Three Quick Ways To Checking A Defective Land In Lagos by Nobody: 6:54am On Apr 25, 2017
Getting to acquire a piece of land in Lagos could be a huge achievement, and the excitement of such purchase usually beclouds the buyers' sense of judgment. They usually hurry off to build on such land and thereafter go for perfection of the paper-works. You don't want to be told that the land you have recently invested a large sum of money to build upon belongs to a government acquisition area or has been earmarked for social projects. So here are some basic things every prospective land buyer should know:

1. Do Your Survey Plan
It is pertinent that you get a Survey Plan, at this stage. The Survey Plan must contain the name of the Owner of the Site, The Size of the Land, description of the land and the date the survey plan was made. If Your Survey Plan does not have the “Free from Acquisition
Stamp” it is a sign that something is very wrong. After obtaining the Survey plan, you should now give it to your Property Lawyer experienced in Land Matters or a reliable Independent Surveyor different from the Surveyor that did it to lodge a copy of the survey plan in the SURVEYOR GENERAL’S OFFICE so as to obtain a LAND INFORMATION CERTIFICATE .

2. Payment Of Requisite Fees
At the Surveyor General’s office, your surveyor or lawyer is required to pay the requisite fees to obtain the Land Information Certificate and he will be given a Tax Receipt. Absence of this Receipt shows that the Land Certificate Obtained for You has been forged and should be discarded. At this point, you should be insistent on obtaining the tax receipt from the surveyor or lawyer. It is your document and proof of payment of lodgement.

3. Time Check
Here, you can detect if your surveyor or lawyer is taking you for a ride. It takes between 3 to 4 weeks for the Land Information Certificate to be processed at the Surveyor General’s Office. ( It shouldn’t take longer than that under normal circumstances) after payment has been made.

If it is a good land, it will be stated that it has been zoned for either Residential or Mixed
Development land and that means your investment is safe. But if the Land you bought is a defective land, Under Government Acquisition that cannot be ratified or a committed land, then it would be better to stop any construction work going on, to cut your losses.

That a survey contains FALLS WITHIN GOVERNMENT ACQUISITION does not automatically means that it is not free. Most of such acquisitions are rectifiable and hence there is rectification procedure of land registration

Your explanation is not entirely in order. It is a very long procedure and not for a prospective buyer. The fastest way to verify if a land is free or under acquisition is by way of CHATTING, this gives you an instant result in one day. Take an independent registered surveyor to the site, pick the coordinates of the land and chart it at the Surveyor general's office and you will get the instant result .

Then after verifying the freeness of the land from acquisition you can now proceed to know other details or the nomenclature of the land as you explained.

All this is story. Just make sure omonile have not initially sold the land to someone else as long as you have done so you are fine.

I remember a friend spending over 5 m cause he is buying a land free from government acquisition, yet same size of land on the opposite side of the community sells for just 500k. It's been 7 years now government has not come for their so called land and the later even now sells for more than the so called free land he bought.

From a Property Consultant point of view, I believe the quickest way to check a defective land is to:

Get two vital professionals involved in land acquisition; a lawyer and a surveyor before ever paying for the land. this advice is for those who are willing to spend an extra cash before investing in a property. You could get a Lawyer (we usually have surveyors that work with us).

The survey will visit the land in question with the lawyer (ensure you go with them- its better) and take the coordinates. it will be cross-checked in the office of the Surveyor General to verify if it is under Govt acquisition or not. They will tell you verbally (usually called unofficial Chatting in Lagos and Ogun state because it's not documented)

Even if it is not under govt acquisition, it is not proof that the land is free from encumbrances.

For example one of my client brought the documents to a property he intended purchasing. On going through the documents, i advised him not to purchase it. He was surprised because it to about 2 mins. he asked why and I told him that the owner is alleging that the original is missing and also that the deed of assignment was not even signed. This does not totally mean that the land is fake but in terms property acquisition, it is better to run away with your hard earned money if a property has as little as 20% encumbered.

Finally, your lawyer will help you check any other documents that is necessary depending on the type of property.
