Business / Diamond Bank Issued 15-day Ultimatum Over Sacked Workers by Unike1(m): 1:14pm On Jul 15, 2016
An Abuja-based Legal Practitioner, Mr Frank Tietie, has accused the management of Diamond Bank Plc of unfair labour practices against some recently sacked workers of the bank.
In a letter dated June 29, and addressed to the Managing Director of the lender, Tietie said that the workers were “rudely” informed of their sack by e-mail on May 27.
He said that the action breached the provisions of Section 20 of the Labour Act on redundancy as well as “other labour regulations, standards and best practices”.
The lawyer alleged that 400 workers were affected, but the bank confirmed the sack of only 200 in a statement on May 27 .
‎According to Tietie, Diamond Bank goes further to unilaterally deduct supposed ‎long-term loans from the bank accounts of the affected workers against earlier agreed loan tenures.
‎‎‎He said such an action was unbecoming of a Nigerian bank against its staff, which was yet to recover from the trauma and shock of the unexpected termination of their employments.
“By that action, they have been further subjected to the punishment of being suddenly thrown into serious financial dire straits.
“This is despite the unblemished and meritorious services they had rendered to the bank as committed and dedicated staff for periods ranging from one to 20 years.”
He gave the bank 15 working days from the day of receipt of the letter to enter into negotiations with representatives of the affected workers or face legal action.
When contacted by the News Agency of Nigeria (NAN), the Head of the bank’s Media Relations Unit, Mr Ikechukwu Omeife, reaffirmed the lender’s claim that only 200 workers were affected.
Omeife explained that the sack was part of a rightsizing recently undertaken by the bank to “optimise cost and enhance value for the shareholders at the end of the business year”.
He said that the affected 200 employees were those whose performance records were lower than the minimum required to drive the bank’s strategic growth plan.
Omeife wondered why the lawyer singled out Diamond Bank for attack over an exercise that was a normal practice in the corporate world and which other banks had also undertaken.
The spokesman denied knowledge of the alleged loan deductions but said it was also a standard practice in the case of sacked workers with loan obligations to their employers.

This is the key message here. Laid off/retrenchment/redundancy is not the same as being fired/sacked.
When you have massive sack like you have in some banks, it is redundancy. And the law (labor act 1990) requires that certain payments be made to the affected persons. That is why the government asked the banks to pause their lay offs. Not because they can control who is sacked but to ensure the terms are properly defined and such affected staff getting their proper benefit. There is also nothing wrong with telling a potential employee you were affected by redundancy.
If, however, the person calls the person back to resign, the company has succeeded in cheating him/her of his entitlements. This is wrong and unethical HR practice. All those involved can take out a class action suit against their former employer.

Spot on. You just said it all. We often mix up or misinterpret both concepts(Sack; professionally termed as DISMISSAL and TERMINATION of employment; which could be initiated by either party). If an employee is DISMISSED, in most cases such employee was involved in some form of unwholesome practices, the organization is not compelled to provide any form of severance package, Infact litigation might follow. If the organization decides to allow you resign, thank your stars. TERMIMATION is bi-faceted. First scenario is the one explained above.(in other words, termination could come in the form of dismissal). Second scenario is when an employee is laid off/a mass retrenchment due to economic factors affecting the company or other internal disturbances. Yes, TERMINATION is used but in such a case those affected should be adequately compensated as it's no fault of theirs and YES nothing stops you from referencing that same company in your next employment. When such is the case and the employer ask you to come resign , it's grossly unethical in HR practice. The company is doing you no favour by asking you to turn in your resignation letter. All these trash exist only in a country like ours where the Labour law is weak and hardly enforced.

I think it's more appropriate to analyze this on a case by case basis rather than take a holistic view or make general statement. Yea, truly she's a young girl that ordinarily one would expect to be in the university and not talking about marriage at the moment. Again, I didn't read anywer in ur post wer u stated she's not doing something meaningful. U rightly mentioned that it's scientifically proven that with age, one gets more mature. Shd we den wait till we r 40 before we consider settling down? Considering the saying that "a fool @ 40 is a fool forever". My dear, if u av a tenable reason y u think she's rushing into marriage, u could state it. Den we can look into ur argument from dat perspective. My fiancée got admission into the university at the age of sixteen(the youngest in d class) at 21 she had obtained her 1st degree. As we speak, she holds a sensitive position as a Research Analyst in a top stockbroking firm. A feat she wouldn't av attained if she wasn't mature to handle. We shouldn't wait for a TIME set by man before we can take that bold step in life. Marriage is no child's play nd shd be treated as such. I would rather u educate her if u feel she's been hasty bt then I gues it's łate. Wot she needs nw is ur prayers and support. My submission.

U ryt on point. I noticed d quick move by Jonathan. He took very brisk steps past Obj bt d latter extended his hand nd rose from his seat. Even his handshake wif Shagari was brief nd hasty. An indication there's a axe to grind. Whatever it is, I hope dey get it behind dem ASAP.
