Determined to enforce the fundamental human rights of its members, Prince Taiwo Konigbagbe, Baba Oba Paramount Stool Yewa land and Mr Dele Ojugbele on behalf of Exodus Poverty Alleviation Welfare Programme, who owns and operates commercial motorcycle, commonly called Okada in Ogun State, have dragged the state government before the state High Court sitting in Ilaro.

Other defendants are Ogun State Commissioner of Police, Ogun State Attorney General, Ogun State Ministry of Inland Revenue Service and 11 others.

In an affidavit on behalf of other applicants, Mr. Konigbagbe is complaining that the fundamental rights of its members were violated by the Ogun State Government and agents of government.

The applicants are asking the court to declare that the defendants have no statutory power to interfere, direct or control the foundation, management and operation of the claimants as Private Okada Commercial Motorcycle Services Operation under Exodus Poverty Alleviation/Welfare Programme.

In an amended statement of claim by their lawyer, Mr. Babatunde Ogabi, the plaintiffs are contending that they have a right to operate as a Private Okada Commercial Motorcycle Service operator under the Exodus Poverty Alleviation programme without the approval, consent and recognition of the defendants.

The plaintiffs are further contending that its member can, under Exodus Poverty Alleviation Programme operate as Private Okada Commercial Motorcycle Service Operators without joining of the other association purportedly recognised and approval by the defendants.

A declaration that the claimants and its members can, under Exodus Poverty Alleviation Programme Operate as Okada Commercial Motorcycle Service Operators under the Exodus Poverty Alleviation Programme in the state.

The applicants are praying the court restrain the respondents from arresting and detaining its members’ motorcycles, in addition to demanding N5 million as compensation for assault and occasioning harm against its members by the defendants agents and privies.
