Section 4 of part II of the police Act and Regulations cap 359, Laws of he Federation of Nigeria 1990, give the police the power to arrest.
It states thus:
“the police shall be employed for the prevention and detection of crime, the apprehension of offenders, the preservation of law and order, the protection of life and property and the due enforcement of all laws and regulations with which they are directly charged and shall perform such military duties within Nigeria as may required by them, by, or under the authority of, this or any other Act”.
If you are arrested by the police, you temporarily lose your right to freedom, but you have many other rights that protect you while you are in custody. It is this basic information about what to expect, and the laws that protects you that this piece is about.
If the police suspect you have involved in a crime, they have a right to arrest you wherever you are and when they find you and it doesn’t matter whether on the street, in your home or at work.
However, they must respect the provisions of S.35(3) of the 1999 Constitution which states that
“any person who is arrested or detained shall be informed in writing within 24 hours and in a language he understands of the facts and grounds for his arrest to detention”.
