allowed appeal. However, you would have a further right of appeal against that decision.

in Section 21 THE REQUIREMENTS YOU NEED TO MEET sub-section C - You must meet the immigration status requirement it states:

You must not be in the UK as a visitor, or with leave for 6 months or less (unless you are here as a fiance or proposed civil partner), or here with temporary admission. Your current stay in the United Kingdom must be lawful. You should not be here illegally or have remained here once your permission to stay has ended. We can however, overlook a period after your leave to remain ended.
From the above going by the current guidance note FLR(M) for applicant applying from the within the UK for spousal, cannot be on tourist/visitor visa.
