Air Nigeria's CEO Arrested Over N5billion Tax Debt by Ptimes: 2:21pm On Jun 19, 2012
The Federal Inland Revenue Service (FIRS) has arrested the Managing Director of Air Nigeria, Kinfe Kayssay, for alleged failure to remit about N4.9billion tax revenues due to the Federal Government.

The arrest of Mr. Kayssay is in pursuit of the drive by the tax Service to recover over N170.I billion outstanding taxes owed government by various public and private organisations as well as ensure that all taxpayers are captured in the tax net, the tax agency says.

Not his fault, the chairman of the airline Mr Jimoh Ibrahim obviously ordered him not to pay. Business men that are politicians hardly pay tax in Nigeria.

INVASION OF AIR NIGERIA OFFICE BY FIRS
The Federal Inland Revenue Service (FIRS) stormed Air Nigeria office on Monday, 18 June 2012, with mobile policemen armed with guns to demand for past taxes allegedly owed during the period when Mr. Richard Branson of Virgin Atlantic was running Virgin Nigeria, now Air Nigeria. These taxes have been in dispute and needed to be reconciled and agreed upon.

The FIRS is however not patient with such reconciliations but resorted to a military approach in a civilian era.

Air Nigeria is not indebted to the government on current taxes since the acquisition of the airline by Dr. Jimoh Ibrahim, OFR. We therefore consider the FIRS action as uncivilized and condemnable.

We are at a loss as to what the FIRS has been doing for the past 8 years without collecting the taxes from previous management of the airline. We assure the general public that Air Nigeria cannot be intimidated by this crude approach and will not be ready to give bribe to any person no matter how highly placed. We will brief the general public as the issue progresses.

It should be noted that since the commencement of international operations on the Lagos - London route, Air Nigeria has become the object of an orchestrated attacks that show clearly that this is a case of the voice of Jacob and the hand of Esau. In following the external influence, local staff of the airline went on strike in May for May salary which the management has resolved amicably.

As the airline was coming out of that, the news of it being grounded by the Nigerian Civil Aviation Authority (NCAA) infiltrated town. Again, as the airline was coming out of this with a clean bill of health, barely two days after, the airline is yet invaded in a military manner. We suspect that one other line of action will be coming in the coming week to further attempt to damage us in the public eye; but we assure the instigator of such uncivilized approach that Air Nigeria will not compromise its corporate values and development strategy.

wonder why Nigerian buisnessmen makes fool of themselves in the open. Is Jimoh Ibrahim telling me he didnt go through the books of Virgin Nigeria before he took over the operations? Thought while buying a company d liabilty is yours unless stated odawise, the company should not come up with a silly excuse of witchunting. They should pay. Always hiding under one disguise or the other, the Govt should go ahead and arrest all those defaulters(tax) that flaunt ill gotten wealth. Am talking as if the Govt is even an upright one? Messed up country!

Perhaps your limited knowledge should know that your president's name is Goodluck 'EBELEMI' Jonathan.
A typical IJAW man with no Ibo connection whatsoever.
Furthermore if your 'LIMITATIONS' can allow you, then you should know the Ibos have the least percentage
in the LOOTING of the national treasury since independence. Their clever and no nonsense approach
to doing business which other parts of the country is too lazy to emulate is the simple reason why YOU ARE SO DELUDED.

FIRS Sues Jimoh Ibrahim, Air Nigeria, for forgery, N5 billion Tax Fraud-NAN

The Federal Inland Revenue Service (FIRS) has filed charges of evading five years tax payment of N4.86 billion naira and forgery of Tax Clearance Certificate (TCC) against Air Nigeria.

A copy of the charge filed at the Federal High Court in Abuja was exclusively obtained by the News Agency of Nigeria (NAN) in Abuja on Wednesday.

Mr Jimoh Ibrahim, the company’s Chairman, Mr Kinfe Kahssaye, Managing Director and Air Nigeria Development Company Limited (formerly Virgin Nigeria Airways Ltd), were joined in the 10-count charge.

The suit comes barely 48 hours after the service arrested Kahssaye in Lagos on Monday.

He was flown to Abuja same day and detained by the service and released on Tuesday afternoon.

An official of FIRS, who confirmed his release to NAN, said the service met with Ibrahim on Tuesday, but did not reach any agreement on the payment of the tax.

In the charge, FIRS accused officials of the indigenous airline of illegally obtaining Tax Clearance Certificates.

They were also said to have unlawfully presented the fake certificate to the Minister of Interior for the renewal of expatriate quota positions for 20 pilots and 10 other persons.

According to the FIRS, the accused persons failed to deduct and pay taxes accruing to government from Withholding Tax and Value Added Tax (VAT) from 2007 to 2010, totaling N4.86 billion.

The charge said Air Nigeria and the accused persons failed to deduct at source, N394.16 million being taxes accruing to government from withholding tax between January and December 2006.

Similarly, the company was said to have failed to deduct withholding tax of N775.20 million being 10 per cent of the payments for direct services as prescribed under the Companies Income Tax Act.

The offence, according to the court papers, is punishable under Section 40 of the Federal Inland Revenue Service (Establishment) Act No 13 of 2007.

The accused were also said to have failed to file annual returns of the company for 2011 with the FIRS, as prescribed by Section 55 (1) of the Companies Income Tax Cap C21 Laws of the Federation of Nigeria 2010.

The charge said the failure to file annual returns ``was with the connivance of Ibrahim and Kahssaye; and you hereby committed an offence punishable under Section 55(4) and (5) of the same Act.''

According to the FIRS, some officials of Air Nigeria, sometime in January ``made counterfeit of tax certificate, purportedly issued by the FIRS in favour of Air Nigeria Development Company Ltd.
