Secondly, the other biological parent (in this situation, the mother), or another legal guardian or family member of the child can request the termination of an absent parent’s parental and legal rights if they can prove that the absent parent has acted in a way that does not promote the child’s best interests. The foremost means of proving this is via abandonment of the child, that is, if the absent parent has not seen or contacted the child for at least four months. Another is via neglect. I have this much to say, any man that impregnates a woman, denies the paternity of her child and puts her integrity and person to question but returns when she had had to be a single parent all her life should know that he is in no place to demand access to that child's life; it was not your child 16years ago, what changed?? 21 Likes |

The only problem I see here is the girl grew up without knowing the truth. She should have known all this years so that the anger will build inside of her on how the father abandoned her. falcon01: Very funny especially the first statement. If you read my statement, I said, the mother agreed the man is the real father and she never denied such according to your statement. If she denies, DNA would be required and since there is no need for such, the man is still thr father. His irresponsibility does not deny him the girl. However, it would definitely deny him of custody. Think of this, if later in future your sister's pass, the will now categorically states she's not his daughter or some other issue arises that the girl knows the man is not her real dad, don't you think she would hate her mum for keeping such away from her all these years.? Then, it would be more worse and irredeemable because she would be wiser and better to take drastic decisions. The real father cannot take custody but let the girl know her real father. Let all necessary arrangements be made to take some responsibility. It is not for today but the tomorrow we all don't know. Paternity issue is a serious issue that should be handled with caution and not threat or victimization hence, let the welfare department take charge and you would be glad you did. 1 Like |

Ayotemide: That is why women should take necessary steps whenever a man denies a child's paternity . It is very easy. Go the welfare office, he and his family would be invited, counselled and if he still insist, he would sign documents agreeing not to claim the child which in future would make him loose everything because by then, the court would have ruled and if possible another man would have adopted and taken custody. The case ends there forever and ever. The problem women have from experience is that, they still have an iota of feelings for their child's father probably due to culture or religion. It would make them move on with the hope that oneday, someday, the man would come back. They are always been taking for granted which they accept. Even if the man comes after 40yrs and what I said above has not been done, he can still claim paternity. 2 Likes |

niaralandtopuser: Definitely, she can. However, it should be done properly. Let me reiterate, see, put feelings aside and take necessary steps. The man can fight for custody which he knows he won't get but just to tell the woman she has no right to dictate for their daughter. Like I said, issues like this can be funny at times if the woman does not act fast, the young girl will find it hard to decide. The man to me has facts and knows what to do to get his daughter hence, his decision. He would want to start being a responsible father so as to win the heart of the young girl. No need for any family meeting, let the court decide for them and luckily, most judges in family court are women, she would get custody. The deed has been done. It is left for amicable solution. Ladies should learn to close their legs and if they can't, make sure they do court wedding and if it's not visible and their is any child out of wedlock, let the welfare agency take necessary steps to avoid loosing in all sides. Don't put any sentiment, feelings, pleadings from family and friends. It it bornes down to this, sometimes, you might be at the loosing end. 1 Like |

Tell your sisters husband to start abduction process on the girl. Legally the efulefu has no say. Secondly, ask your sister to invite him to the family house, then make sure you use matchet to pursue him and his people. Thirdly, the girl will know only what you and your sister tell her as truth. Make sure you spoil her mind over years where that idiot dey. You can't just get a woman pregnant, run away without support and return after 16 fu. kin yrs to claim paternity. Even a biological father, who had been there for her kid since birth can be denied custody if he was an alcoholic, has no job, or seem not be the right figure in the life of the child. In other words, the law is against irresponsible fathers, and doesn't give a shit about DNA. A situation whereby the father denied his unborn child. Even after her birth, he never visited or took responsibility for 16 years. Only to come out of the blue to claim responsibility? He needs about 50 strokes of cane, and be mandated to pay monthly child support, without still having custody of the kid. That is the law operating on an objective stance, without sentiments involved. Even if the girl child wants to be with the father, the court will see to it that she doesn't. He is utterly irresponsible. His type doesn't even need an audience in court. It takes much more than sperm to father a child. Op, if that your sister no get a sense, talk sense into her.
