The appeal court in its ruling yesterday on a case filrd by Dr umar ardo challenging Nyako's election as PDP flag bearer ruled that Nyako emerged PDP's flag bearer illegally becausr ardo was discriminated but did not order for re-election because of some provisions of the electrol act according to the court.

There was nothing like coming third in the main election as reported by naijapundit , the court actually removed him due to irregularities in the primary elections.

Justice Igwe pointed out that the evidence before the court proved that the fundamental human rights of Dr. Umar Ardo, who showed interest to participate in the primary election, were trampled upon by denying his supporters nomination forms to participate as delegates."

The judge also stated that Dr Ardo failed to prove to the court that he participated in the primary election in which Nyako was declared winner; he therefore ruled that Ardo lacks the constitutional powers to challenge the outcome of the election since he was not a participant in the controversial primary election.
On the jurisdiction to hear the matter, Justice S. Denton-West held that Section 87, sub-section 4 empowers Federal High Court, state High Court and the FCT High Court to preside over such complaints brought before them. Is it not money they use to conduct elections Why is d judge calling for a fresh election when it is clear someone came 2nd & 3rd. I don't get it.

Any polititician sacked by a competent tribunal should be made to return all salaries and emoluments he received and should be deemed to never been a governor/LG chairman/senator etc.
