A Saudi woman condemned to death for “witchcraft” is still clinging to hope that King Abdullah will spare her life after Human Rights Watch appealed her sentence.

Fawzi Falih faces imminent beheading for sorcery unless the King issues a rare pardon. But the influential rights group has stopped short of asking for intervention from foreign governments in the case, which has captured international attention and highlighted discriminatory aspects of the Saudi justice system, where courts often fail to follow due process.

Such was the case in the trial of Ms Falih, Human Rights Watch argues.

Religious police arrested the illiterate woman in 2005, allegedly beating her before forcing her to fingerprint a false confession. Her accusers included a man who claimed that she rendered him impotent with her sorcery.

In April 2006 the Saudi courts ruled the woman should be put to death to “protect the creed, souls and property of this country”. In a letter sent to the King this week, Human Rights Watch wrote: “King Abdullah should halt the execution of Fawza Falih and void her conviction for ‘witchcraft’.

“The religious police who arrested and interrogated Fawza Falih and the judges who tried her in the northern town of Quariyat never gave her the opportunity to prove her innocence against the absurd charges,” it said.

Christophe Wilcke, the Human Rights Watch researcher in charge of the case, said: “I do feel that we have hope that she will be saved, by demonstrating how many things went wrong in her trial, and that we can persuade the King.”

Mr Wilcke said that Ms Falih was tried for the vague crime of witchraft and was convicted on the basis of faulty evidence. Apparently, Ms Falih’s lawyers were not even allowed in the courtroom. The trial, Human Rights Watch argues, failed to meet the Kingdom’s own standards of justice.

However, under Saudi law, Ms Falih has run out of avenues to appeal her sentence. Her life can only be saved by a rare intervention from King Abdullah. The last time he issued such a pardon was in December, for an 18-year-old girl from Qatif who was sentenced to lashes after she was gang-raped.

Her sentence was reversed in response to a chorus of international protest, which included rare criticism from Washington, Saudi Arabia’s long-time ally.

This time, Human Rights Watch has stopped short of asking for similar intervention: “This is a matter for Saudi to deal with,” Mr Wilcke said.

CNN.com is reporting about a marriage in Saudi Arabia between a 47-year-old man and an 8-year-old girl. What is the basis of the marriage? The girl's father owes one of his "close friends" money so he is giving her to get the debt forgiven. His debt may be forgiven but his action should never be.

In fact, this is the third daughter that he has given up this way.

This really just opens up a floodgate of existing problems in Saudi Arabia.

This man is married but he is separated. However his wife is not allowed to fight for her daughters because she does not, being a woman, have the same rights as her husband. Further the girls have no rights being essentially chattel.

Now it would seem that their "religion" would stand up for right and wrong but no such luck. Saudi cleric Sheikh Abdul Aziz Al-Sheikh says it's alright for girls 10 or 12 to marry.

Not to be outdone by the spiritual leaders of this country, the law's judge Sheikh Habib Abdallah al-Habib refused to annual the marriage of the 47-year-old "man" and the eight-year-old girl. Oh, he did say the old guy had to keep his hands off of her until she reached puberty. Yeah, that'll happen.

What about these poor girls who are treated as so much livestock?

Apparently, according to sources in the CNN.com article, these girls lose all sense of security and nurturing. Further, they become very depressed and hopeless.

However, these so called national leaders say that not allowing girls to marry at these ridiculous ages is being unfair to the girls.
If you're a female reading this article and you had to marry at 15 would you rather marry someone 18-years-old or someone 47-years-old? Yeah, that's what I thought.

Then the world forced them to save face

CNN) -- A[b] court in Saudi Arabia has granted an 8-year-old girl a divorce from her 47-year-old husband, after twice denying the divorce request previously, local media reported Thursday. [/b]

The marriage sparked condemnations around the world from human rights groups and U.S. and other government officials when it first came to light in December.

Local media, which is highly regulated by the Saudi government, reported that the court in the city of Onaiza approved the divorce decree Thursday, and the divorce is final.

A source at the court told the Saudi daily newspaper Al-Watan that the divorce "came after a series of pleas made by a number of officials in the region to the husband."

CNN efforts to reach court officials, the husband and the girl's father have been unsuccessful.

According to the attorney for the young girl's mother, the father of the girl had arranged the marriage between his daughter and a close friend of his to settle his debts with the man.

When the mother went to court to try to get the marriage annulled, Saudi judge Habib al-Habib rejected the request on a legal technicality. The judge ruled that the mother -- who is separated from the girl's father -- was not the child's legal guardian and therefore could not represent her in court, according to the mother's lawyer, Abdullah al-Jutaili.

However, the judge required the girl's husband to sign a pledge that he would not have sex with her until she reaches puberty, al-Jutaili said. The lawyer said in the original marriage agreement, the father of the girl stipulated that the marriage would not be consummated until she was 18.

The judge also ruled that the girl could file a petition for a divorce when she reached puberty, al-Jutaili said.

The young girl lives with her mother, the attorney said, and was never told that she was married.

When the initial petition to annul the marriage was rejected, the mother appealed the verdict to an appeals court in the Saudi capital of Riyadh. The appeals court declined to certify the original ruling, in essence rejecting al-Habib's verdict, and sent the case back to him for reconsideration.

Under the complicated Saudi legal process, the appeals court ruling meant that the marriage was still in effect but that a challenge to the marriage was ongoing.

Earlier this month, the original judge refused for a second time to annul the marriage. Soon after that decision, Saudi Arabia's justice minister told Al-Watan that he planned to enact a law that will protect young girls from such marriages.

The law will place restrictions on the practice to preserve the rights of children and prevent abuses, Justice Minister Mohammed Al-Issa was quoted as saying. Additionally, al-Issa said there would be a study of a system that will include regulations for the marriage of minors and everything related to such unions, the newspaper reported. No details on the restrictions or regulations were mentioned.

The minister did not say whether child marriage would be abolished.

Responding to the justice minister's comments and the possibility of a new child marriage law, al-Jutaili told CNN at the time, "this is what we requested from day one, and we know that Saudi officials are working so hard on resolving this issue."

Al-Jutaili believes that such a law would help not only his defendant but many other Saudi minors facing a similar problem.

In Washington Monday, Under Secretary of State for Political Affairs William Burns called the marriage a human rights abuse.

"Child marriage is, unfortunately, still common in much of Saudi Arabia and we have voiced our concern about this practice at the highest levels," he told a conference on U.S.-Saudi relations.

"We were encouraged by reports that the Justice Ministry had begun to review the legal age of marriage."

After the divorce was denied for a second time, the head of the United Nations Children's Fund issued a statement expressing concern about the case. UNICEF Executive Director Ann Veneman said, "the right to free and full consent to marriage is recognized in the Universal Declaration of Human Rights. Consent cannot be free and full when either party to a marriage is too young to make an informed decision."

The issue of child marriage has been a hot-button topic in the deeply conservative Saudi kingdom recently. While rights groups have petitioned the government for laws to protect children from such marriages, the kingdom's top cleric has said that it's OK for girls as young as 10 to wed.

"It is incorrect to say that it's not permitted to marry off girls who are 15 and younger," Sheikh Abdul Aziz Al-Sheikh, the kingdom's grand mufti, said in January, according to the regional Al-Hayat newspaper. "A girl aged 10 or 12 can be married. Those who think she's too young are wrong, and they are being unfair to her."

Al-Sheikh reportedly made the remarks when he was asked during a lecture about parents forcing their underage daughters to marry.

"We hear a lot in the media about the marriage of underage girls," he said, according to the newspaper. "We should know that sharia law has not brought injustice to women."

Sharia law is Islamic law, and Saudi Arabia follows a strict interpretation of Islam called Wahhabism.

Saudi women face severe discrimination in many aspects of their lives, including education, employment, and the justice system and are clearly regarded as inferior to men. Although they make up 70% of those enrolled in universities, women make up just 5% of the workforce in Saudi Arabia,[7] the lowest proportion in the world.

The treatment of women has been referred to as "gender apartheid."[8][9][10] Implementation of a government resolution supporting expanded employment opportunities for women met resistance from within the labor ministry,[11] from the religious police,[12] and from the male citizenry.[13]

These institutions and individuals generally claim that according to Sharia a woman's place is in the home caring for her husband and family. It is a country where culture and religion make women live mostly restricted segregated lives. There is also segregation inside their own homes as some rooms have separate entrances for men and women. [14]

In the legal system, women face discrimination. An example of this is the requirements for testifying in criminal proceedings; The witness must be deemed sane, the age of an adult, and a Muslim. Non-Muslims may not testify in criminal court. Women may not testify unless it is a personal matter that did not occur in the sight of men. The testimony of a woman is not regarded as fact but as presumption. The reasons women are forbidden to testify in proceedings are (quote):[15][16]

Women are much more emotional than men and will, as a result of their emotions, distort their testimony.
Women do not participate in public life, so they will not be capable of understanding what they observe.
Women are dominated completely by men, who by the grace of God are deemed superior; therefore, women will give testimony according to what the last man told them.
Women are forgetful, and their testimony cannot be considered reliable.
As a result of these laws women are vulnerable in cases of assault and/or rape, as their testimony is treated as a presumption, while that of their attackers is accepted as fact. In some cases, victims of sexual assault are punished on the grounds that they should not be alone with unrelated males. It happened recently when a woman, victim of a gang rape, was sentenced by a Saudi court to six months in prison and 200 lashes for violating laws on segregation of the sexes, as she was in an unrelated man's car at the time of the attack.[17]

This case attracted the attention of the UN which expressed its concerns regarding the social attitudes and the system of male guardianship which deter women from reporting crimes and lead to a patriarchal system. Women are therefore prevented from escaping abusive environments because of their lack of autonomy and economic independence, practices surrounding divorce and child custody, the absence of a law criminalizing violence against women, and inconsistencies in the application of laws and procedures.[18]

Women are not allowed to drive or ride bicycles on public roads in large cities. However, some do so on rural roads illegally.[citation needed] Women are allowed to fly aircraft, though they must be chauffeured to the airport.[19]

Women's rights are at the heart of calls for reform in Saudi Arabia - calls that are challenging the kingdom's political status quo[14] and the pressure from Western governments and from institutions such as the UN helps speed up the process. Local and international women's groups are also pushing governments to respond, taking advantage of the fact that some rulers are eager to project a more progressive image to the West.

The presence of powerful businesswomen—still a rare breed—in some of these groups helps get them heard.[17] Prior to 2008, women were not allowed to enter hotels and furnished apartments without a chaperon or mahram. With a 2008 Royal Decree, however, the only requirement needed to allow women to enter hotels are their national ID cards, and the hotel must inform the nearest police station of their room reservation and length of stay, however this happens with everybody staying in the hotel not just women.[20]

Encouraged by the recent advances in women's rights, advocates for the right of women to drive in Saudi Arabia - the only country in the world that prohibits female drivers – have collected more than 3,000 signatures hoping that the driving ban will also be lifted this year (2008) by King Abdullah. But the chances for this to happen are still small in Saudi Arabia's deeply religious and patriarchal society, where many believe that allowing women the right to drive could lead to Western-style openness and an erosion of traditional values.[21]

According to the CIA world factbook, 70.8% of females are literate, in comparison to 84.7% literacy rates in males.[22]

slavery ended in the west hundreds of years ago but a few years ago in that part of the world

Some of these states, such as Yemen, were British protectorates. The British left South Yemen without forcing it to give up slavery, but did pressure the UAE into giving it up.

In 2005, Saudi Arabia was designated by the United States Department of State as a Tier 3 country with respect to trafficking in human beings. Tier 3 countries are "countries whose governments do not fully comply with the minimum standards and are not making significant efforts to do so."

I had some Muslim friends back in college who were very religious, and literally forced me to read the Qu'Ran because it was so "beautiful" and I would convert as soon as I read and understood it.


Well I read it, didn't make me join Islam, in-fact it turned me off more from organized religion.

Well, at least now when someone argues with me and concludes "you don't understand my beautiful religion because you haven't read the Qu'ran",

I can retort and let them know I have and it’s nothing special, another big book of rules full of creative stories, similes, soliloquies and anecdotes about life in the 0600s.

Saudi Arabia needs to climb out of the dark ages it has buried herself in for centuries and stop beheading women for very stupid accusations like "witchcraft". Witches are harmless members of society and are no more dangerous to society than a nuclear scientist is dangerous to society.

When will those idiots running Saudi Arabia behead a prince? Or the princes don't commit crimes? Such nasty punishments are reserved for the poor, those not connected to the so-called royal family, women, foreigners and migrant laborers.

It is sad that cruelty has come to define the essence of the wicked interpretation of Islam by an out-dated monarchy that is supposed to be a shining example of the benevolence of Islam.

While seemingly progressive Muslim nations like Turkey have banned the death penalty, socially retrogressive nations like Saudi-Arabia still relish the sight of the lifeless head of a middle-aged mother. Will the Muslims in Saudi-Arabia claim to be closer to Allah than the Muslims in Turkey? Allah will judge. As for me, I'm making my own judgment now:

I will tell you a story.

There was a day i was walking with my friend on the Street, and we passed one woman wearing a burka.

The woman even from the little I could see wasn't in any way attractive, in other words good looking would be an opposite description of her.

So thoughts were going in in my mind like - although I did not say a word - who do this women think there fooling telling us a woman's body is meant to be covered from prying men.

The next thing I heard from my friend was the funniest thing I could imagine. He went:

"What makes this woman think that if she walks naked I would look at her twice."  cheesy

In all modesty i couldn't help laughing out loud.  cheesy

Another incident happened.

I was at the bar with some budies so a woman in burka walked past, one guy said and I quote:

"You know you can't tell if thats a man or a woman in that thing."  cheesy

Very funny incidents. But I still believe we should be tolerant though, you never know one might need to wear the burka someday, if only to avoid your wife noticing you leaving your gf's house.  cheesy

In most parts of the world, the elite class often gets away with crimes while the poor suffer. It is not exclusive to Saudi Arabia, or are all african countries Islamic states?

While Turkey has a large population of Muslims, it is not an Islamic state, and thus it is unfair to compare t to Saudi Arabia. Turkey is a secular state with a parliamentary democracy. If you want fair comparison, why not use other islamic states like Iran or Pakistan.

Every topic is about religion or "Hausa" people. I sometimes wonder who woulda been the butt of her joke's if there weren't Muslims. I bet this female bully woulda found an "imaginary" enemy, what a sad person.

Saudi Arabia needs to climb out of the dark ages it has buried herself in for centuries and stop beheading women for very stupid accusations like "witchcraft". Witches are harmless members of society and are no more dangerous to society than a nuclear scientist is dangerous to society.

When will those idiots running Saudi Arabia behead a prince? Or the princes don't commit crimes? Such nasty punishments are reserved for the poor, those not connected to the so-called royal family, women, foreigners and migrant laborers.

It is sad that cruelty has come to define the essence of the wicked interpretation of Islam by an out-dated monarchy that is supposed to be a shining example of the benevolence of Islam.

While seemingly progressive Muslim nations like Turkey have banned the death penalty, socially retrogressive nations like Saudi-Arabia still relish the sight of the lifeless head of a middle-aged mother. Will the Muslims in Saudi-Arabia claim to be closer to Allah than the Muslims in Turkey? Allah will judge. As for me, I'm making my own judgment now:

I strongly think your attitude of jumping into conclusion sometimes is not very right.

If the Saudis believe that death penalty is the way to go, good for them, Saudis are learned pple on the average. The illiteracy level in many other nation is worse than that of the Saudis, but they have choosen that the death penalty is still the way to go.

So I think sometimes people should be left with their believes, and surely someday they would gradually grow out of it. Afterall when was the death penalty abolished in the Sates?  angry

While Turkey has a large population of Muslims, it is not an Islamic state, and thus it is unfair to compare t to Saudi Arabia. Turkey is a secular state with a parliamentary democracy. If you want fair comparison, why not use other islamic states like Iran or Pakistan.

Iran and Pakistan have their own share of problems that stem from Islam. UAE might be the best example.

If you go to Saudi Arabia and they decide to call you a witch, Christian or anything that will allow them to behead you without trail, remind yourself that they are learned.

If you cant stand Saudi laws dont go to Saudi Arabia. If a your visitor sees the food you dish out to him as stale, then let him not come back. Why must he try to change your way of life. angry

I don't recall people being forced to go to Saudi Arabia (or any other country in the world), and the fact that they operate the sharia law is not a hidden fact. If you have a problem with their system, stay out of their country. Do not be self righteous, and thus blindly criticize the way of life of another.

What about the women that are forced into the system. Women are sometimes raped as revenge to the family and they are still killed for honor and not much done to the men. These women are under fire but can't stay out the kitchen, what do they do?
PS, I have no plans of going to Saudi Arabia, never have, never will
