One of my friends bought a keke and needed a rider for balance and take hire purchase. A keke man who stays in same area with him brought a rider for him.

My friend requested that the rider brings two responsible guarantor with tangible source of income.

My friend referred them to his lawyer.
The lawyer requested for the guarantors but the keke rider has nobody except a Police woman. The lawyer advised my friend against accepting the Police woman as a guarantor for convincing reasons he shared with my friend.

The would-be keke rider started begging my friend to give him the keke and that he wouldn't disappoint him.

My friend insisted he brings 2 responsible persons with significant source of income but not Police.

The rider kept on begging, by this time my friend had travelled to another state. My friend then discussed with the lawyer on the way forward, the lawyer insisted he brings 2 other guarantors.

My friend's neighbor who's a keke rider too also started begging my friend to accept the guy. Based on compassion, my friend told the lawyer to give the guy a benefit of doubt. The lawyer prepared the usual agreement on behalf of my friend and the keke rider went with his copy.

The keke was handed over to the keke guy.
This keke rider started riding the Keke mid-September last year and since then, he has always paid his weekly due to the bank account of my friend.

My friend keeps record of every transaction even though the keke rider doesn't come to sign his place.

My friend doesn't know the keke rider's place neither does my friend's neighbor knows his place of residence. They only know he stays in another town far away.

Yesterday, there was a little misunderstanding between my friend and the keke rider. My friend actually instructed the keke rider to give the keke to a friend of his who was without money as the keke rider went on a journey with this his friend and they left at night. So no money for the friend to come back to town. The keke rider said he had no money. So my friend instructed he gives the keke to this his friend (a friend of my friend, let me call him TK) so he rides to my friend's place and then my friend would give him money to continue his journey home with the mind that the keke rider would come and pick up the keke the next morning from his place (the keke owner's)

The keke rider refused giving him the keke or money. This his friend had to turn beggar from junction to junction until he got to his home around 11p.m

This kind of pissed off my friend on hearing it. He then put a call to the keke rider, asking for an explanation. The rider first lied that the guy refused the keke, but when confronted, he admitted he refused giving him the keke because he doesn't want someone else to touch his thing.

My friend requested to have a meeting with the keke rider in his place (my friend's place) today at a given time. The keke rider replied my friend that he doesn't have that time. That he has no business going to my friend's place as long as he is balancing him weekly.

Mind you, all throughout December, 2021, my friend told this keke rider to work for himself without remitting any money to him so he could take proper care of his family during the Christmas and New year celebration.

Now, my friend requested the keke rider come to his place today at a stated time. When the time was getting near, my friend called the rider to inform him. He said he's leaving his place to my friend's. About 30minutes later, my friend called him again, then he told my friend that he couldn't come to his place. He asked him what was he going to do in my friend's place, that he's tired.

Then my friend got angry and asked of the keke, the rider said he didn't come to town with it. My friend said he should meet him in his place, he told my friend that he won't. Then my friend asked him if when he met with the lawyer the lawyer told him the keke belongs to him automatically, he said no.

In anger, my friend told him to come to his place with the keke, then he told my friend that he shouldn't disturb him. He ended the call.

My friend started calling him, by then my friend was already getting angry. When he finally picked, my friend actually said he is very stupid for how he's talking to him. Again, he ended the call on my friend. This provoked my friend who kept on calling and calling while he's not picking.

When he finally picked, in anger, my friend said he must be mad. That he should come with his keke. He said he didn't come to town with my friend's keke and he's gone to somewhere else (an area after my friend's place). When my friend kept on insisting, then he told my friend that he should do whatever he wants to do. That he should bring his lawyer and police, that if they can locate him, okay, but for now, he has seized the keke. He ended the call.

My friend called me, I went to meet him. We were calling the keke rider's line, he was wasting our credit and telling us he has seized the keke and that my friend should do his worst.

I asked my friend if he knows where he lives, he said it's in a village outside town, very far and that he doesn't even know the location like that, but if we go there, we will try to locate his place, that he can try his best since he's been there only once.

We kept on calling the keke rider, he was bragging that he had seized the keke. So my friend said God must punish his family for that statement. They started exchanging words. I picked up the phone from my friend and informed the guy that since he said he's not with the keke, we were going to his place.

Then 30minutes later while we were pacing up and down, my friend called the guy again, this time, he's with the elder sister of my friend. My friend instructed his sister to take the key of the keke.

We drove there. When we got there, we met the keke guy begging. The elder sister then appealed on behalf of the keke guy. My friend never wanted to give the keke guy the key again, he wanted the business ended immediately but the elder sister prevailed.

My friend is not comfortable, I am not comfortable. We want the keke retrieved.

My friend is a very private person but this keke rider had gone to tell his family about the issue.

My friend called me an hour ago and said he's not comfortable that the guy went with the keke napep. The keke rider is to come and take us to his house tomorrow so my friend and others know the place but my friend doesn't want the rider again. I also don't want him.

Please, can my friend terminate the contract?
Remember, the whole of December, he gave this keke rider privilege to work for himself and his family without remitting a kobo to my friend.

My friend is a very soft, generous and private person. He doesn't get angry easily but once he does, he always wants his decision respected.

Please can he terminate the contract?
Can he take the key from the keke guy tomorrow?

Can he insist on him bringing his guarantors?
Remember, the rider didn't bring a qualified guarantor initially, he was given the keke based on compassionate ground

Legally speaking your friend cannot terminate the contract since by his own admittance the Keke guy has been making his payment without default.

Your friend was wrong to have asked the Keke guy to give the Keke to another guy to drive simply because he was stranded. The Keke guy probably refused cos he knows that if he had given the guy he would probably have mishandled the Keke.

Also, your friend erred when he asked the Keke guy to give some money to the stranded guy simply because he gave the Keke guy the month of December as month of grace...what he should have done is to ask the Keke guy to make the give the stranded guy the money but to count it as part of the payment he has made to your friend.

Getting trustworthy and deligent people in the transport business is extremely difficult therefore your friend should count himself lucky that he was able to get a Keke rider who has been keeping to agreed terms by making payments regularly inspite of the fact that he is in another locality.

The decision by you and your friend to retrieve the Keke and cancel the contract is a needless ego trip which you guys should forget for now.

Trust me if your friend retrieves that Keke he will eventually regret it for the following reasons:

1 - The Keke has been used therefore it will now be regarded as second hand which means the value is now less.

2 - Any new Keke rider your brother gets will probably be much not be deligent with making his payments as agreed

Just advise your friend to let sleeping dogs lie so he can get his money in full!

1. Why didn't he your friend transfer money to his stranded friend instead of looking for trouble when there's none?
2. The keke guy pays as at when due.
3. The keke guy didn't beg to allow him use all the money accrued in month of December he did it out of good will.
4. In their agreement form did your friend state that he can select anyone to drive his keke besides the driver? Oga do you know what hire purchase is?
5. Respect is reciprocal he disrespected the keke driver and got disrespected in return case closed.

Referring to your second paragraph, the journey the keke guy went with my Friend's friend was this:

The keke rider brought one of his relatives to my friend so my friend can buy keke and give to that one to do balance and take.

The keke guy, his brother and my friend's friend then embarked on a journey to a different community they saw keke at a cheaper rate (there a politician dashed some of the villagers keke, so the villagers were selling them cheaper, presently keke is about N1.1million)

The keke guy decided to be looking for keke to recommend for my friend to buy for his brother from the village.

My friend sent his friend to accompany him so in case he would buy, it's this his friend that would ride the keke down to town.

While the rider left his normal duties to be looking for keke for his brother, my friend then told him to take the week off, that is, any money he realized this week, he should take it for himself for stress.

When the keke rider traveled to the other community where they sell keke, my friend gave him money. Before they left that community, my friend was keeping in touch and asked if they had money, as one of his friends was in that area, in a situation they don't have, he wanted to tell him friend to meet them before night fall but the rider claimed he had money.

Then at 8:30p.m, when he called his friend to know the point he was, his friend then told him the keke rider said he had no money. That was when he told the keke rider to give the guy the keke to take down to my friend's place. He would keep the keke in his place and give his friend money to continue his journey.

Why did the rider refuse?
Is the rider the owner of the keke?
Did he contribute a penny to the purchase of the keke?
Does leasing a keke out now automatically means the borrower is the owner?

My friend has every right to insist the keke be parked in his compound every every, to be picked by the rider in the morning. Many keke owners do it here.

Is it because he's very free with the rider?

Now, before you judge my friend, can you give a stranger your property worth almost a million naira? A stranger you don't know his place of residence which is even in a far community from where you are?

Can you leave your keke with a stranger who has threatened to seize the keke simply because you know no guarantor of his, you don't know his place of residence? Can you?

Can you grant a loan of N100,000 to a stranger whose house you don't know and who didn't bring a guarantor?

Before you judge my friend wrong, please answer my questions.

If you can, then I want to beg you to buy a keke napep so I refer this rider to you so you give him the keke for balance and take.

You talk as if the keke rider contributed part of the payment for the keke.

You talk as if the keke rider has automatically become the owner of the keke.

Mind you, my friend can request for that keke at any time and use. It is his own. The rider came to beg for it.

Now, we want him to look for guarantors before we will give him the keke. We can not give our property to someone who would be threatening to seize the property of my friend over a minor misunderstanding.

Let him bring a guarantor who would be held liable in case he runs away with the keke. For now, no guarantor and his place of residence is not known.

Can you buy a keke of N1million and give it to a total stranger whose place of residence you don't know? And then the stranger has the guts to threaten you of seizing the keke. Who does thatt?

And be informed he's worked only for 4months. He still has till February next year to complete his payment. Who knows what might happen in the coming weeks or months? Most keke riders usually start well, paying as at when due but as time goes on, they come up with flimsy excuses.

For the guy to threaten his boss like that now, what would happen if he fails to pay and my friend tell him he wants to terminate the contract? You can imagine what he would do.

If you will not obey your boss, then don't work under him

If you choose to disrespect your boss for whatever reason, then you must honorably quit the job.

Private property is different from public property.


Mr. Ahmed, can you count a million naira to buy a keke, and give to a total stranger who stays in a different community from where you stay, and you don't even know his house and he has no guarantor? Please answer me.

We want the keke rider to get responsible guarantors, if possible, involve a lawyer and let us know if giving him the keke on lease automatically makes him the owner or not.

We want to know if my friend, the buyer doesn't have any right to use his property simply because the keke rider is riding it.

Don't forget, it is my friend that is doing the rider favor. The rider is not doing my friend any favor.

While many keke owners collect 15% of the cost of the keke from whoever wants to hire it before leasing it, my friend doesn't collect a dime. Rather my friend puts tapolin (this is supposed to be the rider's duty and at his expense)

While many keke owners start collecting settlement the first week their riders start using the keke, my friend gives all his riders one week to work themselves and get some money before starting to pay him.

The keke rider uses money realized from riding the keke to feed his family, pay house rent, his children's fees and other bills

Whenever govt imposes any levy, my friend takes care of it

Now, go ask keke riders if they enjoy these things from the owners of their keke.

Why is he scared of going to work elsewhere? Because he knows very well he wouldn't enjoy the benefits my friend gives to them.

I believe the keke rider had the guts to threaten my friend to seize the keke because his relative is a Police officer.

My friend doesn't go to business centers to prepare fake court papers. He goes to court. He pays a lawyer for this and he bears the cost alone.

So he is prepared for any case.

The Keke owner is wrong in many ways.

First it's a business transaction and he got emotional.

I don't blame the Keke guy for refusing to hand over the Keke to someone else. Transporters do not hand over just like that.

Solution: stop all the bad blood and move on with the basic business.

Call the Keke driver and tell him to continue the weekly delivery as agreed.

ALL parties go back to the basics and move on.

Rider pays weekly and everybody is happy.

Note: The owner (your friend) should stop dealing with this particular rider directly. Let the lawyer deal directly with the rider going forward.

At this point I'm tempted to share some guidelines on the hire purchase business model in transportation.

I have been in the business of transportation for a couple of years ( not so active at the moment as I have other interests ).

Hire Purchase (HP) is a partnership. Each party has rights and obligations.

As the owner when do you have access to your asset? Remember the asset has been handed over to a rider or driver as the case may be.


1. In the case of default in payment the owner has a right to call for his asset, terminate the contract and take full possession.


2. Regular inspection. The owner may call for his asset in order to inspect and verify if the asset is being used properly and in good shape.
To make it easy both parties usually agree on an inspection schedule. This may be weekly or monthly.

3. In case of an unplanned circumstance beyond control the owner may take possession of the asset temporarily or permanently.

Example: the driver or rider may fall sick and the owner keeps the asset for some time. Another example is the Covid 19 lockdown we all witnessed in 2020. A completely unplanned situation.

Op,to make this post lot more understandable and garner more contribution,I suggest you change all this friend,friend you used up and down to names.
It maynot be their real names or just their first names.
Your friend could Mr A,the rider Mr Pius,u Mr Anthony,the rider friend Mr Jimi for eg.
Too many friend of friend of friend u used diluted the interest and many people find it difficult reading long posts,talkless when there is confusion of any sort.

Thank you every contributor to this post: whether you supported my friend or were against my friend. I enjoyed the discussion and honestly I appreciate your honest opinion. Everyone must not have the same opinion, everyone must not always agree but the ability to disagree to agree; or to see strength in our diversity is what makes us enlightened.

Update: The keke rider was notified of his invitation to the owner's place this morning with the keke so he could take my friend and a relative to know his place.

The rider agreed to honor the meeting. At the stated time, he didn't show up. He was called on phone severally, while the phone kept ringing, it wasn't picked. Then after about 30minutes of ringing, he said he was on his way to meet my friend.

They gave him time, after some time, they called him to know where he had reached, he said he's not feeling fine, and couldn't make it. �

By then my friend was beginning to get tensed. He called and called the keke rider, the rider said he couldn't make it to my friend's place. He would talk and end the call on my friend. When my friend tried tirelessly to call him, he wasn't picking.

Then he switched off his phone. My friend decided to go to the community he lives to try and track the keke and make enquiries. As he was going, he was calling the rider. The rider on noticing my friend was on the road due to vehicle sounds, he said he was on his way to my friend's place.

My friend decided to reverse and he met the driver in his street. He requested the key from the rider and told him he is free to go to court.

The keke was ridden to the car park and it's been locked.

We have resolved not to give him the keke again. No need to even bring guarantors, my friend is done with him.
