There was serious drama between the Governor of Bayelsa State, Henry Seriake Dickson and supporters of Chief Timipre Sylva, leader of the All Progressives Congress (APC), in the State when leaders of the Niger Delta were meeting with President Muhammadu Buhari at the Presidential Villa Abuja on Tuesday.

Governor Henry Seriake Dickson who accompanied the leaders of the region to the villa to dialogue with the President on the need for a workable template in drifting away from its present situation.

NEXTNEWSLIVE.COM gathered, the drama started when Dickson was embarrassed by a youth leader and Niger Delta Activist, Sir Jonathan Lokpobiri at the Presidential Villa for laying frivolous allegations against Ex- militant leader Paul Eris popularly known as Ogunboss to the Service Chiefs in an attempt to launch a coordinated attack on him.

We gathered the APC stalwarts from Bayelsa State were furious at Dickson’s move to nail the Ex- agitator at the villa.

Our sources reported that Dickson was more than embarrassed when Hon Famous Daunemugha added more fuel to the fire started by Sir Lopkobiri by attacking Dickson and putting up a strong defense for Gen Ogunboss and was supported promptly by Brigadier-General Paul Tarela Boroh, Special Adviser to the President on Niger Delta and Coordinator of the Presidential Amnesty Programme who is also from Bayelsa State.

Recall, there have been a standing battle between Governor Dickson and Gen Ogunboss who’s loyalty to Chief Timipre Sylva appears to be unshaken.

When contacted, youth leader Sir Lokpobiri confirmed the incident and said it was unfortunate for the governor to have labeled an innocent and peaceful man who’s sole aim is to ensure peace return back to the Niger Delta.

"He couldn’t believe what we did right in his presence.

"We told the National Security Adviser (NSA) and the Service Chiefs right in his presence that he was lying against the innocent young man.

"Thank God the Inspector General of Police (IGP) was also around when it all happened

"We couldn’t bear the pain especially when he was giving Ogunboss’s details to the NSA and Chief Of Army Staff.

"He was so embarrassed especially when Gen Boroh also supported us promptly and openly confirmed that He was lying against Ogunboss.

"I’m so grateful to God for giving us opportunity to tackle him immediately,” Lokpobiri said.

Reports reaching us now has it that Doctors under the aegis of Association of Resident Doctors, Federal Medical Centre (FMC), Yenagoa, Bayelsa State are on the streets protesting.

NEXTNEWSLIVE.COM gathered the doctors grievances for taking to the streets in Yenagoa ranges from payment of 4months 50% shortfall of salaries due them which has consequently caused unimaginable difficulties in the harsh recession affecting the country.

Other cogent reason for their protest is that, FMC Yenagoa is the only Federal Tertiary Hospital in Bayelsa State which they said will cause crisis that will result to high mortality rate if no intervention from the Federal Government Of Nigeria to rescue the situation.

YENAGOA ———Early morning fire raised down the Etegwe home of Hon. Nimbofa Ayawei, Chairman Bayelsa State Revenue Board and owner of DANIELLO PULO, a fuel filling station along the Sani Abacha Expressway by Etegwe.

The fire claimed the life of his first son and a lady believed to be his fiancee while two others managed to escape through the window.

Although the exact cause of the inferno is yet to be ascertained but eye witnesses believed the fire may have been caused by electrical fault as the incident occurred about 4am, almost same time the light was brought.

My independent findings around the premises revealed that the inferno may have started from the last floor of the one story building, spreading to all other parts of the building without engulfing the DANIELLO PULO, the fuel filling station right in front of the residential building.

The corpses have been taken to the Yenagoa morgue of the Federal Medical Center as at the time of filing this report.

However, Hon. Nimbofa Ayawei could not be reached for comments as he is said to be not too sound in health for number of days now.

Section 148
A search warrant may be issued and executed at any time on any day, including a Sunday or public holiday.

149 (1)
Where any building, thing or place liable to search is closed, a person residing in or being in charge of the building, thing or place shall on demand of the police officer or other person executing the search warrant allow him free and unhindered access to it and afford all reasonable facilities for its search.

149 (2)
Where access into the building, thing or place cannot be obtained, the police officer or any other person executing the search warrant may proceed in the manner prescribed by section 9, 10, 12, and 13 of this Act.

12 (2)
Where access to a house or place cannot be obtained under subsection (1) of this section, the person or police officer may enter the house or place and search it for the suspect to be arrested and in order to effect an entrance into the house or place may break open any outer or inner door or window of any house or place. Whether that of the suspect to be arrested or any other person or otherwise effect entry into such house or place if after notification of his authority and purpose and demand of admittance duly made, he cannot obtain admittance.

I have read several articles and comments alike about the proprietary or otherwise concerning the DSS raid and arrest of some members of the bench on the 8th of October, 2016. What bothers me is not just the vague arguments and laws cited, but us being so naive to even think we can comfortably cloud our eyes to due process, injustice and despotism especially while we are in a democratic platform.
So many people have cited laws and have even borrowed precedents from other sovereign state, all in a bid to play the devil’s advocate and screw deeper some justification just to back up their misconceived views.
Falling to understand the key issues in this matter has no doubt create the gap for this unnecessary laws and precedents cited by so many contributors. As such I would be drawing the vital issue here for determination. Which are as follows.

i.) Whether the DSS or other security agency alike in Nigeria has the disciplinary powers to discipline Judicial Officers?

ii.) Whether the actions of DSS qualifies and or can be condone as an investigative attempt?

A proper understanding of these issues, settles the disputes in this matter.

As for issue one.


It should be noted that the Constitution in Section 153(1)(i) and Part 1 of the Third Schedule thereto establishes the National Judicial Council (NJC) and empowers same to regulate and discipline judges across the Country.
Section 21 of Part 1 of the Third Schedule which specify the powers of the NJC, states in paragraph (b) and (c) in effect that the National Judicial Council shall have power to recommend to the President or Governor (depending whether it has to do with the federation or a state) the removal from office of a judicial officers, and to exercise disciplinary control over such officers.
That provision is no doubt a clear case of checks and balances as between the Executive and the Judiciary, so as to curtail the arbitrary use of power by either of the arms.
To this end, the proper path to follow to discipline any erring judges will be to forward a petition containing any wrong doing to the NJC along with any evidence in support thereof. Which the NJC shall react on it accordingly.
Though the actions of the DSS doesn’t amount to being disciplinary or removal, since they lack such capacity.
However, it should at best be seen as a direct assault and battery to our democratic existence. It’s not only a Ceaser’s stab to our sacred doctrines of Separation of Powers and Checks and Balances, but a dead pool to strict negation of following due process.
Aside the fact that, it is unprecedented all through our existence as a nation, not even during the dreadful era of the military regime.

Or could the actions of DSS qualify as an investigative routine? This will lead us to addressing the second issue.

Though, just like many may tempt us to perceive, that the actions of DSS should at best be seen as an investigative attempt. I will urge us to resist such temptations and call a spade by its name. Going by the functions and duties of the DSS as contained in the National Security Agency Act. It is submitted that their functions deals with actions that mainly threatens the external and internal security of Nigeria. Consequently, since according to the press release issued by them on the 8th of October, 2016, it wasn’t the case that these Judges were involved in any actions that threatens our national security either external or internal like harbouring of terrorists and the likes. It is submitted that the proper body to carry such investigation should have been the EFCC, ICPC or even Nigerian Police.
Also the force applied and the nature of the circumstances in place, points differently for use to conclude the actions of the DSS as an investigative attempts. This is due to the fact that the spanned detention itself by DSS is uncalled for. Having a coordinated interview and, or an authorised search would have been proper in a civilized setting anchored on the tenets of democracy. But that wasn’t the case here.

With the foregoing, it is material to note that citing section 148 and 149 of the Administration of Criminal Justice Act, so as to justify whether the arrest is proper or not, was far too unnecessary.
Also, it is quite unfortunately lame, that other contributors are making use of precedents of same raiding in other climes like in the United State to justify what happened in Nigeria.
It should be noted that, United State is United State and Nigeria is Nigeria. Our laws and that of United State are not the same. While that of our laws have established a body to attend to matters as these nature, the laws of that of other clime may call for a direct arrest by the police and immediate prosecution, but ours doesn’t.
This is the very reasons we call on the Presidency being the Commander in Chief of the arm forces, and the DSS to abide on due process, as the actions taken is unconstitutional, bereft of legal backings and grossly undemocratic. It is highly condemnable, as the independence of the Judiciary must be protected at all times, and not discouraged, threatened, bullied, nor jeopardize.

OP, you are on point.

Any security agency can be tasked/empowered by the president to arrest any criminal. Even in the United States, the greatest democracy, SSS, FBI etc arrest judges who involved in bribery and corruption. See below:

Trashy article hastily put together!! Sting operation indeed!!! Why don't they go to Sambissa and conduct their sting operation there. It seems you don't know the horror of having armed men surround your home in the dead of the night. So many things'd be going through your head: are these robbers, has there been a coup, Fulani herdsmen, or worse still kidnappers??.
The executive has really goofed up this time and they need to be called out. Mind you, this is not the DSS's first time of conducting such gestapo operations.

Last year, they invaded Akwa Ibom's govt house.
This year they invaded Ekiti's State House of Assembly.
And now invading judges' home in the middle of the night.


Look, we aren't saying the judges aint corrupt. If convicted, I don't care if they spend the rest of their lives in Kirikiri. All we are saying is that the rule of law must be upheld and duly followed. No one is above the law...not me, you, the judges, DSS or even Mr Buhari.

The best the executive should have done is to push for judicial reforms. If the bench is corrupt, fine go ahead and push 'anonymous' wiretaps, video recordings and other evidence before the public domain...and see what will happen.
No matter how correct this DSS arrest is, some persons will never accept it because it is difficult for one thief to crucify the other. I feel your pains jor grin

In recent times, what has been trending on the news is the arrest of Justices of the Supreme Court and other judges. As usual, the action of the DSS has sparked off heated arguments about the justness and unjustness of the act. It is my submission that the DSS, by arresting the Judges, in that manner, is not outside the armbit of the Nigerian Jurisprudential boundaries.

Although the NJC is the institution mandated for the discipline of judges, it has slept on that constitutional responsibility, either as a result of being overwhelmed by the corruptness of the system or by feeding fat from it. It could be justifiable for the DSS to help them put its house in order, and as such, they should not cry over that which they have brought upon themselves.

"The question now will be whether in the circumstances, the arresting agency should have followed the laid down procedures of inviting the judges"

The answer would be that although Politically Exposed Persons (PEPs) and VIPs are usually to appear before investigating agencies, the DSS has made it clear that it was a sting operation. We must note that, this is one of the derogations to the Right to personal liberty. (See Section 35(1)(c) and (f) CFRN 1999). And so, the action of the DSS becomes constitutional by the express provisions of these sections,thus,mooting the option of adherence to the procedures of invitation or procurement of an arrest warrant from a court of competent jurisdiction.

Public policy will also favour the act of the DSS as it has reposed some level of confidence in the citizenry regarding their hope in the Judiciary.

It is instructive to note that the "Sting Operation" was not carried out against the office of the judges but against the individuals occupying and abusing that office. It is also to be noted that by the act of the DSS, the supremacy of the Nigerian Constitution has been restated, so also is the immortal words of Thomas Fuller, over 300 years ago "Be ye howsoever tall, ye are never taller thañ the law".

I therefore suggest that, state of emergency be carried out on the NJC, NBA and the Bench as a whole.

Investigation by the DSS on this case will reveal all those who aided, abetted, by omission or commission in any way possibly, to the rot in the system.

That anyone found to have aided or abetted in any way possible, be relieved of his work to face prosecution and possibly, conviction. Including the Justices.

This way, cold shivers will run down the spine of other government officials and sanity will yet again return to the system.

YENAGOA —–The Governor of Bayelsa State, Henry Seriake Dickson has approached the the State House of Assembly seeking to pass a bill to empower him pay fifty percent (50%) salaries across board.

NEXTNEWSLIVE.COM gathered that, the said bill has thrown the house into serious confusion and this time even among members loyal to the governor.

A PDP stalwart from Southern Ijaw local government area of the state who spoke in confidence said, the move by Dickson has infuriated a ninety-five percent (95%) dominated house of assembly.

The source further revealed that, eleven (11) out of the twenty-four (24) members has accepted to help push the bill for fear of falling out with the governor while the other thirteen (13) are still not in agreement to a move that will worsen the already suffering civil servants.

She further expressed sadness over what she called "an act to perpetually impoverish civil servants who would be imprisoned for the next four years.”

Governor Dickson if given the nod by the state house of assembly will be paying civil servants half salaries through out his tenure without questions from any worker as he would be backed by law to do so.

Recall, governor Dickson has been paying workers in the state half salaries for more than six months with paucity of funds as reason pending when the economy allows payment of full salaries.

As Bayelsa clocks 20, there is need to access critically, Bayelsa state power sector under the Dickson Seriake Henry administration.

The power sector yet another celebration of mediocre achievement by the Restoration administration.

I have refused to let the mood of the Bayelsa state celebration becloud my sense of judgement and reasoning like many.

It was the Marxist who postulates that “in the grip of political psychosis, truth, reason and common reason give way to instinct, passion and emotions”. The above statement coming from the Governor in the wake of the 2015, December 5 election is a pungent indictment that his administration is a failed one in respect to power supply in the state. It was also a sad apriori that the sector was omitted in the second term agenda of the Occupier of CREEK HEAVEN.

The Governor was quick to forget that the microphone he used in taking advantage of Bayelsans credulity was possible because it was powered by a generator plant and not government's electric power, solar or mill power.

Poor electricity supply has cost the state a lot. Large and small scale businesses have closed shops. The polythene industry has gone moribund. Grave power deficit and cost of alternative power sources, accounted for relocation of few industries that came to the state during the twilight of Alamieyeseigha's administration.

Five years after giving Governor Dickson our mandate, Bayelsans are still paying for darkness courtesy, the national grid.

Every Nigerian state, Local Government or community is expected to be connected to the National grid, but where need be as an Oil producing state, the need to liase with corporate bodies such as Shell, Agip, Texaco etc that are domiciled in Bayelsa state to convert the flaring gas electricity as an alternative for the benefit of the masses for the state where all communities are expected to benefit, for example the Kolo Creek gas turbine, an initiative of Chief Melford Okilo supplied light in the whole of Ogbia, Southern Ijaw, Yenagoa and some parts of Sagbama Local Government Areas without necessarily connecting them to the national grid is an epitome of good government.

However, this noble project is seemed to be abandoned by the present administration and has kept the erstwhile benefiting communities to perpetual darkness.

We cannot overemphasize the importance of electricity (power supply) and the impact it can have in boosting our economy.

Bayelsa state is paying an exorbitant amount in electricity taxation without necessarily getting the dividends of such nefarious taxation.

One sad commentary about our current administration experience is the wanton glorification of responsibility and irresponsibility as dividends of democracy.

In saner climes, the performance of a Leader’s statutory obligations and constitutional functions such as Staff welfare, Community welfare and Institutional strengthening do not constitute achievements (or giant strides as we say here). It is a Leader’s capacity to craft and fashion out a vision that will manifestly translate into the total liberation of his subjects from the interlocking clutches of poverty, socio-economic exploitation, geo-political domination, ethno-cultural dislocation as well as a neo-fascist enslavement implanted by past years of myopic and tyrannical leadership (the Bayelsa story for the past nineteen years) that constitute what is known as achievements in office.

How can a governor boast of connecting his state to the national grid which is a necessity an achievement? Such can only happen in a state where people cannot demand for the basic things of life from their leaders

It is only special when we go outside the national grid inorder to provide electricity for us.

Experience does not count in governance, what matters is ideas which Dickson is bereft of. While he puts on the plant at Gabriel Okara culture centre on October 1, I will suggest he leverage energy sources such as coal, solar, gas, hydro, biomass and others to lift the power sector growth and sustainability.

Every Nigerian state, Local Government or community is expected to be connected to the National grid, but where need be as an Oil producing state, the need to liase with corporate bodies such as Shell, Agip, Texaco etc that are domiciled in Bayelsa state to convert the flaring gas electricity as an alternative for the benefit of the masses for the state where all communities are expected to benefit, for example the Kolo Creek gas turbine, an initiative of Chief Melford Okilo supplied light in the whole of Ogbia, Southern Ijaw, Yenagoa and some parts of Sagbama Local Government Areas without necessarily connecting them to the national grid is an epitome of good government.

However, this noble project is seemed to be abandoned by the present administration and has kept the erstwhile benefiting communities to perpetual darkness.

We cannot overemphasize the importance of electricity (power supply) and the impact it can have in boosting our economy.

Bayelsa state is paying an exorbitant amount in electricity taxation without necessarily getting the dividends of such nefarious taxation.

One sad commentary about our current administration experience is the wanton glorification of responsibility and irresponsibility as dividends of democracy.

In saner climes, the performance of a Leader’s statutory obligations and constitutional functions such as Staff welfare, Community welfare and Institutional strengthening do not constitute achievements (or giant strides as we say here). It is a Leader’s capacity to craft and fashion out a vision that will manifestly translate into the total liberation of his subjects from the interlocking clutches of poverty, socio-economic exploitation, geo-political domination, ethno-cultural dislocation as well as a neo-fascist enslavement implanted by past years of myopic and tyrannical leadership (the Bayelsa story for the past nineteen years) that constitute what is known as achievements in office.

How can a governor boast of connecting his state to the national grid which is a necessity an achievement? Such can only happen in a state where people cannot demand for the basic things of life from their leaders

It is only special when we go outside the national grid inorder to provide electricity for us.

Experience does not count in governance, what matters is ideas which Dickson is bereft of. While he puts on the plant at Gabriel Okara culture centre on October 1, I will suggest he leverage energy sources such as coal, solar, gas, hydro, biomass and others to lift the power sector growth and sustainability.

Military era mentality may never leave this country.
I'm beginning to foresee a future whereby when everybody completely forgets there was once a military rule the military would usurp the democratically elected government of the time, resetting the people's way of thinking back to the pre-democracy era.
We sometimes wonder if there's actually some kind of difference between military way of rule and the way some Democratically elected leaders behave presently in this country.

They are several criticisms on social media about the first lady giving birth to these babies saying it was stage managed as he was not carrying any pregnancy few months ago but surprised to hear that she gave birth to not only one but four.

Fresh reports reaching us shows that, those carrying out unwarranted attacks and making mockery of the recent “good news” recorded by the Bayelsa State government may soon be cooling off at Okaka prison, in Yenagoa.

Recall, wife of Governor Henry Seriake Dickson of Bayelsa State, Dr Rachael Dickson on Friday gave birth to quadruplets in the United States of America after several years of marriage.

NEXTNEWSLIVE.COM gathered from a reliable sources who is an integral part of the Restoration government in Bayelsa state said the mockery and unwarranted attack on Dr Rachael and her new born babies is becoming unbearable and has to stop henceforth.

The source who pleaded to be anonymous said children are gift from God and it was unnecessary to make fun of the situation irrespective of our political affiliations and differences and assured that if this continue, those who have made it an habit to carry out their mockery campaign on the first family in Bayelsa State to the social media will soon be doing so at the famous Okaka prison in Bayelsa State.

"When one or two culprits are arrested and detained at Okaka prison, the rest will be history and they will let Her Excellency and her babies be in peace,” the source said.

Dr Rachael Dickson who was made First Lady of Bayelsa State in February 2012 during her husband’s first tenure recently travelled to have her first baby in the United States of America.

Okaka prison in Bayelsa State has been a major hammer used in silencing opposition critics in recent years by the present administration and from our revelations concerning First Lady and her children, more persons are expected to be thrown into it soon.
