As discussed in our earlier blog post, a contract is an agreement backed with the force of law.   There are certain basic elements that makes a valid contract. These elements are

Offer
Acceptance
Consideration
Capacity
Intention


Offer: #1 Element

In every valid contract is an offer. There must always be a party who made the offer. An offer is specific statement of proposal from a party to another. An offer may be oral or written. An offer may be made through any means of communication, so far the person intends to be bound by its acceptance.

An offer may be made to a specif person or a group of persons. An offer is made to a specific If it is made particularly to a person which he alone could have accepted.

Scenerio 1
Mr. A agreed to sell his house to Mr. B for #500,000. This offer is specifically made to Mr. B, so Mr. Q cannot validly accept such offer because it's not made to him.


An Offer can be made to a group of persons or to the public at large and in such instance it can be accepted by any person who falls within that category.

Scenerio 2
Star lager beer, in there advert claims that any body who can get 7 Pink bottle caps of their beer product will be given #500 000. Any body who gets such bottle caps will be entitled to the amount.
In real live situation, in other to restrict or limit their liability, the include that "Terms And Conditions Apply"
