Not true. An APC aspirant/candidate who fully participated in the primaries (other than Modibbo) gets it.
The supreme court. Has ruled it in favour of the candidate that came 2nd in the secondary election having par took in all the stages. That should 1 for PDP.

Conflicting judgements here and there.

Did Yayaha Bello participate in all the stages of the election, when he was awarded the Governorship seat after the death of the actual winner?

Did Rotimi Amaechi participate in all the stages of the election before he was handed the Governorship seat in Rivers State?
Good observation but has been taken over by recent pronouncements.

But didn't INEC say they don't even have any server ?
They simply ran away from thorough scrutiny at the PEPT and now this! INEC has been busted.

Those apc goons jubilating that inec simply didn't make a defense at the PEPT as a good move will soon see their folly!

I just pray that a technicality hasn't been planted somewhere cos Atiku/PDP has a compelling petition.

Bringing up witnesses will be like nailing their coffin the more
On point! The apc goons here are just sentimental. INEC is already boxed presenting any witness will simply slay them. It is a tactical retreat but, Buharideens feels it is a blow to the petitioners.

I like the profuse thank you of Atiku's counsel.

Let the remaining two defendants too tow same path.

Whatever the outcome Atiku would have done well for our democracy. I respect his democratic credential.

Atiku's witnesses supported INEC's case must especially the recharge card hawker from Kenya that Pdp called an engineer.

Someone somewhere told those witnesses to wreck Atiku. I strongly suspect that Livy Uziukwu of working against Atiku. Who introduced Uzoukwu to Atiku? Saraki and Wike.

Those 2 idiots have sabotaged Atiku to increase their chances in 2023.

DonCandido:
Not totally true.

INEC is a creation of the law which is saddled with the conduct of elections. INEC is to follow laid down rules and regulations as contained in the INEC Act.

What a petitioner needs to do is to show by evidence that an election conducted by INEC and in which he was a candidate did NOT comply with the Electoral Act and the regulations made pursuant to it.

The petitioner must call credible witnesses, provide documentary evidence and link ALL together to show how INEC did not follow the law. It is only when a petitioner does this that the onus of proof shifts to INEC.

What INEC needs to show is to demonstrate that it complied SUBSTANTIALLY with the law. No more, no less.

The fulcrum of Atiku and PDP's case before the tribunal is that he won majority of lawful votes and relies on a server's result.

Nigerians who follow political developments avidly know that the 2019 election was conducted based on the old law- 2015 Electoral Act. The are also aware that the last minute attempts by Saraki's Senate to amend the law to allow e-voting failed as the president refused to sign it into law as the purported amendment violate existing law and ECOWAS protocol of which Nigeria is a signatory.

I am of the view that is silly to rely on the evidence of a Kenyan who was told by an INEC whistleblower that Atiku won the election based on result sent to a site allegedly from INEC server.

Common...

The most shocking part of the whole mess of a case was when Atiku's national collation officer abandoned the INEC server claim at the tribunal and admitted that collation was in fact done manually.

That sounds the death knell on Atiku's petition.

Atiku should ask for a refund from his lawyers.
The petitioners have done the needful. INEC simply took a swerve to avoid further damage being done to them.

They must explain what happened to the monies hurriedly approved and disbursed for them, yet, gave us a terrible election.

Anyway, that is done with next is APC and buhari to enter their defense.

What are you saying? Educate yourself more bro, thats not what they are talking about, they are referring to a database where result were transmitted to from polling units, processed and editted before going to public. What you described above is just like surfing the website, same as you are doing right now. Read more on server. On the contrary I doubt if such exists, and if it does PDP should convince us
Surfing the website is only possible cos server exists!

Their non presentation of witnesses is not based on neutrality but based on what atiku presented.they cannot be neutral as far as there the first respondents.the only neutral party now are the judges
Their non presentation of witnesses is cos they can't defend the case against them. Leave the lame talk of there was nothing to defend.

That won't inhibits the tribunal anyways.

Thats what i have been trying to say.you can see what is happening at akwa ibom.i wont be surprised if buhari and apc also refuse to call witnesses
That is not what you have been trying to say dude.
INEC has no defense and make a face saving submission. They would have been taken to the cleaners from budgeting, disbursement, procurement, training, denial and subsequent admittance of server as well as the weight of conscience.

Now let the remaining one defend themselves. This was exact Osun scenario and tribunal rule in favor of the petitioner.

The trap of technicalities must have been planted somewhere. We are watching.

Why do you like uttering nonsense? Can you give an example of the overwhelming evidence pdp dropped?
I remember that was their exact stance in the Osun trial.

Now let the apc and buhari defend theirs as schedule.

For inec to even put up a defense will further put them on the spot.

I am no legal luminary but I believe INEC is saying that Atiku and PDP have not made out a case known under the extant laws regulating elections in Nigeria and therefore there is no reason to help them make out one or join their comic reliefs of the past weeks.
That was their same position in Osun's case. They should be neutral.
PoliticsRe: BREAKING: We Won’t Call Any Witness In Defence Of Petition By PDP, Atiku – INEC by tuniski: 11:50am On Jul 29, 2019
MobilityExpress:
Maybe there's nothing to defend. That shows you how useless and empty Atiku's case has been, so pathetic that they defeated their case by themselves and INEC doesn't even want to waste its time trying to establish its defense.
That was the same Way they didn't call any witness in the Osun trial.
