The global oil tanker association has dared Nigeria’s president, Muhammadu Buhari and the Nigerian National Petroleum Corporation (NNPC) over the ban on oil tankers. The body, in a letter of protest, stated that a ban on 113 oil tankers by the NNPC must be lifted by the Nigerian leader immediately as no grounds have been given for the measure. This protest is coming following a letter issued by the NNPC on July 15, where it cited a directive from president Muhammadu Buhari, in which the vessels, mainly VLCC crude oil tankers, were banned from calling at Nigerian crude oil terminals and also from Nigerian waters with immediate effect. But according to PM News, INTERTANKO, whose independent members own the majority of the world’s tanker fleet, said in a letter to NNPC, dated July 22, that there were no “evidence or grounds” given for the ban. “INTERTANKO protests in the strongest possible way that these bans should be lifted with immediate effect until grounds and evidence for the ban have been given to each vessel and vessel owner/operator, and the owner/operator has had an opportunity to respond,” General Counsel Michele White was quoted to have written in the letter. Buhari had been working to fulfill a campaign promise to tackle corruption, particularly in the oil industry and has since, assuming office in May, 2015, dissolved the NNPC board and ordered an investigation into a scheme through which the country swaps crude for oil products such as gasoline. A Federal High Court in Lagos has voided the powers of the Federal Road Safety Corps (FRSC) to impose fines on motorists for traffic offences. Justice John Tsoho held that the FRSC could not turn itself into a court of law by punishing those who commit traffic offences. A lawyer, Tope Alabi, had approached the court to declare that only a court of competent jurisdiction could pronounce a person guilty under Section 10 (4) and 28 (2) of the FRSC Act 2007. Other defendant in the suit was the Attorney General of the Federation. A copy of the judgment made available to newsmen in Lagos on Wednesday quotes Justice Tsoho as declaring the sections null and void for being inconsistent with Section 6 of the 1999 Constitution. The judge also awarded N1 million damages in favour of the plaintiff because officials of the FRSC had confiscated his vehicle and driver’s licence. According to him, while FRSC was statutorily empowered to arrest and fine traffic offenders, a closer look at the definition of the word “fine” means a pecuniary criminal punishment or civil penalty payable to the public treasury. Justice Tsoho said: “In the instant case, however, the involvement of the element of arrest takes the imposition of fine by the FRSC to the realm of criminal punishment. “From these definitions, it is obvious that the act of sentencing is a judicial action or exercise, and imposition of fine connotes conviction for an alleged offence. “It is thus very clear that the FRSC, not being a court of law, cannot impose fine, especially as it has no powers to conduct trial. “Hence, the exercise of the statutory powers given to the defendant under the Act as pertain to imposition of fine is clearly a usurpation of judicial powers exclusively vested in the courts. “In the circumstances, I endorse the plaintiff’s submission that by virtue of Section 1(3) of the Constitution, the power to impose fine conferred on FRSC by the enabling Act is null and void to the extent of its inconsistency with the Constitution,” the judge held. Besides, Justice Tsoho held that the FRSC resorted to “legislative absurdity” when it imposed a fine of 3,000 on the plaintiff, rather than the N2,000 statutorily prescribed. “FRSC’s function should not go beyond issuance of mere notices of offence. “It is a cardinal principle of natural justice that no person can be condemned without being heard. “It is in observance of this that a person alleged to have committed an offence has to respond to such allegation before a court of law during trial,” he said. According to the judge, the plaintiff was issued a Notice of Offence Sheet on April 4, 2013, but FRSC did not take him to court for five months before the plaintiff filed his suit on Sept. 9, 2013. “The vital question to ask is how long would it take the FRSC to reasonably commence prosecution of a traffic offence? “The plaintiff was not under obligation to wait indefinitely for redress due to FRSC’s inaction or laxity,” the judge added. “I hold the view that the confiscation of the vehicle was unnecessary in the first place, though the FRSC spiritedly sought to justify it.” The judge then granted 11 of the 14 reliefs sought by the plaintiff, adding that he also awarded N1million in his favour instead of the N10 million prayed for. US names Nigeria's Boko Haram and Ansaru'terrorists' Boko Haram militants have been blamed for a series of deadly attacks in recent years The US has designated Nigeria's Boko Haram and Ansaru militant groups as foreign terrorist organisations. The state department described the move as "an important" step to help Nigeria "root out violent extremism". It means US regulatory agencies are instructed to block business and financial transactions with the groups. Boko Haram wants to impose Islamic law in northern Nigeria, and has been blamed for thousands of deaths. Ansaru is seen as an off-shoot of Boko Haram. Boko Haram began its insurgency in 2009, and targets both the military and civilians, including schools, and frequently clashes with the Nigerian armed forces. Ansaru was formed in January 2012, though it rose to prominence only about six months later through the release of a video in which it vowed to attack Westerners in defence of Muslims worldwide. The group has proved to be a formidable threat during its short existence, using dynamite to penetrate heavily-fortified compounds and taking foreigners hostage. Atrocities claim In a statement, the US state department said Wednesday's "designations are an important and appropriate step". But it stressed that this was "only one tool in what must be a comprehensive approach by the Nigerian government to counter these groups". Again, NCC Fixes New Date For Mobile Numberportability Launch The Nigerian Communications Commission (NCC) has again fixed another date for the launch of Mobile Number Portability (MNP). This time, the commission chose April 22 as the new launch date across all networks of Global System for Mobile Communication (GSM). The Director of Corporate Affairs at NCC, Mr. Tony Ojobo, who dropped the hint Thursday, told THISDAY in a telephone interview that NCC eventually settled for the April 22 MNP launch date, having been convinced by the network operators that their networks were ready for the roll out of Mobile Number Portability in Nigeria. “We are going to celebrate it in a colourful launch that will hold in Lagos on April 22,” Ojobo said. NCC had earlier warned that it was not going to shift grounds on the planned roll out of MNP, and insisted that the roll out must be in April this year, without mentioning any particular date in April. The reason for not fixing a particular launch date earlier, according to Ojobo, was to allow the operators to choose a convenient date, based on the state of readiness of their networks. He had however insisted that the roll out of MNP would not exceed April this year. NCC had fixed April 1, for the launch of MNP, but shifted it to an unknown date in the same month of April, after telecoms operators came begging for three weeks extension to enable them complete test-run of their networks, in preparation for the eventual roll out. NCC had in 2006, announced for the first time that it was going to implement MNP, but it was not implemented, as telecoms operators resisted it on the ground that the network infrastructure as at then, was not robust enough to accommodate the challenges associated with mobile number porting. In 2009, NCC re-introduced Mobile Number Portability and again the operators turned it down, giving the same reasons. In 2012, NCC gave December 2012 as deadline for operators to commence the exercise, but they reluctantly agreed yet they could not meet the deadline. In January, NCC fixed March 25, as the new date for the commencement of MNP, but again, telecoms operators were unable to meet up with the March date, a situation which compelled NCC to further shift date to April 1. Having discovered that the April 1 date was not going to be feasible, NCC Thursday, announced April 22 as the new date for the launch of MNP. In technical parlance, Mobile Number Portability is a process that allows subscribers to migrate from one network to another, in search of better quality of service, while still retaining the original phone number, irrespective of the network the subscriber chooses to migrate to. Amid poor service quality that has continued to bedevil the telecoms sector, the federal government has backed the initiative of the Nigerian Communications Commission (NCC) to commence number porting across the GSM networks today. The Minister of Communications Technology, Mrs. Omobola Johnson, told THISDAY that Mobile Number Portability (MNP) would give subscribers the choice to select networks that offer best telecoms services, insisting that Nigerians have to embrace it, since it was the best option in a bad situation. “We are going ahead with MNP because it will increase competition in the industry. It, however, does not stop the service quality issue because we have a nationwide service quality issue, which cuts across networks. We are doing a lot of other things to improve telecoms service, by creating an enabling environment for network operators to rollout infrastructure, and reduce bottlenecks on right of ways, wilful destruction of telecoms facilities, among other measures,” Johnson said. Confirming that it would commence the exercise today, the Head, Public Relations at NCC, Mr. Reuben Muoka, told THISDAY that all was set for full implementation of MNP across GSM networks. According to him, “all the GSM operators are ready and NCC is set to rollout the service, which is long overdue.” He, however, said operators of Code Division Multiple Access (CDMA), like Visafone, Capcom, and Intercellular, would not be part of the exercise at the moment, because of the different technology that they operate. He said NCC would begin with GSM operators, and later include the CDMA operators, if that of the GSM operators became successful. The Corporate Services Executive at MTN, Mr. Wale Goodluck, told THISDAY that MTN was fully ready for MNP, owing to its nationwide modernisation exercise, which he said, had improved service quality to some extent, even though the project is ongoing. He was optimistic that MTN, just like other GSM operators would not experience any hitch in the takeoff of the exercise.
