The Economic and Financial Crimes Commission, EFCC, Benin Zonal Office today, June 17, 2019 secured the conviction of one Akhigbe Gabriel before Justice M.G. Umar of the Federal High Court sitting in Benin City, Edo State.

Gabriel was convicted on a three count charge of impersonation and intent to defraud through the internet contrary to Section 22(2)(b)(ii) of the Cyber crime (prohibition, prevention etc) Act 2015 and punishable under Section 22(2)(b)(IV)) of the same Act

Gabriel who at various times presented himself as Mathew Swan, Mathew Chang, David Wong, Richard Swan and Mark Peter was alleged to have, with intent to defraud sent electronic messages to one Candy Selfie, an American lady in order to hoodwinked her.

One of the counts reads: “That you Akhibge Gabriel (a.k.a Mathew Aswan, Mathew Chang , David Wong, Richard Swan and Mark Peter) sometime between 2018 and 2019  at  Uromi  within the jurisdiction of this Honourable Court did fraudulently impersonate the identity of one Michael Chan by sending an American picture to Candy Selfie  a lady in America through the internet which picture and identity you claim to be our own with the intent to obtain money from her, and you thereby committed an offence contrary to Section 22 (2)(b)(ii) of the Cybercrime (Prohibition Prevention etc) Act, 2015 and punishable under Section 22 (2)(b)(IV) of  the same Act”.

Akhibge pleaded guilty to the charge when it was read to him.

Based on his plea, the prosecution counsel, F.A. Jirbo preyed the court to sentence and convict the defendant as contained in the plea bargain agreement. .

However, the defence counsel, Peter Asemota pleaded with the court to temper justice with mercy as his client was a first time offender, a youth who has become remorseful and has promised never to go back to the crime.

Justice Umar thereafter sentenced the accused to six (6) months imprisonment with an option of N2,000,000 (Two Million Naira).

There is no justification to take from another what belongs to them. Not one! Why the hurry in life. Why trying to impress people who don't really care about you.

I once met a young boy many years ago who was into online fraud. He was a crafty guy. I spoke to him about salvation and part of his rehabilitation was to learn how to code. I handed him over to guy who guided him from the basics of web development, database, to PHP to Python, Embedded systems, and hardware coding on arduino microcontrollers. He recently called me that he is presently undertaking Artificial Intelligence (Data Analysis) courses. He has built solutions for medium organizations but narrowly missed on Andela callup.

For every thing and tasks that he learnt, he posed an incredible degree of understanding. His God given talent was unleashed, a raw genius long hidden under the garment of fraud.

If I were the President, I will identify the exceptions and give them a chance to learn indepth coding in prison. I will create a special prison that will provide real solutions to Nigeria's problem. Just a wish.

First attempt or not - this is bullshit. They should be getting much harsher sentences that'll make them think twice before they ever touch a laptop.

is it that the guy impersonated alone?dont tell me he didn’t obtain money or defraud anyone yet and you’re handling such judgement seriously 6months/2million isn’t that ridiculous isn’t that what Naira Marley who was caught with peoples credit card gonna pay as fine also if found guilty?so how much fine are the ones who have defraud there victims of 20k usd ups or 10m Naira ups gonna pay?or am I missing something here?if it’s just for intent I think 2months/300k fine is enough abeg...dos politicians that steal in billions get away with it most times and a lot of them only pay back bout 20-30% of the money stolen when they plead guilty
