By the ethics of education, it is wrong for the lecturer to penalize them due to lack of evidence during the exams.
But if it were me, I'll just score them very low and wait for summons to prove my case if necessary. There are few things that infuriates me as much as scholars 'copying'. It boils me down to my soul and I've never been one to tolerate such nonsense. I trust my sense of judgement and look out for these when I assess scripts.
What kind of 'dummies' that can't think for themselves are we training and graduating these days?

Honestly cases like this make me abhor examination malpractice. I go to the exam hall prepared spiritually, physically, mentally and otherwise even those times I don't know what to write, I just go submit than looking for who to give me answers or who to give.
