A court in Zimbabwe has convicted a couple who made love in a hospital ward in the full glare of other patients - Businessman Elton Chitanda, in July, stormed the hospital where his wife was on admission to make love to her - This contravenes laws and the couple have been sentenced to a fine of N27,000 each In July 2018, it was gathered that a prominent restaurant owner in Zimbabwe snuck into a hospital’s female ward to make love to his wife who had been admitted there. The man, Elton Chitanda, who runs Delicious Delight Restaurant in Masvingo, a city in south-eastern Zimbabwe forced his way into a female ward at Masvingo Provincial Hospital at 3 AM, to have sexual relations with his wife, Fadzai Chivende. The act was reported to have been carried in the presence of 10 other patients who were also admitted in the ward.
Prior to forcing his way into the ward, the man had argued with the hospital nurses in the middle of the night insisting that they allow him see his wife. Chitanda and his wife's conduct contravened Zimbabwe's laws and they were subsequently put before court. Reports coming in from Zimbabwe indicates that the case has come to a close with the magistrate, Peter Madiba, convicting them and handing them a fine of N27,000. Alternatively, they would be jailed for 15 days each. According to Zwnew, the magistrate accused the two of torturing other patients by having sex in their full view and making noise before he convicted them of public indecency.
Chitanda is said to have stated he did not have sexual intercourse with his wife but they only hugged and kissed before he tucked himself in with her on the bed to sleep. Prosecutors, however, insisted that the couple had sexual intercourse in the full view of Patricia Vuma, Varaidzo Chinomwe and other admitted patients. Initially the two totally denied doing anything sexual but they quickly shifted their positions when the State threatened to bring in witnesses. They then said they had a sex act but did not have intercourse. Having a sex act in a legal terms means there was arousal but no intercourse. “How big is your appetite to an extent that you had to follow your wife to hospital? Why don’t you let people die in peace instead of disturbing them with funny noise that you were making?", the magistrate reportedly asked before passing judgement. The two accused were asked to pay a fine of N27,000 each by October 12 or serve 15 days in prison.
