In recent weeks, the political space in Rivers State has been inundated with renewed impeachment drumbeats against His Excellency, Governor Siminalayi Fubara. These threats, amplified by a few desperate actors, may sound loud in the media, but in truth, they are hollow, baseless, and empty in substance.

Impeachment under the 1999 Constitution of the Federal Republic of Nigeria (as amended) is not a political slogan nor a weapon of intimidation. It is a grave constitutional process strictly guided by law, evidence, and due process. For any impeachment to stand, there must be clear, provable allegations of gross misconduct as defined by the Constitution. To date, no such offense has been committed by Governor Fubara. None has been substantiated. None even credibly alleged.

What we are witnessing is not a constitutional exercise but a calculated attempt by vested interests—threatened by Governor Fubara’s independence, people-centered governance, and refusal to mortgage the future of Rivers State—to create artificial tension and distract the government from its mandate. These forces thrive on chaos, not progress; on propaganda, not performance.

Governor Fubara’s administration has remained focused on stabilizing Rivers State, promoting peace, strengthening institutions, and delivering dividends of democracy across communities. His calm disposition in the face of provocation reflects statesmanship and a deep respect for the rule of law. While others beat war drums, he continues to govern.

Let it be clearly stated: nothing will happen to Governor Fubara. The impeachment threats will fail, just as previous attempts at political blackmail have failed. Rivers people are wiser, institutions are stronger, and the Constitution is clear. Noise cannot replace numbers, and intimidation cannot override legality.

Furthermore, Governor Fubara remains the undisputed political leader of the All Progressives Congress (APC) in Rivers State. His growing influence within the party is rooted in legitimacy, popular support, and alignment with the progressive ideals of the APC at the national level. He enjoys the confidence of the grassroots, the backing of well-meaning stakeholders, and the goodwill of President Bola Ahmed Tinubu’s administration.

The vision is clear and unwavering: Governor Siminalayi Fubara will complete his constitutional mandate and, by the grace of God and the will of the people, serve Rivers State for eight uninterrupted years. No amount of empty threats, sponsored protests, or legislative theatrics will derail this destiny.

We therefore urge Rivers people, members of the APC, and supporters of good governance to remain calm, vigilant, and focused. Do not be distracted by political noise. The future of Rivers State is secure, and its leadership is stable.

Fubara also should behave and carry the house of assembly members along in the running of the state.

If you ask me, the #100,000 he sent to each legislator for Xmas is an insult to them and I don't know who advised fubara to do that. It's unnecessary.

Organize a 2-Day Retreat for Executive and Legislators. Let the progress and development of Rivers State and its people be the team of the retreat. Invite erudite scholars, and mixed with former Govs, Speakers, former Senate president, former speaker house of Reps to give talks.

Present your budget to the House. Accommodate their Constituency projects into the Budget, and release their Allocation to them when they request for it. Even at the Federal level, senators and Reps members do same to Tinubu. They'll add theirs and Tinubu cannot do anything about it.

With these, things will change and the state will witness peace and move forward. Life is about give and take.

This is my own suggestions for the resolution of the crisis.

The ongoing impeachment moves against Governor Siminalayi Fubara of Rivers State have once again brought to the fore a recurring constitutional question in Nigeria’s democratic practice: Can the courts stop an impeachment process once the House of Assembly has invited the Chief Judge to constitute a panel to investigate allegations against a governor?

The simple answer is yes.

Impeachment in Nigeria is a constitutional process governed strictly by Section 188 of the 1999 Constitution (as amended). While it is often described as a political tool in the hands of legislators, the law is settled that impeachment is not beyond judicial scrutiny. What courts may not interrogate are the political reasons for impeachment; what they can and do examine is whether the procedure laid down by the Constitution has been faithfully followed.

Under Section 188, impeachment follows a sequence: a notice of allegation signed by not less than one-third of the members of the House, service of the notice on the governor, a resolution supported by two-thirds of members, and a request to the Chief Judge to constitute a seven-man panel to investigate the allegations. Only after the panel submits its report can the House take the final step of removal.

Once the House writes to the Chief Judge to set up a panel, the process has certainly advanced. However, it has not crossed the point of no return.

Nigerian courts have consistently held that they can intervene at any stage of impeachment proceedings where there is evidence of constitutional breach. This position was firmly established in landmark cases such as Inakoju v. Adeleke and Dapialong v. Dariye. The courts made it clear that while impeachment is political in nature, compliance with constitutional procedure is a legal obligation enforceable by the judiciary.

Therefore, a court order can lawfully stop impeachment proceedings, even after the request to the Chief Judge, if certain conditions exist. These include situations where the House of Assembly is not properly constituted, where there is no valid quorum, where lawmakers involved are themselves under legal dispute, or where the steps taken violate the clear provisions of Section 188. Similarly, denial of fair hearing, rushed timelines, or actions driven by bad faith can attract judicial intervention.

In such cases, courts may issue restraining orders, injunctions, or orders maintaining the status quo. These orders may prevent the Chief Judge from constituting a panel or halt the panel from continuing its work. Contrary to popular opinion, this does not amount to judicial interference in legislative affairs; rather, it is the enforcement of constitutional supremacy.

However, it must also be stated clearly that courts are generally reluctant to interfere with impeachment where due process is strictly followed. If the House of Assembly is lawfully constituted, the required numbers are met, and every procedural step is complied with, the judiciary will likely allow the process to run its course.

Applied to the Rivers State situation, the decisive factor is not the political tension or the personalities involved, but the legality of the process. If Governor Fubara can demonstrate that the House’s actions are constitutionally defective, illegitimate, procedurally flawed, or done in bad faith, the courts are empowered to intervene. If not, the impeachment process may proceed unhindered.

This distinction is critical for Nigeria’s democracy. Allowing courts to enforce due process prevents impeachment from becoming a tool of vendetta or political ambush.

In the final analysis, impeachment is neither above the law nor immune from abuse. The Constitution remains the ultimate referee, and the courts remain its faithful guardians. Whether the impeachment of Governor Fubara proceeds or stalls will depend, not on political noise, but on strict adherence to constitutional discipline.

That, ultimately, is the true test of democratic maturity.

Those handling Fubara are not helping matter at all. Since they had their quasi-settlement they would have found away to lure the House into passing the Budget of 2024 Supreme Court asked him to present into law. None of them did this and this is one case used against him since it has been decided by supreme court. Fubara was allowed to come back on political solution not that he was cleared on the offences the House leveled against him.

If the governor feels the processes weren't duly followed. The court will hear him and give advice.
Fubara didn't need to walk this tight rope at all.
The notice of impeachment will be served to his lawyer in court. This is what his detractors want . They can't serve him in Government House, they will serve his lawyers if they appear on his behalf.

Wike is a politician that wants to remain relevant in the scheme of things not only in Rivers State but in the country at large. He has started building up a network since he was the LGA Chairman. He climbed through the ladder and became the governor of the state. As a matter of fact no one came out to say he assisted Wike and Wike didn't fulfill their understanding. He showed the Odilis overwhelming love including the Jonathans. Since 1999 no outgoing governor had been able to install a preferred successor. Odili tried it, AMaechi tried it. They couldn't succeed. Wike is the first to have tried it and succeeded.
Fubara wasn't a politician. Fubara didn't have any ambition of governance. Wike promoted him to the position of state accountant general. With the issue Wike had with Atiku he felt that the best person to defend him should Atiku win was Fubara who had a lot of information about his administration. Remember they are all corrupt. Fubara seemed to be the weakest among their clique and who could sing easily should EFCC come after him. To protect him Wike had to appeal to all frontrunners for the position to have understanding to endorse Fubara. Fubara was unwilling. He knew his strength and weakness.
Eventually he accepted because the odds were clear Wike had what's required to make him the governor. Now to get the other contenders appeased Wike agreed with Fubara to make them commissioners and everyone of them should make sure they deliver their constituency in the election. Can you see how it appears that Wike appointed commissioners for Fubara? It is not truly the case.
