The Federal High Court sitting in Lagos on Tuesday dismissed a suit challenging the use of Arabic inscriptions on Naira notes.

Justices Yellin Bogoro held that Section 53 (1) of the Banks and Other Financial Institutions Act (BOFIA) empowers the Central Bank of Nigeria (CBN) to print, design and issue the currency and compels the need to establish bad faith before an action can be brought to challenge the act or omission of the Federal Government or the apex court.

The court also held that the suit brought by a Lagos-based lawyer, Malcom Omirhobo, challenging the Arabic inscriptions on Naira notes failed to establish that the CBN’s powers were exercised in bad faith.

Omirhobo had filed the suit against the CBN in Jan. 2020 contending amongst other things that Arabic is not one of the four official languages of Nigeria namely English, Yoruba, Hausa and Igbo. He contended that Arabic is not indigenous to Nigeria and to have it on our country’s currency offends certain provisions of the Constitution.
The CBN, in its response, had filed a preliminary objection insisting that Omirhobo had no locus standi to file the matter. The bank also filed a defence.

Three other interested persons joined the suits as defendants, the Incorporated Trustees of the Muslim Rights Concern (MURIC), its Founder, Ishaq Akintola; and a Kebbi-based legal practitioner, Umar Kalgo.

After listening to all the defendants in May 2024, the court fixed its judgement for today (Tuesday).

First, Justice Bogoro dismissed the CBN’s preliminary objection and held that Omirhobo had the locus standi to institute the action of being a taxpayer. The court also held that public interest actions must be encouraged.
The court, however, held that Omirhobo failed to prove that the CBN acted Mala Fide, in bad faith and accordingly dismissed the suit.

In his reaction to the judgment, Omirhobo said he had applied for a Certified True Copy of the judgement and would study the same to decide his next line of action.

According to Omirhobo, the court also noted that Nigeria is a secular state and as such no religion is superior to the other. The lawyer also said the court noted that Nigeria is a multi-ethnic and religious country and that no ethnic group or religion is superior to the other.

The lawyer claimed that the court held that Arabic is not Nigeria’s official Language and advised that for Nigerians to coexist in harmony, perhaps it is time for the Central Bank of Nigeria and the Federal Government to remove the Arabic inscription on the N200, N500 and N1000 naira notes since it has been removed from the N5, N10, N50 and N100.

During Buhari's government, Nigeria, through the CBN, was spending according to some estimates, more than $12billion per year to maintain 2 exchange rates N440, and I think N570 to a dollar.

That $12 billion dollars was effectively a subsidy.

By the time Buhari left, Nigeria had just about $3.5 billion in its account. It is from that amount that we have to pay our debts and pay for imports of goods.

As you can see, Nigeria no longer had the $12 billion dollars required to keep naira/dollar rate at less than N600. So the current government had no choice but to give up on trying to subsidise the naira.

If Atiku or any other candidate had won, they would have had no choice than to follow the same path.

It is like buying a BMW when you had money. If you no longer have money to maintain it, what do you do, you give it up. No be so?

Your friends and neighbours who see you taking Okada will call you stupid for giving up such a beautiful car. But, younno longer have know what they don't know - you no longer have the money to maintain the car.

Eminent Nigerians in the North under the aegis of the Arewa Initiative for Defence and Promotion of Democracy, have said the harsh economic situation being faced by Nigerians is the fallout of the comatose economy handed over to President Bola Tinubu by his predecessor.

The Arewa Initiative which is also an amalgamation of Pro-Democracy Groups from the 19 northern states under the Chairmanship of Prof Shehu Abdullahi Ma’aji also stated that Nigerians should ignore sponsored protests staged against the Federal Government in Kano and Niger states recently.

Some Nigerians particularly in Minna, the Niger State capital, recently took to the streets, protesting the harsh economic situation in the country arising from recent hike in prices of goods and commodities.

Similar protests were also held in Kano and Kogi states over the hardship in the country.

Addressing the media in Abuja, the Chairman of the Arewa Initiative, Ma’aji, said pockets of protests staged in some states, were uncalled for, and the Federal Government is already addressing the problems.

Ma’aji further pleaded that an eight-month-old government was too early to be assessed, let alone criticised by people with ulterior motives
The group noted that it consulted with various Northern stakeholders and that “the North is solidly behind President Tinubu and will continue to support and cooperate with him for the actualisation of his Renewed Hope Agenda.

He said, “The current administration of President Bola Ahmed Tinubu inherited a lot of problems from the past administration of Muhammadu Buhari which it is currently trying to address.

“For instance, the Kwara State Governor AbdulRahman AbdulRazagq and chairman of the Nigeria Governors’ Forum had just revealed that the crude oil the country will be getting in the next six months had been sold in advance by the immediate past administration and the solutions to the problems cannot be instantly solved but in a gradual pattern.”

Ma’ji added, “Nigerians should show patriotism by cooperating with this administration in its bid to find solutions to the country’s problems such as inflation, corruption, insecurity – banditry, and kidnapping that the country is currently facing.

“Disgruntled politicians and other unpatriotic elements who have perfected plans to mobilise bogus civil society organisations to stage phantom protests across the country to smear the image of this administration should stop their evil machinations.”

The Arewa group, however, added that they are not averse to any form of legitimate protest to show grievances to government policy or programme provided it is done in good faith and under the laws of Nigeria.

The Economic and Financial Crimes Commission (EFCC) has arraigned the former Minister of Power and Steel, Mr Olu Agunloye, before Justice Donatus Okorowo of the Federal High court, over allegations of fraud.
Mr Agunloye was brought before the court on Wednesday where he pleaded not guilty to the charges read against him.

The Judge ordered that he be remanded in Kuje Correctional center, pending when the bail would be granted.

The EFCC in December 2023, declared Agunloye wanted on an alleged case of forgery and corruption. In a communique shared by the Commission on X and its website, the former minister’s image was displayed with a message urging the public to provide information that could lead to his arrest.

Shortly after the EFCC’s alert, Agunloye was apprehended and detained.

Digging deeper into the case, it was discovered that the minister who served under President Olusegun Obasanjo’s government (1999-2003), was being quizzed in connection with the Mambilla project.

Obasanjo had accused him of fraudulently awarding the contract for the project without the Federal Executive Council (FEC) approval. But Agunloye denied the accusations and claimed the former president was distorting facts.

Agunloye’s travails generated a lot of reactions from Nigerians. Nobel Laureate Wole Soyinka while weighing-in on the matter, questioned the EFCC’s action.
In his statement titled – “In pursuit of justice, productivity, under the rule of law,” Soyinka argued that the practice of citizen detention at the whim of either religious blackmail or secular arrogation demands curtailment at source, most especially when exercised in defiance of the law, and the pronouncements of its agencies.

“The immediate provocation for these reflections is the ongoing predicament of a former Minister of Power, Dr. Olu Agunloye, currently detained by the EFCC, in total contempt of sense and justice, or indeed, basic humane considerations. We shall not go into the merit or demerits of the charges raised against him over a 16-year-old project that bears the name Mambilla. –that is the business of the law courts,” Soyinka wrote.

“Our concern at this moment is however only partially on the basis of individual fundamental human rights. Most fortuitously, the detention of any former public servant under circumstances such as Agunloye also provokes the question: how is public interest – such as the pursuit of justice – served by such an arbitrary exercise of power?’’

The Lagos State Government has assured that its Rail Mass Transit Red Line is on course for the planned unveiling in March with all of its infrastructure nearing completion.

Giving an update in a video obtained by The PUNCH on Monday, the Managing Director, Lagos Metropolitan Area Transport Authority, Mrs Abimbola Akinajo, said the agency was “confident and comfortable that we will meet the deadline that Mr Governor has given us.”

Akinajo said the tracks for the rail system were 95 per cent completed while the eight train stations being built as part of the Red Line infrastructure were “literally completed.”

“We are implementing eight stations and that is all the way from Agbado. We have a station at Agbado, we have a station in Iju, we have a station in Agege, we have a station in Ikeja, we have a station in Mushin, we have a station in Oshodi, Oyingbo and Yaba. Now, all those stations as a point of update are literally completed. We have most of them, except Yaba, 99.9 per cent completed.

“Yaba, at the moment, is about 89 per cent completed. Now, from where we’re sitting, that means that we are confident and comfortable that we will meet the deadline that Mr Governor has given us. In terms of the track work, we’re done. If you remember, this is the one line that we’re sharing with the NRC tracks,” she said

The LAMATA MD added that Governor Babajide Sanwo-Olu had procured two sets of trains for the Red Line operations, saying, “So, we’re very confident that it will be completed by the first quarter of 2024.

“Now for us, if you will also remember, Mr Governor had procured two sets of trains. Those will be ready for the testing and operations that will start immediately after the unveiling of the rail system.
“So, we expect that to start come the beginning of March, the middle of March and that will allow us to begin to test and also to work the interfaces between NRC.”


The PUNCH reports that Sanwo-Olu had said that President Bola Tinubu would unveil the first phase of the Lagos Red Line rail in the first quarter of 2024.
