WITH the official backing of President Muhammadu Buhari, the Economic and Financial Crimes Commission (EFCC) is set to grill suspects linked with the $16billion failed power projects. Twenty suspects, among them, two ex- governors, three former ministers, a former chairman of a bank and an ex- aviation chief, will be invited by the anti – graft body to say all that they know about the projects. Also to be grilled are 17 companies linked to the projects. The projects were executed during the administrations of ex-President Olusegun Obasanjo, the late President Umaru Yar’Adua, ex-President Goodluck Jonathan and the first term of President Buhari. But those in charge of the projects said $8.58billion was actually allocated between 2005 and 2018. The breakdown is as follows: $2.2billion from 2005- 2007; $600million in 2008; about $5.37b from 2010/2011 to date; $150m-$200m made available to NNPC by CBN; and about $80million for Ibom Plant. The EFCC however insisted on following the cash to know if the NIPP projects were overpriced and whether or not there was either embezzlement or diversion of the cash meant for power projects. A special team has been raised by the EFCC and all documents from relevant Ministries, Departments and Agencies (MDAs) have been obtained. “The EFCC has received the backing of President Muhammadu Buhari to probe the power projects by following the cash to ascertain alleged overpricing of the projects; payments for job not done and whether or not there was embezzlement of funds or diversion to private accounts, “ an EFCC source said yesterday. “We will take about 20 key people who were involved in the execution of some of these projects. We have also shortlisted about 17 companies for investigation. “There are two former governors from the South-South, a former chairman of a bank and a former chairman of an airline whose companies have been implicated. “After hearing from those short-listed, the Special Team of the EFCC will also have the opportunity to visit the sites of some of these projects to ascertain the completion or otherwise of some of these projects,” he said. He said the investigation is not targeted at any individual but “to uncover alleged underhand deals which dotted the projects and to verify if the projects awarded were executed or not.” “Where there are allegations of mismanagement or diversion of funds, we will fish out those behind it. We will start inviting some of the key players in the next few days and weeks,” he added. The anti – graft official said a report of the House of Representatives Ad hoc Committee on Power Probe, headed by the current Minority Leader, Hon. Ndudi Elumelu explained in details cash withdrawal from the Excess Crude Account (ECA). “Go and read the report, you will see that beyond the surface dressing or claims by some officials in charge of these projects, there were some alleged shady aspects. “We will be as open-minded as possible and allow all those concerned to clear the air as much as possible, “ he said The Elumelu report said in part: “From the oral and documentary evidence, it was clearly established that the total expenditure in the power sector during the period 1999-2007 was US$13, 278,937,409.94billion. “Indeed, had the supplementary budget of the power sector in 2007 been implemented, the expenditure could then have been over $16billion reported by the Speaker of the House of Representatives. “There are also unfunded commitments to the tune of US$7.265billion for NIPP projects as at May 29, 2007. “There is another US $1billion for PHCN capital projects awarded between 2000 and 2007, which have been captured in the 2008 Appropriation Act. “Additionally, the total commitment of the NNPC and its Joint Venture partners(of which the Federal Government, through the NNPC has an average of 51% interest) towards IPP power plants, gas sources development, gas transmission and metering of JV IPPs, PHCN power plants and NIPP power plants, according to the submission of the acting GMD of the NNPC is US$7billion, out of which about US$1.62billion has been expensed, leaving outstanding commitments of over US$5.5billion out of which the Federal Government will provide about US$3billion. “Recognition of these unfunded commitments would bring the total (funded and unfunded) FGN expenditure commitments in the power sector to over US$24.5billion between 1999 and 2007. “From the assessment done during the Committee’s tour of the project sites, it is safe to conclude that no meaningful progress was made in the execution of power contracts. “It is curious and quite strange that officials rush to pay contractors in full even before engineering design for the projects have been completed and approved. “NIPP contracts were not only overpriced in comparison with PHCN contracts, they are also wide off the mark when viewed against comparable power stations in several parts of the world. “A comparable review of the cost of power installations in varied regions of the world such as South Korea, Saudi Arabia, U.S.A, Taiwan, Hong Kong, Mexico and Chile showed that $10billion could have built plants to produce between 5,000 to 6,000 MW of electricity. But this amount failed to do so in Nigeria. “Unfortunately, all NIPP payments were made without following Due Process. In its place, a process called ‘Waiver of Due Process Certification for Payment’ was adopted in flagrant disregard of Due Process Policy, thus paving the way for dubious and highly risky payments to contractors and consultants by the Federal Government of Nigeria. “The committee found hard and widespread evidence of systematic over scoping of projects in order to inflate costs both in PHCN and NIPP. “At least 15 transmission lines and substation projects have been identified. For example, the New Haven-Ikot-Ekpene 2x330kv Double Circuit Line was over-scoped by 49% whilst the Afam-Ikot Ekpene 330kv line was over-scoped by more than 100%. “The estimated aggregate cost inflation identified so far for transmission projects is over N20billion and this is recoverable from contractors. “A clear example of project cost inflation is the proposed supply of 9No GE frame 9 gas turbines and auxiliaries at the cost of N185billion($1.55billion) awarded to Rockson International. “In comparison, it is noteworthy that GE supplied 18No turbines of similar specification previously at about $404million, including cost of Technical Assistance (TA) services and Long-Term Service agreements (LTSA). The implicit cost inflation on the nine additional turbines and associated services exceeds $1.145billion. “Another example is the costing of the so-called change-order provisions for Alaoji Power Plant (Phase I) at a highly-questionable amount of US$123million. “NIPP Distribution EPC contracts were awarded at costs averaging about 10 times the norm when compared to PHCN contracts costs for similar projects in the past five years. This 1,000% cost inflation of the NIPP Distribution EPC work scopes translates to an aggregate overpricing of over N50billion.” Somebody who was involved in the project but does not want his name in print , said: “We only hope EFCC will be fair to appreciate the fact that those who implemented these projects were patriotic. “The first premise the EFCC must focus on is the fact that no $1billion was released by the Federal Government. “Between 2005 and 2018, the projects gulped about $8.58billion including $2.2billion from 2005- 2007; $600million in 2008; about $5.37b released from 2010/2011 to date; $150m-$200m made available to NNPC by CBN; and about $80million for Ibom Plant. “In 2007, a former Accountant-General of the Federation said $2.2billion was released for the NIPP projects. “The $8.58billion was allocated as follows: *About $4.4billion—Power Plants (5,000MW) at less than $1m per Megawatt *About $2billion for Transmission Lines *About $1.5billion for 350 distribution projects *$600million -$700million for gas pipelines *$80million loan from the Excess Crude Account (ECA) for Ibom Power Plant which resulted in an interest-free debenture “The EFCC’s probe is a welcome development because it will afford Nigerians to know the truth about the power projects. Some of the projects being commissioned by the Buhari administration are parts of the projects. “As a journalist, you can do a Google Search, you will realize that some of these projects have been completed and commissioned because government is a continuum, “ he said. Buhari vows to probe power project contracts Buhari while campaigning in Yenagoa, Bayelsa State in February for re-election, vowed to probe the $16bn allegedly spent on failed power projects. Government, he vowed, would recover the money and expose those behind the scam. He mentioned no name. He said: “The previous government mentioned on their own that they spent $16bn on power but you are better witnesses than myself. “Where is the power? Where is the money? According to Premium Times, Nigerian soldiers manning a checkpoint in Adamawa State have intercepted six mine resistance vehicles that seemed to have been transported into Nigeria without due process. The military personnel, attached to the Nigerian Army 23 Armoured Brigade in Yola, seized the equipment in Fufore Local Government Area this week. The Nigerian Army could not immediately verify the ownership of the equipment, where they were being shipped from and their destination, PREMIUM TIMES learnt from military sources. Although the Nigerian Army headquarters has directed an urgent investigation into the discovery, the equipment have been handed over to the Nigeria Customs Service (NCS) in the interim. On Saturday, the commander of 23 Armoured Brigade, S.G. Mohammed, handed over the vehicles to the comptroller of Customs in charge of Adamawa and Taraba, Olumoh Kamaldeen, at a ceremony in Konkol, Fufore LGA, PREMIUM TIMES learnt. It is not immediately clear whether suspects have been arrested. It is illegal to import such equipment without an end-user certificates from the Office of the National Security Adviser (ONSA), which is the only federal agency with powers to issue such document. The development could further upset security agencies, who have continued to grapple with acute insecurity and violence across the country. Security analysts regularly question how terrorists and other criminals acquire weapons they have used to keep the country under siege for many years, urging security and intelligence agencies to devote more time to understanding the complex web of illicit arms movement. The latest seizure of six mine-resistance all terrain vehicles (MATV) came three months after a Nigerian politician, Ibikunle Amosun, handed over weapons he had illegally stockpiled for several years to the police. Mr Amosun kept the weapons for several years at Government House, Abeokuta, until his last day in office when he realised he would no longer enjoy immunity from arrest and prosecution. The police have failed to arrest the former governor, now a serving senator, despite the widespread uproar and concerns amongst Nigerians that prosecuting Mr Amosun could serve as deterrence to other politicians involved in proliferation of deadly arms across the country. Kebbi Police Command has arrested a 42-year-old man, Ibrahim Umar of Nufawa village, Basaura district of Jega Local Government, for allegedly raping a seven-year-old girl at Katako area of Bara village in the state. The state Commissioner of Police, Mr Garba Danjuma told newsmen in Birnin Kebbi on Thursday that the suspect dragged the minor to a millet farm and forcefully had intercourse with her. Danjuma said after the suspect was done with her, he gave her one packet of candy, valued at N25. He will be charged to court to face the law,” the police chief said. Danjuma appealed to members of the public to see the duty of fighting crime as a collective responsibility. ”We should continue to partner to maintain our status as the safest state in Nigeria,” he added. A dismissed soldier, Abdullahi Danladi and three other suspected members of his gang have been arrested by the police in Kebbi State. Danladi, who police said claimed to be serving in the 533 Brigade Signal in Yola before he was dismissed in 2009, was arrested in Abuja after allegedly snatching a Toyota Camry car from a woman at Gobirawa, Argungu area of Kebbi State. The Commissioner of Police, Garba Mohammed Danjuma, said the ex-soldier and his gang members, Chibuzo Anefuna and Sani Abdullahi, were invited from Abuja and Masaka area of Nasarawa State by one Peter Patrick to Argungu area of Kebbi State to carry out the car snatching operation. “The gang came to the residence of the lady with dangerous weapons, they tied her with rope and carted away her Toyota Camry car with registration number Abuja 514EQ and two of her handsets,” the CP said. He added that after the attack, the personnel of Operation Puff Adder swung into action and through reliable information they were able to intercept the gang, arrest them and recover the car. While speaking to our correspondent at the police command in Birnin Kebbi, the suspect said, “I was formerly attached to the 533 Armoured Brigade in Adamawa. This was the first time I was coming to Kebbi to steal car. I was dismissed from the army in 2009 for AWOL. I was working with Star Marshal as Security Officer when I was contacted for this operation”. The Trump administration on Wednesday unveiled a rule that allows officials to detain migrant families indefinitely while judges consider whether to grant them asylum in the United States, abolishing a previous 20-day limit. The rule, which is certain to draw a legal challenge, would replace a 1997 court settlement that limits the amount of time U.S. immigration authorities can detain migrant children. That agreement is generally interpreted as meaning families must be released within 20 days. It was the Republican administration’s third major regulation restricting immigration in little more than a month, all during an unsettled period when senior immigration officials hold “acting” titles lacking U.S. Senate confirmation. Trump has made cracking down on legal and illegal immigration a hallmark of his presidency after campaigning in 2016 on a promise, so far unfulfilled, that Mexico would pay for a border wall to keep migrants from entering the United States. In what would be another attempt to dismantle established immigration law, Trump told reporters on Wednesday his administration was seriously looking at ending the right of citizenship for children born to non-citizens within the United States. Immigration officials are looking for any kind of deterrent to reverse a record surge in families fleeing violence and poverty in Central America. Department of Homeland Security (DHS) officials say they have caught or rejected 475,000 family members in the past 10 months, more than three times any previous full year. On July 15 the administration unveiled a rule to bar almost all immigrants from applying for asylum at the southern border, and on Aug. 12 it announced regulation denying visas and permanent residency for those who fail to make enough money. Multiple lawsuits were filed within days of the two previous immigration rules. Legal challenges have held up many of Trump’s initiatives, but immigration advocates say he has managed to build an “invisible wall” through executive actions bypassing Congress. The administration framed the policy as a humane approach to a crisis. “To protect these children from abuse, and stop this illegal flow, we must close these loopholes. The Economic and Financial Crimes Commission (EFCC) has released from its custody Abdullahi Babalele, the son-in-law of the Peoples Democratic Party (PDP) presidential candidate in 2019, Atiku Abubakar. Babalele, who was remanded by a Federal High Court, Lagos, over alleged money laundering, was freed on Friday after he met the N20million bail term imposed by the judge, Mr Nicholas Oweibo, and has since returned to Abuja. Oweibo granted him bail after he pleaded not guilty to a two-count charge of money laundering levelled against him by the anti-graft agency. However, Atiku’s lawyer, Mr Uyiekpen Giwa-Osagie, a partner in the law firm of Africa Law Practice (ALP) and his brother, Erhunse Giwa-Osagie, who were also arraigned by the EFCC on a different money laundering charge, are yet to meet their bail terms. Following their arraingments and not guilty plea to the three-count charge last Wednesday, the judge, in his ruling last Thursday, placed both defendants in the custody of their counsel. The EFCC alleged that Babalele laundered $140,000 with the aide of one Bashir Mohammed. While Giwa-Osagie and his brother, Erhunse were accused of laundering $2 million. The trio were arraigned last Wednesday. The offences according to the prosecution contravened Sections 18(c), 18(a), 1(a), 16(1), (d) of the Money Laundering (Prohibition) Act, 2011 as amended and were punishable under Section 16, 16(2)(b)16(2)(b) of the same Act. They were however, granted bail in the the sum of N20 million with one surety each, after their counsel, who include Chief Mike Ozekhome (SAN) for Babalele and Mr. Raji Ahmed and Mr. Norrison Quakers, both SANs, for the Osagies, argued their clients’ bail applications. In the charge against Babalele, the EFCC alleged that Atiku’s son-in-law, on February 20, 2019, procured and aided one Bashir Mohammed to make cash payment of $140,000 USD, without going through a financial institution. The EFCC alleged that the Osagie brothers on February 12, 2019, aided each other and made cash payment of $2 million, without going through a financial institutions. Femi Falana, a senior advocate of Nigeria (SAN), says any president or governor who commits criminal act could be arrested while in office. He said the supreme court had ruled out absolute immunity, therefore governors involved in criminal charges, including the leadership of the national assembly, must face the law. Falana said this in Benin on Saturday while speaking on: ‘Limit of executive immunity’ at a ceremony to mark the 60th birthday of Julius Ihonvebere, secretary to the state government (SSG) of Edo. Faulting the invitation extended to Abubakar Malami, attorney-general of the federation, by the leadership of the senate, Falana urged Senate President Bukola Saraki and Ike Ekweremadu, his deputy, to face the forgery charges against them. He accused the senate of politicising the issue, saying: “they have no immunity to dodge the charges against them. “The senate is now politicising the issue, saying it is political victimisation but not that the offence was not committed. “As leaders of the national assembly, you are supposed to be above board and that is even the more reason you must be careful.” The lawyer said Malami is not answerable to the senate, insisting that: “Any issue that is criminal in nature must be treated as such. “The attorney-general of the federation is only answerable to his boss, who is the president and nobody else. “The same thing applies to the states, so there is no longer absolute immunity in this country. “And that is why what is happening in Ekiti today about money found in a bank and the governor is saying it is illegal to freeze his account, that is not true.” Source: https://xynews.co/absolute-immunity-governors-can-now-be-arrested-while-in-office-falana/

Residents of Calabar, the Cross River state capital, can now expect to get 24-hour electricity. Unveiling a newly-completed 23 megawatts (MW) power plant during the weekend, Ben Ayade, governor of the state, said the cost of electricity supplied to residents will be affordable. Ayade described the power plant as the “fulfilment of a dream”. “Cross Riverians can see my passion has not changed, so I wasn’t doing this project because I was seeking re-election. I was doing what I was doing because I believed that that was what God brought me here to do. I am happy,” the governor said. “Today I’m excited because it is the first time we are evacuating power to the public. My office has enjoyed a steady power supply since the evacuation of power started. “So interestingly, Calabar will be the first city to have uninterrupted power supply even as we get ready to commission our Calabar Smart City project that will also make it the first smart city in the country. “There can’t be anything better with Christmas approaching and Calabar having 24hours electricity supply.” cross rivers power project Ayade said the power plant shows that “the spirit of commitment was indeed stronger than any amount of money because I don’t know where Cross River would have got $25M to put up the plant with all that is required”. The Cable - Ibraheem El-Zakzaky, leader of the Islamic Movement in Nigeria (IMN), has returned to Nigeria after a ‘medical stalemate’ in India. Before his return, he alleged that the Nigerian government was making it difficult for him to get the needed treatment at Medanta hospital, India, and that he was being treated like a prisoner in the country. In a video shared with TheCable, the cleric, while at the hospital, could be seen detailing his experience to an unidentified Indian official. He said he enjoyed some level of freedom in Nigeria unlike in India where he is in ”prison”. ”I have been about four years in prison now; a house fully furnished. In fact, our next neighbour was the senate president; a large house. I was free to move about. Similarly, when they moved me to Kaduna I was in the best best area – government reserved area. It is a house fully furnished with large bedrooms and I was free. I have never been in detention with police there; in fact, the soldiers used to stay outside at the gate. That is what they have been doing. When we came here we were put in prison,” he said. ”I will definitely prefer another hospital. PREMIUM TIMES - At least three people were killed while two houses and a car were burnt early Monday as party goers clashed at a birthday bash in Bauchi, police said. The police said a minor disagreement at the birthday party soon snowballed into violence. Witnesses at Yelwa area of Bauchi state said their sleep was disrupted when they began to hear shootings at about 1a.m. that night. “The shooting was deafening and it lasted for hours as we heard footsteps of people running,” said a trader who only introduced himself as Mr. Mathew. “The shootings, which we later came to understand was from the soldiers and policemen deployed to quell the fracas, lasted till dawn. “We learnt some lives were lost in the fight,” he said. The police public relations officer, Kamal Datti, told PREMIUM TIMES that 75 person have so far been arrested in connection with the incident. Mr. Datti, a deputy superintendent of police, confirmed that lives were lost in the fracas. “What actually happened was that yesterday, in the night, some group of persons were celebrating at a birthday party at Lushi area, during which they had a misunderstanding, and in the process a fight erupted among them,” he said. “As a result of the fight three people were killed, two houses and a car were burnt, while five persons were injured. Mr. Datti denied the incident had religious undertone “What the police want to make clear about this incident is that it is not a religious crisis as it is already been tagged and reported,” he said. “It is just a fight amongst some group of people and it started from a birthday party.” He said the police had been fully mobilised to monitor the area to avert possible escalation. “The situation has been put under control and people are already going about their normal businesses, even though our personnel and that of other security agencies are still on ground monitoring the situation. “We have fortified the area, and we are already investigating the incident. So far 75 suspects have so far been arrested by the police,” he said. Although there was no curfew imposed in the area, the residents of Yelwa district comprising Yelwa-Tudu, Yelwa Tsakani and Nguwan-gas were mostly indoors as they embarked on self-imposed curfew for fear of the unknown. Most businesses in the crowded commercial area were not opened at the time PREMIUM TIMES visited. Commercial motorcyclists would not take passenger beyond the Yelwa market junction that leads into the affected area. How victims died A female witness who would not want her name mentioned in this report gave an account of how the attack happened. “It was a mere kids birthday party that took place in Laushi near the mobile Telecom mast,” she said. “Suddenly, they began to enter people’s houses. At the first house they entered, they rounded up the man and hacked him to death using cutlasses and knives. After that, they set the house on fire. “The second house that was burnt was even more pathetic. When they were advancing towards the house some neighbours went and alerted the man who quickly moved his family and children out on time to a family friend’s house. “But sadly, the man returned to the house to stay. He locked himself up and attackers came to set fire on the houses burning him alive till he died. “The third man that was killed was on a bike when they stopped him and began to beat him up. They poured petrol on him and set him ablaze,” said the woman who had just returned from the police station where she said her younger brother who knew nothing about the fight was being detained. Women protest Several women, mostly wives or mothers of the 75 arrested suspects in connection with the incident, stormed Yelwa police station to protest what they described as illegal arrest and detention of their family members by the police. President Muhammadu Buhari has spoken on the impeachment notice served on Benue Governor Samuel Ortom by eight members of the State House of Assembly. Buhari’s reaction was contained in a statement Tuesday morning by his spokesman, Femi Adesina. It read: “Even while attending the ECOWAS/ECCAS Summit in Togo, strident attempts were being made to drag President Muhammadu Buhari into the unfolding drama between the executive and the legislature in Benue State. This is paranoia at its worst, coming from people who have wittingly positioned themselves against the clean-up of the country, and the way we do things. It said the action of the National Working Committee (NWC) was not only outrightly unlawful but also null and void. LABOUR, under the auspices of National Association of Academic Technologists (NAAT) has demanded prosecution of the dismissed s3x-for-marks lecturer of the Obafemi Awolowo University (OAU), Ile-Ife. NAAT said after its National Executive Council (NEC) meeting held at the OAU, that his prosecution would serve as the deterrent to other varsity workers, especially lecturers and will also entrench sanity in the system. The union hereby advises FGN to sustain this policy and continue to involve the universities in other sectors of the diversification plan including agriculture and tourism. This is a sure way to challenge the universities to be relevant to the needs of society,” the union said. It also applauded the removal of the obnoxious policy of dichotomy between HND and B.Sc holders in the public service. NAAT recalled that the Federal Government, through a circular from the office of the Head of Civil Service of the Federation, dated 26th March 2018, conveyed details of abrogation of the HND/B.Sc dichotomy. This development, according to NAAT, would encourage holders of HND and students of polytechnics to put in the best efforts in their chosen careers. NAAT, however, expressed worries over the unabating atmosphere of insecurity throughout the country, adding that “the union will continue to add its voice to other well-meaning groups and individuals, calling on the government to use all machinery at its disposal to bring this menace to a halt or its barest minimum.” It pointed out that the current situation where both the rich and the poor are afraid of their lives on a daily basis is certainly not acceptable. Nine knife-wielding Nigerians allegedly peddling drugs in Mumbai have been arrested by India’s Anti-Narcotics Cell (ANC). During the arrest on Friday night, police recovered 104 grams of cocaine and nine grams of mephedrone, all worth Rs 5.38 lakh, from the accused who attacked the cops with knives while resisting search. According to MumbaiMirror the accused were identified as Charles Ifini Ijia, 27, Okoro Jems Aja, 38, Mascells John Dino,32, Samuel Baju Okeni,30, Ken Kon Ishmel,37, Kofi Jems Romalik, 30, Chikku Fry, 43, Nanna Harisans Agvu, 28, and Joku Humai Vachuku Pais, 32. The names were mangled by the officers as the Nigerians did not carry their passports on them, another offence, according to Indian law. drug sellers Investigators said three of the accused were also involved in an attack on officers of ANC’s Worli unit during an operation to nab a Nigerian national allegedly selling cocaine in Byculla on July 19. Four police officers had sustained injuries in the attack. While the attackers managed to flee then, a case was registered at the JJ Marg police station and night patrolling was increased based on Deputy Commissioner of Police Shivdeep Lande’s order. “On Friday night, our officers, who patrolling the South Mumbai area, had neared the Eastern Freeway when they spotted some foreigners hanging around suspiciously under the bridge. The officers approached the group and was about to search them when two of them drew out knives and attacked them. While they attempted to flee, our officers, who had sustained minor injuries, managed to overpower them,” said an ANC officer. During interrogation, three of the accused confessed to their involvement in the earlier attack in Byculla and revealed the identities of five others who were involved in the same. “We are on their lookout,” said the officer. “The accused obstructed police from discharging their duties and intentionally injured four personnel.
