the 240,000+ votes didnt only belong to audu, it also belong to faleke, only if a fresh elections is conducted that faleke may not be considered as gubernatorial candidate, in fact more than 90% of the election has been concluded. it is also wrong to use 49,000 cancelled votes to justify the inconclusiveness of a 41000 margin lead election. Owerri-base Legal Practitioner, Barr Stanley Chukwu, said: ”The present situation arising from the death of Audu, the APC gubernatorial candidate in Kogi has created an unprecedented situation not envisaged in the 1999 Constitution of the Federation as Amended. While Section 181 of the Constitution envisaged a situation where if a Governor elect dies before taking oath of office his deputy is to take over. Subsection 2 of section 181 provides that where both the Governor elect and his deputy die before taking oath of office, that there will be a flesh election. ”The Kogi situation is that the Gubernatorial candidate died at a time election has not been concluded and supplementary election is to be conducted so that a winner would be declared. In this scenario, APC no longer have a gubernatorial candidate for the supplementary election. In fact, supplementary election would be a waste of time. Audu’s running mate cannot step into his shoe. There is no provision in the Electoral Act or the Constitution that assigned any role to a running mate upon the demise of the Gubernatorial candidate before declaration of winner. The only option is for an a flesh election to be conducted in which APC will field a candidate. Again, this is one scenario which our law fail to envisage and there is now the need to take care of it in future constitutional amendment. ”The argument that it is the party that stands for election will not fly when you analogically consider section 181(2). of the Constitution which orders for fresh election where both the Governor Elect and Deputy Governor elects die before taking oath of office. If the Constitution recognises the party above the candidate, it would have simply required the Party to field a new Governor-elect and Deputy Governor elect but instead, the Constitution required a new election. So in this case, since Audu has not been declared, his running mate can only be seen and not reckoned with. The only option now is conducting a fresh election.” This is the best option otherwise, some intending deputies can take advantage on this to eliminate the suppose party flag bearer knowing fully the benefit awaiting them! 1 Like |

Unfortunately, in all the cases(Yar Adua/GEJ, Obasanjo/Atiku) you cited above, election was concluded, candidates returned duly elected, and not inconclusive as in the case of Kogi. Also recall the case of Rotimi Amaechi, where the SC ruled for party supremacy over the candidate. The deputy can only assume or step in when his governor or president has been returned elected,after concluded elections. In this case, election is inconclusive, Faleke is not even deputy- governor designate so cannot step into the position of Governorship aspirant. Secondly, he did not contest for the party primaries as governor as grounded in the constitution. Opposition party can also sue against this if he is chosen by the party. The onus now falls or rests with the party to select its candidate to replace Audu. |

gpublish:being nominated by the winner of the primary covers him on the ground of participation of primaries, the inconclusive of the election is not total,INE has already announced winner in major parts of the state about they can't cancel it.for safety APC should approach the supreme Court for interpretation, if not anyone can go to court and take advantage of this lacuna,what the AGF said is not final the court might have it own interpretation. |

I think the party wants to play safe by conducting another primary election but to play safe, they should pray Falake wins the primary election to avoid any lacuna for PDP to win the case in court of law. Because if in case the Supreme Court pronounces judgment against Falake, for not been part of the primary that produced Audu as the candidate for this election, then the primary election he won(assuming he wins) will cover for it , and if the Supreme Court Judges otherwise by insisting people voted for the party and not the candidates and since he is the same deputy that contested alongside Audu, he will be automatically eligible to become the Governor. So, I support primary election that's if only Falake becomes the winner. |

udeh3:if you eliminate anyone na prison be your house, the totality of the election is what is inconclusive but the results of other areas have being announced and it cannot be cancelled,Audu and Faleke won in those areas. |

faulty analysis. the key word here is candidate. how can a deputy governorship candidate be upgraded to a governorship candidate because the opposition wants it to be done. its the prerogative of the party to choose a candidate who can win an election for them, to replace the deceased. |

We talked of law, lets talk about the ordinary voter whose mind was to vote for the gubernatorial candidate NOT the deputy or assistant. If we all believe that the party is the one winning not individual then we are in future opening a scam or 419. Now you may not understand but Nigerians l know will go to any length to scam an election in the eye of the LAW. Don't read me wrongly its not about this natural death. |

@ TonyeBarcanista Great efforts. I think the APC is right with the decision to conduct fresh primaries for the following reasons: 1. The election is inconclusive. Hence still ongoing. 2. The prima facie prerequisite in this case is that any candidate to be fielded by a party must have emerged through Primaries. The supplementary election in the affected areas is no exception. 3. Ditto 2 above, Faleke did not participate in the Primaries. Hence not qualified. 4. Faleke would have emerged the Governor-Elect if APC had won on Saturday, considering that the House of Assembly had already been constituted, ab initio. 5. Ditto above, Boni Haruna had a positive case on this basis. 6. The APC is right. Fielding Faleke as Governorship Aspirant for the supplementary election without him participating as a Primaries candidate would have been a faux pas and basis for PDP to contest the election in court if eventually won by APC.
