Six lawmakers of the Imo State House of Assembly, on Monday, defected to the Peoples Democratic Party (PDP).

The lawmakers announced their defections in a letter they addressed to the Speaker and read by the clerk of the House during plenary.


Five of them dumped the Action Alliance (AA), while the sixth person was a member of the All Progressives Grand Alliance (APGA).

The AA lawmakers who defected to the PDP are: Mike Iheanaetu (Aboh Mbaise), Victor Onyewuchi (Owerri West), Ken Agbim (Ahiazu Mbaise) Lloyd Chukwuemeka (Owerri North) and Bruno Ukoha (Ezinihittte Mbaise)

A Federal High Court in Abuja has reversed the withdrawal of operating licence of the Daar Communications PLC over alleged breach of broadcasting code. Justice Inyang Ekwo on Friday ordered the National Broadcasting Commission (NBC), the Federal Ministry of Information and Culture, the Attorney General of the Federation to revert back to state of affairs before May 30, 2019.
Justice Ekwo asked the parties to appear before the court on Thursday, June 13 to show cause why the motion on notice challenging the action of the regulatory agency should not be granted. In an ex parte application brought by its lawyer, Mike Ozekhome (SAN), Daar PLC operators of African Independent Television (AIT), Raypower FM, Faaji FM and Daarsat had on Thursday asked the court to order status quo ante bellum pending the determination of the main suit. ADVERTISEMENT The NBC had in a letter dated May 27, 2019 accused Daar of breaching the Nigeria’s Broadcasting Code with its Kakaaki and other programmes and subsequently withdrew its licence. In the suit against the NBC, the Federal Ministry of Information and Culture, the Attorney General of the Federation, Daar claimed that it had since the licence of its television and radio stations been conducting its operations in line with Section 22 of the 1999 Constitution. It therefore asks the court to make an order “restraining the defendants from blocking, jamming, stopping removing from air and/or interfering with the air waves of the plaintiff/applicant (Daar Plc) in any way and manner however called from invading the premises of the plaintiff/applicant (Daar Plc) or closing down, viet armis, the said premises, its operations or broadcast services, pending the hearing and determination of the motion on notice filed along with this application.” Enumerating grounds for the action, Daar Plc said the defendants had on April 16 in a Gestapo-style invaded its premises and pulled down two buildings and gates leading to its operational office in Asokoro, Abuja worth millions of naira. Independent National Electoral Commission (INEC) has presented a certificate of return to the Candidate of Peoples Democratic Party (PDP), Mohammed Mattawale as Governor-elect of Zamfara State.

The National Commissioner, Amina Zakari made the presentation in Abuja on Monday during the formal presentation of the certificates to all the candidates of the party.

Six members of House of Representatives and three senators also received their certificates.

The Chairman of the commission, Mahmoud Yakubu urged the political parties to adhere strictly to the internal democracy which serves as guiding principle particularly the conduct of the primaries.

In his own acceptance speech, the Governor-elect thanked the commission for obeying court order. He, therefore, asked the people of Zamfara state to see the verdict as the will of God.

Mattawale promised to run an all-inclusive government in the state just as he asked them for their cooperation in the interest of the state.

Wasted votes and void votes are the same. All these arguments are just semantics from partisan interest. Wasted/void votes are valid when determining the total vote cast in any election. Arguing otherwise is going against the constitution and the electoral act. If the PDP candidate failed to get 25% of total vote cast in at least 2/3 of the local governments in the state, INEC will have to conduct a run-off election between the candidates of PDP and the party that came third. Anything short of what I have explained will amount to illegality.

What happens to the citizens' right to vote?

INEC should not have included APC candidates on the ballot papers in the first place. However, court asked them to and now those citizens that voted APC can still go to court to fight for their right. Their votes can only be void or rejected and must be included in the final votes cast. In this case, there are more voided votes than valid..
Supreme court should have called for new election without APC.

When the president is inaugurated on 29th, he may approach NASS to approve an administrator for Zamfara State. The question is what happens between May 29 and this period if INEC should take a position that is not immediately giving pdp candidate certificate of returned. The CJ of the state may take over.

You are right with your analysis but the question is this, does PDP have the at least 25% of votes in 2/3 of the LGAs as required by the constitution? It has the majority vote now, no doubt but it and INEC must prove that it satisfies the other requirement.

The APC National Vice Chairman, South South, Ntufam Hilliard Eta, says the ruling party has no option than to accept the ruling of the Supreme Court that nullified its victories at the governorship as well as state/federal legislative polls in Zamfara State. Eta, who fielded questions from journalists on Friday after a meeting of Comrade Adams Oshiomhole-led National Working Committee (NWC) at the APC National Secretariat in Abuja, said the party had learnt some lessons from the scenario in Zamfara State. He said with the judgement, “it’s a sad day for every member of the APC. It’s a very sad day for us.” When asked whether the party mismanaged the crises in Zamfara, he said, “I don’t think that the party mismanaged the crises in our Zamfara state chapter. We don’t have any option than to accept the judgement of the Supreme Court and go ahead and learn some lessons from it. That is what I can say for now.”
On his view on the place of internal democracy in the country, Eta said, “for me, I am a democrat. The issue of internal democracy is a serious problem in our country but it is work in progress. We have made a lot of stride in the party.” Friday`s NWC meeting was attended briefly by Yobe State Governor-elect, Mai Mala Buni, the outgoing National Secretary.

The Independent National Electoral Commission (INEC) says it will announce its decision on Zamfara elective positions on Monday.

Reacting to the supreme court ruling which sacked all candidates of the All Progressives Congress (APC) in the general election, Festus Okoye, INEC director of voter education and publicity, said the commission will meet on Saturday after an emergency meeting held Friday afternoon.

The APC had been declared winner of the state governorship election as well as seven house of representatives seats, three senatorial positions and 24 house of assembly seats.

The new Zamfara Governor-elect, Alhaji Bello Matawalle of the Peoples Democratic Party (PDP) has commended Nigeria’s judicial system for standing up to the truth in the discharge of its responsibilities. The News Agency of Nigeria (NAN) reports that Matawalle became the new governor-elect on Friday, as the candidate with the second highest number of votes from the last governorship election in the state.
This followed a 5-member panel decision of the Supreme Court which nullified the All Progressives Congress (APC) victory over the party’s failure to conduct primaries as contained in the party’s constitution. In a statement signed by one of his aides, Mallam Umar Mohammed, Matawalle said, “The Judgement is a testimony that the judiciary has remained fair in the discharge of its responsibilities.
“l wish to congratulate the people of Zamfara State especially PDP supporters for remaining peaceful and orderly throughout the time we were seeking redress in the courts. “l want to assure you that we will not fail in this confidence reposed in us and l want to appeal to all people in the state to continue to be law abiding as we transit into the new government,” he said. Also reacting to the new development, the state’s out going Deputy Governor, Mallam Ibrahim Wakkala commended the Supreme Court Judgement describing it as “a landmark achievement for the nation’s democracy. ” Wakkala who contested for the governorship position but lost out because he was not supported by his boss, outgoing governor Abdulaziz Yari, later joined seven other aspirants all within the APC and formed a faction which fought the governor and his supporters to a halt. Meanwhile, supporters of the PDP as well as those of other political parties in the state have taken to the streets in jubilation over the Supreme Court announcement.

Presidential candidate of the Peoples Democratic Party, PDP in the 2019 election and former Vice President, Alhaji Atiku Abubakar has commended Friday’s ruling of the Supreme Court, which nullified the elections of all candidates fielded by the All Progressives Congress, APC in Zamfara state in the last general election.

Describing the verdict of the apex court as a victory for the rule of law, the former Vice President said “nothing is as pleasing to the ears of believers, as justice being served in the holy month of Ramadan.”

In a statement signed by his media adviser, Paul Ibe, Atiku lauded the Lord Justices for putting aside the “interests of the powerful and upholding the interests of Nigeria and Nigerians,” adding that for the nation to move forward, the right thing must and should always be done at all times.

“God first, Nigeria second, must be our priority as trustees of the people. When justice prevails, the people rejoice, chains are broken, freedom is multiplied and society is enriched,” he noted.


He called on the eggheads in the temple of justice to treat all election petitions that will come their way, with good conscience and the fear of God, stressing that once this is guaranteed, the rule of law would prevail.

The ex-Vice President congratulated the new governor-elect Hon. Bello Matawalle of the PDP and the people of Zamfara, even as he assured the people that peace would return to the place in no distant time.

Similarly, Bayelsa state governor and newly-elected chairman of the PDP Governors’ Forum, Seriake Dickson has congratulated former federal lawmaker, Dr. Bello Mohammed Matawalle, on his return as the governor-elect for Zamfara and the victory of other PDP candidates in the state, following Friday’s ruling by the Supreme Court.

The governor also congratulated the leaders of the party and its teeming supporters in Zamfara for their dedication, commitment and resilience which according to him culminated in the party’s victory at the polls.

He added that the ruling by the five-member panel of the Supreme Court read by Justice Paul Adamu Galinji, which annulled all the votes of the APC and returned Matawalle as winner of the governorship election was “victory for justice and democracy in action.”

“I hereby congratulate the gubernatorial candidate of the PDP in Zamfara State, Dr. Bello Mohammed Mutawalle, on his victory at the Supreme Court whose (sic) ruling returned him as the winner of the gubernatorial election in the state.

“I also commend the leaders of the PDP and the teeming supporters of the party in Zamfara for their dedication and resilience. And very importantly, I thank the Judiciary, once again, for standing up to the expectations of the well-meaning Nigerian public as a strong, impartial arbiter that could be trusted.

The governor commended the national chairman of the PDP, Prince Uche Secondus, for what he called his exemplary display of leadership which has resulted in several victories for the PDP even during “the prevailing circumstances.”

On his part, famous constitutional lawyer and human rights activist, Mike Ozekhome, SAN, said the ruling of the apex court would go a long way in deepening democracy in the country. Ozekhome, who was the lead counsel of the Kabiru Marafa-led faction of the APC seeking the nullification of the party’s primaries, said justice has been served and rightfully so.

In his reaction, the legal luminary noted: “What the apex court has done today (Friday) is to deepen, widen and strengthen democracy and our democratic precepts. It shows that parties must maintain internal democracy and cannot whimsically, capriciously and arbitrarily operate outside their constitution, guidelines, the Electoral Act and the Constitution.

“The Supreme Court has redefined our jurisprudence by showing that when a party damages its primaries, it can never reap the proceeds of its illegalities. That is why and how the PDP that came second has today produced the governor, all Senators, all House of Representatives and House of Assembly members today in one fell swoop.”
