I am so sorry, I can't believe this has happened, I was so sure after I saw your comprehensive list of submitted documents that you had this one in the bag. I just don't understand why it took them so long to come to these ridiculous conclusions. I know you must be upset but now its just time to get all your documents together so that you get this appeal submitted as soon as possible.

1. The guidelines for this visa clearly state that there is a requirement that you have met face to face. It does not give measurement of how long after you've met that you are permitted to get married. This can not be used to determine the validity of your relationship. When you respond to this point make sure you refer them to the phone records you submit and other communications before you met. Your relationship developed over that period and note that before you met you had made a commitment to each other.

2. Note here that before you got married your divorce was finalised and documents have been submitted as proof. The process of divorce took over 1 year and therefore the suggestion that I got married too soon after separating from my first wife is not valid. Again draw their attention to the phone records and other communications stating that documents have been submitted that prove the legitimacy of your relationship over a period of time.

3. Johnwray has given you some great advise around getting the call card documents. In this section I would also re-submit any other communications you sent with the initial application. In your statement draw their attention to all these documents that support the status of your relationship.

I'll be praying for you guys, let me know if there is anything else you need help with
Thank you so much @girfio for your contribution and words of encouragement. Honestly I am now so sure it seems they at times indiscriminately just refuse visa without common sense.

I've noted all the points raised I will get on with it ASAP and get our appeal submitted next week.

justwise: Sorry to read this, i know the feeling but take your time to go through the refusal letter again.

Don't dismiss reason no 1 they gave, because visa is involved here, meeting somebody and getting married within 7days will definitely raise an eyebrow, even without the issue of visa, people will be surprised that you people did not take time to know each other before rushing to marriage.

Yes it may look that way but we don't just rush into the marriage we have been communication over the phone, emails, met my family members and I have been introduced to her parent over the phone with my pictures even before we met. I know it is visa that is involved here but it will also be wrong that two adults decided to marry each after 10 months of detailed communicating and family involvement we have gone, should not have been overlooked.

This is not enough reason for them refuse...How will they justify my spend some thousands of pounds communicating, travelling and spending on wedding, And even a stupendously wealthy man will not do this.

we had everyday of average of 60 minutes communications on phone coupled with emailing each other and I don't even have any idea I will need this as evidences to the application. All supporting documents as evidence were sent with the application.

In the email screenshots we sent we have our pictures when we start sending to each and parent pictures ... they cannot just come that conclusion ... this ECO has been biased in his judgement of our situations going by the level of details communications we sent to them before and after we met ... I think it should have been a better result.

Anyway point taken, more advice or opinions will be highly appreciated please.

Points 1 and 2 are just rubbish
For point 3, I guess you use call cards so you itemized telephone bill only shows the dial access number (behind the card) and the recipient's number. You will need to provide a sample of the call card showing the access number... This will validate the telephone bill as evidence of communication.

I am actually gobsmacked by the flimsy excuses they gave to justify their refusal for point 1 and 2.

Quick question though, Some of the documents like Letter from Employer and Landlord are retained by the ECO, do I have to get another copies for these and also do I have to send all the same original copies of the supporting documents or copies?

Hi Guys, my wife received her decision today and it was a refusal...we are very devastated about this news. I have not gotten the scanned copy of the refusal letter yet but here are what I can picked up from the phone discussion with her:

They gave these reasons:

1. We met for the first time and withing seven days we are married but never put into considerations the fact that we have been communicating daily over phone and internet.

2. That my divorce was recently finalized and I went to get married but I went through divorce for a 13 months. What are they talking about?

3. That I my telephone call logs does not have official letter from the card company so cannot verify that calls if it's true or not.

On the basis of the above does not believe my our marriage is genuine so refusal

I will post the details when I get the scanned copy but I am very grumpy and devastated fella right now.

@Justwise, JohnWray, girlfio, and others What do I do guys?

I know I will go appeal but can't think right now... any ideas of what argument(s) I can put in right now please?

Just wanted to update y'all on my wife's appeal process. After waiting for DHL for dis, they eventually delivered d passport on Wednesday and the Visa was processed that same day. It got dispatched to Lekki VAC thursday today and shld be in Lagos Monday.
I will like to point out that my persistent email to visasheffield has kinda been helpful. They were replying almost instantly and I was carried along in the whole process.
Does anybody in the house know the phone nos for Lekki VAC so that we can contact them on monday 'cos I heard they are not that effective in their service.
Once again, thanks to you guys...........Your efforts have been appreciated.

3. Does it now means that spouses of settled immigrants may need not worry to apply directly for Settlement visa, which takes ages to get and can even be years if appealing but can now opt to apply for just visitor visa and can take from there?

If question (3) is true, i think this will be a big relieve indeed.
justwise: I really don't see much in the changes, allowing family on visiting visa to make spouse visa application in the UK is not much of a change. The spouses still can not work while on visiting visa and i doubt if he or her will be allowed to extend the visiting visa if it expires while waiting for the outcome of the application.

The only good thing is that the family will have each others support while on the long frustrating waiting time
Yes, you are very correct to think that way as I thought that way as well but I also believe that the circumstances of the individuals involve will dictate if there is the need for UKBA to allow extension of visitor visa because if they can allow family members to apply for settlement while on visitor visa from within the UK, surely they may allow families to extend if they needed to.

Another thing is that even if they don't extend the visitor visa from within the UK, sure the family member can always go back to his/her country to extend her visiting visa to two years, may be, and still continue to be with their loved ones.

Over all, either way we look at it, I still feel applicants will benefit more in this new rule changes just as you stated 'The only good thing is that the family will have each others support while on the long frustrating waiting time'

D police were initially reluctant to follow me and d DPO said "if na Church my hand no dey" and only reluctancly gave me an officer when i said i would petition d IG. The police man came with me to where d car was and immediately d Church guys asked d culprit to go into church to hide, the police said "oga we no tell u?" and when he could not find d culprit, he left back to his station; that is where d violence started, it was a 7.00am service and d clothes I wore to Church that day almost 9 years ago i keep till today as a souvenir. I was beaten thoroughly by about 12 people, my clothes torn and i was dragged on d floor for having d audacity to bring law enforcement to Church, I was screaming and shouting so badly that d pastors on d pulpit inside had to send someone to find out what was going on.
Please understand that I am not condoning the actions of church security guards as what they did to their fellow brother (the person who wrote this story)...something is still missing here. Just like it they say 'fire does not start on its own, there must be the lighter and fuel to start a fire' I presume I will always blame parties here. If you have the Spirit if God in you, first you will be clothed with humility and gentleness especially in the house of God. I know what they did was wrong by deflating your tyres but with the Spirit of humility and gentleness operating in at least one of you the parties involved, this story would have been different.

In the book of Proverb 15:1 it states that A soft answer turns away wrath: but grievous words stir up anger...you can always get to this level when you actively asked God for His Spirit to impart you.

You see I will repeat I did not condone what those guys did but If I were 5 year old member of a Church as big as the Winner Chapel, I would have by now know where and who to report the matter to when I got to my car and I discovered it the tyres were deflated. I will report to the head of my Unit first, take further to the Pastor with pictures taken and I will threaten to leave the church if nothing is done or even send the details report to the headquarters. But I will not go to the police.

See if this had gone to the human court, I bet you both parties especially the writer of this story would also be heavily penalized because just like I said in the beginning of this posting ... fire does not start on his own.

What is it that said that made a church security guard(s) to get angry so much as beat a brother on Sunday morning and tore his clothes?

Please I will suggest that you should forgive and forget. Let no one judge anybody in this matter because we are not there and whatever we are told now is one sided. Having said this I am not in support of the actions of the church security guard(s).

Foe you my friend who wrote this story, you still have some level of personal decision to make as your your relationship with God. Foe me I don't want to be just church goer, I want to exudes godly characters and be able to discern when the devil was about to raise his ugly head, it does not matter where and when...so that what happen that they will never happen to you again, YOU NEED TO IMBIBE THE SPIRIT OF GOD. Please befriend the holy spirit, he will guide you well. the truth they say it's very bitter.

Well to apply for settlement visa using the new format, check this out below:

1. go to - http://www.visa4uk.fco.gov.uk/ and apply online. Follow the instruction below:
When you get to Visa4UK you will need to register and create an account.

When you have completed your online application form, you will need to print and sign your completed form. If you do not have access to a printer when you apply, you can log in and print the form later.

If you are applying as a student under Tier 4 of the points-based system, you must use the online appointment calendar to book an appointment at the visa application centre. You can book, change or cancel your booking online. If you are applying under any other category, you do not need to book an appointment.

When you have completed your online application, you will receive an email message containing your application number (also known as a 'GWF reference'). Please make a note of this number. Your appointment must be no more than 90 days after the date you completed and submitted your online visa application form.

Before you sign your application form, you must ensure that the information on the form is correct and your supporting documents are genuine and unaltered. If you do not have a document you should explain why you do not have it. You must not provide a false document.
2. Then print out the VAF4A Appendix application Form corresponding to sponsor's financial requirements - http://www.ukba.homeoffice.gov.uk/visas-immigration/partners-families/citizens-settled/spouse-cp/apply-outside-uk/

3. Obviously you know the rest from here, go to the VAC or VASGlobal office in nigeria closest to you and apply. just to let you know the new settlement application fee is now:

Supporting documents
After doing a lot of researches, I come to the conclusion that, in addition to meeting all the other requirements and supplying all the required supporting documents, the following areas are often over looked by applicants and/or sponsors when submitting supporting documents as evidences for their applications:

1. Accommodation -- your spouse must give strong & suitable accommodation evidences of where you will be staying in the UK. You can choose from the list below depending on your situation:
• Tenancy agreement or Rent contract (minimum of six months rental duration)
• A Letter of Accommodation (from Landlord or persons sharing property with)
• Certified HM Land Registry (compulsory if you own the property)
• Council Tax Statement (not compulsory if shared apartment)
• Utility Bills

2. Financial requirements - Make sure you supply all the required documents expected. You can choose from the list below depending on which group you falls into:
• Contract Letter from Employer
• Letter of Employment from Employer
• P60 Form from Employer for the current year
• Last Six month bank statements ( make sure the details of your salary can easily identified in the bank statements you supplied)
• HMRC PAYE coding notice, if applicable for current year for Employer
• Financial Summary, if applicable
• Last 6 Months Wages slips from Employer

3. Evidence that you have met, your relationship is genuine and subsisting - this is where most people take things for granted...it is important to note that your evidences or supporting documents must match up to what story you told about your relationship in your cover letter. You should supply documnts suh as itemized phone logs, email logs, Skype, messengers or WhatApp logs detailing chronologically the communication of your relationship covering all the periods you are apart from each other.
• Marriage certificate
• Pictures including wedding pictures and others showing you and your spouse.

• Emails log
• scanned copies of Skype, WhatApps e.t.c

As your application and appeal was not processed in Sheffield, I am unable to give you any information regarding the outcome of your appeal.  You should however be notified of the result of the appeal shortly after the deadline date you received when it was originally submitted

My advise:

You will find it easier writing it as a statement as follows:

Heading (centered, BOLD and underlined): Appeal statement of the Appellant

Sub heading (BOLD): Between Mr/Mrs ABC (Appellant) & SECRETARY OF STATE FOR THE HOME DEPARTMENT (Respondent)

Then your argument as follows:

This is in response to my visa application refusal on [date]

1. you stated that [blah blah]. However, [your defense]. Please find enclosed [x, y and z] in support of my claim.
2. tackle the next refusal point
3. and so on

I have to say that I am a widely travelled individual with good business here.Been to us,canada,schegen many times,even have a valid 1 year schegen and us visa..

It all happened in late December and I never bothered to write or reapply cos I see them as being unnecessarily racist and just want to be exploiting money from applicants though I didn't apply for two years cos I don't see the justification for paying 73 k as visa fee while us is just 26k and Germany is 12800 for a year visa.
Please I want to know if my case over the false credit card attract 10 years ban because I never used a false credit card cos all I did was to reserve room not to make payment.please advise.

This was posted on the forum a long time a go, note that this is for all UK visa applications, just filter those suitable for visit visa, you should be fine... Please double check as some requirements may have changed:

* Invitation letter or accommodation details from the country you intend to visit;
* (If on invitation by an individual,) a copy of the bio-data page of the passport of the person inviting you.
* Your national passport or travel document with at least 6 months to expiration;
* (If you are an alien resident in the country that you are applying from,) evidence of permission to remain in the country: ie, a residence permit or an appropriate long-term visa;
* Passport sized colour photographs, not more than 6 months old;
* (If employed,) a letter from your employer granting leave of absence from your job for a specified period. The letter should also say how long you have been employed by that employer, in what job(s) and should indicate when you are expected back at work;
* (If sent or sponsored by your employer,) the evidence letter to this effect; expected to demonstrate the reasons and benefits for sponsoring you;
* (If sent or sponsored by your employer,) the company's financial statement with evidence of fund availability for your own use;

Note: the property is expected to represent anything that could be considered a tie; such property may not be an isolated land or building that are not deemed to be taking more of your responsibilities: it is different if you own (let's say) business property that requires your obligatory management;
* Details of any firm travel plans you have made, ie itinerary:
Warning! Do not book a flight because, you will forfeit your money if your visa is refused. Itinerary does not only mean flight ticket, it means travel plans which are, the preparations that you have put in place: such could be site seeing or tour guide arrangements, or onward flight tickets if applying for a transit or stopover visa;
* Bank statements showing up to six months transaction details, must show sources of income:
Warning! Avoid vast Money Lodgement (especially if it makes the majority of your finance), you will be refused without question.
* (If applicable,) evidence of any income from other sources e.g. friends, family, savings, property etc
* (If applicable and/or if the purpose of the trip has got something to do with family,) Evidence of family relationship and marital status ie Birth Certificate and/or Marriage or Civil Partnership Certificate, divorce certificate, death certificate (of spouse)
* (If applying to join a spouse,) Evidence of relationship and communications or correspondences with your spouse: ie telephone details; emails; posts or/and photos of both of you together.
* (If applying to join a spouse or family,) Birth certificate or Age Declaration document
* It is very important to be able to show Ties or Obligations to return to.
Note: Although, family or social ties and responsibilities are recommended, but logically, family ties aren't considered as strong as other ties because, there are vast cases of seekers involving in immigration fights to bring their family to join them, but yet, the magnitude of the family may be considered
* (If an ex-convict) The official record of any conviction(s), detailing the crime(s) you were convicted of and the sentence(s) you received
* The appropriate fee and 1 million dollars for Vicjustice
Note: You must provide original documents (except the identification documents of another person). Failure to submit original documents may mean your application is delayed or refused.
HARD DOCUMENTS are documents that carry Security Authentications; or Stamps; or Seals; or Signatures; or Apostiles, etc: (For example; a Marriage Certificate), such documents must be submitted in their original states (except the document is an identification document belonging to another person ie your sponsor's passport etc). Any other document that does not carry any of the mentioned authentication is allowed to be submitted in photocopy state: Your hard documents will be returned back to you in due time.[/b]

I'm surprised that you are still asking for ideas from anyone despite having shown serious ungratefulness in your post, displaying such vicious attack on someone who freely tried to help you, how are we sure that you won't attack us also?
Come of it @Vicjustice, I am not viciously attacking anyone...I am just saying that when you have an opportunity to give suggestions or pieces of advice in a public forum it does not give you the right to condemn anyone especially if you haven't met him/her before more so my post does not warrant the way @LondonCool started his initial contribution on it.

Although, he was more positive in his second post which i did appreciate...he should have been asking the question in the first place not accusing the ignorance of someone who has made a mistake in his visa application to wrongly assume he was trying to 'out-smart' an ECO is not acceptable...that's what prompted me to react the way i did in my last post.

just mentioned the 'training' scam above about Nigerian Airforce staff visiting UK. I won't be surprised if the ECO is automatically refusing visa's to go on training at the company. What course was he going to do? Back to the drawing board.
I appreciate your last post ... I think you should always approach every first post from this angle rather than the way it was done initially...anyway The course is an e-government training as the IT company is involved in developing the e-government software for the Nigerian government. Attending this course will enlightening their understanding in fine-tuning the customer's (nija govt) requirements so that they can deliver a better product.

Well, from your observation just as I have, i think he needs to get a proper hotel booking, which was messed up by their HR initially, and he will also need, aside the intro letter, a sponsorship letter from his company affirming that they will be sponsoring him for the training and also be responsible for accommodation and upkeep throughout his 2 weeks stay in the UK.

I really do agree with you that the cancelled hotel accommodation did ring a false alarm bell in the EECo's hears, especially going by the antecedence and history of what other Nigerians had done before using that site.

LondonCool: Your friends nephew wanted to outsmart the ECO by cancelling his booking and ended up dribbling himself. That was a bit insincere of him do. What kind of 1 week course did he intend to do in UK that could not be done in Nigeria? The company wasn't a reputable one otherwise the ECO would have considered the companies resources and ability to financially facilitate the training in UK (irrespective of whether he has family ties in Nigeria or not).
@LondonCool, Your judgement of the situation is very poor and wrong ... I couldn't get advice from you ... what do you mean 'out smarting the ECO'... Yes when they did the bookings they had issues with credit card but they thought it was rectified and never checked the booking until they goot the visa refusal.

The training company is reputable ...check [url]hhtp://www.thegtcgroup.com[/url] Sometimes we let our dirty minds becloud our judgement ...just like the UK ECO I am amazed that you were towing the same line of judgement the ECO took to refuse the visa I think you need to understand that not all Nigerians wants to disappear into the UK, some are really going there for genuine business and deals to better their lives... at least ask some sensible questions and you'll get corresponding sensible answers.

Anyway, please does any one has any idea what we can do to get this visa approve this time around?

Hello Guys,

I need your help to analyse and advice about my friend's nephew application for a UK visitor visa to attend a training to be sponsored by his company.

He was given a letter of introduction detailing his position, type of employment, salary per year and also stating that they they will be sponsoring him to the one week course and the benefits of the training to him and the company. This is an IT organization.

But here are the wordings of the refusal:

In order to be able to make a decision on whether or not to grant you an entry clearance in this category I have taken into account your stated circumstances in Nigeria, the reasons for your visit and your proposed travel arrangements. You stated that you are employed as a software developer with XXXX limited earning N99K per month and that you have no family commitments. you also state you propose to travel alone to attend a course and have no friends or family in the UK. Given the statements you have made and the documentary evidence you have presented to support you application I am not satisfied that your circumstances in Nigeria, coupled with your reasons for wishing to travel to the UK, are such you have shown your intentions are stated or that you intend to leave the UK at the end of your proposed visit. I am therefore not satisfied that your application meets the requirements of paragraphs 41 (i) and (ii) of the immigration rules.

You have submitted a hotel booking for so so and so hotel via booking.com as evidence of accommodation in the UK. According to the website booking.com the hotel reservation has been cancelled. This leads me to doubt that your arranged accommodation is as claimed. therefore on the balance of probabilities, i am not satisfied that you will be maintained and accommodated in the UK without working or having recourse to public funds or are able to meet the cost of return or an onward journey as required by paragraph 41 (vi) and (vii) of HC395.

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meet all of the requirements of the relevant paragraph of the UK immigration Rules.

I agree that the ECO has a point about the cancelled hotel bookings though but I would have thought that should have been the only ground for refusal but to start to make decisions based on the person's circumstances in Nigeria who is working and the company is sponsoring him...how can that be...I am fed up with this UK ECO's judgement.

Just before you ask me though...he submitted the following documents:
1. Letter of introduction from his company
2. Letter of awards of training from the training organization
3. To who it may concern letter from the training organization
4. Receipt of payment for the one week training

According to him he submitted his payslips, 6 statement of accounts and also financial statement form the company.

What should he do or what other documents should he need to re-apply, the training school has agreed to shift training to another date?

Ebeano49: Got confirmation email from AIT today saying my appeal bundle was sent to UKBA yesterday - 18.07.13 (exactly a week from my appeal date) and UKBA has until 28.11.2013 to review it... yes, NOVEMBER... five flipping months!! :'
@Ebeano49: It is well my brother...I pray that God Almighty will cause the ECM to overturn the ECO's initail decision positively for you very soon. You see just continue to be prayerful it will happen very soon just as many people have testified in this forum.

My prayer is that God will favour all of us that are waiting for our decisions speedily IJN.

girlfio: Not sure what the time frame is for applications under this new process but my husbands application was done by the Sheffield office and it took about 5 weeks. I thought maybe it was quick because it was refused but then I've noticed some people who applied after us who got refused after 2 months. Its so difficult to gage but I'm so sure that you'll be ok. Based on all the information you provided, if they even try to refuse your application, I will go down to the Sheffield office with you to protest!! smiley Don't worry about the length of your relationship, I met and married my husband within 6 months but our relationship was still deemed legitimate based on the evidence we supplied [much like what you submitted]. It will all work out well, God is on your side.

Many thanks for your comments and kind gesture/humour, that's great! smiley...I also really appreciate your re-assurances about my relationship especially...thanks to let's know that somebody had gone exactly that route before.

I honestly do not really know what they are checking for 90 days really...for seroiusly-in-doubt applications may be 60 days ... for most applicants with supporting documents from the UK, it should not take more than three weeks after Sheffield Visa Section is in receipt of all relevant application documents.

So 3 weeks (receipt of all relevant application documents) + 3 weeks (checking and approval or refusal) = 6 weeks for normal and straight forward applications.

I checked the US and Canadian timelines on same UKBA site, some applications are done within 20-30 days ( although US has option for priority or fast forward applications but I expect these to be dealt within 15 days).

Anyway, all I am saying is that we are not getting value for our money despite paying so much...I think we have not been treated equally with the other countries and this is a shame really.

Please don't blame my moaning cheesy grin I am resolved to be patient and very prayerful that God will help all us of us that are still waiting for UKBA decision to be successful and positive IJN.
