aswani:Please accept my unfettered apologies if I mis-categorized your political affiliation. I am for whomsoever will do good for Nigeria. May we cross path again. |
aswani:So, the 2023 presidential election was marred by massive irregularities, blatant rigging and brazen non-compliance with extant laws governing the electoral process in Nigeria. INEC even shut down its portal for over 24 hours due to what it called technical difficulties and glitches. You know what that means. Now, I am severely limited in the extent to which I can fairly discuss the foregoing with someone who obviously may not have legal training. The other limitation is that those who have erred on the side of the aforementioned aberration will forever defend their position argumentatively, making any meaningful discussion of the subject a novum. That being said, the collation, declaration and issuance of a certificate of return to Ahmed Tinubu in this election is contrary to the provisions of Sections 25; 47(2); 60(1), (2), (4) and (5); 62; 64(4)(a) & (b); 70; and 148 of the Electoral Act; Section 38 of the INEC Guidelines and Regulations; Sections 2. 8.4; 2.9.0; and 2.9.1; of the INEC Manual For Election Officials, 2023; and the Judiciary. And, in the Federal Capital Territory, Abuja, where the total valid votes cast was 478,923, according to Inec, Ahmed Tinubu, if the APC secured only 90,902 (19.76%) of the votes against Atiku Abubakar's 74,194 (16.13%); and Peter Obi's 281,717 (61.23%). Your argument, however, is that the people of Abuja do not have two heads to make them superior to other voters. This is a pedestrian rebuttal that, with all due respect, only someone illiterate in constitutional jurisprudence could make. A constitution is the birth certificate of a nation. It is the organic law, the fons et origo, and the fundamental norm. We have established case law in Nigeria e.g. ROSSEK V. ACB LTD (1993) 8NWLR (PT 312) 382; DAPIALONG V. DARIYE (2007) 8 NWLR (PT 1036) 332. For clarity and better understanding of the issues, I invite you to read Section 134(2) of the 1999 Constitution if you have not done so, and read it again if you have. It is very important to note that the law provides for two requirements which are conjunctive and not disjunctive, that is, (a) the candidate must have a majority of the votes cast at the election; and (b) he must have not less than one-fourth of the votes cast at the election in each of at least two-thirds of all the States of the Federation AND the Federal Capital Territory, Abuja. Candidates must meet both conditions of 25% in 24 states and 25% in the FCT, Abuja. One without the other will not work. To determine whether a candidate must win 25% of 24 states apart from the FCT, Abuja to be declared winner, we must consider the provisions of Section 134 against the background of a common reading of Sections 2(2), 3(1) & (4), 48, 297, 298, 299, 301 and 302 of the 1999 Constitution. Section 2(2) of the Constitution of the Federal Republic of Nigeria states: "Nigeria shall be a federation composed of States and a Federal Capital Territory." The section did not just say "States". It added "and the Federal Capital Territory". While it is true that a literal reading of Section 299 of the Constitution of the Federal Republic shows that the Federal Capital Territory is not a state, from the words "as if it were a state" contained in the provision, Section 229 actually grants the FCT the benefits accruing to states in Nigeria and ensures that it is treated as such with respect to legislative, judicial and executive powers. Section 299 does not confer on the FCT the status of a subdivision of a state for the purposes of Section 134. Cumulatively, the only logical conclusion is that Sections 134 and 299 are not mutually exclusive or inconsistent. On the contrary, Section 299 actually supports and complements Section 134. Look, I am not out to litigate a matter that has already been decided, and we are definitely not in a court of law. Ahmed Tinubu is the President today, even if some of us rightly disagree that his fraudulent emergence is constitutional. My limited contribution in this regard is to nuance the false claim and challenge to the contrary by your camp in an obvious attempt to legitimize a brazen and oppressive attack on our country and constitution. That those with money and power can compromise the electoral and judicial process to achieve a particular outcome does not make it legal or constitutional, and to support and celebrate this criminality makes the celebrant, in my humble opinion, both criminally culpable and ignorant. I do not expect you to agree, at least not publicly, and I take special note that you have not been reduced to the usual insults and foolish braggadocio of APC defenders in your engagement so far. Bravo!. May I ask, are you really one of them? ![]() |
Russia is as weak as jelly. The fuulish invasion of Ukraine has exposed Russia to the world as a weak, dilapidated and ineffective fighting force. Crying "nuclear" every eke market day further underscores Russia as a catastrophic failure. |
bennybuhari:Someone once said that if you want to hide something from black people, put it in a book. We need to make better friends with bare-knuckle record keeping. There was a reason for shorthand. Remember Pitman's shorthand? The lady did the job she came to do, while our brother did what we do best, which is fill the position. |
UltraSolid:C'mon bro. You can't possibly ignore the message but attack the messenger. That's a low blow. Debate the lady with the content of her post, not her gender. |
aswani:The last paragraph of your reply gives me great joy and I wish every Nigerian could agree with us. Now, the other issues you discussed will remain a matter of personal opinion, which you are entitled to, by the way, but not Abuja. Abuja is a constitutional safeguard in the same color as the US Electoral College. If the US was Nigeria in 2016 Hilary Clinton vs. Donald Trump, I think you would also argue that since Clinton won the popular vote, she should become president even if she fell short of constitutionally required 270 electoral college votes to win. We must stop repositioning situations to suit our purposes in Nigeria. Not if we hope one day to build strong institutions and a just and equitable society. And, am I an Obidient?. I am a Nigerian. Nigeria first. |
Prime Minister Narendra Modi is here to defend India's interests, not Nigeria's. That is what a leader does. It is still about the oil and gas located in the SE and SS. Can anyone imagine what our lives in Nigeria would be like if these resources were deposited in Yorubaland?. Anyway, with the ongoing war in Ukraine, and the increasingly frosty relationship between Russia and China over North Korea, India wants to secure further access to cheap oil. A backup plan. That's why the man is here, not because some Ikwerre drunk has suddenly become sober. And why was he not received by his counterpart? Abi body dey do Tinubu ni?. With this optics, it is now clear that Shettima's sidelining has begun. 2027 on their mind, or in case Emilokan becomes incapacitated. By the way, Bianca is Igbo, such a beauty. Just a subtle reminder for some of you scratch faces. |
HugoBoss10:Hehehe, go and verify. In Wike's voice, go and do what?, verify! ![]() |
Richtaiwo:God bless SE!. And oh, have you eaten?, or are you are still canvassing for Tinubu on an empty stomach?. Onokpasa and Dokubo before him have told you urchins say the man no send una. Look who's chopping 🍗 now, Daniel Bwala of the pfee dee pfee ![]() |
aswani:First of all, let's be clear, Ahmed Tinubu did not win the 2023 presidential election. You know it, as does every Nigerian, including his CIA handlers. He is not even qualified to run on account of his certificate forgery and criminal conviction. That being said, Peter Obi left the PDP after the shenanigans of Nyesom Wike and Atiku Abubakar, and in a short 8 months shook the very foundations of politics in Nigeria, dislodging your Lord and Savior, Tinubu from the very Lagos he claimed to own in his wake. Abuja, a must-win territory under the constitution, also fell into his lap. You see, it is only because Nigeria is a shamelessly corrupt enclave that people like you are allowed to speak. If the shameless and ignoble Inec or the Supreme Court in-Justices had the integrity to perform their duties and not pander to their personal greed and cowardice, Nigeria would have President Peter Obi today. Lastly, do not dwell on the belief that the brazen electoral robbery of 2023 will become a mainstay in Nigeria. The PDP also left the stage after a long 16 years of rigging elections like your APC is doing now. |
Any arrangement in Nigeria's opposition that does not have Peter Obi's signature is dead on arrival. The Obidient movement has stamped its authority with the millions of votes cast on behalf of the man they stand behind.and they will go wherever Peter Obi goes. The winning ticket as I see it is Obi/Kwankwaso. Atiku need to become a kingmaker. As for agbadorians, they will cry like bitches in a bid to make you believe anything that is not APC is impossible. An announcement is coming Sooner that they'd expect. |
Paraman:Hallelujah!. How soon please?. Time to finally sell that gas for what it's really worth. Ask Qatar. |
This man should be forbidden near a microphone 🎤. He has increasingly become an embarrassment to himself, his family, the church he pastors and the body of Christ. |
lgbosCriminals:Thunder scatter your mouth dere. |
IseOluwatoyosi:Who died in Nigeria?. You sure say you get sense like dis?. |
One critical question that must be asked is, why do members of Nigeria elite class always die in foreign lands?. They are them that has stolen enough to avail themselves foreign medical care at the detriment of those they are appointed to serve. How many poor soldiers have died because this man and his class in the military have not done right by them?. May God forgive his failings and comfort those he left behind. |
richeeyo:But you and your gang told everyone there are no Yoruba in the Southeast. Guess this one is a ghost. |
Bobodee09:Way better than the lead gutter packer role they gave efulefu Joe Igbokwe in Lagos. |
Tabithatim:I hope some of you tribalistic urchins read this?. Shey Yomi Jaye na Igbo man?. Una See correct appointment so?. Na dat ijiot wey gree collect gutter commissioner in Lagos I blame. |
It's called self help. That what we are all doing in Nigeria. Whether you provide roads, electricity, water or forcefully remove an extortion checkpoint or checkpoints in your neighborhood, they are all self help, therefore justified. |
olalat:You know say na your papa be first class ignoramus. You and your slowpoke father should be ashamed of your useless selves by him releasing you as sperm between a woman's legs in place of a tissue paper where you rightly belong. What do you know about River Basin commissions in Nigeria, kid?. Nothing. Go play with your toys and enjoy your 30k stipend. Beware of your skull out there in Yorubaland. |
sreamsense:Lie Lie pants on fire. Southeast is, and remains Nigeria gas headquarters, think what that is in relation to oil deposits. Let me school your empty skull, take away Igbo engagement in Lagos, Lagos will immediately become a shadow of its former self. Should I repeat that for your empty, boastful skull again?. Igbo capital, resilience, ingenuity and taxes drives Lagos. Go to Alausa and look at the books, who are the landlords in Lagos?. Yoruba continue to earn the reputation we already know you to possess. How about turning Osun, Ekiti, or in fact, any other southwest state or city to Lagos or a shadow thereof ?. By the way, and that will be assuming you have the means to afford anything worth a mention, the next time you make most purchases, you probably just further enriched an Igbo man who may be sitting in his village mansion in your hated Southeast. That's the nature of the beast. We own you. Ewu!. |
olalat:You attempted to make sense, but unfortunately, you only ended up confirming that which I had long suspected. My apologies to myself for wasting my time on an individual whose intelligibility capacity is clearly absent or at best, hollow. Beware of agberos. One has been promoted your overlord. |
olalat:If I were to position myself as an apologist for failure, as you have, I'd still be ashamed to be a mouthpiece for those who continue to ruin this country. If this is about the River Basin Authorities, which is a federal instrument by the way, how about funding them all equally? The government you support has taken graft and nepotism to new heights, so it is impossible to expect anything other than the garbage you wrote. .Apologist. |
Rubbish. Shey una wan export agberoism, and this time, digitally. Who commissioned Lagos State the as the coordinator of anything. What is Tinubu and APC going to do with the collected data?. Mumu sophisticated slaves. Tell Tinubu to fix the nationwide death traps called federal roads. This ought to be on his priority list, not useless slogans. |

She's right. They are not ready to be billed undeservedly. To carry the responsibilities of an entitled, grown adult who is not handicapped. Nonsense!. |
porthouse7:So do yours. |
Sleekfingers:Did you not learn how to construct simple English sentences, or did you not attend a formal academic school?. Please come back when you do. I no dey waste my time arguing with people wey no gree get sense. |
