(a)the country the plane departed from (b)the country the plane is headed (c)the country above which the plane was when the birth occured (d)they should be given the option of choosing all or from countries 1,2 and 3.

They will have citizenship by inheritance.

In other words, they will automatically become citizens of the parent's home country. everything else is . . . trickish.

if a baby is born on air, the baby will become a citizen of the country that owns the flight plane!

Actually this is not the case. The only option which is possible here is C. And It is applied in specific cases.

It depends on the citizenship law of country the Plane flies over. If the nationality law is based on the principle of Jus Soli (Right of the Soil) the child acquires automatically the citizenship of the said country. The problem is, countries that apply Jus Soli are rare, and even getting rarer. However, it should be noted that the US and Canada for instance, apply this principle.

In all other cases - Countries where Jus Soli is not applied - it changes nothing whether the child is born in the air territory of the Country, or in a hospital in that country. The child receives the citizenship of his parents.

Therefore a b and d are incorrect. C is correct only in the case of Jus Soli.
