TECNO OWN THE STAGE KARAOKE COMPETITION

REGISTRATION AND AUDITION RULES

These terms and conditions (“Rules”) govern registration, audition and participation in the Tecno Own The Stage Karaoke Competition (“Competition”) of Multichoice Africa (Pty) Limited and their authorized agents (“MULTICHOICE”). Please read the Rules carefully and make sure you understand it before you enter the Competition or participate as a Contestant in the Competition. Do not enter or participate further in the Competition if you do not agree to these Rules. Your entry on the Site into the Competition and/or participation as a Contestant in the Competition, will be confirmation that you agree to be bound by the Rules.


The Rules are to be read with the Site Terms and Conditions which are published at http://dstv.com. Certain defined terms in the Site Terms and Conditions are used in the Rules. MULTICHOICE reserves the right to amend the Rules at any time and in any way in its sole discretion. The amended Rules will be published on the Website. Notification of amendment of the Rules will be by way of notice on the Website. The amendments shall come into effect immediately and automatically when it is published on the Site.


The terms “Contestants” and “Entrants” are used interchangeably in the Rules. These terms and variations thereof are references to entrants into and contestants of the Competition as well as any person who intends becoming an entrant into or contestant of the Competition.


THE COMPETITION AND THE PRIZE

The prize winner/s will be selected from the Contestants by MULTICHOICE or their authorized agents based on the Competition’s requirements and in MULTICHOICE’s sole discretion, in accordance with the Rules. MULTICHOICE’s decision regarding prize winners will be final and binding on all Contestants.

Prize winner/s will be notified by email and announced on the Competition specific page of the Site where the Competition is conducted or in the manner specified in the Rules, by the time and on the date described in the Rules.


ELIGIBILITY REQUIREMENTS

Entrants must:

– be permanent residents or citizens of Nigeria, Tanzania or Kenya;

– be 18 years of age or older on 30 September 2015;

– not have any contractual agreements with brands competing with Tecno Mobile, Mnet, Multichoice or the Africa Magic group;

– be in possession of a valid passport that enables them to travel if they are chosen as one of the successful contestants for the show;

– be able to travel and be available to shoot during October 2015 and February 2016;

– adhere to any possible shoot changes which may change the dates of travel between October 2015 and February 2016;



ENTRY INTO THE COMPETITION

In order to enter the Competition, the Entrant must be eligible and will be required to have access to a personal computer or equivalent electronic equipment with a web browser capable of accessing the Competition on the Site where it is hosted and submitting an entry.

The Entrant is solely responsible for obtaining, gaining access to and/or maintaining whatever equipment and facilities the Entrant may require in order to enter and participate in the Competition at the Entrant’s own cost.

Submitting an entry on the Site does not guarantee the Entrant a position in the show.

Submitting an entry on the Site is not an audition, it merely secures the Entrant a slot at an audition.

The Entrant may not use its entry into the competition commercially.

The Entrant must produce proof of eligibility on request.

Submission of an entry on the Site is not transferable (another person cannot perform for the Entrant)


AUDITION REQUIREMENTS

All Entrants attending an audition must:

– bring to the audition their passport, a copy of their passport and 4 visa photographs;

– have rehearsed to one of the background instrumentals listed on the Site;

– be well dressed for television in the Entrant’s best performance gear

The organizers reserves the right to refuse an Audition to an Entrant away if the Entrant is not eligible

All auditions are on a first come first serve basis.

Queuing starts at 8:30 in the morning and ends at 4:45pm.

No entrants arriving after 4:30pm will be considered for auditioning.

Venue: Holiday Inn, Dar Es Salaam

Time : 9am to 5pm


Kenya, Nairobi

Date: 4 October 2015

Venue: Hilton Hotel, Nairobi

Time: 9am – 5pm


Nigeria, Lagos

Date: 10 October 2015

Venue: 8 Odegbami Close, ABC Estate,

Adeniyi Jones, Ikeja, Lagos

Time: 9am – 5pm



PARTICIPATION IN THE COMPETITION

The Contestants selected after the auditions will compete against each other on a television show.

The Contestants agree that their performances in submitting an entry, at the audition and during the television show may be recorded, broadcast and used in any way by MULTICHOICE in any territory worldwide for as long as MULTICHOICE may choose without a Contestant being entitled to any additional payment or compensation.



DISQUALIFICATION FROM THE COMPETITION

Entrants that do not meet the eligibility requirements will be automatically disqualified.

No entries will be received or considered after the closing date.

Entrants and contestants who are in breach of the Rules or who acted dishonestly, fraudulently or unlawfully shall be disqualified and shall not be eligible to win the Competition prizes.

MULTICHOICE may in its sole discretion select substitute prize winner/s from the Competition entries if the original prize winner is disqualified.

The substitute winner/s shall take the place of the disqualified winner/s and shall be informed as soon as is reasonably possible.

MULTICHOICE’s determination and decision will be final.



PERSONS PROHIBITED FROM ENTERING THE COMPETITION

Employees and family members of employees of Tecno, Multichoice, Mnet, Africa Magic group are not eligible to participate in or enter the Competition.

Any prizes which these persons may win by participating in the Competition will be forfeited and awarded to the next suitable Contestant.



COMPETITION AND PRIZE CHANGES, SUSPENSION OR CANCELLATION

Prizes may not be exchanged for money or otherwise for any goods or services, except where such prizes may be substituted in accordance with the Rules.

The Entrant agrees that MULTICHOICE may suspend, change or cancel the Competition at any time if the Competition cannot continue for any reason beyond MULTICHOICE’s control. MULTICHOICE will take reasonable steps to notify Competition Contestants should it become necessary to cancel the Competition, which notification shall be on the Site. MULTICHOICE shall use reasonable endeavours to remedy any disruption to the Competition and resume on a fair and equitable basis to all Contestants.



PRIVACY POLICY

By entering and participating in the Competition, the Entrant agrees to the PRIVACY POLICY of MULTICHOICE published in the Site Terms and Conditions.

In addition, MULTICHOICE may require Contestants:

to be present at the prize draw or when the winners are announced;
to permit the use of the Entrant’s image and recorded performance material in marketing material without any right to additional compensation or payment;
to participate in related marketing activities subject to the Entrant’s right to decline in writing prior to participating as a Contestant.
Contestants are required to inform MULTICHOICE in writing prior to participation as a Contestant in the Competition if the Contestant declines. MULTICHOICE reserves the right in its sole discretion to disqualify a Contestant if a Contestant declines.

Social Platform Privacy Policy: Where the Competition is conducted on a Social Platform, the Entrant is also bound by that Social Platform’s privacy policy. It is the Entrant’s responsibility to access and understand that platform’s privacy policies and to comply with them.

MULTICHOICE uses personal information in accordance with the PRIVACY POLICY published in the Site Terms and Conditions.

If there is any conflict between this Privacy Policy and the privacy policy contained on one or more of the Sites or Social Platforms, the Privacy Policy contained herein will prevail to the extent of the conflict.


APPLICABLE LAW AND DISPUTE RESOLUTION

The laws of the Republic of South Africa shall apply to the interpretation and application of the Rules and the Entrant’s entry in and/or participation as a Contestant in the Competition. The Entrant irrevocably consents to the resolution of any dispute in the English language by arbitration to be conducted according to the rules of the Arbitration Foundation of South Africa in Gauteng, South Africa and at such venue as may be nominated by MULTICHOICE.


LIABILITY

DISCLAIMERS AND LIMITATION OF LIABILITY

The Entrant agrees that MULTICHOICE is unable to, and is not required to, guarantee a particular result or set of results from either the Entrant’s participation in the competition or possible winnings.

The Entrant agrees that MULTICHOICE, its subsidiaries, affiliates and MULTICHOICE’s officers, representatives, servants, agents or contractors or other persons in respect of whose actions MULTICHOICE may be held to be vicariously liable, shall not be liable in respect of any loss, damage, damages, liability, claim, expenses, costs orders or demands however arising and whatever the cause, particularly as a result from entry into or participation in the competition.

MULTICHOICE, its subsidiaries, affiliates and MULTICHOICE’s officers, representatives, servants, agents or contractors or other persons in respect of whose actions MULTICHOICE may be held to be vicariously liable, shall not be liable in respect of any loss, damage or damages however arising and whatever the cause, as a result of, or arising from the Entrant’s access to the sites or from the Entrant’s inability to access the sites in connection with the competition.

INDEMNITY


The Entrant indemnifies MULTICHOICE, its subsidiaries, affiliates and MULTICHOICE’s officers, representatives, servants, agents or contractors or other persons in respect of whose actions MULTICHOICE may be held to be vicariously liable, from any loss, damage, damages, liability, claim, expenses, costs orders or demand demands however arising and whatever the cause which may arise as a result of the Entrant’s participation in the competition and, where applicable, subsequent prize award and delivery.
