Nairaland / General / Court Suspends Bench Warrant Orders Made Against Ibeto by Tonydivinep: 4:26pm On May 07
The Lagos Division of the Court of Appeal has adjourned till Sept. 19, the hearing of the appeal filed by the Chairman of Ibeto Energy Development Company, Cletus Ibeto, challenging the jurisdiction of Lagos State High Court in Ikeja to try him over an alleged N4.8 billion fraud.

The appellate court presided over by Justice Muhammed Mustapha adjourned the appeal to await the report of ongoing negotiations between the Economic and Financial Crimes Commission (EFCC) and the defendant.

Justice Ismail Ijelu had ordered the businessman's arrest after he failed to appear before the court on many occasions to take his plea over the alleged fraud case despite repeated hearing notices served on him.

The anti-graft agency had charged the defendant alongside his companies, Ibeto Energy Development Company and Odoh Holdings Ltd, on a 10-count charge of conspiracy, fraud, forgery and fraudulent use of documents.

However, dissatisfied with the order and the refusal of the court to hear his preliminary objection, the defendant filed an appeal before the Appeal Court, formulating seven grounds for appeal.

Also, during Tuesday's proceeding, Justice Mustapha and other panel members, Abdullahi Mahmud Bayero and Paul Bassi suspended the enforcement of the bench warrant issued on November 3, 2023, against the Appellant by Justice Ismail Ijelu.

The justices suspended the warrant after Ibeto's lawyer, Chief Wole Olanipekun and the EFCC’s counsel, Adebisi Adeniyi, informed the court that the parties are in the process of settling the matter and that the appellant has refunded about N1.7 billion to the Commission.

When the case was called, Adeniyi informed the court that the appellant had been making payment in line with the settlement proposal, so the EFCC felt that going ahead with the appeal might not be appropriate.

He also told the court that the matter had started de novo before another lower court judge and the EFCC felt that the appeal had become academic and as such, the anti-graft agency had filed an affidavit showing the settlement and all that has transpired in the case so far.

Responding, Chief Olanipekun confirmed that the parties are settling the matter in line with a Rivers State High Court judgment.

He, however, urged the court to set aside the bench warrant against his client since the Appeal Court is not seized of the matter.

In a short ruling, Justice Mustapha suspended the enforcement of order as the warrant of arrest can not continue to hang over the defendants head since he has started settling the matter out of court.

He, therefore, held, "The bench warrant is now suspended and we encourage parties to continue with the negotiations until the next adjourned date of September 16.

The appellant, through his lawyer, Chief Wole Olanipekun, argued that his appeal raised the issue of constitutional territorial jurisdiction and that it is of such a threshold nature that it demands to be heard and determined before his client can be prosecuted.

He also contended that his client's presence in court and his arraignment are not mandatory or preconditions for the hearing of a preliminary objection touching on the court's jurisdiction, which was already ripe for adjudication.

The appellant, therefore, asked the Court Appeal to set aside or vacate the warrant of arrest and also strike out the suit before the lower court.

Recall the judgment, which was decided by the Port-Harcourt high court, that Chief Ibeto should refund the deposit of over N2 billion that was paid to the nominal complainant, Chief Chukwudozie, and that he should have his land and there should be no further encroachment or trespass by anyone was brought to the Lagos state court of appeal where it was said that all bench warrant against Chief Ibeto was suspended.

Speaking with Uche Obi (SAN), he said that the matter was called up and the counsel for EFCC did inform the court that there seems to be progress in the compliance of Chief Ibeto with the judgment of the Port Harcourt High Court.

According to him, Chief Ibeto agreed to comply with the letters of that judgment. Sequealed to this, he has commenced payment/refund of the deposit paid by the nominal complainant and over 2 billion was paid.

He added that since the matter was fixed today, 7th May, for the hearing of the appeal, the court could no longer proceed, after listening to the council, the applicant, and the appellant, who moved that the bench warrant made against chief Ibeto in January be vacated or suspended. Since things are being resolved out of court.

“That was what happened, this court today has suspended the bench warrant orders made against Chief Cletus Ibeto with immediate effect, that’s the position now. There is no bench warrant order on ChiefIbeto. The most important thing now is that the bench warrant made against chief Cletus Ibeto has been suspended by the order of the court of appeal sitting in Lagos today, which is the 7th day of May” he said.

Nairaland / General / N4.8bn: Court Awaits A'court Verdict To Hear Ibeto's Application On Jurisdiction by Tonydivinep: 3:36pm On Apr 15
Justice Oyindamola Ogala of the Lagos State High Court in Ikeja has adjourned the trial of Chairman of Ibeto Energy Development Company, Chief Cletus Ibeto who was charged by the Economic and Financial Crimes Commission (EFCC) over alleged N4.8 billion fraud, till May 27, 2024.

The judge fixed the date for further hearing in case , due to the defendant's counsel, Adedayo Oshodi prayer to move an application challenging the jurisdiction of the court to hear the charge.

However, the prosecution counsel, Rotimi Jacob opposed the application on the ground that the defendant had filed an appeal on same issue before the Court of Appeal and the appellate is yet to decide on it.

Besides, Jacob also insisted that court could not entertain the application because the defendant has not submitted himself for trial, however, Oshodi argued that the presence of the Defendants is not necessary in view of the pending application.

After listening to the both parties, the trial judge, Justice Ogala ruled that hearing the defendant's application would amount to nothing because the same issue is currently pending before the appellate court.

The judge held that it will be to better for the court to awaits Court of Appeal's verdict on the matter before taking any further step on on the matter.

The EFCC had charged the defendants before the court on a 10-count charge of conspiracy, fraud, forgery and fraudulent use of documents.

However, the defendant is yet to appear before the court to take his plea having challenged the jurisdiction of the court to entertain the matter.

Recall that the state high court in Port Harcout, Rivers State has given a Judgement on the same issue. In a judgment delivered on March 29, 2023, the State High Court declared Ibeto Energy Development Ltd as the rightful owner of the land. The court further rulled that since Sir Chukwudozie Daniel of Dozzy Oil did not complete the payment of the land in dispute, Chief Ibeto should make a refund of the money to him.

Being dissatisfied with the decision, Sir Daniel Chukwudozie and his companies lodged an appeal at the Court of Appeal Port Harcourt Division. While the case was pending, Sir Daniel Chukwudozie filed a petition with the EFCC in Lagos to turn a failed civil land transaction into a criminal case.

A case that is already pending in the appeal court in Port Harcourt. This led to a charge being brought against Chief Dr. Cletus Ibeto in Charge No. ID/2149/23 between the Federal Republic of Nigeria and Chief Cletus Ibeto. This is the basis of the jurisdictional objection filed by Chief Cletus Ibeto pending before the high court of Lagos in the criminal charge.

Nairaland / General / Erisco And Chioma Okoli Saga — How Not To Catch Cruise At Somebody’s Expense by Tonydivinep: 6:01pm On Apr 02
By Godson O. Moneke

For sometime now, the internet has been abuzz with the story of the rift between the Chief Executive Officer of Erisco Foods and one Mrs Chioma Okoli over what Erisco foods described as an attempt by Chioma to demarket their tomato puree brand.

Although, Chioma’s cheerleaders called her actions an innocuous product review, it is my considered opinion that Chioma did not set out to do a professional review of the product. What she did amounted to a reckless demarketing and demonization of the product for no just cause other than to catch cruise and draw unnecessary attention to herself. That to me is an irresponsible action for her age and marital status.

The advent of feminism does not mean that an otherwise responsible woman should go about looking for trouble where no trouble exists. Any person who has an idea of marketing management would tell you the parameters that must be present for any product review to occur.

It amounts to insults on the intelligence of Nigerians to describe Chioma’s actions against the Erisco tomato purée brand as a product review. Let us briefly revisit what the public is being fed as a product review. Chioma said that she went to the market to buy her usual brands for use but could not see them. This means that if Chioma had seen her preferred brand, she would not have touched the Erisco brand.

She had already condemned Erisco brand ostensibly because it was a Nigerian brand. Chioma compared the Erisco tomato purée brand to two other competing brands and arrived at the verdict that the Erisco brand was not fit for the purpose. What criteria did she use to arrive at her verdict? Where was the logical framework and the scientific basis for her actions? She only said that Erisco was sugary.

That is all !!! What kind of review is that? You don’t use somebody’s means of livelihood to catch cruise. That is an expensive joke. Instead of admitting her mistakes and apologizing, she wants the world to believe that she was right. When has sugar being one of the active ingredients in tomato purée become a crime? Chioma further said that because she could not see her preferred brands to buy, she had to make do with the Erisco brand which she said was nothing but sugar deceptively packaged to harm consumers.

CHIOMA did not tell the public if the product contents of the Erisco product disclosed that sugar was one of the ingredients or whether the sugar content was more than what was disclosed on the package.

Consumer preferences differ, there are those who prefer tomato purees without sugar and there are those who would not buy any tomato purée without sugar, yet there are numerous others who are indifferent. Since, it is a consumer product, what matters is the wholesomeness and this can only be guaranteed by NAFDAC approval.

In what capacity did Chioma make the statement that the Erisco tomato purée was ki****ng people? Does Chioma have such evidence? Chioma was just reckless in her actions and I feel sorry for her because instead of looking for peace, she is busy grandstanding and hobnobbing with a mob.

An apolitical matter which has to do with bad conduct by an uncultured and indisciplined married woman is being reduced to a partisan battle involving supporters of Mr Peter Obi widely known as Obidients who instead of staying neutral like other Nigerians decided to take sides with one of the parties. The impression should not be created that Obidients are a lawless lot. The CEO of Erisco is not into partisan politics but only a law abiding citizen who is into local manufacturing.

Why give the impression that he is against Obidients? When Nobel laureate Prof Wole Shoyinka described Obidients as behaving like fascists, we all condemned that description as inappropriate. But how do you describe their actions in the current Erisco vs Chioma saga? Obidients need to put on their thinking caps because they should have seen that propagandas, hurling abuses at people, intimidation and noise making cannot lead them anywhere. Social media can be used productively but reckless use of the social media can be counterproductive. Too many cooks spoil the broth. I can infer from the people who have played one part or the other in this matter that the CEO of Erisco and Chioma are both from the Nnewi axis.

The question begging for answer is; is there anything between them that we don’t know? In our culture down there, it is scandalous for a married woman to behave as recklessly as Chioma is doing talk-less with her current pregnancy status. What does she want to achieve and what will she gain in bringing down a Nigerian brand which is providing employment directly and indirectly to thousands of fellow Nigerians and conserving foreign exchange for Nigeria through backward integration? In this matter, Chioma is the aggressor and no deodorizing by her many enablers would make her blameless and clean. Those who are egging her on to continue fighting an unjust battle which she has already lost do not love her. She does not need this battle, I believe it would ruin her.

No amount of propaganda and social media braggadocio would help her unless she retraces her steps and tenders an unreserved apology to the parties she has hurt and lied against. CNN is cable network news, it is not different from the Channels and other TV stations in Nigeria. The only advantage it has over them is that it enjoys a wider coverage. What impact would Chioma and Erisco matter being aired by the CNN and other international news outlets have on the independent decisions of the Nigeria Police and the Nigerian Courts on this matter? How much did Chioma’s enablers raise for her through the Gofundme and how many times can it take her to Abuja and back plus accommodation and airport taxis? The court matter has not yet started.

How would she raise the money to prosecute this case? What happens to her family when she is running up and down on this case? It is not in the place of the opponent to press a case where it would be convenient for the other party. So those who are arguing that Erisco is pressing the case in Abuja and not Lagos are talking nonsense. That line of thought is lazy and an absolute balderdash. Police, litigations and court processes are very expensive and should be avoided except where absolutely necessary. I do not see the need for Chioma to embark on this costly frolic. Her husband should call her to order and take the initiative to resolve this matter before it gets out of hands.

Nigeria is a sovereign country with its laws and order. It is a crime for anybody who is under a Police bail to jump bail as Chioma is being encouraged to do by her cheerleaders. Police is always reluctant to grant bail to any suspect who has jumped the first bail the second time. It is ungrateful and wrong of Chioma to cause her surety to be arrested by the Police because she jumped bail. The surety should not be made to suffer the indignity of imprisonment in the Police cell because of Chioma’s intransigence. He is just being magnanimous and should not be punished for Chioma’s eccentric behaviors.

The X which is the social media platform used by Chioma has a nationwide coverage. Therefore, it is wrong for Chioma and her confederates to be arguing that because Chioma used the social media platform in Lagos, the jurisdiction must be Lagos. Since the effects of Chioma’s actions are felt across Nigeria and the CEO and other apparatchiks of Erisco are domiciled elsewhere in Nigeria, only the courts can determine the actual jurisdiction. It is a sign of irresponsibility for a pregnant woman to go out of her way to court trouble only to use her pregnancy status as an instrument of blackmail. You may not like the Police because of their many infamous conducts but it is not advisable for any citizen to ignore them and treat them with contempt and levity. That would be a harbinger for lawlessness in the society which we should deprecate. Propaganda cannot take the place of law in any society. It is therefore wrong for a party who has joined issues in law to resort to propaganda to intimidate the other party.

The courts are there to adjudicate disputes between parties and the Police are there to enforce the laws, parties should allow the laws to run its full course without let and hindrance. Erisco is a Nigerian brand which operates under the present harsh economic environment, it is very wicked of Chioma to be playing the devilish role she is playing in trying to destroy the Erisco brand by invidiously presenting it negatively to the advantage of competitors.

Many Nigerian brands have closed down because of the antics of characters like Chioma who behave like loose cannons. Mentioning the disputed matter by the CNN and other international media is never tantamount to mentioning it in heaven or bringing it before God. At the end of the day, it is the Nigeria Police and Nigerian Courts that are seized of the matter. Chioma is better advised to come down from her contrived high horse and plead for leniency, first from the Erisco CEO and then the Nigeria Police before it is too late. Denying a letter of apology which she freely wrote to the CEO of Erisco with the invented excuse that it was written under duress shows she is naturally a troublemaker , untrustworthy and untruthful. Duress by who? Proving duress is not as easy as the word sounds or is used.

You can defame somebody’s character for wrongfully accusing him of duress. Propaganda and noise making do not change anything in Nigeria and elsewhere once the law is involved. It is better to get one’s facts right when ventilating issues in courts . Public opinion cannot whitewash a bad case. You can ask OBIDIENTS where all their propagandas and noises over the 2023 presidential election took them. The loser may be more popular than the winner, what matters is the strategy employed by the parties, after all, Trump defeated Hilary Clinton in the 2016 US presidential election even when he had less popular votes.

Nairaland / General / Case Between FRN, Ibeto Handed Over To Lagos Attorney General by Tonydivinep: 8:32pm On Jan 29
Justice I.O. Ijelu has handed over the case between the Federal Republic of Nigeria and Chief Cletus Ibeto CON to the Lagos State Attorney General for reassignment.

This decision comes as the court lacks jurisdiction to hear the matter.

The Lagos State Attorney General has taken over the prosecution of the case, following a letter written by the Lagos Attorney General.

The transfer of the case to the Lagos Attorney General was prompted by a petition submitted by Chief Robert Clark. SAN, the counsel to Chief Cletus Ibeto, to the Attorney General of Lagos State.

The case originated when Daniel Chukwudozie filed a petition with the Economic and Financial Crimes Commission, EFCC.

Subsequently, charges were filed at the Lagos High Court Ikeja against Chief Cletus Ibeto and his companies.

These charges are alleged to be fabricated and stem from a failed business transaction between Chief Cletus Ibeto and Sir Daniel Chukwudozie and his companies, which occurred at the Reclamation Road Layout in Bundu Amo Community, Port Harcourt Local Government Area, Rivers State.

Both parties voluntarily appeared before the High Court of Rivers State to resolve their dispute in Suit No. PHC/15S/CS/2022, between Ibeto Energy Development Limited & Anor vs. Dozzy Oil & Gas Limited & 2 Ors.

In its ruling, the Court in Port Harcourt, Rivers State, declared Ibeto Energy Development Ltd as the rightful owner of the land, awarding them the Statutory Right of Occupancy over the land situated along the Reclamation Road Layout at Bunda Ama communities, Port Harcourt City Local Government Area of Rivers State.

Dissatisfied with this decision, Sir Daniel Chukwudozie and his companies have lodged appeals, while Chief Ibeto has filed a Cross-Appeal challenging a specific aspect of the judgment.

These appeals are currently pending at the Court of Appeal Port Harcourt Division.

While the case is still awaiting resolution at the Court of Appeal Port Harcourt, Sir Daniel Chukwudozie filed a petition with the Economic and Financial Crimes Commission (EFCC) in Lagos.

This resulted in a charge being brought against Chief Ibeto in Charge No. ID/2149/23, between the Federal Republic of Nigeria and Chief Cletus Ibeto & 2 Ors. The charge is scheduled to be heard before Honorable Justice 1.O. IJELU at the Ikeja High Court.

The transfer of the case to the Lagos State Attorney General marks a significant milestone in the legal proceedings as the jurisdictional matter is addressed. The Attorney General will now proceed with the prosecution of the case based on the petition presented by Chief Robert Clark, SAN, the counsel to Chief Cletus Ibeto.

Nairaland / General / Revealed! How Foreign Importers Kill Nigeria Made Tomatoes Brand by Tonydivinep: 9:06pm On Sep 26, 2023
President Bola Tinubu's efforts to strengthen Nigeria's "Made in Nigeria" tomato brand face challenges as government agencies continue to favour foreign producers.

This situation has triggered concerns among local producers, who lament the dwindling support for their products, ultimately jeopardizing the industry's viability.

Although the Federal Government, through the National Agency for Food and Drug Administration and Control (NAFDAC), has imposed a ban on tomato paste imports, evidence suggests that foreign products continue to flood the Nigerian market.

These unauthorized imports undermine local producers, harm the economy, and pose potential health risks to consumers.

Speaking on condition of anonymity, a local producers expressed dismay, saying, "Despite the goodwill and support Nigerian consumers have shown to local producers, foreign tomato paste importers and their associates are actively working to tarnish our integrity and credibility."

A Facebook post by Chioma Egodi, an alleged agent of one of the banned tomato paste importers, accused a Nigerian tomato paste producer of manufacturing products harmful to Nigerians. This post has gained significant attention and threatens to erode consumer trust in the "Made In Nigeria" brand.

However, the company's management released a statement refuting these allegations and urged consumers to disregard the post, emphasising the importance of fact-checking before believing online information.

"In this competitive landscape, the battle between local and imported products intensifies, potentially leading to the spread of false information to discredit local offerings," he added.

Nairaland / General / How Fire Guts TCN Transformer In Alagbon Transmission Substation by Tonydivinep: 10:48pm On Jun 14, 2023
There was a fire incident at the Transmission Company of Nigeria, TCN, Alagbon Transmission Substation.

The fire incident which occurred at about 1632hrs, today, affected one of its 60MVA power transformers in the substation.

Nairaland gathered that the operator on duty heard a heavy bang from the switchyard and immediately moved to the switchyard to investigate the sound and found fire under the cooling fans/fins of the transformer.

In a statement signed by the General Manager, Public Affairs, Mrs. Ndidi Mbah, she stated that, frantic efforts were made to put out the fire with the fire extinguisher in the substation, but oil, which started dripping from the transformer, ignited the fire more.

According to her, "The engineer had to switched off power supply in the substation on the 300MVA 330/132/33KV transformer and also made calls to the Federal Fire Service in Onikan and the Lagos State Fire Service at Dolphin Estate. The fire was put out at 1735hrs by the fire services.

"From initial assessment, the transformer can be salvaged/repaired, and presently, the situation is under control.

"Normal supply to the station was restored at 1927hrs. All available transformers in the station have been restored. Eko Distribution is on the ground for the management of the affected three no. 33KV feeder, as we have redundancy in the station.

"All customers feeding from Alagbon 330/132/33KV substation will have supply tonight. The situation is under control, and TCN will do a comprehensive check of the affected transformer immediately to enable it properly asess the transformer for repair work.

"We are truly saddened by this incident, especially as the company had operated from the beginning of this year to- date without any system collapse or major incident such as this.

"Even as we have already mobilized our engineers to commence the transformer assessment and repair work immediately, we will endeavour to ascertain the trigger of this fire incident with the view to forestall such incident in our substations."

Nairaland / General / Pictures: Innoson Unveils Gas Powered Vehicles by Tonydivinep: 11:57pm On Jun 07, 2023
As a suitable alternative for Nigerians following the rising price of petrol and diesel, Innoson Vehicle Manufacturing, IVM, has mass-produced varieties of Compressed Natural Gas, CNG, buses.

The showcase of the CNG vehicles took place at the company's factory in Nnewi, Anambra State.

The vehicles range from trucks, mini-buses, ambulances, long buses, SUVs, and several others.

Speaking during the unveiling, the Chief Executive Officer, IVM, Dr. Innocent Chukwuma assured Nigerians of the safety of CNG Vehicles and the availability of various kinds of cars.

"We manufacture according to demand, and we manufactured these buses because there is a demand for them now. During the COVID-19 Pandemic, we produced more ambulances, so we are on the ground and ready to produce.

"CNG vehicles bring a solution to total dependence on one or two kinds of vehicles.

"The CNG vehicles are a solution, that's why we produce them. We made space for CNG, LNG, and Fuel so that anyone available in an area can be used to drive the vehicles. Electric cars, biogas, and solar-powered vehicles are also produced in this factory."

Similarly, the Governor of Anambra State, represented by the Commissioner for Industry, Anambra state, Mr. Christian Udechukwu stated that the state is gearing up to provide solutions to the challenges facing Nigerians because of the removal of subsidies.

In his words, "We are aware that Innoson has renewable technologies, CNG, LNG and Solar powered technologies that can contribute to the mass transport system in Nigeria and other national solutions".

"The withdrawal of the subsidy has created a shock and the price of fuel has increased by almost 200% leading to restiveness in the Nigerian Labour Congress, the trade unions, and other Nigerians. The cost of transportation has risen apparently and one of the ways the government can alleviate that is by introducing mass transit systems that run on alternative energies as well as fuel. The more you have the ones that run on gas and solar, the greater the chances of a stable fuel price due to the existence of choices and Innoson offers that".

He also added that local manufacturing and empowered industries are needed in Nigeria to boost the economy and shrink the national debt profile. All we need is for the industries and everyone else to look to local solutions and Innoson is one."

The Head of Corporate Communications, IVM, Mr. Cornel Osigwe pointed out the advantages of Natural Gas Vehicles and the need to patronize local manufacturers. According to him, "Gas has high combustion rate than fuel. So generally, gas is more environmentally friendly. Nigerians are used to petrol cars but the abundance of natural gas has provided sustainable alternatives to all.

"Transportation is very crucial to economic development. Beyond the movement of people from one place to another, it also facilitates the quick and effective distribution of goods and services.

"At this stage in Nigeria's development, better transportation options are the perfect solution to the rising dependence on petrol and diesel to meet the transportation needs of over 200 million persons.

"Innoson Vehicle Manufacturing, an indigenous car manufacturing company has produced hundreds of CNG-powered vehicles suitable for Nigerian and African Roads."

Also, another Onyedika Chukwuma was also found wanting, as the warrant requested for them to be brought before the court for arraignment.

The warrant was particularly direct to the Inspector General of Police, Usman Alkali Baba.

Justice F.O Riman gave the order following what the court described as their refusal to be served with the Charge against them by Baba.

The Court noted that since the 29th day of March 2023 that the police completed their investigation on Hon. Ike and Chukwuma and was indicted, that the duo has refused to show up and they have been on the run.

The development has made it difficult for the Court to serve them with the charge against them.

The Court further stated that it will not assume jurisdiction to start hearing the charge unless they are served and that the only option left is for the Court to issue a bench warrant to the IGP to effect their arrest.

Hon Augustine Ike is the Hosue of Assembly Member Elect representing Nnewi North at the Anambra State House of Assembly. His arraignment in Court together with Onyedika Chukwuma may not be unconnected with a petition filed to the IGP by Billionaire Businessman, Dr. Cletus Ibeto.

The 11 count order filled at the Federal High Court Awka by Anthony Egwu Esq, the Prosecuting counsel to the IGP, Mr Augustine Ike and Onyedika Chukwuma were alleged to commit a criminal offence through the use of cyber stalking by using computer system to send messages on Social media known as FaceBook and WhatsApp, wherein they published that Dr. Cletus Ibeto is a "land grabber who want to defraud Nnew/ Community of their land, surrounds himself with thieves, criminals, armed robbers and have been rejected by universal God".

Nairaland / General / I'm Determined To Connect Africa's Best Brains To Global Opportunities - Sokunbi by Tonydivinep: 10:51am On Sep 24, 2022
Oludayo Sokunbi, is an IT specialist, Entrepreneur and a seasoned business consultant, passionate about antennas and microwave structures used in wireless systems.

He is particularly interested in metamaterials decoupling structures for millimeter wave/5G antennas, high gain, and reconfigurable antennas.

Sokunbi who is also the CEO of Japaconsults, presently work with Prof. Ahmed Kishk at Concordia University, Canada where they are currently exploring the capacities and possibilities inherent in 5G Antenna Technology for millimeter-wave Applications.

As a recipient of MSc and Ph.D. Scholarships, the tech guru felt indebted to humanity and hence resolve to share fully funded scholarships on social media, with over 140 persons already benefited this year.

Tell us about your portfolio?

My name is Oludayo Sokunbi popular known as Deewon.

I graduated with a First Class in Electrical and Electronic Engineering at LAUTECH, Ogbomoso, Nigeria.

After that, I worked as an IT analyst for GlaxoSmithKline and Aviat Networks, two large multinational corporations.

I later received a fully funded MSc scholarship at the King Fahd University of Petroleum and Minerals in Saudi Arabia, after more than 20 unsuccessful trials.

I received a second fully funded PhD scholarship at Concordia University in Montréal, Canada and I'm still working on it today along with many other things.

Tell us about the birth of Japaconsults?

When I started, I really didn't have the business in mind at all. I was just angry that a lot of fake agents take money from people and don't do good things for them, like get them into good schools or give them scholarships.

So, I decided to start telling people about free opportunities on Twitter. I soon found out that I had a lot of followers, and people were happy to see how I made the admissions and scholarship process as clear as possible.

If you go to my Twitter page right now and look at the tweets I have pinned, you can get free MSC or PhD scholarships abroad yourself. I found that I do this easily, and it made me so happy to see other people succeed. So I continued.

After some time, I also learned that there are people who can pay for this service and people who don't have time to read my tweets. So, I started the business and let everyone know that scholarships could be gotten without paying anyone. But if you also want to use our service, you can.

I did this because I know that many people can't pay for this service, and I wanted them to be able to read and do it themselves.

In fact, most of our success stories are from people who did things on their own after reading my tweets.

About five times a day, I share information on Twitter.

What is key for your business?

My top goal for Japaconsults as a company is to introduce as many people as possible to exciting new opportunities all over the world so that they can lead happier, more successful lives. In the course of my travels, I have learned that many people, particularly Africans, are unaware of the international admissions processes, scholarship opportunities, and employment opportunities available in other countries. Due to the fact that I have been awarded scholarships to pursue a Master of Science and a Doctor of Philosophy degree, I have a sense of obligation to the human race. For this reason, I have made the decision to share information about fully funded scholarships on all of the social media platforms I use, most notably Twitter. More than one hundred and forty people have received fully funded admissions, scholarships, jobs, and visas for this year 2022 as a direct result of reading and using the information contained in my tweets and posts. While some of them make use of the paid services that we provide at www.japaconsults.com, the vast majority of them handle it on their own.

What has been your major challenge?

Some of our clients believe we are "magicians" because of our success stories. They soon realise how much work is involved when we start their job.

At Japaconsults, we get our clients involved in the process so that they can understand how we apply for admission, scholarships, and write application essays.

We also made it clear in the agreement that we don't usually guarantee anyone's success because we are not the admissions/scholarship committee.

We only know how to put in the best application, but we absolutely have no power over who gets admission or scholarship.

This usually confuses some clients. But they later understand the process.

Transparency has been our hallmark, and it has given us a lot of referrals.

What plans do you have on ground to make Japaconsult a global brand?

Our brand is currently registered in Nigeria and Canada, where the majority of our clients are located. Despite how busy I am with my PhD, I still manage to work closely with many people, and at Japaconsults, we are constantly exploring new concepts. The goal is to establish a well-known global brand that will link the brightest minds in Africa to job opportunities and fully-funded MSc/PhD scholarships abroad.

Due to harsh economic realities, we also learned that many people lack the funds necessary to even begin the application for a scholarship or job. We are thinking about paying for young Africans with talent to take tests and pay for their international passports.

Advice for the Youths

Youth should remain focused and look at international opportunities.

Even if you still want to come back home, you will be more respected if you have foreign experience (degrees or work experience).

Be outstanding!

Expectations for 2023.

To connect more youths to International opportunities.

Our goal this year is 200 success stories and we have recorded more than 140 already.

Next year, we are moving to 400 success stories.

Nairaland / General / N2.5bn Debt: We Stand By Our Statement Against Imo Govt - Innoson by Tonydivinep: 5:31am On Aug 02, 2022
Nigerian indigenous automobile company, Innoson Vehicle Manufacturing, IVM, yesterday, maintained that the Imo State Government is yet to pay N2.5 billion debt for the purchase of various IVM vehicles including their parts from the company.

This is coming against the backdrop of
a press statement issued by the Commissioner for information and Strategy, Declan Emelumba on behalf of the Imo State Government.

Emelumba had alleged that the state government has serviced over 70 percent of the debt.

But in a swift reaction, IVM's, Head, Corporate Communications and Affairs
Cornel Osigwe, noted that the statement was written to water down the facts and substance stated in the company's earlier statement.

He said: "We do not wish to join words with Imo State Government as we now have it on good authority that it has engaged its e-dogs to discredit our brand in the media space. The matter is now before the courts and we have always believed in the integrity of the judiciary to do the right thing when facts are stated.

"However, to ensure that the public is not deceived by the response, we have decided to puncture the pack of lies and further strengthen the facts.

1. On buying N5B worth of vehicles: In March 2020, Imo State Government under His Excellency, Senator Hope Uzodinma on the assumption of office as the Governor of Imo State procured and paid for its first set of Innoson Vehicles it ordered from the company. The Governor assured Innoson that his government will always patronize Innoson Vehicles for its vehicular needs. The details of this transaction were not done in secret but were carried in the media.

"After one year, specifically in April 2021, Imo State Government requested the supply of another set of vehicles with an understanding the State Government will pay for the vehicles after deliveries to them, just as was the case with the first transaction and which request was granted and honored. This particular transaction was reported by many news media.

"Innoson Vehicles has made all efforts since April 2021 through every means possible to make the Governor pay for the vehicles, all to no avail, even with the involvement of top officials in Government, clergies, and Bishops both with and outside Imo State to intervene on the matter, yet Imo State Government never responded to all these interventions.

"More so, Innoson Vehicles gave Imo State Government an option of setting up a payment plan on monthly basis, yet there was no response or word from the State Government. Approaching the courts to recover the debt was the last option for us since The Governor has rebuffed all entreaties made to him to pay us.

2. Contractual Agreement: it is not correct that Innoson Vehicles agreed with the Imo State Government that Innoson Vehicles will set up a Service Centre in Imo State. For the avoidance of doubt, Innoson Vehicles have various vehicle servicing partners in Imo State where Innoson Vehicles are maintained and serviced. More interestingly, Innoson Vehicles has its unique mobile workshop that provides maintenance and vehicle servicing to its clients.

"To the best of our knowledge, Innoson Vehicles has always maintained and serviced the vehicles supplied to the Imo State Government up to the stage the company decided to disengage its maintenance and servicing as a result of non-payment of servicing parts used which have risen to above 7M naira. This particular debt among others is what Innoson Vehicles has detailed to recover from the law court. Innoson Vehicles is not a charitable organization but a business concern that needs money to stay in business.

3. Debt Servicing. The statement on servicing of debt in all its entirety is false. Note especially that the mode of transaction Innoson Vehicles did with Imo State Government is not only peculiar with the State, but Innoson Vehicles have also used a similar model to many of its clients including state governments. We have some clients who couldn't pay at once but entered a payment plan with the company even up to a 12months plan. Since the vehicles were delivered in April 2021, the State Government hasn't paid one naira. The company has utilized every known means to make the state pay or negotiate a payment plan that will clear the debt but all to no avail.

4. On Not Being Served. The Honorable Commissioner is either being economical with the truth or not aware of happenings in his State. The defendants in the suit including the Attorney General of Imo State have been served by the bailiff of the honorable court.

5. In as much as Innoson Vehicles doesn’t delight in going to court with its customers over matters of this nature. In this instant case, seeking redress is the last option open to the company as the government was not disposed to settling the debt or reaching an understanding with the company on terms of settling the mounting debt. It was just indifferent and unmindful of the effect on the company.

"To us resort to court became the last port of call. Unfortunately, the government instead of addressing the issue of debt owed resorted to blackmail and de-marketing tactics as a spurious defense.

"The discerning public is not deceived. There are several receipts of letters and messages sent to the State Government and the Governor appealing to his conscience that the nonpayment of this debt or its servicing will lead to the shut down of operations of Innoson Vehicles, not for once did we get any response of hope from the Governor.

5. Innoson Vehicles is urging the Imo State Government to do the needful and pay its debt with the accruing interest so that the case will be withdrawn from court."

Nairaland / General / Innoson Sues Imo Govt Over N2.5bn Debt by Tonydivinep: 4:36pm On Jul 29, 2022
By Jimoh Ajasa

Nigeria's indigenous vehicle manufacturing company, Innoson Vehicles Manufacturing (IVM) has filed a lawsuit against the Imo State Government over its failure to pay or service the debt of N2,547,666,435.00 (Two Billion, Five Hundred and Forty-Seven Million, Six Hundred and Sixty-Six Thousand, Four Hundred and Thirty-Five Naira).

The N2. 5 billion was for the purchase price of the various IVM Vehicles including their parts which IVM manufactured, sold and delivered to the State Government but its government had refused and failed to pay same despite repeated demands and appeals.

In a statement issued by the company's Corporate Communications Head, Cornel Osigwe, it stated that, "The lawsuit which was filed by Prof Joseph N Mbadugha, SAN, FCPA of McCarthy Mbadugha & Co, the counsel to Innoson Vehicles coming against repeated attempts made by the Chairman of Innoson Vehicles Manufacturing, Dr. Innocent Chukwuma, to the Governor urging him to pay the company on the vehicles sold, and delivered to the State Government.

"For the avoidance of doubt, sometimes in April 2021, the Governor of Imo State, Senator Hope Uzodinma invited the Chairman/CEO of Innoson Vehicles, Chief Dr. Innocent Chukwuma to the Imo State Government House, Owerri where they discussed and agreed that Innoson Vehicles would sell and supply various specifications of its brand of Vehicles to the State Government which includes, inter alia;

1. 70 units of Innoson 5 Seater double cabin pick-up (IVM Carrier) 4WD

2. 10 units of Innoson 5- Seater double cabin military pick up (IVM G12)

3. 10 units of Innoson 5 seater single cabin military pick-up (IVM G12)

4. 100 units of a complete siren with public addressing system, revolving light, and street police light;

5. 2 Units of IVM Ambulance Vehicles

6. 20 Units of IVM G12 MS11

7. 20 sets of B. Canopy

"The above vehicles which were valued at over N2.5 billion ($6.3M) were supplied in good faith to the Imo State Government based on an understanding with the Governor which arose after a special request that Innoson Vehicles grant the State the favor of paying for the vehicles after deliveries to them and which request was granted and honored.

"The special and privilege request granted to the Governor turned into a nightmare for Innoson Vehicles and Its Chairman after Chief Chukwuma had at various times through several visits, phone calls, messages, and submission of letters requesting payment appealed to the Governor and his conscience to make total payments or set up a payment plan that will offset the debt.

"The inability of the State Government to pay the aforesaid purchase price of the vehicles supplied has resulted in Innoson Vehicles having difficulties in fulfilling its loan repayment obligations to Keystone Bank Limited and Bank of Industry. These Banks granted their credit facilities at the rate of 10% interest and other fees therein. More so, it has led to the loss of profit arising therefrom and the accruing interest.

"It is also interesting to note that as of July 27th, 2022, the over N2.5 billion worth of vehicles supplied to Imo State Government in April 2021 which is valued at $6.3M is now worth $3.8M. Even if the money is paid today, the value of the money has depreciated by over 40 percent.

"It is therefore based on this premise that Innoson Vehicle Manufacturing Company Ltd has begun the process of recovering its debts against the Imo State Government by slamming a lawsuit of over N2.5 billion with an interest rate of 10% on the entirety of the sum claimed at the High Court of Anambra State, Nnewi Division."

Nairaland / General / Innoson Oil & Gas On The Cusp Of A Huge 8tcf Gas Discovery In Sierra Leonean Bas by Tonydivinep: 9:28am On May 14, 2022
With estimated recoverable resources of 8.2 TCF and 234 MMbbl of gas and condensate respectively, the Ryder Scott Company, has confirmed Innoson Oil & Gas Ltd.’s own findings from a rigorous hydrocarbon exploration campaign it’s been engaged in, in the Sierra Leonean basin since 2020.

A recently concluded independent third party evaluation, by the Ryder Scott Company, revealed an SPE-PRMS P50 estimated unrisked gross prospective recoverable resources of 8.2 TCF and 234 MMbbl of gas and condensate respectively, attributable to the Innoson Oil & Gas (IOG) concession offshore Sierra Leone.

According to a statement made available to newsmen by IOG, Head, Corporate Communications, Cornel Osigwe, it stated that "IOG was awarded nine graticular provisional blocks in May 2020. The following year, the parliament of Sierra Leone ratified a petroleum exploration and production license in favor of IOG as confirmed in a letter of conveyance to IOG in April 2021.

"The Sierra Leonean basin has a working petroleum system, corroborated by oil deposits encountered during previous exploration activities amongst others by Anadarko, Repsol, and Tullow Oil that achieved the Venus B1 discovery and Mercury wells."

Also, IOG’s Administrative Director, Martin Nweke, noted that the boldness, and the willingness to deploy unconventional but performant technological ingenuities and people, constitute foundational propositions that drove the campaign of the industry novice.

With cost, time, and precision quintessential, IOG exploration team, led by Dr. Andrey Sergeev (Project Director & Chief Geologist) deployed ab initio, robust earth remote sensing (ERS) method for basin reconnaissance. Assessment of gathered ERS data pre-informed the choice and number of graticular blocks in IOG extant acreage. The so determined ERS acreage pre-knowledge reduced the need for 2D & 3D seismic- and well-data to target only prospective anomalous zones in the contract area.

The development opportunity is currently being appraised. Asset evaluation, a field development plan, and the setup of a data room are vigorously pursued with the immediate objective to engage a farm-in partner; ideally, with the financial strength, technological and management competencies to accomplish joint discovery, development, and production.

IOG has a 100% working interest on the prospect with a 10% carried, plus an optional 5% paid interest(s) for the state of Sierra Leone. Attractive fiscal and tax regimes by the state of Sierra Leone offer a flexible so robust environment for a big take.

Nairaland / General / Court Restricts EFCC From Arresting, Further Inviting Innoson’s Lawyer by Tonydivinep: 10:01am On Mar 02, 2022
A Federal High Court, in Abuja has restricted the Economic and Financial Crimes Commission, EFCC, from arresting and further inviting Nigeria’s indigenous auto industrialist, Innoson Nigeria Ltd counsel, Prof. McCarthy Mbadugha, SAN.

This is coming against the backdrop of , Innoson's long running legal battles with Guarantee Trust Bank Plc.

Innoson Nigeria Ltd is concerned about the interference of the EFCC, in the legal matters in a manner that it has become apparent that EFCC is pursuing the interest of the bank in the pretext of exercising its statutory investigatory powers and curbing of financial crimes and the bank is pulling strings in the EFCC.

In a statement made available to newsmen in Lagos by Innoson Group, Head of Corporate Communications and Affairs, Cornel Osigwe, it stated that, in January 2022, EFCC invited Mbadugha to an interview on 1st February 2022. Mbadugha honoured the invitation.

"During the interrogation, EFCC showed him the counter affidavit to show cause which his Secretary deposed to and filed on 23rd March 2011 in opposition to the tier one bank affidavit to show cause in a matter which has been decided by the Federal Court and the decision of the Federal High Court which has affirmed by the Court of Appeal is presently pending at the Supreme Court- SC. 694/2014.

"EFCC told Mbadugha that the depositions in the counter affidavit to show cause were false and asked him the source of the information. But the SAN emphatically told EFCC its personnel interviewing, embarrassing and humiliating him, that the depositions are true.

"That it was his client that provided all the information he used in prosecuting the case and that he verily believed his client. Mbadugha insisted that both the trial court and Court of Appeal found that the depositions in the Bank's affidavit were false and that the first generation bank did not deny the depositions in the counter affidavit of 23rd of March 2011 and that he relies and stands on the judgments of the two courts which have settled the matter and can only be overturned upon appeal and not the needless belated charade of investigation of the truth of the stated facts. EFCC kept him in its custody for over seven hours."

He further stated that, subsequently his counsel, Mike Ozekhome, a renowned Senior Advocate of Nigeria filed, at his instruction, a fundamental human rights suit at the Federal High Court, Abuja Division against EFCC and 5 other persons which include the tier one bank.

Consequently, he stated that, following, an ex parte application at the Federal High Court Abuja by Ozekhome, praying the court for an ex-parte Order of Injunction restraining the EFCC from inviting, arresting or detaining or keeping in its custody the counsel to Innoson Nigeria Ltd, Mbadugha in relation to the allegations which he knows nothing about pending the hearing and determination of the substantive originating motion.

"The Federal High Court granted the application and ordered that status quo ante bellum as at 7th February 2022 be maintained until the determination of the originating motion.

"EFCC is a Federal Government Agency, created by Law to fight against financial crimes and provide law and order in the business environment based on objective principles. It is unheard of that counsel who has filed processes to put forth the position of his client as it was related to him in his instruction should thereafter be quizzed on a matter that is not his personal matter and in which he had acted on purely in his professional capacity. It is obvious that the aim of EFCC is to muzzle the mouth of Innoson’s counsel.

"The counter affidavit that EFCC is presently investigating was filed in the Federal High Court, Ibadan Division in the matter between Innoson Nigeria Limited and Nigerian Customs Service Board.

"The tier one bank filed an affidavit to show cause in March 2011 in a garnishee proceedings in Suit No. FHC/L/CS/603/2006 between Innoson Nig Ltd and GTB.

"In response, Innoson filed through its Solicitors- McCarthy Mbadugha & Co. - on 23 March 2011 a counter affidavit to the affidavit to show cause. This resulted in the bank filing a further affidavit to show cause and Innoson Nig Ltd filing a reply/further counter affidavit to the further affidavit to show cause."

"The court after GTB and Innoson joined issues therein and oral arguments by the parties’ lawyers held in its Judgment that GTB “has not disclosed utmost good faith as regards the proceedings…. and that GTB did not sufficiently deny the counter affidavit of 23rd March 2011. To the favour of Innoson, the Court made a Garnishee Order Absolute and ordered GTB to pay the sum of over N2Billion to Innoson Nig. Ltd.

"Being dissatisfied, GTB appealed to the Court of Appeal in Appeal No. CA/I/258/2011. However, in a unanimous decision of 6 February 2011, the Court of Appeal dismissed the appeal and affirmed the findings and the trial court’s decision. The Court of Appeal ordered GTB to pay over N2Billion to Innoson Nigeria Ltd.

"Still not satisfied with the Court of Appeal Judgment, GTB approached the Supreme Court and interestingly in a motion on noticed filed at the Supreme Court on 5th February 2016 to amend it’s notice of appeal GTB deposed in a 15 paragraph affidavit in support that Innoson Nigeria Ltd obtained the judgment of the Court of Appeal by fraud and by fraudulent suppression of material facts with a view of using that to have the Supreme Court set aside the judgment of the Court of Appeal and thus avert paying the judgment debt.

"However, the Supreme Court in a unanimous decision on 12th May 2017, dismissed GTB’s said motion on notice; and while dismissing the motion, stated inter alia, that GTB engaged in double speaking and in a frivolous frolic.

"As the main appeal is yet to be decided by the Supreme Court, the EFCC through the instigation of GTB is currently investigating some aspects of the matters already decided by the courts.

"For instance, EFCC through acts of torture and intimidation during its interrogation of Prof J. N. Mbadugha, SAN, the counsel to Innoson Nigeria Ltd, is requesting “the source of information he used in preparing the counter affidavit of 23rd March 2011where and when Prof. Mbadugha, SAN informed EFCC that he got all the information used in prosecuting the case from his client given that he did not instruct himself, the EFCC asked him to bring his client from whom he derived the information.

"It must be noted that EFCC has refused to show Prof Mbadugha, SAN a copy of the Petition allegedly written against him, however in the process of opening the file by one Mr Babangida Yahaya, a staff of EFCC, Prof. Mbadugha sighted a letter from GTB which he believed is the petition.

"Having since been subjected to endless invitations by EFCC, threats of arrest, mental torture, Prof. Mbadugha, SAN through his Counsel Chief Mike Ozekhome, PhD, SAN approached the FHC Abuja demanding for an enforcement of his fundamental human rights in consequence of which Hon. Justice I.E. Ekwo made the ex parte order of 21st February 2022 pursuant to Prof. Mbadugha, SAN’s ex parte application which was argued by his Counsel- Chief Mike Ozekhome, PhD, SAN
The said order and the originating substantive application have been served on the EFCC and all parties in the action.

"At the resumed hearing on 25th February, 2022 in which EFCC and two of its staff who were sued with it and GTB were represented by counsel the learned trial judge - Hon. Justice I. E. Ekwo made a confirmatory or a further order that none of the parties before the court should take any further step in respect of case which includes re-inviting and re-arresting the Applicant. Also, the court made an order for accelerated hearing of the substantive application and adjourned to 29th March, 2022 for hearing," the statement added.
