The body of a Hartebeespoort man was recovered on Monday after his car was swept away by flash floods.

According to National Sea and Rescue Institute (NSRI) Hartbeespoort Dam station commander Arthur Crewe, the man was travelling with his wife on Sunday when their vehicle was swept away when they attempted to cross a flooded bridge.

Crewe said they were returning home when the incident happened.

“At 20:03, on Sunday, NSRI Hartbeespoort Dam duty crew were activated following reports from the SRRU [Strategic Response Rescue Unit] of a vehicle swept away by flash floods from a low-lying bridge on a tributary of the Crocodile River in Welgegund on the Glen Afriq Estate close to Hartbeespoort Dam.

“It is believed the husband was able to break a window of their vehicle while it was being swept downstream.

The wife was able to escape through it and reached the riverbank. She raised the alarm at a nearby house where residents activated their panic alarm.

“SRRU members, an NSRI Hartbeespoort Dam swift water rescue team, NECSA ambulance services, the SA Police Services, Eagle Towing, CPF members and a police dive unit responded,” said Crewe.

During the search, the submerged vehicle was found 300m downstream.”NSRI swift water rescue swimmers, Eagle Towing and SRRU members rigged a rope system across the river and despite the fast-flowing water, the NSRI swift water rescue swimmers reached the vehicle and were able to confirm that one person remained in the vehicle.

“Police divers, deployed at the scene, recovered the man from the vehicle and sadly paramedics declared him dead.

During the operation, Eagle Towing members and their resources provided vital assistance.

“The body of the man has been taken into the care of government health forensic pathology services.

The police have opened an inquest docket,” said Crewe.

The vehicle was recovered from the river on Monday morning.

Officers at Isebania police station are on the spot for throwing into a cell a defiled minor after the girl had gone to report the case. The distraught 12-year-old girl had accused her father, a police officer, of defiling her on November 1 at their home in Nyabohanse town after luring her into his bedroom. The victim on Tuesday told the Nation that her attempts to have the suspect arrested were futile after officers turned against her. SEX ABUSE They locked her up in a bid to conceal evidence of defilement and shield their colleague. Shedding tears, the Standard Five pupil at a private school in Nyabohanse town narrated her harrowing ordeal when attempts to seek school fees from her biological father saw her sexually assaulted. She told the Nation that her father, a police officer who guarded a senior politician in Migori County before being interdicted from police service, lured her into his bedroom and defiled her in broad daylight. “I went to see him to collect my fee balance on instructions of my grandmother with whom I lived. She could not afford Sh13,890 which I owed the school so I went to my father who operates a pub in Nyabohanse town,” she said. “I was cleaning utensils when he came home that morning. He called me to his bedroom as he wanted me to do some shopping for breakfast. I was helpless as he pinned me on his bed and committed the act, she said. POLICE CELL According to the minor, she rushed out of the house weeping and ran to Nyabohanse Police Post where she reported the incident. “I reported the incident to a female police officer, who called my father and the area chief and tried to persuade me to forgive him,” she said. At about 2 pm, she was transferred to Isebania Police Station where she was placed in a cell and, two hours later, was taken to Nyayo Hospital where she was tested and given a prescription. The minor said she stayed in police custody for six days, sharing the cold floor with adults. Officers at the station, she said, allowed in her father to check on her, only to threaten the girl to drop the case. “When we visited her on the same evening she was arrested, the officer declined to release her, saying the national flag at the station had already been lowered and we were not allowed to see her,” her grandmother told the Nation. Attempts by the old woman and the girl’s mother to have her freed were unsuccessful. There was no explanation as to why she was being held that long or why she was not charged or released from custody, with the officers constantly piling pressure on her to drop the case. JUSTICE “All we need is justice for the minor. It is sad that the police, who ought to have protected her, conspired with the suspect to torment her further,” the girl’s grandmother said. “The suspect, who should be in custody, walks scot-free and was accessing the girl freher as we were denied any chance to see her.
Currently, the minor is staying with a guardian whom the Nation will not name to protect the victim.

The guardian said the girls grandmother said the medical report, P3 form, police statements and medical reports were tampered with severally to destroy the case.

“The six-day detention was a plot to conceal possible evidence of rape. Even police records and the occurrence book entries were skewed,” she said on Monday.

What shocked the mother and the guardian was the fact that the medical examination revealed the minor had been infected with a venereal disease.

But, despite all this pain, hopes for justice seem to be dimming by the day.

NO EVIDENCE

The Office of the Director of Public Prosecutions Noordin Haji says it seeks to close the case “due to lack of evidence”.

In a letter dated November 5 and addressed to the OCS Isebania Police Station, Mr Martin Mwongera, a senior prosecution counsel, says the case should be terminated.

“… after perusing police files and statements, I find no sufficient evidence to charge the suspect with the said offence,” the letter reads in part.

When the Nation visited Isebania Police Station on Monday, senior officers privy to the case declined to comment and instead referred us to Kuria West police chief Bernard Muriuki and Migori Police Commander Celestino Nyaga.

Mr Muriuki said attempts to take the suspect to Kehancha Law Courts twice on November 5 and 19 failed after the prosecution counsel cited lack of evidence.

However, he said he was not aware the victim was held at Isebania Police Station for six days.

“We want to duplicate all the files, including evidence and statements, and send back to ODPP for review for the minor to get justice,” Mr Muriuki said.

On his part, Mr Nyaga said they will internally investigate the matter and ensure the minor and the suspect get justice.

Nyamosense-Komosoko MCA Susan Mohabe called on the Independent Police Oversight Authority (Ipoa) and Mr Haji’s office to fast-track the case.

Mrs Mohabe said Kuria West police officers were yet to arrest suspects who gang-raped a 70-year-old woman a week ago.

“Women in this region have been turned into sex objects,” she said.

“Victims of sexual abuse and gender-based violence who attempt to seek justice from police have always met resistance. Some even receive threats from the same officers who should be protecting them.”

As the Nation was pursuing the story on Monday, police arrested a 14-year-old boy who defiled and killed a four-year-old girl in the same area.

Three rescue workers on a mission to help people caught in floods in southern France were killed when their helicopter crashed near Marseille.

The EC145 aircraft had been on a rescue and reconnaissance flight in the Var region on Sunday night when contact with it was lost, officials said. The crashed helicopter and the three crew were found near the town of Rove. An investigation is under way. Heavy rain in south-east France has led to severe flooding and several deaths. An Octogenarian has been jailed for 30 years with an option of paying a Ksh.1.2 million fine for grabbing land he claimed to have bought 51 years ago.Evanson Kihumba was found guilty of six counts including willfully procuring for himself the Embu land.
The 83-year-old had claimed to have bought the land from Paul Kamara (deceased) at the Embu district’s land office on December 18 1968,

The land under registration No. Gaturi/Weru/377 actually belonged to Nyaga Kombuthi and was valued at Ksh. 12 million.

The accused was found guilty of irregularly obtaining the land, forging land transfer forms for Gaturi/Weru/377 and purporting it to have been transferred to him by Paul Kamara.

Other charges include swearing false oath on December 18, 2015 that his land Title Deed Gaturi/Weru/377 had been burnt and that he wanted a replacement.

He was also found guilty of conspiring to defraud Nyaga Kombuthu of the land between June 9, 2014 and November 18, 2014, by pretending that he had bought it from Paul Kamara.

Years Principal Magistrate Samuel Mutai said witnesses who had been called by the prosecution proved beyond reasonable doubt that the man committed the offence.
The magistrate then fined him Ksh. 200,000 for each count and in default, he is to serve five years for each.The octogenarian has 14 days to appeal the sentence with his lawyer Kirimi Guantai expressing his objection.

According to him, the sentence is too harsh and is illegal as it is not provided for in the Penal code.

A man from Alaska was arrested last week for smuggling drugs hidden inside spoiled goat intestines stored in his checked luggage, US authorities said. The suspect, Cenen Placencia told investigators he planned to eat the rotten intestines, which were frozen together in a single mass inside a 21kg fish box.The drugs were allegedly found wrapped inside spoiled, frozen goat intestines. As the meat thawed, investigators said it smelled rancid. Authorities eventually pulled out 10 balls of duct tape from one intestine and discovered plastic bags inside, the affidavit said.

In a remote village in the Philippines, terrified residents saw a highly venomous Philippine cobra that had already killed a python Snake and swallowed it whole, with only its victim’s tail hanging from its jaws.

The panicked locals – who have seen several people succumb to cobra bites in recent years – whacked the predator with a club until it died.


They then cut open the cobra and found the python inside its stomach.

One villager said: ‘There are lots of snakes in our area, but this is the first time we saw a cobra eat a python.

After the cobra was killed, residents used a machete to cut it open. They estimated that the cobra was around 12ft long while the python was smaller, measuring between 6ft and 8ft.

Two unnamed men were boiled alive when their car suddenly submerged into a sink hole of scorching water that opened up in a Russian city.

The pair were trapped in the vehicle and died almost immediately.

Distressing pictures showed their bodies being lifted by crane from the 167F water alongside wreckage of their Lada Largus car.


A burst hot water pipe under a car park was seen as the cause of the horror.

In Russia hot water is piped to work under residential buildings for heating during the severe winters.

‘What an horrendous way to die – one moment you are driving a car, the next underground drowning in hot water,’ said one woman.

‘The driver noticed the ground beginning to steam – and quickly drove off.

‘Then these two man came.

‘They parked – and the asphalt collapsed right under them.’

There was an outpouring of anger with the local authorities on social media.

I got married 10 years ago when I was only 22 and didn’t do it for the right reasons.

I felt suffocated living at home – I didn’t get along with my mum’s partner, but had to live there after uni as I couldn’t find a job that paid enough to move out.

Then my husband came along and he offered a way out. I’m not in love with him though.

At first things were OK and our love life was fine too, but I definitely settled for him – it wasn’t a case of passion.

There was someone I was in love with at uni, but he ended up moving home as he was in the same position as me, so our – relationship ended.

Recently, we’ve reconnected – I know it’s a cliche trying to get something going again with your first love, but we still have strong feelings for each other.

He’s in a relationship too, although not married, and neither of us has kids.

I don’t want my life to pass me by, but should I gamble on things working out with my ex?

I’ve tried to accept my marriage and make it work, but it’s never going to happen. I’d love your advice.

It sounds to me as if you’ve made your mind up about your marriage and you certainly shouldn’t stay with your husband because it’s a “safe bet” and because things may not work out with this other guy.

That kind of thinking is what got you here in the first place.

However, I’d advise against jumping straight into something else with your ex. Both of you are in relationships and those need to be worked out first.

You need a bit of space and thinking time on your own to really consider what you want in your future.

Don’t jump into another relationship because it offers an escape route, which is exactly what you did by getting married in order to leave home.

If you’re meant to be with this guy, then take it slowly and be in the right place before starting something with him.

When it comes to ending your marriage, there’s no easy way to do it, I’m afraid. Your husband will be hurt, and you’ll have to deal with the emotional fallout and any other financial and ­practical considerations.

However, I’m sure he wouldn’t want to stay married to someone who’s not in love with him and he also deserves a chance to be happy and start again.
