Mistaken identity you say? That second picture right up there is most likely a shot from the CCTV footage of the crime scene. He had gloves on and a head warmer - typical, right? Although lotsa innocent guys also dress that way but given that he was identified carrying out the crime on a CCTV, I'll go with no mistaken identity.
