TINUBU IS NOT PRESIDENT-ELECT BY VIRTUE OF SECTION 134(2)(b) of the Nigeria constitution1999.

Section 3(1) of Nigeria constitution 1999, named 36 states and excluded abuja.
This means that FCT, Abuja is not a state.
S3(4) of the Nigeria constitution1999, states thus: 'The FCT, Abuja shall be defined in part ii of the first schedule to this constitution.'

The first schedule of the Nigeria constitution 1999 enumerated the 36 states with their capitals and LGAs; excluding FCT, Abuja. The same first schedule of the Nigeria constitution 1999, separately defined FCT, Abuja, and its area councils.

This means that FCT, Abuja is not a state.
By s.298 of Nigeria constitution 1999, the FCT. Abuja is described as, shall ( mandatory) be the Capital of the Federation and seat of the Government of the Federation.
By this section, the FCT, Abuja, is not a state.
From the above constitutional provisions, Tinubu is not a President-elect because he did not score 25% of the votes cast in FCT. Abuja; and therefore cannot be lawfully sworn in as President of Nigeria, on 29th May, 2023.
Indeed. any attempt to swear in Tinubu as President of Nigeria is unlawful, unconstitutional, undemocratic; and those involved in so doing are going against the constitution of Nigeria, they swore to protect.

By S.1(1)(2)(3) of the Constitution of Nigeria 1999, the constitution is Supreme, any other law, the declaration of Mahmood Yakubu, the Electoral Act 2022.
Any Institution or authority, that made any decision contrary to our constitutional provisions is null and void ab initio, and is of no effect, as it does not exist in the first place.

What Mahmood Yakubu had done by declaring Tinubu, President elect is illegal, unconstitutional, immoral, undemocratic, lawless; and is an action aimed at causing anarchy in Nigeria.
By S.64(9) of Electoral Act 2022,
Mahmood Yakubu is guilty of announcing false result by declaring Tinubu, President-elect; and is liable on conviction to a fine of N5million or imprisonment of not less than 3 years or both.
We cannot afford to continue sweeping illegality under carpet; because it is causing mediocres to remain in power and constantly underdevelop Nigeria and Nigerians.
Nobody or institution or authority should be seen as being above the law, if we must enthroned peace to enable us progress and develop.
