You can only enforce refunds on contractual agreement which can take any form. If not what are we arguing? Obtaining by false pretence does not apply here. NBA reserves the right to change the venue of their event at any time. SmartyPants: Did I mention contractual agreement? |
Politics › Re: ₦300m not a 'gift', refund or we recover through legal means - Ibas' replies NBA by Walai(m): 6:52am On Apr 16, 2025 |
It depends on the context. First the letter is a mere appeal and NBA can prove that if they wrote to other state govts and corporate agencies for support. For you to enforce it as a contractual agreement, RIVSG have to prove that the letter is a valid instrument of making an offer of which the acceptance of the offer is premised on the 300 million donation, I doubt if the content of the letter qualifies for that. The 300M is like money you give to your girlfriend with the understanding that she will be loyal, it has no legal backing in terms of refund when things go wrong. SmartyPants: Will you agree that the NBA likely wrote to Fubara and asked for donations on the grounds that they would be hosting the conference in Rivers? If yes, does changing the venue amount to obtaining by false pretense? |
Politics › Re: ₦300m not a 'gift', refund or we recover through legal means - Ibas' replies NBA by Walai(m): 10:34pm On Apr 15, 2025 |
Not true, there was no valid contractual agreement with respect to the money. It is a mere gift. What the Rivers State govt is holding unto is mere assumed understanding which does not qualify for a valid contract. The case is dead on arrival . FYI, I offered a law course on contract during school days Arapmoi22: In any court of law, whatever description used to describe that transaction is what it is. NBA cannot assume it is a gift if the description in Rivers state record of transfer is Payment to host the event. Ibas can tell what the title of that transaction is. Surely not "chop and clean mouth". |

The bolded is true he is a freelancer, a millionaire freelancer acquiring assets here and their. I still regret not venturing into Tech but as for my children, once they clock 3yrs coding and AI programming don start. Infact their formal schooling will be on part time basis. Baldwretch: The fellow is probably freelancing on Upwork.com or one of these freelance websites.
He is earning the dollar equivalent for his labour in Naira while he lives in Nigeria. I still insist that he made a very poor financial decision. He could have put this client on hold, or outsource the job to someone else, or do anything within his ability to see to it that the said client never leaves.
Three-and-a-half million earned within three months in this country is quite huge regardless of how much "pepper" you hands might have touched and regardless of where you live.
How many people earn a million naira monthly in Obodo-Nigeria as we speak? I'd say less than one percent of the general population, or you don't agree? |

He prefers foreign clients that pay more higher amount and he's already got many contracts he is executing . What I'm trying to say in all of these is that dude have touched big money running in tens of millions therefore M3.5 looks too small to him but to me it's big money because of my financial level. On the other hand, this is one mentality I hate among Africans. They acquire their talents and training here and instead of using that talent to work and contribute to the society development, they will prefer to use it in foreign countries just because of money. Baldwretch: We are praying to God to make a way for us.
But rejecting a three months contract as a senior developer that should pay you 3.5 million naira is very, very unwise. I don't know, should we call this foolishness, stupidity, both, or what? Isn't this just about coding? On a device? What are you even purchasing to do this task besides the use of your God-given brain?
And this guy would probably be required to do all he would be do, virtually - through the online space. I say this because you hinted of him getting paid in dollars. NO, this is very unacceptable. Some extremely poor decisions (financial) wear the dirty garment of stupid confidence (of getting hired elsewhere) and extremely (un)wise business negotiation skills.
Tell him to pull off that garment, or has he gotten what he does for a living?
This bro's wants to pay 200 naira for your wares and you're insisting he pays 250 naira. If he pays 200 naira, you only make a profit of 70 naira. Well, seventy naira is not good profit so you insist he pays 250. After haggling back and forth and no headway, he goes away.

I have been sad lately over the diminishing image of the once respected Nigerian army but the incident I saw today made me to weep.
