Is Prostitution Illegal in Japan?

As used in Japan, prostitution is the act of engaging in sexual intercourse with many and unspecified people for compensation or with the promise of receiving money. All kinds of sexual intercourse acts are legal and there is no penalty to those involved in the illegal act. What does this mean? Is prostitution legal in Japan? Read on to understand prostitution and whether it could lead to arrest.

Prostitution is prohibited by law, but it alone cannot lead to punishment. The reason is that the people who fall into prostitution need relief welfare rather than punishment. Although prostitution is prohibited by law, it is not punishable, and since the first time the law was enacted, the law was criticized as a ''rough law''. There have been changes in the various kinds of prostitution and sexual awareness arising in recent years, leading to a decrease in the number of people punished because of prostitution. Actions such as soliciting prostitution and soliciting prostitution in a way that is visible to the public or providing loans meant to facilitate the act of prostitution, or making or engaging in the business of prostitution can be punishable.

Sex-related particular business, as known in Japan, is not synonymous with prostitution. As outlined earlier, Japanese law defines prostitution as having sexual intercourse either for compensation before having sexual intercourse or promising to receive compensation after the sexual intercourse.

The definition of prostitution according to the Anti-prostitution law as having sex with many and unspecified persons for compensation protects businesses dealing with sexually oriented activities, including similar acts, is legal and is not included in punishment as per Anti-prostitution law.

What are the Mediation Acts of Prostitution?

As much as the Anti-prostitution law prohibits prostitution, people who engage in prostitution are considered to be in a needy position that requires assistance; a person caught engaging in prostitution will not be punished.

However, a person facilitating prostitution by perhaps providing a place for prostitution will be arrested. Therefore, the Anti-prostitution law targets people who facilitate prostitution by providing a place for prostitution. A person who engages in sexual acts with a minor will be charged with prostitution by various laws regardless of whether the other party agrees.

Special Supports by the Tokyo Police in 2022:

Following the increasing number of cases of women engaging in prostitution in Tokyo, The Metropolitan Police Department was assigned to give support, such as accompanying such women to counseling services. The Anti-prostitution law was enacted in 1956, 11 years after the end of World War II, women had no choice but to turn to prostitution, and therefore the law was enacted to protect and rehabilitate impoverished women.

In conclusion, Japanese prostitution law is structured in a way that women engaging in prostitution should not be penalized, taking into account the leading circumstance to the action of prostitution. However, prostitution is illegal, and the culprits facilitating the act are exposed. In Japan, the number of women working as sex workers nationwide is 290,000, which means that one of every 20 adult women has sex work experience.
